1. The axiom: substance and cause

The starting point:

The idol is forbidden for benefit, and seif 1 extends that prohibition to everything that comes from it. What remains is to know what comes from it. The siman answers with two measures, and uses no other.

Substance — a thing is still the idol so long as something corporeal of it remains. Coal and ashes: yes. Flame: no.

Cause — a produced thing is forbidden if the prohibition made it. If a permitted cause joined in making it, it is permitted; but on two conditions, which the siman tests in seifim 7 and 4: that both causes acted together, and — according to the Taz — that neither was indispensable.

Hence the axiom: before each case ask first whether substance remains, then who made the thing.

The two measures, in their two founding texts:

2. The 4 reflex questions

  1. Does substance remain? If so, it is still the idol (coal, ashes). If not, it is no longer (flame) — but only if it is detached from it, says the Taz.
  2. Does the act damage or improve? Slaughtering a healthy animal damages it: permitted. Cutting it, or slaughtering a dying animal: improves, therefore forbidden.
  3. Did the prohibition act alone? Alone: forbidden (shuttle, bread, vessels). With a permitted cause, and at the same time: permitted (vegetables, field, cow). One after the other: forbidden (the pot of seif 7).
  4. Was the benefit intended? Intended: forbidden (listening, looking). Unintended, and one could have turned away without savouring it: permitted (Rama, Shach ס״ק ל״ד).

The third question is that of seif 7, where the Mechaber himself says why the double cause does not apply there:

4. The great difficulty: the Rambam’s language brought from orlah

The printed text itself warns that seifim 5, 6 and 7 are the Rambam’s language written for orlah, with only the words “orlah peels” replaced by “wood of idols”. But orlah has a permitted coal and the idol a forbidden one: seif 1 has just said so. Hence the whole difficulty.

The Shach opens his ס״ק י and says it outright:

« באמת דברי הטור והמחבר ושאר פוסקים צריכין נגר להולמן » (ש״ך יו״ד קמ״ב ס״ק י)

and states the contradiction:

« אבל בעצי אליל שגחליה ואפרה אסורים איך יהא מותר בבישול ע״ג גחלים ובתנור חדש הא כולה גורם דאיסורא הוא ועצי איסור עדיין לא הלכו להם » (ש״ך יו״ד קמ״ב ס״ק י)

The teruts he eventually found, in the Tosefta of Orlah, which sets asherah wood apart:

« שוב מצאתי אחר זמן רב בתוספתא פ״ק דערלה תנור שהסיקו בקליפי ערלה אם חדש יותץ אם ישן יוצן אפה ובשל בגחלי׳ מותר אפה בכולם (כלו׳ בכל איסורי הנאה שהוזכר שם) מותר חוץ מעצי אשרה עכ״ל מזה ראיה ברורה למה שכתבתי » (ש״ך יו״ד קמ״ב ס״ק י)

Hence his conclusion, which governs the practical reading of seifim 4 and 6:

« אבל לפע״ד אפילו בחומו של תנור או ע״ג גחלים אסר הרמב״ם הכא באליל ודוקא בערלה שאפר׳ וגחלתה וכן חומו מותר חילק כן משא״כ באליל » (ש״ך יו״ד קמ״ב ס״ק י)
Ruling. According to the Shach and the Taz, in idolatry — unlike orlah — neither the oven’s heat after the embers have been raked out nor cooking on the embers themselves is permitted. The Baer Hetev records this as the conclusion:
« ומסקנתו דלא כהמחבר אלא דגחלת של עבודת כוכבים אפי׳ בדיעבד אסורה וכ״פ הט״ז דאפי׳ בתנור ישן וגרף ממנו את כל האש ובישל או אפה בחומו של תנור אסור אף בדיעבד » (באר היטב יו״ד קמ״ב ס״ק י)

5. The Taz against the Nekudot HaKesef: the indispensable cause

Seif 11 permits by the double cause; seifim 3, 4 and 5 forbid things that look like double causes. Two readings stand opposed, and they are not about the same thing.

The Taz
The double cause is a leniency. Idolatry is not entitled to it once the prohibition was indispensable.
The Nekudot HaKesef
The double cause is a statement of fact. The cases invoked are not double causes at all: there is nothing to except.

The Taz’s thesis, in his ס״ק ד:

« דכל מה שיש הכרח אל האיסור וא״א זולתו או אע״פ שיש ג״כ גורם דהיתר אסור בעבודת כוכבים מ״ה בתנור חדש שנגמר בעצי איסור ובפת שנאפה בעצי איסור בתנור ישן שא״א לפת להיות נאפה בלא עצים וכן בגד א״א להיעשות בלא כרכור על כן אסורים משא״כ בגינתא דאזדבל בזבל דעבודת כוכבים דהזבל משביח הקרקע » (ט״ז יו״ד קמ״ב ס״ק ד)

and his conclusion:

« וכן נראה לע״ד ברור כשמש שיש להחמיר בזה וזה גורם הללו גבי עבודת כוכבים דמי ירים ראש להקל נגד מה שכתב הרא״ש בפי׳ וכן הרמ״ה והרמב״ם ולסמוך על פירוש דחוק ברמב״ם ולהקל » (ט״ז יו״ד קמ״ב ס״ק ד)

The Shach’s reply, in the Nekudot HaKesef:

« האריך בדברים שאין בהן ממש דהדבר פשוט דכרכר דמתני׳ היינו בחד גורם » (נקודות הכסף יו״ד קמ״ב)
« אבל באמת הדברים ברורים ע״ש בש״ך באריכות ושם נתחוורו כשמלה » (נקודות הכסף יו״ד קמ״ב)
What both concede. In practice there is no disagreement within the siman: the shuttle, the bread and the vessels are forbidden, the field, the cow and the vegetables are permitted. The disagreement is about the reason, and therefore about what will be inferred in a new case. And on one point they agree expressly: a double cause permits only after the fact, the vegetables excepted.
« משמע דוקא דיעבד אבל לכתחלה לא וכן בפרה שפטמה כו׳ משום דכל זה וזה גורם דמותר היינו דוקא דיעבד ואע״ג דכתב ריש הסעיף דמותר לזרוע כו׳ דמשמע אפילו לכתחלה שאני התם דבשעת זריעה אין כאן הנאה אלא אח״כ ממילא קאתי » (ט״ז יו״ד קמ״ב ס״ק ט״ז)

6. The redemption: mixture, amount, reach

Three questions, three disputes, and the Shach decides all three.

The first two disputes, in the Tur:

« כתב הרז״ה שאין להתיר באכילה ע״י הולכת הנאה לים המלח אלא בהנאה לבד וה״ר יונה כתב דאפי׳ באכילה נמי שרי ולזה הסכים א״א הרא״ש ז״ל » (טור יו״ד קמ״ב)

and the Shach’s rule:

« משמע שכל שלא נתערב לא מהני הולכת הנאה ליה״מ וכן גבי פת בסעיף ד׳ » (ש״ך יו״ד קמ״ב ס״ק ח)
The way out. Where there is no mixture and therefore no redemption, the Shach opens another road: selling to a non-Jew minus the value of what is forbidden, provided the object is then out of reach.
« דיכול למכור הבגד והפת לעובד כוכבים חוץ מדמי איסור שבו כשהעובד כוכבים יחתוך הבגד והפת לפני הישראל בענין שא״א שימכרנו שוב לישראל אחר » (ש״ך יו״ד קמ״ב ס״ק ח)

7. The 5 golden rules

  1. Substance decides, not heat. Coal and ashes forbidden, flame permitted — but detached from the coal (Taz ס״ק ג).
  2. What damages is not a benefit. And slaughter that rescues no longer damages: the dying animal is forbidden entire, with no redemption (Shach ס״ק ו).
  3. Two causes together permit; one after the other, they do not. That is the whole difference between seif 11 and seif 7 — and the Mechaber states it himself in seif 7.
  4. A double cause permits only after the fact. Except the vegetables under the asherah, where the benefit comes of itself (Shach ס״ק כ״ה).
  5. What one does not intend is not a benefit — but only if one does not savour it. And if one does intend, it is forbidden even when one cannot leave (Shach ס״ק ל״ד).

8. Mnemonic — the aide-mémoire “גחלת”

ג גַּחֶלֶת — substance. What has body is the idol; the flame has none (seif 1).
ח חִתּוּךְ — effect. Cutting improves, slaughtering damages; and slaughter that rescues improves (seif 2).
ל לֹא לְבַדּוֹ — cause. A prohibition alone forbids. Accompanied, and at the same time, it permits (seifim 4, 7, 11).
ת תַּכְלִית — aim. What is sought is forbidden; what comes unsought is not (seif 15).

The four letters follow the order of the siman, from the first seif to the last, and cover all fifteen.

9. The 5 classic pitfalls

  1. Thinking the flame is always permitted. It is not: the Taz restricts it to a flame separated from its coal, and refuses the distinction of small and large.
  2. Reading seif 6 as a plain permission. The Shach and the Taz refuse it for idolatry: the seif is the Rambam’s language written for orlah.
  3. Taking seif 7 for an exception to the double cause. It is not one: the two kinds of wood did not act together, so there never was a double cause.
  4. Thinking the redemption always works. It requires a mixture; without one it achieves nothing, and for the shuttle even redeeming the shuttle does not suffice.
  5. Confusing seif 14 with seif 15. The bathhouse is permitted because the idol there is decoration; looking at an idol actually worshipped remains forbidden. The Shach ס״ק ל״ג draws the line: an idol that has been served, not figures made for adornment.

On the last pitfall, the Shach’s line:

« פי׳ באלילים עצמן שנעבדו אסור להסתכל בהן לראות נויין אבל צורות שנעשו לנוי ולא לעבוד מבואר בתו׳ והרא״ש דמותר » (ש״ך יו״ד קמ״ב ס״ק ל״ג)
