How to read this level. Every statement here is anchored either in the text of the Shulḥan Arukh and its nossei kelim, or in a named and verifiable posek (Tur, Beit Yossef, Rambam, Tosafot, the gemara of Avodah Zarah). On Yoreh De'ah there is no Mishna Berura (which comments only on Orach Chaim), and no Shulḥan Arukh HaRav (the Admur HaZaken did not write the YD). The Pit’hei Teshuva does not comment on this siman. The Arukh HaShulḥan is not cited: its text on this siman is not accessible to us, and one does not cite what one cannot check. There remain, and they suffice: the Shakh (י״א ס״ק), the Taz (ח׳ ס״ק), the Baer Hetev (י״ב ס״ק) and the Nekoudot HaKessef (one entry). Where the question runs beyond the siman — and first of all the question it presumes settled, namely what counts today as an idol — this level says so and stops: halakha lema'asse goes through your Rav.

The founding case. An object has touched the worship of an idol. The Mehaber does not ask what it is worth: he asks which of the four it is — the idol, what serves it, what adorns it, what has been offered to it — and to whom the idol belongs. From these two answers comes the moment at which the prohibition falls.

Then the key to the whole practice. Seif 2 says which of the four can still be annulled. Two never can: the idol of a Jew, and the offering. It is this last clause that decides nearly every concrete case, because it turns a reparable doubt into a doubt with no way out.

1. שורש הפסק — ארבעה חפצים, שני זמנים, ושאלת הביטול

This siman never asks more than one question, in fifteen forms. Before an object come from a place of worship, one does not ask “how grave is it?” but “ which of the four is it, to whom did the idol belong, and does an annulment remain? ”. The first two answers fix the moment of the prohibition; the third decides whether anything can still be done.
Seif 1 enumerates the four objects and the two moments. The idol of a non-Jew is forbidden as soon as it is made; that of a Jew only once served; appurtenances and ornaments, with the one as with the other, once used; the offering, as soon as it has been brought and offered.

And seif 2 gives the key. What the Taz explains in one sentence: annulment acts upon what depends on wholeness. The idol and its ornaments depend on it — broken, they cease to be worshipped. The offering never depended on it: one offers a paltry thing, and mutilating it takes nothing from it.

What this changes for you. Before an object that has left a place of worship, the decisive question is not “is it forbidden?” but “ if I am mistaken, is the mistake reparable? ”. On an ornament or an appurtenance an annulment remains possible and the doubt has a way out. On an offering there is none — and it is there that the Ba’h, reported by the Shakh, places his stringency. The whole practical line of the siman rests on that asymmetry.

2. פסק המחבר — מפת הסעיפים

Siman 139 has fifteen seifim — that is the count announced by the heading (ובו ט״ו סעיפים) and it is the real count of the text. The Rama intervenes three times: at seif 1 (the brick set upright), at seif 11 (what is put upon the idol) and at seif 15 (the sale of books, where he piles up three positions).

The moment, and what the Rama adds to it

The Mehaber distinguishes by the owner; the Rama adds the case where the two cross — a Jew prepares, a non-Jew serves. The Shakh sets its exact limit: the agency extends only to what the Jew himself designated.

And the apostate? The Taz decides that he remains a Jew for this siman: his idol is forbidden only once served, and he cannot annul. The Nekoudot HaKessef — this is their only entry on this siman — set the Rambam against him and do not conclude. The Baer Hetev reports both without deciding: a real case is therefore put to a Rav.

Lema'asse. The idol of a non-Jew is forbidden in benefit as soon as it is finished; its appurtenances and its ornaments only once used in the worship — a new object, never used, is not yet forbidden. An object belonging to a Jew which he himself prepared for worship, and which another served in his place, is forbidden and without annulment (Shakh ס״ק א). The case of the apostate is not decided here: Taz on one side, Nekoudot HaKessef on the other — to your Rav.

4. גדר התקרובת — כעין פנים, והמקום

ותקרובת כל שכיוצא בו קרב על גבי מזבח כמו כל מיני מאכל כגון בשר שמנים וסלתות מים ומלח אם הניחו לפניה לשם תקרובת נאסר מיד

Two measures, and a doubt of fact

What is of the kind offered in the Temple is forbidden from the moment it is set down. What is not requires an act resembling the Temple. But inside, the act is no longer asked for: the place counts as proof. And for the Rambam, as the Beit Yossef reads him, everything inside is forbidden, offered in the Temple or not.

It is here that the one practical stringency of the siman is born. The Beit Yossef draws the consequence for the candles; the Ba’h extends it to everything that has stayed in a place of worship; and the Shakh takes it up while qualifying it: כל בעל נפש יש לו להחמיר.

The exact reach of this stringency. It does not say that the halakha follows the Rambam. It says that a doubt of fact — דשמא נכנסו — is not weighed the same way according to what is at risk: to be mistaken about an ornament leaves an annulment open, to be mistaken about an offering leaves none. The stringency therefore bears on the category of risk, not on the ma’hloket.
Lema'asse. An object known to have been set before the idol by way of offering — and first of all everything of the kind offered in the Temple, foodstuffs, oils, water and salt included — is forbidden with no remedy. An object of which one does not know whether it entered the very space of the worship falls under the doubt the Ba’h treats as a matter for a בעל נפש : one abstains from it. An object that stayed outside and was handled without honour does not fall into this category (seif 5, end). The division between these three situations is factual: it is described to a Rav, it is not guessed.

5. הביטול למעשה — נרות, כלים ומלבושים

נרות של שעוה שמדליקין לפניה נויה הם ואסורים ואם משכנם או מכרן לישראל מותרים דכיון שכיבן לצורך עצמו זהו ביטולן

כלים שאוחז בידו והמחתה שמקטיר בה משמשיה הם וצריכים ביטול ואם מכרן העובד כוכבים או משכנן לישראל זהו ביטולם ויש אומרים שאין זה ביטולם

Seif 9 and seif 12 do not say the same thing

At seif 12 the sale is the annulment, and one opinion denies it. At seif 9, says the Taz, it is only a proof that the extinguishing was final — and that is why even he who denies its force at seif 12 concedes it here. The Shakh, for his part, leaves the tension open with a צ״ע.

The garments, for their part, are not the idol’s ornament. They adorn the priest, and the Mehaber does not even require an annulment. The Rama sets the limit: what is put upon the idol itself is an ornament in the full sense.
« מלבושים שלובשים הכהנים כשנכנסים לבית אלילים נוי שלהם הן ולא נוי של אלילים ואפילו ביטול אינם צריכים ויש מי שמצריך ביטול » (שו״ע יו״ד קל״ט:יא)

(2) Extinguished to be rekindled, then sold: forbidden — the sale then proves the opposite of what would be needed (Taz ס״ק ח). (3) Gone out of itself, then sold: forbidden on the Shakh’s reading (ס״ק ז), who notes that seif 12 seems to say otherwise and concludes with a צ״ע.
Lema'asse. An ornament or an appurtenance of a non-Jew’s worship remains annullable, and sale or pledge to a Jew is the way the siman names. But two conditions, often forgotten, hedge it: the annulment must come from the non-Jew, who alone is its master, and at seif 9 it holds only if the object was withdrawn from the worship for good. Where the Shakh writes צ״ע, the concrete case is put to a Rav.

6. איסור המיאוס — נר מצווה, טליתות וספרים

נרות ושעוה של אלילים אסורים לנר מצוה דשבת ודחנוכה ודבית הכנסת וכן תכשיטי הכהנים (כגון המעילים שלובשים כהניהם) לא יתקן מהם טליתות ולא שום דבר מצוה משום דמאיסי

Here the prohibition changes in kind. Seifim 13 to 15 no longer speak of the prohibition of benefit — several of the objects named there are expressly permitted — but of מאיס : what has served another’s worship shall not serve the Torah. That is why an object may be perfectly permitted for sale and forbidden in the synagogue.

On the sale of books, the Rama piles up three positions and blesses the stringent. The Mehaber reports the permissive opinion; the Rama sets against it those who forbid any sale, then those who forbid it only to priests, and concludes. The Shakh adds that the Ba’h held the prohibition to be the strict law.

Parchment and ink: the measure is certainty. The Rama reports stringent authorities; the Shakh cites the Ba’h and the Maharshal, for whom this is only a precaution, and the Darkhei Moshe, who forbids only where the use is known . The prohibition follows certainty, not possibility.
« וכ׳ הב״ח דאין איסור בדבר אלא נכון ליזהר וכן כתב מהרש״ל בביאורי סמ״ג וכתב ד״מ סימן קכ״א דאינו אלא בידוע שרוצה לכתוב ספר דתם אבל סתמא שרי » (ש״ך יו״ד קל״ט ס״ק י״א)
Lema'asse. What another’s worship has used does not become an object of mitzva, even when it is permitted in benefit: no light of Shabbat, of Hanukkah or of the synagogue, no tallit, no cover, nothing of the kind — and the Shakh joins to this studying by that light. On the sale of books of worship, the Rama’s line is clear and needs no forcing: והמחמיר תבא עליו ברכה, and the Ba’h even holds it to be the strict law. On lending money to build a place of worship, the Mehaber writes והמונע מצליח ; on binding, אין לקשור, with the exception of the registers of judges and scribes and the way out of enmity.

7. מקרים בני זמננו

👈 Case 1 — The object bought at a flea market, come from a place of worship
One knows neither whether it was used, nor whether it stayed in the space of the worship. If it was never used, it is not forbidden (seif 1). If it was used as an appurtenance or an ornament, it is forbidden but remains annullable (seif 2). If it was brought into the very place of the worship, it might be an offering — and there would then be nothing left to do: this is the doubt the Ba’h, in the Shakh (ס״ק ג), treats as a matter for a בעל נפש. Describe the provenance precisely to your Rav; do not decide alone.
👈 Case 2 — The candles and the wax
A non-Jew sells or pledges to a Jew extinguished candles that burned before the idol: seif 9 permits them, provided he extinguished them for good. Extinguished to be rekindled, or gone out of themselves, they remain forbidden (Taz ס״ק ח, Shakh ס״ק ז). And even permitted, they will not serve as a light of Shabbat, of Hanukkah or of the synagogue (seif 13).
👈 Case 3 — The priest’s garment
A mantle or a stole worn by the priest during the office are his own ornament, permitted, and do not even require annulment according to the Mehaber; one opinion, reported at seif 11, requires one. But what is put upon the idol itself is an ornament of the idol and requires annulment (Rama). And in every case, one will make of it neither a tallit nor an object of mitzva (seif 13).
👈 Case 4 — The goblet, the censer, the objects held during the office
Seif 12 ranges them among the appurtenances: they require an annulment. That sale or pledge to a Jew by the non-Jew constitutes it is the first opinion of the seif; a second denies it. An object acquired without the non-Jew having properly ceded it — found, inherited, taken in deposit — therefore has nothing that counts as an annulment on either opinion. To be put to a Rav.
👈 Case 5 — The bookseller and the bookbinder
Selling a book that serves another’s worship: three positions at seif 15, and the Rama blesses the one who abstains; the Ba’h, in the Shakh (ס״ק י), holds the prohibition to be the strict law. The Shakh (ס״ק ט) also ranges there, in the name of Rabbenu Yeruḥam, Bibles translated for their use. Binding: the Mehaber writes אין לקשור, apart from the registers of judges and scribes, and gives the way out of enmity — to slip away as far as one can.
👈 Case 6 — The paper and the ink
Supplying a place of worship with neutral material — paper, ink, today any supply — falls under the prohibition, according to the Darkhei Moshe reported by the Shakh (ס״ק י״א), only where one knows that it will serve for their books of worship. Without that certainty, the Ba’h and the Maharshal see in it only a precaution: נכון ליזהר.
The point this level will not decide. Siman 139 begins after an object has been recognized as belonging to the worship of an idol. To know what, today, falls into that category — a place of worship, a statue, a liturgical object, a decorative image — is not the matter of this siman: it is the matter of simanim 141, 150 and 151, and of your Rav. This level says what siman 139 does with an object so recognized; it does not say what is so recognized.
