1. שורש הסימן — a prohibition that is never nullified

↩ Detailed explanation (level 1)

All of Yoreh De’ah teaches how a prohibition becomes nullified. This siman opens with a prohibition that is never nullified, and one must first understand the nature of this exception — for both ways out of the seif depend on it entirely.

The Mishnah, and the word that governs The Mishnah that closes Avodah Zarah lists the things that are never nullified, and the idol appears there between libation wine and hides with the heart torn out.
Note the form: the Mishnah does not say the idol is more serious — it says it is אוסרת בכל שהוא, that it forbids in any quantity. That is a property of the object, not a measure of its gravity.
The Rambam makes it a regime — and extends it to the accessories and to every offering:
The Beit Yosef explains the extension to accessories from the Gemara’s own cases — the cup and the ring, which are accessories and of which it is said that they are not nullified:
And the Shach adds one word that extends the list a step further:
The chakira of the siman: how can a prohibition that is never nullified ever become permitted? (א) By a deferred nullification — the object is not nullified in the first mixture because of its importance, but it ends up nullified once the majority becomes overwhelming or the passage is repeated. (ב) By a presumption (תלייה) — the object is never nullified; simply, as doubts accumulate, one may say that it is no longer where one is looking. All the casuistry of the seif — second or third mixture, pairs, a single person, one ring or two — depends on the branch adopted.
Immediate nafka mina On (א), once nullification is acquired, one would use the remaining objects without reservation. On (ב), the reservation remains: each pair must contain a certainly permitted object, and no one may benefit from all. The seif keeps the reservations — so it is (ב) that it assumes, and the Beit Yosef says so in one word: דתלינן להקל.

2. רב ושמואל — does a double doubt work for idolatry?

↩ Detailed explanation (level 1)

The sugya is not in Avodah Zarah but in Zevachim, about mixed offerings. There Rav teaches the ring fallen into the sea; Shmuel refuses.

Rav: the ring that fell into the sea was the forbidden one
Shmuel: no leniency in matters of idolatry
The baraita decides for Rav — and at the same time gives the seif’s second way out, the passage from one mixture to another:
Kushya If Shmuel holds that the double doubt of idolatry is forbidden until the end of the world, he has a reason: the idol is never nullified, so no later mixture should make it disappear. How does Rav answer that logic?
Terutz — the Tur and the Beit Yosef The Tur formulates the answer: a double doubt is not a mechanism of nullification but a mechanism of doubt, and it applies to an idol as to any prohibition.
The Beit Yosef records the poskim’s decision:
Nafka mina The Tur’s words — כמו בשאר איסורין — are not decorative: they attach the idol to the general law of important objects in siman 110. All the conditions set there (a minority, a first mixture permitted by Torah law, pairs) therefore apply here, and the Taz says it in one line:

📜 The text of the Shulchan Arukh — the single seif

↩ Detailed explanation (level 1)

3. תערובת שני או שלישי — the Mechaber against the Tur, the Rambam and the Shach

↩ Detailed explanation (level 1)

This is the only head-on disagreement in the siman, and it lies entirely in a number: the Mechaber permits only the third mixture; the Tur permits the second.

The Tur: the second mixture suffices
The Rambam: likewise — the cup separated from the mixture and fallen among two others is permitted:

The Mechaber: three mixtures — and the reason, in the Shach

The Shach does not merely note the gap; he finds its source in the Kessef Mishneh, and he contests it.

The Shach, first step: the source of the Mechaber’s stringency
Second step: the rejection
Kushya The Mechaber does have a text on his side: in siman 110, for an object that is not nullified because of its importance, he requires the third mixture, and he does so in the name of the Rambam himself — לשון רמב״ם פרק ט״ז מהמ״א. If the idol is not nullified either, why treat it differently from the pomegranates of Badan?
Terutz — the Shach separates two kinds of “not nullified” The Shach writes that the Rambam’s words are clear and do not contradict each other: the Rambam requires the third mixture for important objects (Maachalot Assurot 16) and permits the second for an idol (Avodah Zarah 7). The two texts therefore do not deal with the same case, and it was the Kessef Mishneh that merged them. For the details the Shach refers to his commentary on siman 110; we do not reproduce it here, and we hold to his conclusion, which is clear: The Baer Hetev repeats the conclusion without reservation:
Nafka mina An object from the first lot passed into a second lot of two. According to the Mechaber, that second lot remains forbidden until one of its objects has passed into a third; according to the Tur, the Rambam, the Shach and the Baer Hetev, it is already permitted. That is the difference between following the Mechaber and following the Shach on this siman, and level 4 draws the line from it.

4. אנא תרתי קאמינא — one fallen ring or two

↩ Detailed explanation (level 1)

The seif closes with “there is one who forbids”. The Beit Yosef identifies the opinion, and shows that the whole difference lies in the reading of two words of Rav Nachman.

The Gemara: Rabbi Elazar’s objection, and the answer

Two readings of תרתי

The Tur reads “it is two that I speak of” as bearing on the manner of benefiting: two by two, never one alone. The Rambam reads it as bearing on the number of lost objects: two fallen rings, not one.

The Tur
The Rambam
The Beit Yosef, on the Rambam
Chakira: what does the “two” guarantee? (א) It guarantees a certainly permitted object in each act — the Tur’s reading: when one benefits from two objects together, one of the two is certainly permitted. (ב) It guarantees a sufficient presumption — the Rambam’s reading: one may only say “the one that fell was the forbidden one” if two fell, for then the presumption rests on a pair, not on a single object. The Beit Yosef formulates it himself:
Nafka mina A single object of the lot has burnt. According to the Tur — and that is what the Mechaber writes first — the rest is permitted two by two; according to the Rambam, nothing is permitted until a second object has disappeared. The Mechaber does not decide: he writes the one and reports the other.

5. שנים שנים — the rule of pairs and its reason

The Taz
Siman 110, seif 7, and the Rama’s gloss
Kushya If one presumes that the fallen object was the forbidden one — הך דנפל היינו דאיסורא —, the forbidden object is no longer there. Why then require pairs, and why forbid one person from benefiting from all?
Terutz — a presumption is not a certainty The reason written in siman 110 says it: One does not rely on the presumption alone; one relies on it and on the fact that, in each pair, one of the two is certainly permitted. And whoever benefited from all would, if the forbidden object is still there, certainly have benefited from it — the presumption does not cover that. This is exactly branch (ב) of the chakira in §1.

6. תנאי הבית יוסף — a minority, and a first mixture permitted by Torah law

The seif writes the two ways out; the Beit Yosef writes their conditions, which he takes from siman 110 and from the Gemara.

The Gemara: forty and sixty
The Rambam derives the rule from it
The Beit Yosef: a minority only, and half counts as a minority
And a second condition: the first mixture must be permitted by Torah law
The Rama in siman 110 adds a boundary — the prohibition in the first mixture must be a certain prohibition:
Nafka mina If it is the majority of the first lot that passed into the second, there is no double doubt — the forbidden object is more likely to be in the second lot than not — and everything remains forbidden. And if the mixed-in object was only possibly idolatrous, the second mixture is permitted outright: the Rama says so, and siman 141 will supply the cases.

Three lines to take away. (1) An idol is never nullified; what the seif permits is to presume that the forbidden object is no longer there. (2) That is why all the reservations remain — pairs, not everything to one person, a minority, a first mixture permitted by Torah law. (3) The only dispute in the siman is a number: third mixture (Mechaber) or second (Tur, Rambam, Shach, Baer Hetev).
