How to read this level. Every statement is anchored either in the text of the Shulchan Arukh and its nossei kelim, or in a named and verifiable posek (Tur, Beit Yosef, Rambam, Tosafot, the Gemara in Avodah Zarah). On Yoreh De'ah there is no Mishnah Berurah (which comments only on Orach Chaim) and no Shulchan Arukh HaRav (the Alter Rebbe did not write on YD). The Pitchei Teshuva does not comment on this siman. The Arukh HaShulchan is not cited: its text on this siman is not accessible to us, and one does not cite what one cannot verify. What remains suffices: the Shach (4 ס״ק), the Taz (3 ס״ק), the Baer Hetev (3 ס״ק) and the Nekudot HaKesef (one entry) — together with, because the siman itself refers there, the Shach and the Taz on siman 132. Where the question goes beyond the siman, this level says so and stops: the halakha lema'asse goes through your Rav.

דמי האליל ביד ישראל שמכרה אסורים אבל אם מכרה עובד כוכבים אפילו מכרה כדי לעבדה הדמים מותרים ודווקא שהדבר ידוע שמכרה לעשות צרכיו בדמיה אבל אם אינו ידוע יש לחוש שמא מכרה לקנות בדמיה אלילים אחרים והרי המעות מוקצין לאלילים ואסורים

The founding case. An idol has been sold. The Mechaber does not ask what it is worth or who bought it: he asks who sold it. The Jew — the money is forbidden, it has become the idol. The non-Jew — the money is permitted, even if he sold it to be worshipped.

Then a condition, and a second case. The non-Jew must, as far as is known, have sold for his needs; otherwise the money is set aside for idols. And according to some, the money of a sale on credit whose goods were resold before payment is permitted after the fact.

1. שורש הפסק — the verse and the concern

This siman contains two prohibitions, and only one is written. All the practice follows from it. Faced with money drawn from an idol, the question is never “how much is it worth?” but “who sold, and does one know why?”. If a Jew, the money is the idol — by the verse, without remedy. If a non-Jew, the money is never the idol; it is only suspect, and the suspicion falls as soon as one knows he sold for his needs.
The source is a verse, and a Gemara in the chapter רבי ישמעאל. The Rambam makes it the rule for the price; the Taz and the Shach derive from it the split between the Jew and the non-Jew.

And the Beit Yosef names the line followed: Rabbeinu Tam, through the Rosh — money paid for a debt, permitted; money still in his hands with no known motive, set aside for idols.

What this changes for you. Never reason about the idol: reason about the seller. A Jew may not sell an idol; if he did, the money follows it. A non-Jew may; what then counts is what one knows of the use he will make of the money — and for an idol, doubt suffices to forbid.

2. פסק המחבר — the map of the seifim

Siman 144 has two seifim — that is the count announced by the heading (ובו ב׳ סעיפים) and it is the actual count of the text. Seif 1 reads as four clauses of the Mechaber; seif 2 is a reported opinion (יש אומרים). There is no gloss of the Rama.

The rule, and its extension by the Shach

The Mechaber speaks of the Jew who sold. The Shach reads in the verse a wider rule: it is the idol of the Jew that holds its price — even if a non-Jew sold it.

« דילפינן מוהיית חרם כמוהו כל מה שאתה מהייה ממנו הרי הוא כמוהו ומשמע דאליל של ישראל אפילו מכרה עובד כוכבים הדמים אסורים דהא דמי אליל של ישראל הן » (ש״ך יו״ד קמ״ד ס״ק א)

The Rambam states the general prohibition, then the price:
« עֲבוֹדַת כּוֹכָבִים וּמְשַׁמְּשֶׁיהָ וְתִקְרֹבֶת שֶׁלָּהּ וְכָל הַנַּעֲשֶׂה בִּשְׁבִילָהּ אָסוּר בַּהֲנָאָה » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה ב׳)
« עָבַר וּמָכַר עֲבוֹדַת כּוֹכָבִים אוֹ אֶחָד מִמְּשַׁמְּשֶׁיהָ אוֹ תִּקְרֹבֶת שֶׁלָּהּ הֲרֵי הַדָּמִים אֲסוּרִין בַּהֲנָאָה וְאוֹסְרִין בְּכָל שֶׁהֵן כַּעֲבוֹדַת כּוֹכָבִים » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה ט׳)
Lema'asse. The money of an idol belonging to a Jew is forbidden for benefit — whether the Jew sold it himself, or a non-Jew sold it on his behalf (Shach ס״ק א, Baer Hetev ס״ק א). This prohibition knows no “unless one knows”: it attaches to the thing, not to the seller. What to do with this money — and with the idol itself — belongs to simanim 139 and 146, and to your Rav.

4. דמי אליל של עובד כוכבים — known and unknown

Three situations, two verdicts

Sold for his needs — permitted, even to be worshipped. Motive unknown — forbidden, the money is set aside for idols. And the Taz reports a third term, the Mordechai, which the Nekudot HaKesef set aside for the idol.

The reason, in the Taz and the Shach:
« דכתיב והיית חרם כמוהו כל מה שאתה מהייה ממנו יהיה כמוהו וזה לא שייך בעבודת כוכבים » (ט״ז יו״ד קמ״ד ס״ק א)
« אליל שלו ואפילו מכרה שיעבדוה הקונים דלא בטלה הדמים מותרין » (ש״ך יו״ד קמ״ד ס״ק ב)
The condition, in the Mechaber and the Tur:
« ודווקא שהדבר ידוע שמכרה לעשות צרכיו בדמיה » (שו״ע יו״ד קמ״ד:א)
« כגון לפרוע חובותיו או שאר צרכיו » (טור יו״ד קמ״ד)
The Taz notes the end of siman 132 and the Mordechai:
« ס״ס קל״ב משמע דדוקא בידוע ודאי שמכרה לקנות צרכי עבודת כוכבים אסור ואפשר שסמך על מ״ש כאן אמנם במרדכי פרק א״מ כתב מותר לקבל הדמים אם לא אמר המתן עד שאמכור אליל » (ט״ז יו״ד קמ״ד ס״ק ב)
The Nekudot HaKesef answer, the Baer Hetev reports them, and the Shach at siman 132 names the Derisha:
« עמ״ש שם שיש לחלק בין יי״נ לעבודת כוכבים » (נקודות הכסף יו״ד קמ״ד)
« ובנה״כ כתב שיש לחלק בין יי״נ לעבודת כוכבים וכ״כ שם בסי׳ קל״ב ע״ש » (באר היטב יו״ד קמ״ד ס״ק ב)
« אבל הדרישה בסימן קמ״ד חילק בין עבודת כוכבים ליי״נ דביי״נ לא חיישינן מן הסתם שלקחו לחזור ולקנות בו יי״נ » (ש״ך יו״ד קל״ב ס״ק ל״ח)
The Taz himself, at siman 132, had read siman 144 as forbidding by doubt:
« ומבואר בסימן קמ״ד דאפי׳ מספק יש לחוש שמא מכרה לצורך קניית עבודת כוכבים » (ט״ז יו״ד קל״ב ס״ק י״א)
Lema'asse. A non-Jew sells his idol: if one knows he sold for his needs — to pay a debt, to live — the money is permitted, and the fact that he sold it to be worshipped changes nothing (Shach ס״ק ב). If the motive is unknown, the money is forbidden — that is the Mechaber, and the Nekudot HaKesef uphold the rule against the Taz: for an idol, doubt suffices. The Mordechai’s permission, reported by the Taz, concerns libation wine; for the idol, this level keeps to the Mechaber. A case where the motive is doubtful is put to a Rav.

5. מכירה בהקפה — sale on credit — the Shach’s ruling: substantial loss

Two opinions in Tosafot, two formulas in the Mechaber

Rabbi Elchanan requires that the non-Jew resold — that is seif 2. The Ri is content with meshichah — that is siman 132:1. The Shach and the Taz note the gap; the Shach decides at siman 132.

Tosafot:
« ומכאן דקדק הרב רבי אלחנן הלכה למעשה שאם יש ביד ישראל יין נסך ועבודת כוכבים ודברים האסורים ומכרן לעובד כוכבים בהקפה ומכרם העובד כוכבים לאחר קודם שיתן לזה הישראל הדמים שהדמים מותרין בדיעבד ואע״פ שהאיסור עדיין ישנו בעולם » (תוספות עבודה זרה ס״ב ע״ב ד״ה יאות הן עבדין)
« ועוד הוסיף רבינו יצחק שאפי׳ לא מכרם העובד כוכבים אלא כיון שמשכם אצלו קודם שיתן הדמים דקי״ל » (תוספות עבודה זרה ס״ב ע״ב ד״ה יאות הן עבדין)

The Mechaber, here and there:

The Taz and the Shach on the gap:
« וכ״כ הטור והש״ע דין זה ריש סימן קל״ב כאשר הבאתי שם המראה מקום מזה וא״כ תימה על הש״ע שלא פסק כאן להיתר רק במכרן לאחר » (ט״ז יו״ד קמ״ד ס״ק ג)
« משמע הא כל שלא מכרם אסורים ומשמע אפילו לאחרים והיינו כדעת הר״ר אלחנן דלא כר״י ובר״ס קל״ב הביא דעת ר״י בשם יש מי שאומר דלאחרים מותרים וק״ק » (ש״ך יו״ד קמ״ד ס״ק ג)
The Shach’s decision, at siman 132 — he counts the Rishonim, and concludes:
« מ״מ הרי הרמב״ן והר״ן ר״פ בתרא דעבודת כוכבים אוסרים וכ׳ הר״ן שכן נראה גם כן דעת רש״י וגם רבינו ירוחם לא הכריע מיהו דעת המרדכי שם כהרא״ש וכן מסקנת התוספות שם בשם ר״י » (ש״ך יו״ד קל״ב ס״ק ג)
« הלכך במקום הפסד מרובה שרי הא לאו הכי אסור ואע״ג דלא נ״מ ביי״נ דקי״ל דשרי בהנאה בזמן הזה מכל מקום נ״מ למכר עבודת כוכבים ומשמשיה כדאיתא להדיא בפוסקים דה״ה בעבודת כוכבים והוא פשוט » (ש״ך יו״ד קל״ב ס״ק ג)
Lema'asse. A Jew who held forbidden goods — libation wine or idols — sold them on credit to a non-Jew. If the non-Jew resold them before paying, the money is permitted after the fact (Mechaber). If he only drew them to himself without reselling, the Shach permits only in a case of הפסד מרובה — significant loss — and forbids otherwise, because the Ramban and the Ran forbid; and he specifies that this rule applies to the idol and its accessories, not only to wine. The sale itself should not have taken place: the seif says בדיעבד.

6. קנס למוכר — permitted to others, not to him

The Shach reads in Rabbeinu Yerucham and the Rosh a restriction the seif does not state:
« ברבינו ירוחם משמע להדיא דוקא לאחרים אבל לאותו ישראל לעולם אסורים משום קנס וכן משמע באשר״י ר״פ בתרא דעבודת כוכבי׳ ואפשר גם דעת המחבר כן » (ש״ך יו״ד קמ״ד ס״ק ד)
« אלא שק״ק הא דכתב סתם הדמים מותרים וגם בב״י לא הביא דברי הרא״ש ורבינו ירוחם רק לעיל ר״ס קל״ב הביא דברי רבינו ירוחם בקצרה וע״ל ס״ס קמ״ט » (ש״ך יו״ד קמ״ד ס״ק ד)

The Taz, at siman 132, gives the Rosh’s source and faults the Mechaber for the placement of his “there is one who says”:
« אלא דהרא״ש כתב שם דהמעות אינם מותרים רק לאחר אבל לא לו דנהנה מדמי עבודת כוכבים ויליף לה ממי שמכר ערלה וקידש אשה בדמיה שהיא מקודשת אבל לו עצמו המעות אסורין » (ט״ז יו״ד קל״ב ס״ק ג)
« ואין שייך על זה יש מי שאומר אלא על האיסור לעצמו היה לו לכתוב יש מי שאומר » (ט״ז יו״ד קל״ב ס״ק ג)

👈 Permitted to whom?

(1) To others than the seller: permitted. (2) To the seller himself: forbidden forever, as a penalty — Rosh, Rabbeinu Yerucham, Shach, Baer Hetev. (3) The Mechaber wrote מותרים without more here, but wrote the restriction himself at siman 132:1.

Lema'asse. The money of seif 2 does not go back to the seller: it may be handed to a third party, but the one who sold the idols does not benefit from it. That is the Shach’s reading, and it has the Mechaber’s own text at siman 132 on its side.

7. מקרים בני זמננו — contemporary cases

👈 Case 1 — The inherited cult object

A Jew inherits an object that was worshipped, and a non-Jewish dealer sells it on his behalf. If it is an idol in the halakhic sense (siman 141), the money is forbidden for benefit: it is a Jew’s idol, and the Shach (ס״ק א) writes that even sold by a non-Jew, its price is forbidden.

👈 Case 2 — The debtor who sells a statue

A non-Jew owes money to a Jew; he sells a statue of his cult and pays him with the proceeds. One knows he sold in order to pay: the money is permitted (Tur: כגון לפרוע חובותיו), even if he sold it to a worshipper.

👈 Case 3 — The payment with an unknown motive

A non-Jew sold an idol and offers the Jew a payment whose intended use is unknown. According to the Mechaber and the Nekudot HaKesef, the money is set aside for idols and forbidden; the Taz reports the Mordechai, who is broader. To be put to a Rav, stating that an idol is involved and not wine.

A Jew sold forbidden goods on credit to a non-Jewish merchant, who resold them before paying. The money is permitted after the fact — to others; the seller himself does not benefit from it (Shach ס״ק ד).

Same case, but the merchant only took delivery and pays without having resold. The Mechaber does not permit it here; the Shach (siman 132 ס״ק ג) permits only in a case of significant loss. To be put to a Rav.

The point this level will not decide. This siman begins after an object has been recognised as an idol. What is one today — a museum statue, a disused cult object, a decorative figure — is the matter of simanim 139, 141 and 145, and of your Rav. This level says what siman 144 does with the price; it does not say what has a price.

And finally, the only rule that holds lema'asse. This level sets out the psak of the sources; it does not replace a decision. A seller, a motive, a moment — before or after the resale — form a concrete case, and a concrete case is decided with a Rav, who begins with the question this siman assumes settled: is this object an idol?
