Siman 142 runs to fifteen seifim — the Shulchan Arukh announces it itself: « שהאלילים ותשמישיהם אסורים בהנאה. ובו ט״ו סעיפים » (שו״ע יו״ד קמ״ב:א). The idol is forbidden for benefit; the siman asks how far that prohibition spreads. Its coal, its ashes, its wood, its knife, its shuttle, its shade, its music — how far is the benefit still its own? The answer turns on two measures: what still has substance, and what is the sole cause of the result.

1. The text of the Mechaber and the Rama — the fifteen seifim

Each seif is given in the Hebrew of the Shulchan Arukh as it stands, followed by a flowing English rendering. The passages in parentheses and small type are the glosses of the Rama and the printed source notes; they are kept in place.

Seif 1 — Coal and ashes — but not the flame

שהאלילים ותשמישיהם אסורים בהנאה. ובו ט״ו סעיפים:
כשם שהאלילים אסורים בהנאה כך כל הנאות הבאות ממנה אסורות אפילו אם שרפה אסור ליהנות בגחלתה ואפרה אבל מותר ליהנות משלהבתה:
Title of the siman: that idols and their appurtenances are forbidden for benefit; and it contains fifteen seifim.

Just as idols are forbidden for benefit, so every benefit that comes from them is forbidden. Even if he burned it, it is forbidden to benefit from its coal and from its ashes; but it is permitted to benefit from its flame.
Three states of the same wood, three statuses. The coal and the ashes still have substance: they are the idol, and they remain forbidden. The flame has no substance — « וְהַשַּׁלְהֶבֶת מֻתֶּרֶת מִפְּנֵי שֶׁאֵין בָּהּ מַמָּשׁ » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה י׳) — and one may light or warm oneself by it. The siman opens on this distinction, and returns to it at seif 6 with the coals of the oven.

Seif 2 — The knife of idolatry: slaughtering, not cutting

סכין של אלילים ששחט בה הרי זה מותר מפני שהוא מקלקל (ואם הסכין חדש או ישן ולבנו מאיסור שבו אפילו לכתחילה מותר) (לעיל סימן י׳) ואם היתה בהמ׳ מסוכנת הרי זו אסורה מפני שהוא מתקן והרי זה התקון מהנאת משמשי אלילים וכן אסור לחתוך בה בשר מפני שהוא מתקן ואם חתך דרך הפסד והשחתה מותר:
A knife of idolatry with which one slaughtered an animal — it is permitted, because he damages.

Gloss of the Rama: and if the knife is new, or old but he heated it white-hot to remove the forbidden matter absorbed in it — it is permitted even a priori (see above, siman 10).

But if the animal was in danger of dying, it is forbidden, because he improves, and this improvement comes from benefit of the idol’s appurtenances. Likewise it is forbidden to cut meat with it, because he improves; and if he cut in a way of loss and spoiling, it is permitted.
Damaging or improving: that is the sole criterion. Slaughter takes away from the animal what it was worth alive — for carrying, ploughing, bearing young — so he does not benefit from the knife. Cutting the meat into portions adds value: that is benefit. The endangered animal reverses the first case: without the slaughter it was lost, and the knife saved it.

Seif 3 — The asherah’s shuttle and the garment

נטל ממנה כרכר (פי׳ עץ או עצם שראשו חד ושובטין בו הבגד כשאורגים אותו למען יפרדו החוטין העליונים מן התחתונים) וארג בו את הבגד אסור בהנאה נתערב בבגדים אחרים יוליך דמי אותו הבגד לים המלח ושאר כל הבגדים מותרים:
If he took a shuttle from the asherahexplanation: a piece of wood or bone with a sharp tip, with which one beats the cloth while weaving it so that the upper threads part from the lower ones — and wove the garment with it: it is forbidden for benefit. If it became mixed with other garments, he carries the value of that garment to the Dead Sea, and all the other garments are permitted.

Seif 4 — Wood in the oven, and the bread

If he took wood from it, it is forbidden for benefit. If he heated the oven with it — whether new or old, it is left to cool, and afterwards he heats it with permitted wood. And if he did not let it cool and baked bread in itgloss of the Rama: while the torch burns facing it (Beit Yosef) — it is forbidden for benefit, for the bread carries the enhancement of the forbidden wood (Tur). If it became mixed with others, he carries the value of that bread to the Dead Sea, and all the other loaves are permitted. If he raked out all the fire and afterwards cooked or baked in the heat of the oven — it is permitted, for the forbidden wood is gone.

Gloss of the Rama: what we say — “the bread carries the enhancement of the wood” — applies only to a thing forbidden for benefit; but if he baked or cooked next to a thing forbidden only for eating, even with the torch facing it, it is permitted (Mordekhai in chapter haSokher, Tosafot, and on the verse).

summary: the final gloss distinguishes the prohibition of benefit — where the wood’s enhancement counts — from the prohibition of eating, where heat transmits nothing that forbids.
Four situations in one seif, and they must be kept apart. (1) The oven heated with forbidden wood: let it cool, then relight with permitted wood. (2) Bread baked without cooling, the torch facing it: forbidden for benefit. (3) That bread mixed with others: carry its value to the Dead Sea. (4) The fire raked out, bread baked in the remaining heat: permitted according to the Mechaber. Level 2 will show that the Shach and the Taz contest precisely point (4) in matters of idolatry.

Seif 5 — Vessels fired with wood of idolatry

קערות וכוסות וקדירות וצלוחיות שבשלן היוצר בעצי האלילים הרי אלו אסורי׳ בהנאה שהרי דבר האסור בהנאה עשה אותם חדשים. (הסעיפים ה׳ ו׳ ז׳ הוא ל׳ הרמב״ם פרק י״ז מהמ״א רק שהמחבר כתב עצי אלילים במקום קליפי ערלה):
Plates, cups, pots and flasks that the potter fired with the wood of idols — they are forbidden for benefit, for a thing forbidden for benefit made them new.

Editorial note: seifim 5, 6 and 7 reproduce the wording of the Rambam in Hilkhot Maakhalot Assurot, except that the Mechaber wrote “wood of idols” in place of “peels of orlah”.

summary: the marginal note refers to “chapter 17”; in the current editions and on Sefaria these halakhot are in chapter 16 (halakhot 22 to 24), and that is how the Beit Yosef and the Shach cite them.

Seif 6 — Bread baked over the coals

פת שבשלה ע״ג גחלים של עצי אלילים מותרת כיון שנעשו גחלים הלך איסורן אע״פ שהן בוערות:
Bread that was baked over coals of the wood of idols is permitted: once they became coals their prohibition is gone, even though they are still burning.

Seif 7 — A pot cooked with two kinds of wood

קדרה שבישלה בעצי אלילים ובעצי היתר הרי התבשיל אסור ואע״פ שזה וזה גורם שבשעה שנתבשלה מחמת עצי האיסור עדיין לא באו עצי ההיתר ונמצא מקצת הבישול בעצי היתר ומקצתו באיסור:
A pot that was cooked with wood of idols and with permitted wood — the dish is forbidden, even though both are causes; for at the time it cooked by the forbidden wood, the permitted wood had not yet come, and it turns out that part of the cooking was by permitted wood and part by forbidden wood.
Why זה וזה גורם does not save here. The rule “two causes, one forbidden and one permitted → permitted” assumes both act together. In the pot, the forbidden wood acted alone first; the permitted wood came only afterwards. Part of the cooking is therefore entirely due to the forbidden wood, and that part has no permitted cause accompanying it.

Seif 8 — The chicks and eggs of the nest

אפרוחים שקננו באשרה ואינם צריכים לאמן מותרין אבל ביצים שעליה וכן אפרוחים שצריכים לאמן אסורים והקן עצמו שבראשה מותר מפני שהעוף מביא עציו ממקום אחר (ל׳ רמב״ם פ״ז מהל׳ עבודת כוכבים) (ולא יעלה על האשרה ליטלן אלא יתיז בקנה והם נופלין) (טור):
Chicks that nested in the asherah and no longer need their mother are permitted; but the eggs upon it, and likewise chicks that still need their mother, are forbidden. The nest itself at its top is permitted, because the bird brings its wood from elsewhere (wording of the Rambam, chapter 7 of Hilkhot Avodat Kokhavim).

Gloss of the Rama: and he shall not climb the asherah to take them, but shall knock them down with a reed (Tur).

Seif 9 — The asherah’s shade, and passing beneath it

האשרה בין שהיתה נעבדת בין שהיתה אלילים מונחת תחתיה אסור לישב בצלה (ל׳ רמב״ם שם דין י״א) ואם יש לו דרך אחרת קצרה כמוה אסור לעבור תחתיה ואם לאו עובר תחתיה כשהוא רץ (ודוקא לעבור תחתיה אבל לעבור בצלה בכל ענין שרי) (ר״ן פ׳ כל הצלמים):
The asherah — whether it is itself worshipped, or an idol is placed beneath it — it is forbidden to sit in its shade (wording of the Rambam, ibid., halakha 11). If he has another road as short, it is forbidden to pass beneath it; if not, he passes beneath it running.

Gloss of the Rama: and precisely passing beneath it; but passing in its shade is permitted in every way (Ran, chapter Kol haTzelamim).
Three acts, three rules. Sitting in the shade: forbidden, because one benefits from the tree. Passing beneath it: forbidden if there is another road — and if there is none, one passes running. Passing through the shade without being under the branches: permitted (Rama, in the name of the Ran). The shade is forbidden only to the one who settles in it.

Seif 10 — The shade of a house of idolatry

צל בית אלילים תוכו ונגד פתחו תוך ארבע אמות אסור צל שלאחריו מותר ואפי׳ תוכו אם גוזל הרבים שקדם לו הדרך ואח״כ בנה שם בית של אלילים מותר לעבור דרך שם אבל אם קדם הבית לדרך אסור ויש אוסרים בכל גוונא (רמזים):
The shade of a house of idolatry: inside it, and facing its door within four cubits, it is forbidden; the shade behind it is permitted. And even inside: if it encroaches on the public — the road having preceded it, and the house of idolatry having been built there afterwards — it is permitted to pass through there; but if the house preceded the road, it is forbidden. And some forbid in every case (Remazim).

Seif 11 — Vegetables under the asherah, manure and vetch

מותר ליטע תחת האשרה ירקות בין בימות החמה שהם צריכים לצל בין בימות הגשמים מפני שצל האשרה שהוא אסור עם הקרקע שאינה נאסרת גורמים לירקות אלו לצמוח וכל שדבר איסור ודבר מותר גורמין לו הרי זו מותר בכל מקום לפיכך שדה שזבלה בזבל של אלילים מותר לזרוע אותה ופרה שפטמה בכרשיני אלילים תיאכל וכן כל כיוצא בזה:
It is permitted to plant vegetables under the asherah, both in the hot season, when they need shade, and in the rainy season — because the shade of the asherah, which is forbidden, together with the ground, which does not become forbidden, cause these vegetables to grow; and whatever a forbidden thing and a permitted thing together cause is permitted everywhere. Therefore a field that was manured with manure of idols may be sown; a cow that was fattened with vetch of idols may be eaten; and so in every similar case.
The principle running through the whole siman: « אבל אנן קיימא לן זה וזה גורם מותר בדיעבד אבל לכתחלה אסור » (טור יו״ד קמ״ב) — when a forbidden cause and a permitted cause combine, the result is permitted. The vegetables grow by the shade and by the ground; the field yields by the manure and by the earth; the cow fattens by the vetch and by the rest of its food. Seif 4 (the cooled oven) and seif 7 (the pot) are the two boundaries of this rule.

Seif 12 — The tree whose fruit is kept for the festival

אילן ששומרים פירותיו לעשות מהם שכר לשתותו ביום חגם אסור בידוע שהיא אשרה:
A tree whose fruit is kept in order to make from it beer that is drunk on the day of their festival is forbidden: it is known that it is an asherah.

Seif 13 — Barren trees planted before the idol

אילני סרק (פירוש אילנות שאין עושין פירות) שרגילין ליטע בפני אלילים לא גרע מנוי אלילים ואסור:
Barren treesexplanation: trees that do not bear fruit — that people are accustomed to plant before idols are no less than an idol’s ornament, and they are forbidden.

Seif 14 — The bathhouse where an idol stands

מרחץ שיש בה אלילים מותר לרחוץ בה מפני שהיא נעשית לשם נוי ולא לעבדה שנאמר אלהיהם בזמן שנוהגים בה מנהג אלהות ולא בזמן שמבזים אותה כגון זו שהיא עומדת על הביב והכל משתינים בפניה ואם היה דרך עבודתה בכך אסור (ל׳ הרמב״ם שם דין י״ח):
A bathhouse in which there is an idol — it is permitted to bathe in it, because it was made for ornament and not to be worshipped; for it is said “their gods”: when they treat it as a deity, and not when they degrade it — like this one, which stands over the sewer and before which everyone urinates. But if its manner of worship was such, it is forbidden (wording of the Rambam, ibid., halakha 18).
The decisive word: “their gods”. A statue placed in a bathhouse is not treated as a deity — it decorates. The mishnah in Avodah Zarah says so through Rabban Gamliel: it is not the bathhouse that adorns the idol, it is the idol that adorns the bathhouse. The only reservation is the Rambam’s: if the worship of that idol consists precisely in this degradation, the permission falls.

Seif 15 — Music and the gaze

אסור לשמוע כלי שיר של אלילים או להסתכל בנוי אלילים כיון שנהנה בראייה. (ומיהו דבר שאין מתכוין מותר) (מצא הגהה בשם רבי ישעיה האחרון ז״ל ועיין ס״ק ל״ד):
It is forbidden to listen to the musical instruments of idols, or to gaze at the ornament of idols, since one enjoys through sight.

Gloss of the Rama: however, what is unintentional is permitted (found in a gloss in the name of Rabbi Yeshaya haAcharon; and see ס״ק ל״ד).
The last seif closes the circle opened by the first: the siman began with matter (coal, ashes, flame) and ends with what has no matter at all — a sound, an image. Enjoyment of the senses is enjoyment, and the idol is its source; but what one did not seek to hear or to see is not an enjoyment that one takes.

2. Background — the sugyot from which the siman is woven

Siman 142 has no single source: it is a fabric of sugyot stitched together by the Rambam, then by the Tur, then by the Mechaber. Knowing them is what explains why the seifim follow one another in this order.

The coal and the flame — Beitzah 39a

The beraita that seif 1 condenses is the one in Beitzah:

« גַּחֶלֶת שֶׁל עֲבוֹדָה זָרָה — אֲסוּרָה, וְשַׁלְהֶבֶת — מוּתֶּרֶת » (ביצה ל״ט ע״א)

And the gemara at once asks why the flame of hekdesh is forbidden:

« מַאי שְׁנָא שַׁלְהֶבֶת עֲבוֹדָה זָרָה דְּשַׁרְיָא, וּמַאי שְׁנָא דְּהֶקְדֵּשׁ דַּאֲסִירָא? עֲבוֹדָה זָרָה, דִּמְאִיסָה וּבְדִילִי אִינָשֵׁי מִינַּהּ — לָא גְּזַרוּ בַּהּ רַבָּנַן » (ביצה ל״ט ע״א)

The reason, then, is one of repugnance: the idol is loathsome, people keep away from it of themselves, and the Sages had no need to decree upon its flame. This is worth holding on to: seif 1 is not a leniency, it is the observation that there was nothing here to decree about.

The ashes — Temurah 34a

That the ashes remain forbidden comes from a mishnah in Temurah, where the asherah is the exception to the whole list:

« כׇּל הַנִּשְׂרָפִין אֶפְרָם מוּתָּר, חוּץ מֵאֵפֶר אֲשֵׁירָה » (תמורה ל״ד ע״א)

The Beit Yosef notes it as the Mechaber’s source: « ומ״ש דאפרה נמי אסור בסוף תמורה (לד.) כל הנשרפים אפרם מותר חוץ מאפר אשירה » (בית יוסף יו״ד קמ״ב)

The knife — Chullin 8a

Seif 2 is the beraita of Chullin, with its reason written into the text itself:

« סַכִּין שֶׁל עֲבוֹדָה זָרָה מוּתָּר לִשְׁחוֹט בָּהּ, וְאָסוּר לַחְתּוֹךְ בָּהּ בָּשָׂר. מוּתָּר לִשְׁחוֹט בָּהּ – מְקַלְקֵל הוּא, וְאָסוּר לַחְתּוֹךְ בָּהּ בָּשָׂר – מְתַקֵּן הוּא » (חולין ח׳ ע״א)

The gemara immediately adds the two cases that reverse the rule — the dying animal, where slaughter becomes an improvement, and the cutting that is not one:

« פְּעָמִים שֶׁהַשּׁוֹחֵט אָסוּר – בִּמְסוּכֶּנֶת, וּמְחַתֵּךְ מוּתָּר – בְּאַטְמֵי דְּקָיְימָן לְקוּרְבָּנָא » (חולין ח׳ ע״א)

The wood, the shuttle and the bread — Avodah Zarah 49b

Seifim 3 and 4 are the mishnah of Kol haTzelamim:

« נָטַל מִמֶּנָּה עֵצִים — אֲסוּרִין בַּהֲנָאָה. הִסִּיק בָּהֶן אֶת הַתַּנּוּר, אִם חָדָשׁ — יוּתַּץ, וְאִם יָשָׁן — יוּצַן. אָפָה בּוֹ אֶת הַפַּת — אֲסוּרָה בַּהֲנָאָה » (עבודה זרה מ״ט ע״ב)
« נָטַל הֵימֶנָּה כַּרְכֵּור — אָסוּר בַּהֲנָאָה. אָרַג בּוֹ אֶת הַבֶּגֶד — אָסוּר בַּהֲנָאָה » (עבודה זרה מ״ט ע״ב)

On the mixture the mishnah sets Rabbi Eliezer against the Sages, and from there comes the whole question of redemption:

« נִתְעָרְבָה בַּאֲחֵרוֹת — כּוּלָּן אֲסוּרוֹת בַּהֲנָאָה, רַבִּי אֱלִיעֶזֶר אוֹמֵר: יוֹלִיךְ הֲנָאָה לְיָם הַמֶּלַח, אָמְרוּ לוֹ: אֵין פִּדְיוֹן לַעֲבוֹדָה זָרָה » (עבודה זרה מ״ט ע״ב)

The gemara explains why both cases were needed — the bread and the shuttle — and not one alone:

« דְּאִי אַשְׁמְעִינַן קַמַּיְיתָא, בְּהָא קָאָמַר רַבִּי אֱלִיעֶזֶר, מִשּׁוּם דִּבְעִידָּנָא דְּקָא גָמְרָה פַּת קָלֵי לַהּ אִיסּוּרָא, אֲבָל כַּרְכֵּור דְּאִיתֵיהּ לְאִיסּוּרָא בְּעֵינֵיהּ, אֵימָא מוֹדֵי לְרַבָּנַן » (עבודה זרה מ״ט ע״ב)

Then it rules: « אָמַר רַב חִיָּיא בְּרֵיהּ דְּרַבָּה בַּר נַחְמָנִי אָמַר רַב חִסְדָּא אָמַר זְעֵירִי: הֲלָכָה כְּרַבִּי אֱלִיעֶזֶר » (עבודה זרה מ״ט ע״ב)

The oven — Pesachim 26b–27a

Seifim 4 to 7 come from Kol Sha‘ah, where the same question is asked about orlah:

« תַּנּוּר שֶׁהִסִּיקוֹ בִּקְלִיפֵּי עׇרְלָה אוֹ בְּקַשִּׁין שֶׁל כִּלְאֵי הַכֶּרֶם, חָדָשׁ — יוּתַּץ, יָשָׁן — יוּצַן » (פסחים כ״ו ע״ב)
« אָפָה בּוֹ אֶת הַפַּת, רַבִּי אוֹמֵר: הַפַּת אֲסוּרָה, וַחֲכָמִים אוֹמְרִים: הַפַּת מוּתֶּרֶת. בִּישְּׁלָהּ עַל גַּבֵּי גֶּחָלִים — דִּבְרֵי הַכֹּל מוּתָּר » (פסחים כ״ו ע״ב)

And the apparent contradiction that the Shach will spend twenty lines untangling:

« וְהָא תַּנְיָא: בֵּין חָדָשׁ וּבֵין יָשָׁן יוּצַן! לָא קַשְׁיָא: הָא — רַבִּי, וְהָא — רַבָּנַן » (פסחים כ״ו ע״ב)

There too are found the pot of seif 7 and the vessels of seif 5:

« הָנֵי קְעָרוֹת וְכוֹסוֹת וּצְלוֹחִיּוֹת אֲסִירִי » (פסחים כ״ז ע״א)
« אֲפִילּוּ לְמַאן דְּאָמַר ״זֶה וָזֶה גּוֹרֵם מוּתָּר״, קְדֵירָה — אֲסוּרָה, דְּהָא קַבְּלָה בִּישּׁוּלָא מִקַּמֵּי דְּנִיתֵּן עֵצִים דְּהֶיתֵּירָא » (פסחים כ״ז ע״א)

And the condition that will become the Rama’s gloss on seif 4 — « אָמַר רַב פָּפָּא: כְּשֶׁאֲבוּקָה כְּנֶגְדּוֹ » (פסחים כ״ז ע״א) — that is, so long as the fire of the forbidden wood is still burning opposite the bread.

The nest — Avodah Zarah 42b

Seif 8 comes from the mishnah about the nest at the top of the tree:

« קֵן שֶׁבְּרֹאשׁ הָאִילָן שֶׁל הֶקְדֵּשׁ — לֹא נֶהֱנִין וְלֹא מוֹעֲלִין, בְּרֹאשָׁהּ שֶׁל אֲשֵׁרָה — יַתִּיז בְּקָנֶה » (עבודה זרה מ״ב ע״ב)

The gemara distinguishes the nest itself — which the bird built from twigs brought from elsewhere — from the eggs and the fledglings:

« הָכָא בְּמַאי עָסְקִינַן? כְּגוֹן דְּאַיְיתַי עֵצִים מֵעָלְמָא, וְקִינְּתָהּ בָּהֶן » (עבודה זרה מ״ב ע״ב)
« בְּאֶפְרוֹחִין — כָּאן וְכָאן מוּתָּרִין, בְּבֵיצִים — כָּאן וְכָאן אֲסוּרִין. אָמַר רַב אָשֵׁי: וְאֶפְרוֹחִין שֶׁצְּרִיכִין לְאִמָּן כְּבֵיצִים דָּמוּ » (עבודה זרה מ״ב ע״ב)

The shade — Avodah Zarah 48b

Seifim 9 to 11 come from a single page. First the mishnah:

The gemara specifies that the prohibition reaches down to the shadow of the shadow — « לֹא נִצְרְכָא אֶלָּא לְצֵל צִילָּהּ » (עבודה זרה מ״ח ע״ב) — and Rashi explains what that second shadow is:

« שחרית וערבית שצל ארוך לכל דבר מאד וכל זמן שלא עברה מדת אורך הצל את מדת גובה קומת האילן הצל עב וחשוך מכאן ואילך הצל דק וקלוש והיא צל צלו » (רש״י עבודה זרה מ״ח ע״ב)

It then resolves the contradiction about passing under the tree by whether or not another road exists:

« וְלָא פְּלִיגִי, הָא דְּאִיכָּא דִּירְכָּא אַחֲרִינָא, הָא דְּלֵיכָּא דִּירְכָּא אַחֲרִינָא » (עבודה זרה מ״ח ע״ב)

And the incident that gave the Tur its phrase about the man of standing: « אֲמַר לֵיהּ רַב שֵׁשֶׁת לְשַׁמָּעֵיהּ: כִּי מָטֵית לְהָתָם ״אַרְהֵיטְנִי״ » (עבודה זרה מ״ח ע״ב) — Rashi glossing « משכני במרוצה » (רש״י עבודה זרה מ״ח ע״ב) — the gemara concluding « לְעוֹלָם, דְּלֵיכָּא דִּירְכָּא אַחֲרִינָא, וְאָדָם חָשׁוּב שָׁאנֵי » (עבודה זרה מ״ח ע״ב).

The vegetables, the manure and the cow — Avodah Zarah 48b–49a

Seif 11 is the mishnah that closes the chapter:

« זוֹרְעִין תַּחְתֶּיהָ יְרָקוֹת בִּימוֹת הַגְּשָׁמִים, אֲבָל לֹא בִּימוֹת הַחַמָּה, וְהַחֲזֵירִין לֹא בִּימוֹת הַחַמָּה וְלֹא בִּימוֹת הַגְּשָׁמִים. רַבִּי יוֹסֵי אוֹמֵר: אַף לֹא יְרָקוֹת בִּימוֹת הַגְּשָׁמִים, מִפְּנֵי שֶׁהַנְּבִיָּה נוֹשֶׁרֶת עֲלֵיהֶן וְהֹוָה לָהֶן לְזֶבֶל » (עבודה זרה מ״ח ע״ב)

then the contradictory beraita about the field and the cow:

which the gemara resolves by the very principle of zeh vezeh gorem: « לְדִידִי, זֶה וָזֶה גּוֹרֵם מוּתָּר » (עבודה זרה מ״ט ע״א) — and rules like Rabbi Yose:

Seif 14 is one of the most famous pages of the tractate: Rabban Gamliel’s answer to the philosopher.

« אֲנִי לֹא בָּאתִי בִּגְבוּלָהּ, הִיא בָּאָה בִּגְבוּלִי. אֵין אוֹמְרִים: נַעֲשָׂה מֶרְחָץ נוֹי לְאַפְרוֹדִיטֵי, אֶלָּא אוֹמֵר: נַעֲשָׂה אַפְרוֹדִיטֵי נוֹי לַמֶּרְחָץ » (עבודה זרה מ״ד ע״ב)

And the closing distinction, which is exactly the Mechaber’s reservation at the end of the seif: « וַאֲנִי אוֹמֵר: אֵינָהּ גְּנוּבָה, זוֹ עֲבוֹדָתָהּ בְּכָךְ, וְזוֹ אֵין עֲבוֹדָתָהּ בְּכָךְ » (עבודה זרה מ״ד ע״ב)

Music and the gaze — Pesachim 25b

Seif 15 rests on two sources. For the prohibition itself the Beit Yosef points to Rabbenu Yeruham:

« כתב רבינו ירוחם (ני״ז ח״ה) אסור לשמוע כלי שיר של אליל או להסתכל בנוי אליל כיון שנהנה בראיה כך מוכח בפרק כ״ש (כו.) מההיא דא״ר שמעון בן פזי קול ומראה אין בהם מעילה אבל איסור יש בהם » (בית יוסף יו״ד קמ״ב)

For the Rama’s gloss, the sugya of davar she’eino mitkaven:

« אֶפְשָׁר וְקָא מִיכַּוֵּין, לָא אֶפְשָׁר וְקָמִיכַּוֵין — כּוּלֵּי עָלְמָא לָא פְּלִיגִי דְּאָסוּר. לָא אֶפְשָׁר וְלָא מִיכַּוֵּין — כּוּלֵּי עָלְמָא לָא פְּלִיגִי דִּשְׁרֵי. כִּי פְּלִיגִי דְּאֶפְשָׁר וְלָא מִיכַּוֵּין » (פסחים כ״ה ע״ב)

3. The key concepts of this siman

אִסּוּר הֲנָאָה — the prohibition of benefit. A forbidden food is not eaten; a thing forbidden for benefit is neither sold nor used in any way at all. The idol stands at the head of this category: whatever comes from it remains it. Seif 1 lays down the rule of propagation — all benefits that come from it are forbidden with it — and the fourteen seifim that follow test its limits.
גַּחֶלֶת וְשַׁלְהֶבֶת — coal and flame. The coal has substance; the flame has none. The Rambam says it in five words: « וְגַחֶלֶת שֶׁל עֲבוֹדַת כּוֹכָבִים אֲסוּרָה וְהַשַּׁלְהֶבֶת מֻתֶּרֶת מִפְּנֵי שֶׁאֵין בָּהּ מַמָּשׁ » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה י׳). This is the first boundary of the siman, and the simplest: where there is no longer substance, there is no longer an idol.
מְקַלְקֵל וּמְתַקֵּן — damaging and improving. Using an appurtenance of the idol in order to damage is not deriving benefit; using it in order to improve is. Slaughtering a healthy animal damages it — its flesh is worth less slaughtered than alive, in the words of Rashi cited by the Shach: « ואין זו הנאה שבחייה עומדת לג׳ דברים לגדל ולדות ולחרישה ולאכילה עכ״ל רש״י » (ש״ך יו״ד קמ״ב ס״ק ד) — whereas cutting it into pieces that will sell better improves it. The whole of seif 2 turns on this pair.
זֶה וָזֶה גּוֹרֵם — the double cause. When a forbidden cause and a permitted cause combine toward one result, the result is permitted. The Rambam makes a general rule of it: « וְכָל שֶׁדָּבָר אָסוּר וְדָבָר מֻתָּר גּוֹרְמִין לוֹ הֲרֵי זֶה מֻתָּר בְּכָל מָקוֹם » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה י״ד), and the Mechaber copies it word for word in seif 11. But it has edges: the Tur recalls that it holds only after the fact — « אבל אנן קיימא לן זה וזה גורם מותר בדיעבד אבל לכתחלה אסור לעשות ע״י זה וזה גורם » (טור יו״ד קמ״ב) — and seif 7 shows a case where the two causes did not act together, so that there never was a double cause at all.
שֶׁבַח עֵצִים בַּפַּת — the contribution of the wood to the bread. The burnt wood is gone, but its contribution remains in the bread it baked. So long as the blaze of the forbidden wood burns opposite the bread — « אָמַר רַב פָּפָּא: כְּשֶׁאֲבוּקָה כְּנֶגְדּוֹ » (פסחים כ״ז ע״א) — the bread carries that contribution and becomes forbidden for benefit. Once the embers are raked out, the contribution has gone with them.
הוֹלָכַת הֲנָאָה לְיָם הַמֶּלַח — carrying the benefit to the Dead Sea. When a forbidden loaf or garment has been mixed with others, one casts the value of the forbidden piece into the Dead Sea, and the rest becomes permitted. This is Rabbi Eliezer’s position, against the Sages who answer « נִתְעָרְבָה בַּאֲחֵרוֹת — כּוּלָּן אֲסוּרוֹת בַּהֲנָאָה, רַבִּי אֱלִיעֶזֶר אוֹמֵר: יוֹלִיךְ הֲנָאָה לְיָם הַמֶּלַח, אָמְרוּ לוֹ: אֵין פִּדְיוֹן לַעֲבוֹדָה זָרָה » (עבודה זרה מ״ט ע״ב) — and here the halakha follows Rabbi Eliezer. The Shach stresses the condition: without a mixture, this redemption achieves nothing — « משמע שכל שלא נתערב לא מהני הולכת הנאה ליה״מ וכן גבי פת בסעיף ד׳ » (ש״ך יו״ד קמ״ב ס״ק ח)
אֲשֵׁרָה — the tree of worship. A tree planted to be worshipped, or under which an idol has been placed. The siman devotes six seifim to it: its fledglings (8), its shade (9), the vegetables that grow beneath it (11), the tree whose fruit is kept for the festival (12), the barren trees planted before the idol (13). The Shach specifies that seif 9 speaks of a tree planted for that purpose: « פי׳ שנטעו מתחלה שיהא נעבד הא לאו הכי לא וכמו שיתבאר בסימן קמ״ה » (ש״ך יו״ד קמ״ב ס״ק י״ז)
נוֹי אֲלִילִים — the adornment of the idol. What decorates the idol without being the idol. From this the Shach draws the key to seif 13: an adornment is forbidden only once it has been used, and standing before the idol is itself its use — « פי׳ ומסתמא אמרינן דנעשו לשם נוי ואע״ג דנוי אלילים אינן אסורים עד שישתמשו וכדלעיל ר״ס קל״ט זהו שעומדים בפני אלילים הוי תשמישן » (ש״ך יו״ד קמ״ב ס״ק כ״ח)
צֵל וְצֵל צִלָּהּ — the shade and the shade of the shade. The dense shade, so long as the length of the shadow has not passed the height of the tree; the thin shade beyond that. Rashi distinguishes them: « שחרית וערבית שצל ארוך לכל דבר מאד וכל זמן שלא עברה מדת אורך הצל את מדת גובה קומת האילן הצל עב וחשוך מכאן ואילך הצל דק וקלוש והיא צל צלו » (רש״י עבודה זרה מ״ח ע״ב) — and the Taz observes that the Rambam, whose language the Mechaber copies, did not forbid the second, which astonished the Ran and the Kesef Mishneh.
דָּבָר שֶׁאֵין מִתְכַּוֵּין — the unintended act. Hearing without listening, seeing without looking. The Rama’s gloss on seif 15 rests on the sugya in Pesachim, where the cases sort along two axes — can one avoid it, and does one aim at the benefit:

5. The Shach, the Taz, the Baer Hetev, the Pitchei Teshuva and the Nekudot HaKesef

Siman 142 is among the most heavily annotated of these chapters: the Shach writes 34 ס״ק on it, the Taz 18, the Baer Hetev 27, the Pitchei Teshuva 3, and the Nekudot HaKesef answer the Taz here in a single entry. This level gives only the entries that change how the text is read; level 2 takes them up in depth.

The Shach — the decisive entries

ס״ק ג — why the knife is permitted, and yet not entirely. The Shach separates two prohibitions lying one on top of the other: that of idolatry, lifted because one is damaging, and that of the taste absorbed in the blade.

« מיירי שהוא ישן ולא לבנו מאיסור שבו והלכך אע״פ שמטעם משמשי אליל מותר לשחוט בו אפילו לכתחלה כיון שהוא מקלקל אפ״ה מטעם געולי עובדי כוכבים אסור לשחוט בו לכתחלה » (ש״ך יו״ד קמ״ב ס״ק ג)

ס״ק ה — on the Rama’s gloss. The Shach recalls that an appurtenance is forbidden only once it has been used in the worship.

« וכגון שחתך בה בקעת לאליל דאל״כ תשמישי אליל אינם אסורים עד שישתמשו בהן » (ש״ך יו״ד קמ״ב ס״ק ה)

ס״ק ו — how far the prohibition of the dying animal reaches. The Shach reads the Mechaber strictly:

« מלשון זה משמע שכל הבהמ׳ אסור׳ ולא מהני הולכת הנאת שכר סכין לשחוט בה לים המלח » (ש״ך יו״ד קמ״ב ס״ק ו)

and he adds that for cut meat the redemption is still required: « אבל עכ״פ הולכת הנאה לים המלח בעי גם בבשר » (ש״ך יו״ד קמ״ב ס״ק ו)

ס״ק ח — the condition of the redemption, and a way out. Without a mixture, carrying the value to the Dead Sea achieves nothing; but one may sell the bread or the garment to a non-Jew deducting from the price the value of what is forbidden.

ס״ק י — the longest entry in the siman, and the most important. The Shach opens by saying that the text as it stands does not hold together:

« באמת דברי הטור והמחבר ושאר פוסקים צריכין נגר להולמן » (ש״ך יו״ד קמ״ב ס״ק י)

He recalls that the idol’s coal is forbidden, and that if it is, cooking upon it ought to be as well:

« אבל בעצי אליל שגחליה ואפרה אסורים איך יהא מותר בבישול ע״ג גחלים ובתנור חדש הא כולה גורם דאיסורא הוא ועצי איסור עדיין לא הלכו להם » (ש״ך יו״ד קמ״ב ס״ק י)

and long afterward he finds the proof he was looking for in the Tosefta of Orlah, which makes an exception of asherah wood:

« שוב מצאתי אחר זמן רב בתוספתא פ״ק דערלה תנור שהסיקו בקליפי ערלה אם חדש יותץ אם ישן יוצן אפה ובשל בגחלי׳ מותר אפה בכולם (כלו׳ בכל איסורי הנאה שהוזכר שם) מותר חוץ מעצי אשרה עכ״ל מזה ראיה ברורה למה שכתבתי » (ש״ך יו״ד קמ״ב ס״ק י)

His conclusion overturns the plain reading of seifim 4 and 6: « אלא ודאי גחלת של אליל אפילו בדיעבד אסור » (ש״ך יו״ד קמ״ב ס״ק י) and « אבל לפע״ד אפילו בחומו של תנור או ע״ג גחלים אסר הרמב״ם הכא באליל ודוקא בערלה שאפר׳ וגחלתה וכן חומו מותר חילק כן משא״כ באליל » (ש״ך יו״ד קמ״ב ס״ק י)

ס״ק י״א — why the vessels of seif 5 are graver than the oven of seif 4.

then he disputes the Rama’s attribution and states the rule with both its edges:

The Taz — the decisive entries

ס״ק א — who burnt the idol? The Taz narrows seif 1: « פירוש ישראל אבל עובד כוכבים ששרפה ביטלה » (ט״ז יו״ד קמ״ב ס״ק א)

ס״ק ב and ס״ק ג — is the coal forbidden even after the fact? The Taz is categorical, against the Beit Yosef:

« נראה לי אפילו דיעבד אסור » (ט״ז יו״ד קמ״ב ס״ק ב)
« אלא ברור דאיסור דאורייתא יש בגחלת משום לא ידבק כדפירש״י וא״כ אפילו דיעבד אסור והב״י כתב מכח קושיא בסי׳ זה דדוקא לכתחלה אסור בגחלת וכתב עליו מו״ח ז״ל שכן הוא פשוט ולע״ד לא דקו בזה כלל » (ט״ז יו״ד קמ״ב ס״ק ב)

and he adds the precision that saves seif 1 from absurdity: the flame is permitted only when detached from the coal.

ס״ק ד — the entry in which the Taz takes issue with the Mechaber himself. It opens with a rare sentence:

« לפי הנראה לע״ד דהרב בעל הש״ע לא יצא ידי כל חובת העיון בדינים אלו » (ט״ז יו״ד קמ״ב ס״ק ד)

His thesis: in idolatry a double cause does not suffice to permit when the forbidden cause was indispensable.

ס״ק ב — the distinction that settles the dispute over the coal: depending on the origin of the prohibition it is rabbinic or biblical.

6. The Rambam — the frame of the siman

Siman 142 is, more than most, a transcription of the Rambam. The printed text says so itself in two places: the note to seif 5 — « הסעיפים ה׳ ו׳ ז׳ הוא ל׳ הרמב״ם פרק י״ז מהמ״א רק שהמחבר כתב עצי אלילים במקום קליפי ערלה » (שו״ע יו״ד קמ״ב:ה) — and the references of seifim 8, 9 and 14 to Hilkhot Avodah Zarah.

Three blocks stand out:

Hilkhot Avodah Zarah, chapter 7 — seifim 1, 2, 8, 9, 11, 14

« עֲבוֹדַת כּוֹכָבִים אוֹ אֲשֵׁרָה שֶׁנִּשְׂרְפָה אֶפְרָהּ אָסוּר בַּהֲנָאָה. וְגַחֶלֶת שֶׁל עֲבוֹדַת כּוֹכָבִים אֲסוּרָה וְהַשַּׁלְהֶבֶת מֻתֶּרֶת מִפְּנֵי שֶׁאֵין בָּהּ מַמָּשׁ » רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה י׳

That is seif 1, word for word. Then the dying animal of seif 2:

The fledglings of seif 8, with the reason peculiar to the Rambam — the asherah serves them as a base, where Rashi spoke of a decree and the Raavad of growth:

The shade of seif 9, where one sees that the Rambam expressly permits the shade of the branches — which the Taz will note:

Hilkhot Ma’akhalot Assurot — seifim 5, 6, 7

These three seifim are taken from the laws of orlah, where the Rambam treats an oven heated with orlah peels; the Mechaber simply replaced “orlah peels” with “wood of idols”. Hence the wording of seif 4:

« גָּרַף אֶת כָּל הָאֵשׁ וְאַחַר כָּךְ בִּשֵּׁל אוֹ אָפָה בְּחֻמּוֹ שֶׁל תַּנּוּר הֲרֵי זֶה מֻתָּר שֶׁהֲרֵי עֲצֵי אִסּוּר הָלְכוּ לָהֶן » רמב״ם הלכות מאכלות אסורות פרק ט״ז הלכה כ״ב

and that of seif 6:

« פַּת שֶׁבִּשְּׁלָהּ עַל גַּבֵּי גֶּחָלִים שֶׁל עֲצֵי עָרְלָה מֻתֶּרֶת. כֵּיוָן שֶׁנַּעֲשׂוּ גֶּחָלִים הָלַךְ אִסּוּרָן אַף עַל פִּי שֶׁהֵן בּוֹעֲרוֹת » רמב״ם הלכות מאכלות אסורות פרק ט״ז הלכה כ״ד
And this is exactly where the whole difficulty of the siman is born. The Rambam wrote these three laws for orlah, whose coal and ashes are permitted. The Mechaber transposed them to idolatry, whose coal and ashes are forbidden — seif 1 has just said so. The Shach and the Taz devote most of their entries to asking whether the transposition holds. Both answer that it does not: « אבל לפע״ד אפילו בחומו של תנור או ע״ג גחלים אסר הרמב״ם הכא באליל ודוקא בערלה שאפר׳ וגחלתה וכן חומו מותר חילק כן משא״כ באליל » (ש״ך יו״ד קמ״ב ס״ק י) and « וכבר הוכחנו בתחילת הסימן דאינו כן אלא איסור גמור יש בגחלת של עבודת כוכבים ואפילו דיעבד ואפי׳ עוממות משום לא ידבק בידך וגו׳ » (ט״ז יו״ד קמ״ב ס״ק ח)

7. Modern practical cases

The seifim of this siman speak of wood-fired ovens and weavers’ shuttles. Their rules, however, bear on questions that are still asked. The cases below are given for study: they show where the siman’s reasoning applies, not what one should do — that is asked of a Rav.

The thread linking all these cases. Ask first whether the object still holds substance from the idol (seif 1); then whether the act damages or improves (seif 2); then whether the prohibition was the sole cause of the result or one of two (seifim 4, 7, 11); and finally whether the benefit was intended (seif 15). Four questions, and nearly the whole siman falls into place.

8. Summary of Siman 142 and comprehension questions

In one sentence. Nothing that comes from the idol may be used — but everything that merely passes near it remains permitted. The siman spends fifteen seifim drawing that line, and it draws it with two instruments: substance and cause.

Four rules to take away

1. What has substance is the idol; what has none is no longer it. Coal and ashes: forbidden. Flame: permitted. And the Taz adds that it is permitted only once detached from the coal.
2. Damaging is not benefiting. The idol’s knife slaughters, because slaughter diminishes the animal; it does not cut, because cutting enhances it. And if the slaughter saves a dying animal, it becomes an improvement again, and it is forbidden.
3. Two causes permit; one alone forbids. The vegetables grow by the shade and by the ground: permitted. The bread baked by the forbidden wood alone: forbidden. The pot of seif 7 is the trap: both kinds of wood did serve, but one after the other — that is not a double cause, it is a sequence.
4. What one does not intend is not a benefit. Seif 15 forbids listening and looking; the Rama, on the strength of the sugya in Pesachim, lets pass what was not sought — provided, says the Shach, that one could have turned away and does not savour it.
