A first approach to Siman 141: the 8 seifim of the Mehaber and the glosses of the Rama, Hebrew text with a flowing English rendering. Siman 139 dealt with the idol itself and its nullification; 140, with the offering that got mixed in. This one turns to images: the statue found in a street, the jewel engraved with a sun, the signet ring, the painting, the seven-branched lampstand. It asks two questions that never merge — what was this figure made for? (seifim 1 to 3) and what may a Jew make, and keep? (seifim 4 to 8).

1. The text of the Mehaber — the 8 seifim

Siman 141 is the most commented of its group — thirty-six notes by the Shakh, fifteen by the Taz, fifteen by the Pitchei Teshuva. The reason is simple: it touches what everyone owns. It reads in two movements. Seifim 1 to 3 — the figure found: a non-Jew made it, and the only question is what for; the place, the attribute, the state of the object and the kind of vessel are the clues. Seifim 4 to 8 — the figure made: here a Jew makes, or keeps, and the question becomes that of the verse לא תעשון אתי and of suspicion.

Two words recur constantly and must not be confused: צלם, the statue made to be worshipped or presumed so, and צורה, the figure in general — the image of a man, a luminary, an animal — which is forbidden only by a verse of its own, independent of idolatry.

Seif 1 — Villages and cities: the presumption about the statue

Title of the siman: the law of the statues and figures of idolatry; and it contains eight seifim.

All idolatrous statues found in villages are forbidden, for by default they were made for the idols; and those found in large cities are permitted, for they were certainly made for ornament (the Mehaber’s wording) — unless they stand at the entrance of the city (the Rambam’s wording, ch. 7 of the laws of idolatry) and the figure holds in its hand the form of a staff, a bird, a ball, a sword, or a crown and a ring.

Gloss of the Rama: a figure before which people bow has the status of an idolatrous statue and remains forbidden until it has been nullified; but those hung around the neck as a keepsake are not called a “statue” and are permitted (Mordekhai, beginning of chapter כל הצלמים, in the name of the Raavyah).
Seif 1 poses the question of the whole siman: why was this figure made? It is not the figure that decides but the intention of its maker — and since we do not know it, we presume it. In a village the presumption is idolatry; in a city, ornament. Two signs overturn the city’s presumption: the place — at the entrance — and the attribute in the hand. The Shakh (ס״ק ב) explains that מדינה here means the city, and both the Shakh and the Taz insist: these signs apply to every figure, not to the human figure alone.

Seif 2 — The fragments, and the hand standing on its base

המוצא שברי צלמים מושלכים או בתוך שברי נחושת או אפילו שברי אלילים עצמן מותרים אבל מצא תבנית יד או רגל והוא עומד על בסיסו אסור:
One who finds fragments of statues thrown away, or among copper scrap, or even fragments of the idols themselves — they are permitted. But if he found the form of a hand or a foot, standing on its base — it is forbidden.
The fragment is permitted because it carries in itself the proof that its owner rejected it — and to reject is to nullify. A hand set on a base does not look like a fragment: it looks as if it were made that way, and people worship hands on their own. The Shakh (ס״ק ז) will show that the Rambam is stricter than the Mehaber on fragments of idols, and that there is a contradiction with siman 146.

Seif 3 — Sun, moon and dragon on vessels: honoured or lowly

One who finds vessels bearing the figure of the sun or the moonGloss of the Rama: that is, figures made for the sun and the moon, in the way the talisman-makers make figures for the stars: for the figures attributed to the sun they draw a crowned king seated on a chariot, and likewise the moon has among them a particular figure (Rambam in the Commentary on the Mishnah, and Bartenura there) — or a dragon, which resembles a snake with something like fins between the joints of the neck: if the vessels are honoured, they are forbidden, for they were certainly made for the idols; and if they are lowly, they are permitted, for they were made only for ornament. And these are the honoured: those on שיראים — bracelets, or silk garments, see the Shakh — nose-rings and finger-rings; and the lowly: (coins) (Hagahot Ashri, Mordekhai, Agudah, Rosh, Semag lavin 92, Bahag, and so I found in the Tosefta, beginning of ch. 7) cauldrons, kettles, water-heaters and the cups one drinks from — whether below or above the water line.

And all this in an undetermined case, where we do not know that these vessels were worshipped; but where it is known that these vessels were not worshipped, even those on honoured vessels are permitted (the Ran’s view). And there is one who says that any figure that is certainly worshipped is forbidden even on lowly vessels, although we do not know that these vessels were worshipped; and accordingly, nowadays, when they engrave vessels and draw idols on them, one who finds vessels bearing idols — they are forbidden.

Gloss of the Rama: and the custom follows the first view; and nowadays, when the non-Jews do not worship these figures, they are permitted for benefit if one finds them, but one should not keep them (Toldot Adam veChava, netiv 17); and there are those who are stringent with all the figures mentioned even nowadays, although we know that they do not worship them (so it appears from the Tur and the Tosafot, chapter כל הצלמים). And the figure of a dragon — it is permitted to make it, only it is forbidden to keep it by oneself, because of suspicion (Beit Yosef from the Rosh and the Tur).
Three figures, and no more, create a presumption of worship on a vessel: the sun, the moon and the dragon. And even then only on an honoured vessel — a piece of jewellery — for nobody worships on a cauldron. The Rama explains that “sun” and “moon” mean the talisman figures, not a plain disc. The seif carries two views about a lowly vessel when the figure is certainly worshipped, and the Rama decides: custom follows the first, and nowadays these figures are no longer worshipped — one may benefit from them, not keep them.

Seif 4 — What a Jew may not make: לא תעשון אתי, relief and intaglio

אסור לצייר צורות שבמדור שכינה כגון ד׳ פנים בהדי הדדי וכן צורות שרפים ואופני׳ ומלאכי השרת וכן צורת אדם לבדו כל אלו אסור לעשותם אפילו הם לנוי ואם עובד כוכבים עשאם לו אסור להשהותם: הגה ומיהו אם מוצא אותם מותרים מלבד בחמה ולבנה שדרך העובד כוכבים לעבדם או שיש הוכחה שעשאן לעבדם שאז אסור ככל הצלמים כמו שנתבאר בריש הסימן (טור): במה דברים אמורים בבולטת אבל בשוקעת כאותם שאורגים בבגד ושמציירים בכותל בסמנין מותר לעשותם וצורת חמה ולבנה וכוכבים אסור בין בולטת בין שוקעת ואם הם להתלמד להבין ולהורות כולן מותרות אפי׳ בולטות (ויש מתירין בשל רבים דליכא חשדא) (טור בשם הרא״ש):
It is forbidden to draw the figures that are in the abode of the Shekhinah, such as the four faces together, and likewise the figures of the seraphim, the ofanim and the ministering angels; and likewise the figure of a human being alone. All of these it is forbidden to make, even for ornament; and if a non-Jew made them for him, it is forbidden to keep them.

Gloss of the Rama: however, if he finds them, they are permitted — except the sun and the moon, which the non-Jews are accustomed to worship, or where there is proof that they were made to be worshipped, for then they are forbidden like all statues, as explained at the beginning of the siman (Tur).

To what does this apply? To a figure in relief; but sunken — like those woven into a garment or painted on a wall with pigments — it is permitted to make them. And the figure of the sun, the moon and the stars is forbidden whether in relief or sunken. And if they are for study — to understand and to teach — all are permitted, even in relief. (And there are those who permit for the public, since there is no suspicion) (Tur in the name of the Rosh).
Here the siman changes its axis. Seifim 1 to 3 asked what a non-Jew did; seif 4 asks what a Jew may make. The source is the verse לא תעשון אתי — “you shall not make with Me” — which the Gemara reads as “you shall not make My servants” (the four faces, the angels, the luminaries) and “you shall not make Me” (the human figure). Three regimes: making is forbidden by the Torah; keeping what another made is forbidden because of suspicion; finding is permitted. And relief: the human figure is forbidden only in relief, but the sun and the moon even sunken, for in the firmament they appear sunk.

Seif 5 — The signet ring

טבעת שיש עליה חותם שהוא צורת אדם אם היתה הצורה בולטת אסור להניחה ומותר לחתום בה ואם היתה הצורה שוקעת מותר להניחה ואסור לחתו׳ בה מפני שהנחתם תעשה בו הצורה בולטת (ל׳ רמב״ם פ״ג מהלכות עבודת כוכבים דין י״א) ואפילו חתם לו העובד כוכבים אסור להשהותה (כן משמע במרדכי פכ״ה ותוס׳) וה״ה בשאר צורות האסורות (בטור וכ״כ הר״ן בשם רי״ף וכן משמע בכל הפוסקים):
A ring bearing a seal that is a human figure: if the figure is in relief, it is forbidden to keep it on, but permitted to seal with it; and if the figure is sunken, it is permitted to keep it on, but forbidden to seal with it, because the impression will produce a figure in relief (the Rambam’s wording, ch. 3 of the laws of idolatry, hal. 11). And even if the non-Jew sealed it for him, it is forbidden to keep it (so it appears from the Mordekhai, ch. כל הצלמים, and the Tosafot); and the same applies to the other forbidden figures (Tur; so wrote the Ran in the name of the Rif, and so it appears from all the poskim).
The seal reverses everything: what is in relief on the ring prints sunken, and what is sunken prints in relief. Hence the symmetry of the seif: the ring in relief may seal but not be worn; the sunken ring may be worn but not seal. The Rama adds that an impression made by a non-Jew may not be kept either — and the Shakh (ס״ק כ״ט) wonders why this needed saying again.

Seif 6 — Animals, birds, fish, trees: permitted

צורות הבהמות חיות ועופות ודגים וצורות אילנות ודשאים וכיוצא בהם מותר לצור אותם ואפילו היתה הצורה בולטת:
The figures of domestic animals, wild beasts, birds and fish, the figures of trees and grasses, and the like — it is permitted to draw them, even if the figure is in relief.
Seif 6 is the boundary of seif 4: outside the “servants on high” and the human figure, everything is permitted, even in relief. The Shakh (ס״ק ל) infers that a lion is permitted, against the Bach who saw in the lion and the bull signs of the zodiac: it is the twelve together that would be forbidden, like the four faces together.

Seif 7 — Only a complete figure is forbidden

יש מי שאומר שלא אסרו בצורת אדם ודרקון אלא דוקא בצורה שלימה בכל איבריה אבל צורת ראש או גוף בלא ראש אין בה שום איסור לא במוצאו ולא בעושה (וכן נוהגין) :
There is one who says that the figure of a human being and of a dragon were forbidden only as a complete figure, with all its limbs; but the figure of a head, or of a body without a head, carries no prohibition — neither for one who finds it nor for one who makes it. (And so is the custom.)
Seif 7 is the Rosh’s view, reported by the Tur: what the Torah forbids is the figure, and a figure is a whole. A head without a body is not a man. The Rama records that this is the custom; the Shakh (ס״ק ל״ב) notes that the Tosafot and the Semag are stricter, and concludes that one who is stringent in this “will be blessed”.

Seif 8 — The Temple and its vessels: no replica

לא יעשה בית תבנית היכל כשיעור גבהו וארכו ורחבו אכסדרה תבנית אולם. חצר תבנית עזרה. שלחן תבנית שלחן מנורה תבנית מנורה. אבל עושה של חמשה קנים או של ששה או שמונה אבל של שבעה לא יעשה אפילו משאר מיני מתכות ואפילו בלא גביעים וכפתורים ופרחים ואפי׳ אינה גבוהה י״ח טפחים:
One should not make a house in the form of the Heikhal, in the measure of its height, its length and its width; nor a portico in the form of the Ulam; nor a courtyard in the form of the Azarah; nor a table in the form of the Table; nor a lampstand in the form of the Menorah — but one may make one of five branches, or six, or eight; of seven one should not make, even of other metals, even without cups, knobs and flowers, and even if it is not eighteen tefachim high.
The last seif no longer speaks of idolatry but of the Temple: one does not make a replica of it, nor of its vessels. The measure is exact likeness — the same dimensions for the Heikhal, seven branches for the Menorah. The Shakh (ס״ק ל״ג–ל״ו) draws the boundaries: changing the dimensions partly permits; wood and earthenware are permitted because they would be invalid in the Temple; and what does not invalidate the Menorah (cups, height) does not exempt either.

2. Background — the mishnayot of כל הצלמים and the sugya of לא תעשון אתי

Seif 1 comes from the mishnah that opens chapter כל הצלמים, and from three clarifications in the Gemara: royal statues, the city gate, and the three added attributes.

summary: all statues are forbidden because they are worshipped once a year — Rabbi Meir’s view; the Sages: only one holding a staff, a bird or a ball is forbidden. The Gemara: the mishnah speaks of royal statues, and of those standing at the city gate; Rabbah: the dispute concerns cities, but in villages all forbid; and a baraita adds the sword, the crown and the ring.

Seif 2 follows the second mishnah and Shmuel’s discussion: why the fragment is permitted, why the hand is not, and the double doubt underlying it all.

summary: one who finds fragments of statues — they are permitted; a hand or a foot — forbidden, for such limbs are worshipped. Shmuel: even fragments of idols. And the hand? — Shmuel explains: when standing on its base. The doubt: we do not know whether they were worshipped, and if so, perhaps they were nullified; but a certain idol — who says it was nullified? And the dispute about an idol broken by itself: Rabbi Yochanan forbids, Reish Lakish permits.

Seif 3 is the third mishnah, decided according to Rabban Shimon ben Gamliel, with Abaye’s answer — why these three figures and no others — and the definition of honoured vessels according to Shmuel.

summary: vessels bearing the sun, the moon or the dragon — they are cast into the Dead Sea; Rabban Shimon ben Gamliel: on honoured vessels, forbidden; on lowly ones, permitted. Abaye: people worship whatever they find, but they draw in order to worship only these three important figures; the rest is mere decoration. Rav: honoured above the water line, lowly below; Shmuel: all these are lowly, the honoured are bracelets, nose-rings and finger-rings — and the baraita goes like Shmuel.

Rav Sheshet gathers the three “except” of the chapter, and the Gemara makes them the key to seifim 4 to 7: finding is not making. The dragon is defined.

The central sugya, in Rosh Hashanah and Avodah Zarah. Rabban Gamliel had figures of the moon; how, if the verse forbids making “My servants”? Abaye’s successive answers draw the map of seif 4 — and seif 8 emerges on the way.

Pure making remains. The final answer distinguishes making from keeping, and introduces suspicion, the ring, the public, the object in sections, and study.

Do we fear suspicion? The synagogue of Nehardea had a statue and people prayed there — the public is different. Was Rabban Gamliel alone? — the public frequented the Nasi; or it was in sections; or: for study it is different — “you shall not learn to do”, but you learn in order to understand and teach.

The Rambam, whose wording the Mehaber copies in seifim 1 and 5, divides the matter between two chapters: chapter 7 (what one finds) and chapter 3 (what one makes).

summary: the statues of villages are forbidden, for a doubt of idolatry is forbidden and, by default, they were made for idols; in cities, permitted, made for ornament. All other signs and all other figures, even the human figure, are permitted to one who finds them. The Rambam forbids a hand or foot found — this is not convincing, the Gemara speaks of a base. And the prohibition on man and dragon targets only a complete figure; a head, or a body without a head, carries no prohibition, neither to find nor to make.

3. Key concepts

צֶלֶם · צוּרָהthe statue and the figure. The צלם is an effigy made to be worshipped, or presumed so; the צורה is an image in general. Seifim 1 to 3 speak of the former, seifim 4 to 7 of the latter — and the rules are not alike: one is forbidden by idolatry, the other by a verse of its own.
חֲזָקָה — כְּפָרִים וּכְרַכִּיםthe presumption — villages and cities. We do not know the sculptor’s intention; we presume it from the place. In a village nobody sculpts to decorate; in a city, they do. The Shakh (ס״ק א) specifies that in a real doubt one forbids: one must know that it is for ornament.
מְכוּבָּדִין · מְבוּזִּיןhonoured and lowly vessels. A jewel, a nose-ring, a finger-ring — honoured; a cauldron, a kettle, a cup — lowly, because one eats and drinks from them. A worshipped figure engraved on a jewel is presumed made for worship; on a cauldron, for decoration. The Shakh (ס״ק י) adds: the middling vessel, neither honoured nor lowly, is forbidden.
חַמָּה · לְבָנָה · דְּרָקוֹןsun, moon, dragon. The three figures that people draw in order to worship, according to Abaye. The Rama and the Shakh (ס״ק ח) specify: the talisman figures — a crowned king on a chariot — not the plain disc.
לֹא תַעֲשׂוּן אִתִּי“you shall not make with Me”. The verse of Exodus 20 read twice: אִתִּי — “My servants”, the four faces, the angels, the luminaries; and אוֹתִי — “Me”, the human figure, the form in which God appears to the prophets. It is a prohibition on making, independent of idolatry.
בּוֹלֵט · שׁוֹקֵעַin relief, sunken. Man is forbidden in relief only, for that is how he appears; the sun, the moon and the stars are forbidden even sunken, for in the firmament they appear sunk (Tosafot, Shakh ס״ק כ״ה). A painting or a weaving counts as “sunken”.
חֲשָׁדsuspicion. Making is forbidden by the Torah; keeping what another made is forbidden only for fear that the owner be suspected of worshipping. Hence three leniencies: the public (no suspicion), the object in sections, and the object meant for study.
תַּבְנִית הֵיכָל · מְנוֹרָהthe replica of the Temple. Seif 8 forbids reproducing the Heikhal, the Ulam, the Azarah, the Table, the Menorah — in the same dimensions, or with seven branches. This is no longer idolatry: it is the respect due to the “servants” below, which can be reproduced and must not be.

The Taz wonders that the Shulchan Arukh did not report the Ramban, and rules: one does not relax against him. But to keep a sunken figure made by another, the Ran in the name of the Ramban permits.

summary: what one paints on a wall or a tablet, even flat, counts as sunken, since it is not in relief like the real object; hence the sun and the moon, which in the firmament are themselves sunk, are forbidden even sunken. And: no figure is forbidden unless complete — two eyes, a whole nose, the whole body; the half-profile that some painters draw is not forbidden.

summary: even the lion is permitted, as the Rashba ruled; the Bach forbade it as a zodiac sign, but then the twelve signs would be forbidden one by one, and nobody is careful about that — the forbidden “signs” are the twelve together, like the four faces. The Taz, for his part, blames those who draw the signs in the machzorim of the prayer for rain; and the Nekudot HaKesef reply: it is obviously to understand and to teach, and it is not a complete figure.

6. The glosses of the Rama (הגה) and the source parentheses

« צורת שמשתחוים לו דינו כדין צלם ואסור בלא ביטול אבל אותן שתולין בצואר לזכרון לא מקרי צלם ומותר » (רמ״א יו״ד קמ״א:א)
Seif 1. The Rama distinguishes two objects the Mehaber did not name: the figure before which people bow — a full צלם, forbidden without nullification — and the pendant worn as a keepsake, which is not a צלם. The Shakh (ס״ק ו) specifies: this pendant is permitted only if one knows nobody bowed to it.
« דהיינו צורות הנעשים לשם חמה ולבנה כמו שעושים בעלי הטלסמאות צורות לכוכבים כגון צורות המתייחסות לשמש מציירים מלך מעוטר יושב על עגלה » (רמ״א יו״ד קמ״א:ג)
Seif 3, first gloss. “Sun” and “moon” are not the disc and the crescent: they are the figures that talisman-makers attribute to the luminaries — a crowned king on a chariot. The source is the Rambam in his Commentary on the Mishnah, and the Shakh (ס״ק ח) infers that the disc found is permitted.
« והמנהג כסברא הראשונה ובזמן הזה שאין העובדי כוכבים עובדין לצורות הללו מותרים בהנאה אם מוצאן אבל אין להשהותן » (רמ״א יו״ד קמ״א:ג)
Seif 3, second gloss — the custom. Between the Mehaber’s two views on the lowly vessel, custom follows the first. And nowadays, when these figures are no longer worshipped, one may benefit from them if one finds them — but not keep them, because of suspicion (Rabbenu Yerucham). The Shakh (ס״ק ט״ז) attaches this sentence to the three figures of the seif.
« ויש מחמירים בכל הצורות הנזכרות אפילו בזמן הזה אע״ג דידעינן דלא פלחי להו » (רמ״א יו״ד קמ״א:ג)
Seif 3, continued. A stringent opinion forbids all these figures even nowadays. The Rama takes it from the Tur and the Tosafot through the Beit Yosef; the Shakh (ס״ק י״ז) refuses to understand it and shows that neither the Tosafot nor the Tur carry it.
« וצורת דרקון מותר לעשותה אלא שאסור להשהותה אצלו משום חשד » (רמ״א יו״ד קמ״א:ג)
Seif 3, end — the dragon. One may make it — it is not in the verse’s list, and the Maharshal explains that it flies in the air without being “in the heavens” — but one may not keep it, because of suspicion. The Taz (ס״ק ו) gives another reason: perhaps it was already worshipped, hence even sunken.
« ומיהו אם מוצא אותם מותרים מלבד בחמה ולבנה שדרך העובד כוכבים לעבדם או שיש הוכחה שעשאן לעבדם שאז אסור ככל הצלמים » (רמ״א יו״ד קמ״א:ד)
Seif 4. What is forbidden to make and to keep remains permitted to one who finds it — except the sun and the moon, which are worshipped, or a figure proven to have been made for worship. The Shakh (ס״ק כ״ד): permitted for benefit, not for keeping.

Seif 4, in parentheses. Some permit keeping a figure in a public place, for there is no suspicion there — the Rosh’s view, drawn from the synagogue of Nehardea. The Shakh (ס״ק כ״ז): this holds only for keeping, never for making; and Rabbenu Yerucham adds that, even without suspicion, the thing is unseemly.

Seif 5 and seif 7. The relief impression made by a non-Jew is not kept either — the Shakh (ס״ק כ״ט) wonders what this adds to seif 4 — and the rule holds for all forbidden figures. In seif 7 one word suffices: וכן נוהגין — the head alone is permitted, and that is the custom; the Shelah advises against it (פתחי תשובה ס״ק י״א).

The parentheses of the seif are not the Rama’s but the Mehaber’s own or his editors’: (לשון המחבר) and (לשון רמב״ם פ״ז מהל׳ עבודת כוכבים) in seif 1 separate what comes from the Tur from what comes from the Rambam; (דעת הר״ן) in seif 3 signs the first view; (ל׳ רמב״ם פ״ג מהלכות עבודת כוכבים דין י״א) in seif 5 refers to the source of the ring. They are copied as they are: they belong to the received text.

7. Contemporary practical cases

The cases below illustrate the seifim; they do not replace a question to a Rav.

Case 1 — The museum statue

An ancient statue, once worshipped, displayed in a museum. To one who finds it, seifim 1 and 2 apply: in a village it is presumed idolatrous, in a city ornamental; broken, it is permitted. But owning it at home falls under seif 4: a complete human figure in relief is not kept, because of suspicion — and according to the Rama (seif 4) the public changes matters. A question for your Rav before buying.

Case 2 — The medal and the coin

A coin or a medal bearing a face in relief. Seif 3 lists coins among lowly vessels; the Pitchei Teshuva (ס״ק ד) reports the view that distinguishes silver, honoured, from copper, lowly; and the Yaavetz (ס״ק י) holds that a bust with a complete face in relief on a coin is a serious prohibition. Ordinary currency circulates without difficulty; a commemorative medal with a man’s effigy is a real case.

Case 3 — The doll and the figurine

A doll with a complete face, in relief, is a human figure — but it is made neither for worship nor for display. Seif 7 (Rosh, Tur) speaks only of the complete figure; the Shakh (ס״ק כ״ה) requires two eyes, a nose, the whole body. Customs vary — some remove a detail — and the Shakh concludes that the stringent will be blessed. Ask.

Case 4 — The sun logo

A radiant sun on a sign, a stained-glass window, a logo. The Shakh (ס״ק ח) permits the disc found, but forbids making it — and the Chatam Sofer (פתחי תשובה ס״ק ג) demanded that a round window with sun rays be removed from a synagogue. An abstract figure is not the talisman figure; a sun with a face is far closer to it.

Case 5 — Figures in the synagogue

Lions, eagles, zodiac signs painted or carved in a synagogue. The lion alone is permitted (Shakh ס״ק ל); Rabbenu Eliakim wanted the lions of Cologne removed, and the Beit Yosef concludes that we do not follow him. But the Taz (ס״ק י״ד) reports that one does not draw these figures facing the one who prays, so that he not appear to bow to them.

Case 6 — The seven-branched Menorah

A seven-branched lampstand, in metal, in a living room or a synagogue. Seif 8 forbids it, even without cups or knobs, even low; the Shakh (ס״ק ל״ה) permits wood and earthenware, invalid in the Temple; the Pitchei Teshuva (ס״ק י״ד) discusses seven branches arranged in a circle and candles instead of oil, and concludes stringently. Six or eight branches, no problem at all.
