1. שורש הסימן — a vessel between two categories

↩ Detailed explanation (level 1)

The siman opens on an anomaly. A winepress is not a jar: wine is not kept in it, it is trodden in it. By the general rule, a vessel that serves only for a moment makes do with a rinsing. Why does this one require ניגוב, sometimes a peeling, sometimes a scalding?

The baraita in Avodah Zarah nevertheless states the opposition in two terms, with no third:

Ḥakira: does the baraita give two boxes, or a scale? (א) Two boxes and nothing between them: what keeps wine is strict, what does not is light, and the winepress simply falls on the second side. (ב) A scale, of which the two terms are only the extremes: what is measured is not keeping but duration of contact, and a vessel may stand between the two. On (א) the winepress should demand no more than a cup; on (ב) it may demand more without becoming a jar.

The Taz chooses (ב), and makes it the opening line of his commentary:

Teruts: a third category, made of a yes and a no The Taz does not classify the winepress: he places it. Yes, it resembles a storage vessel — hence it is forbidden even for a moment’s use, where an ordinary vessel would not be. No, it is not fully one — hence the three-day עירוי is not imposed on it. The whole casuistry of seif 1 lives in that interval: too heavy for an ordinary vessel and too light for a jar.

The Rambam had already stated the upper limit, and had said it as a rule:

And the Shakh gives the limit in the other direction, referring to siman 135:

Nafka mina between (א) and (ב) A vintage implement that a non-Jew used only once, for a moment. On (א) — two boxes — it is on the light side, and no requirement could arise. On (ב) the question becomes: how long did the wine remain in it? And that is exactly the question the Taz will ask in ס״ק י about the large tub, and in ס״ק י״ב about the beam — where he will confine the requirement to the place of contact.

2. גדר הזפת — why it is peeled rather than kashered

The word that recurs most often in seif 1 is neither stone nor wood: it is the pitch. It is a foreign body stuck to the wall, and it changes everything — because it drinks in place of what it shields.

A first refinement: the moment. The Mehaber writes that the non-Jew put wine in בשעת זפיתה. The Shakh refuses the literal reading:

Ḥakira: is the pitch a body that drinks, or an added wall? (א) It is a distinct body, merely stuck on: what it drank is its own, and to remove it is to remove the prohibition itself — hence the peeling, which is not a hekhsher but an excision. (ב) It has become wall: what it drank is absorbed in the vessel, and the peeling is only a way of reaching what lies beneath. This is the ḥakira that explains the Mehaber’s formula — never

The pitch cracks, and it is from there that the severity of treading comes:

Kushya: if the peeling removes the prohibition, why does it not suffice for earthenware? The mishnah is categorical: for earthenware, even if he peeled off the pitch, the vessel remains forbidden. If the pitch were the only reservoir, peeling should suffice everywhere.
Teruts: the material decides who drank The pitch always drinks; the question is whether the wall drank as well. Stone scarcely drinks — peeling frees it, and scouring completes the work. Wood drinks — hence peeling and scouring. Earthenware drinks so deeply that no friction reaches it: nothing remains but steeping. The Shakh gives the general key of reading:

Rabbi against the Sages, and the baraita that contradicts it

The mishnah of Avodah Zarah gives the three materials and, for wood alone, a dispute:

Kushya: the baraita contradicts the mishnah The mishnah permits stone by a mere scouring, even though a non-Jew coated it with pitch. The baraita, for its part, declares wood and stone forbidden as soon as they are pitched:
Teruts: the gemara distinguishes by the treading It answers in one line, and that line becomes the first variable of the whole of seif 1:

A second contradiction remains: the baraita says that Rabbi permits the winepress by scouring and that the Sages forbid it — yet the mishnah had declared earthenware forbidden even after the peeling. Rava answers that the end of the mishnah is already the Sages’ view:

PositionWhat it requires for pitched woodScope
רביינגב — a scouring sufficesThe pitch is not in itself an obstacle
חכמיםיקלוף את הזפת — and, per the Rishonim, a scouring afterwardsThe pitch is the reservoir: it is removed
Halakhah — the Mehaber« קליפה וניגוב או עירוי בלא קליפה » (שו״ע יו״ד קל״ח:א)The halakhah follows the Sages, and the Mehaber adds the path of עירוי
Nafka mina A pitched wooden winepress in which the non-Jew did not tread. Per Rabbi a scouring would suffice; per the Sages one must peel. The Mehaber rules as the Sages — but he opens a second door the mishnah did not know, עירוי without peeling, and there the Shakh will intervene in ס״ק ד.

4. גירסת הטור בשל חרס — the Beit Yosef emends, the Taz defends

Here is the one place in the siman where two Aharonim read the same words of the Tur in two incompatible ways — and where one of them charges the printed text with error.

The Beit Yosef does not merely think it: he writes that the text must be emended.

The Beit Yosef’s proof For wood the mishnah says יקלוף את הזפת, and the Rishonim agree that a scouring is needed after the peeling. If for earthenware the mishnah adds that even after the peeling it remains forbidden, that must mean even with the scouring — otherwise earthenware would differ in nothing from wood, and the mishnah would have taught nothing.

The Taz accepts the demonstration — if one grants that there is no error. But he sets out to rebuild the Tur’s position as it would stand without emendation:

ReadingWhat it makes of the TurEarthenware not trodden in
Beit YosefA scribal error — the text must be emended
A shitah: without treading, wood and earthenware are equal; the distinction bears only on the case where he trodקליפה וניגוב
The Mehaber, in the Shulchan ArukhHe follows the Beit Yosef — that is, himself«
Nafka mina An earthenware winepress coated by a non-Jew who poured wine into it without treading. On the Tur as the Taz reads him, peeling followed by scouring suffices. On the Mehaber, מילוי ועירוי is required. That is a whole rung’s difference on the ladder, and it bears on the commonest case of all: the one where no treading took place.
What the Shakh adds here, and against whom On the path of עירוי without peeling, the Shakh first recalls the consensus, then notes that the Beit Yosef misquoted Rabbenu Yeruham:

5. הגעלה או עירוי — which of the two is the stronger?

Seif 1 offers, for trodden earthenware, קליפה ומילוי ועירוי או הגעלה בלא קליפה — scalding dispenses with peeling, so it is the stronger. But in siman 135 the Tur reported in the name of the Ramban that for an earthenware storage vessel scalding does not suffice and עירוי is required. The two passages contradict one another.

The Taz’s teruts: the comparison holds only where scalding acts at all According to the Ramban it is not that עירוי is stronger: it is that scalding has no purchase at all on earthenware, the Torah having testified that it never gives back what it absorbed. Wherever scalding does act, it prevails:

And for us, concludes the Taz, the difficulty vanishes entirely, since the Shulchan Arukh itself concedes in siman 135 that scalding does act on earthenware in this prohibition:

Ḥakira: why does the winepress make do with scalding by pouring? (א) By necessity: a vat cannot be immersed, and one does what one can. (ב) By nature: what the winepress absorbed, it absorbed cold, and what entered cold comes out easily. The first answer is a concession, the second a principle — and it is the second that the Rashba and the Taz give.
Nafka mina A vintage implement that can be immersed — a measuring vessel, a funnel. On (א) nothing compels one to settle for pouring, since immersion is possible. On (ב) pouring suffices, because the reason turns on what was absorbed, not on what can be done. It is this second reason that seif 3 puts into words:

6. תחילת תשמישה — the Raavad’s novelty, between Rashi and Rabbenu Tam

The last clause of seif 1 is no detail: it comes from an entire sugya, and it sets Rashi against Rabbenu Tam. The question is easy to state — who used the vat first? — and no one agrees on what it changes.

The Tur first reports Rashi, whose position is the most lenient of all:

The Taz explains where Rashi draws this from — a baraita that Rabbi Abahu cites as a source of halakhah, and which contradicts the mishnah:

Rabbenu Tam refuses that reading and upholds the mishnah. It then remains to explain the baraita, and here comes the distinction that the Raavad and the Rashba draw from elsewhere:

The Tur reports the Raavad, and extends his leniency as far as stone:

PositionWhat it holdsResult for the winepress
Rashi, reported by the TurThe baraita of the עדשים is the halakhah: the winepress differs from other vessels in nothingהדחה
Rabbenu Tam, and the Rosh in conclusionThe mishnah stands; the baraita speaks of something else, or of a case where the Jew served firstAs the mishnah
Raavad and RashbaEverything turns on the first use: earthenware drinks most the first timeEarthenware: ניגוב; stone: שכשוך
The Mehaber, end of seif 1Adopts the first-use distinction, and adds wood to itWood and stone: הדחה; earthenware: ניגוב

The Taz explicitly upholds the Shulchan Arukh — against his father-in-law, the Bach:

The Baer Hetev records the outcome in a single line:

Nafka mina A wooden winepress, unpitched, belonging to a Jew, in which a non-Jew came and trod once. Per the Mehaber and the Taz: a rinsing. Per the Bach: a full ניגוב, with its ashes and its four rounds. The difference is several hours of labour, and it arises every vintage.

7. נעורת ובקעים — a detail, or the rule itself?

The Mehaber writes that if flax tow or old rags lie between the boards, scouring no longer suffices. The Taz asks whether the tow is the condition, or only the example.

What the Taz turns around His reading inverts the intuition. One would think the tow aggravates, by holding the wine; the Taz shows that a bare fissure is already forbidden — that is the gemara’s story — and that the Mehaber’s novelty is exactly the reverse: even stopped with tow, the fissure is not mended.
Nafka mina A wooden winepress whose joints are open and stopped by nothing. If one reads the Mehaber to the letter, the clause does not apply and a scouring would suffice. On the Taz, this is the graver of the two cases. Every joint, every caulking, every imperfect weld thus falls under מילוי ועירוי or scalding.

8. שיעור הניגוב — from the עונה to twelve hours, and the tally of the rounds

Two measures run through the siman: how long for the running water, and how many times for the scouring. Neither is found as such in the gemara; one comes from the Rambam, the other from a choice between two schools’ traditions.

The gemara first gives a duration with no number:

It then defines the עונה, and two definitions present themselves:

The Rambam decides in hours, and seif 6 reproduces his wording word for word:

What the passage to a number costs, and what it gains The gemara gives two measures: “either a day or a night”, and “half a day and half a night” — and Rabbi Shmuel bar Yitzhak reconciles them by the seasons. Twelve hours is the fixed measure that satisfies the second definition in every season. It is a choice of workability: one does not ask a vintner to compute an equinox.

For the number of rounds, the gemara reports two traditions, and Pumbedita gives the wider tally:

The Rambam holds four in both cases, and varies only the order:

The Tur reports the Ramah, and then the lenient position of the Rosh:

And the Taz, on seif 10, emends the printed text of the Shulchan Arukh itself:

9. התרת הקשרים — the Shakh against the Mehaber

Here is the only dispute in the siman where the Shakh openly contradicts the Mehaber, and he does so by showing that the latter relied on an inexact report.

The gemara mentions the knots only once, at the end of a list:

Kushya: to what does “ואי איכא קטרי — שרי להו” refer? The phrase follows three rulings — rinse, scour, age. Does it attach to the last only, to the second, or to all? The Mehaber answers in two places: in seif 7 he mentions no knots for the flax strainer that is aged, and in seif 9 he says explicitly that ageing requires no untying.

The Shakh explains where this position comes from: from the reading that the Mehaber, in the Kesef Mishneh, ascribes to the Rashba. He then refutes it, in four words:

And he repeats it on seif 8, so that the practical import should be in no doubt:

The two witnesses the Shakh summons do indeed speak plainly. The Rambam:

And the Tur, who goes so far as to fix the order — untie first, then age:

PositionTo what the knots attachConsequence in seif 9

The Baer Hetev records the divergence, and it is he who sets it before the practitioner:

Nafka mina A flax strainer, or a knotted net, set aside for twelve months. Per the Mehaber one puts it away as it is. Per the Shakh those twelve months are worth nothing if the knots stayed tight — for the liquid shut inside a knot does not go stale. And what is at stake is not one gesture: a whole year may have been lost.

10. לכתחילה ובדיעבד — ששים בחרצנים ובזגים, and a nullification that is none

The siman ends on two passages which together fix its real reach: what those seven degrees are worth when they were omitted, and how far the duty to clean extends.

The Bach, reported by the Shakh, holds a cautious position — he permits reliance on Rashi after the fact, but only in pressing need:

The Shakh’s question on the Bach Why reach for Rashi and a pressing need, asks the Shakh, when there is a far simpler reason, one that depends on no shitah at all?
And the reservation he raises against himself The Shakh does not close the reasoning without bounding it. The sixty come from the volume of pips and skins against the absorbed thickness; there is a geometry in which the tally does not come out:

The Baer Hetev condenses this whole discussion into one line, and adds to it a clause that comes from the Bach’s position and not from the Shakh’s own words — the prior rinsing:

There remains the last seif, and the question it raises: to sweep a winepress without removing the pips — is that not deliberately nullifying a prohibition? The Taz answers, and ties his answer to what he wrote in siman 137:

The line of the whole siman, in one sentence Seven degrees of hekhsher, eleven seifim, nine implements — and at the end, a man sweeping his vat as he sweeps it every day. The siman is demanding before, and reasonable after: it is the same movement the Shakh describes in ס״ק ד and the Taz completes in ס״ק י״ד. What is asked is serious preparation; what is not asked is a hunt for the invisible.
