1. שורש הסימן — substitution of the object, or a concern about the person?

The siman has only two seifim, but it rests on two prohibitions that do not resemble each other. The first is written in a verse; the second is only a concern. Until they are separated, neither seif 1 nor seif 2 can be read properly.

The source: a verse as the Gemara reads it The chapter רבי ישמעאל derives from והיית חרם כמוהו that whatever one brings forth from the idol becomes like it:
« אָמַר קְרָא: ״וְהָיִיתָ חֵרֶם כָּמֹהוּ״, כֹּל שֶׁאַתָּה מְהַיֶּה מִמֶּנּוּ הֲרֵי הוּא כָּמוֹהוּ » (עבודה זרה נ״ד ע״ב)
The Rambam makes it the rule for the price:
« עָבַר וּמָכַר עֲבוֹדַת כּוֹכָבִים אוֹ אֶחָד מִמְּשַׁמְּשֶׁיהָ אוֹ תִּקְרֹבֶת שֶׁלָּהּ הֲרֵי הַדָּמִים אֲסוּרִין בַּהֲנָאָה וְאוֹסְרִין בְּכָל שֶׁהֵן כַּעֲבוֹדַת כּוֹכָבִים » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה ט׳)

The Tur, then the Mechaber The Tur opens the siman with an equivalence — the idol and its price share one status:
« כשם שאליל ותקרובתה אסורין כך דמיהן אסורין » (טור יו״ד קמ״ד)
And the Mechaber writes seif 1 in two steps, the Jew and then the non-Jew:
« דמי האליל ביד ישראל שמכרה אסורים » (שו״ע יו״ד קמ״ד:א)
« אבל אם מכרה עובד כוכבים אפילו מכרה כדי לעבדה הדמים מותרים » (שו״ע יו״ד קמ״ד:א)
The Taz and the Shach give the reason for the split. The verse addresses Israel; it says nothing of a non-Jewish seller:
« דכתיב והיית חרם כמוהו כל מה שאתה מהייה ממנו יהיה כמוהו וזה לא שייך בעבודת כוכבים » (ט״ז יו״ד קמ״ד ס״ק א)
« דילפינן מוהיית חרם כמוהו כל מה שאתה מהייה ממנו הרי הוא כמוהו ומשמע דאליל של ישראל אפילו מכרה עובד כוכבים הדמים אסורים דהא דמי אליל של ישראל הן » (ש״ך יו״ד קמ״ד ס״ק א)
The chakira of the siman: what is the nature of the prohibition on the price? (א) A substitution of the objectחליפין: the money has become the idol, by force of the verse. This prohibition attaches to the thing, depends on no intention, and applies only where the verse speaks — to the Jew. (ב) A concern about the personמוקצין לאלילים: the money has not become the idol, but we do not know what the seller will do with it, and we fear he may buy other idols. This prohibition rests on a doubt, and it falls as soon as the doubt falls.
Nafka mina Three cases fall into place at once. A Jew’s idol sold by a non-Jew: the price is forbidden — that is (א), the money replaces a Jew’s idol, and the Shach says so explicitly (דהא דמי אליל של ישראל הן). A non-Jew’s idol sold in order to be worshipped: the price is permitted — (א) does not concern him, and the Shach stresses it:
« אליל שלו ואפילו מכרה שיעבדוה הקונים דלא בטלה הדמים מותרין » (ש״ך יו״ד קמ״ד ס״ק ב)
A non-Jew’s idol where one does not know why he sold it: the price is forbidden — but only by (ב), and it becomes permitted again as soon as one knows he sold for his needs:
« ודווקא שהדבר ידוע שמכרה לעשות צרכיו בדמיה » (שו״ע יו״ד קמ״ד:א)
« אבל אם אינו ידוע יש לחוש שמא מכרה לקנות בדמיה אלילים אחרים והרי המעות מוקצין לאלילים ואסורים » (שו״ע יו״ד קמ״ד:א)
The Mechaber’s word is מוקציןset aside — and not אסורים כמוה. He does not say the non-Jew’s money has become an idol; he says it is kept at a distance. That is the whole difference between (א) and (ב), and it governs everything that follows.

The Gemara seems to say two opposite things about the idol’s price in a non-Jew’s hands. The Rosh states the contradiction, and three Rishonim answer it in three ways; the Beit Yosef reports them all, and says which one the Tur followed.

The sugya that permits — the last chapter of Avodah Zarah asks the question outright, and Rav Nachman answers:
« הֲדוּר יָתְבִי וְקָמִבַּעְיָא לְהוּ: דְּמֵי עֲבוֹדָה זָרָה בְּיַד גּוֹי, מַהוּ? מִי תּוֹפֶסֶת דָּמֶיהָ בְּיַד גּוֹי, אוֹ לָא? » (עבודה זרה ס״ד ע״א)
« אֲמַר לְהוּ רַב נַחְמָן: מִסְתַּבְּרָא דְּמֵי עֲבוֹדָה זָרָה בְּיַד גּוֹי מוּתָּרִין » (עבודה זרה ס״ד ע״א)
The sugyot that seem to forbid — the Jew returning from the fair, and the Sages who “were not concerned”:

Kushya — the Rosh If the idol’s price in a non-Jew’s hands is permitted, why is the Jew returning from the fair forbidden — is it not because the non-Jew sold his idol there and carries its price?
« וכתב הרא״ש קשה דהכא משמע דדמי אליל ביד נכרי אסורים » (בית יוסף יו״ד קמ״ד)

Terutz — Rabbeinu Tam Two moments must be distinguished. When the non-Jew has sold and paid his debt, the money is permitted, for the verse does not concern him. But at the fair the money is still in his hands, and he did not sell in order to pay: we fear he may buy another idol — that is (ב), the concern, not (א).
« ותירץ ר״ת דודאי היכא שמכרה העכו״ם ופרע בחובו הדמים מותרים דחליפי אליל אסורים מוהיית חרם כמוהו והאי לא שייך בעכו״ם » (בית יוסף יו״ד קמ״ד)

Two further ways: the Rif and the Razah

The Rif does not reconcile: he sets aside the sugya of the fair, since the conclusion of the last chapter is that the price is permitted. The Razah compromises: a priori, one does not deal with him wherever an idol’s price may be feared; after the fact, the creditor collects — for “they decreed for the non-Jew on account of the Jew”.

The Ramban challenged the Razah, the Ran defended him — and the Beit Yosef concludes that the Tur follows the Rosh:
« והרמב״ן ז״ל הקשה עליו והר״ן ז״ל טען בעד הרז״ה ז״ל ודברי רבינו הם כשיטת הרא״ש ז״ל » (בית יוסף יו״ד קמ״ד)
Nafka mina Between Rabbeinu Tam and the Razah the difference lies in the nature of the prohibition at the fair. For Rabbeinu Tam it is a real doubt about the use of the money (מוקצין) — so it falls when one knows. For the Razah it is an a priori decree (גזרו בעכו״ם אטו ישראל) — so it depends not on what one knows but on the moment: forbidden a priori, permitted after the fact. The Mechaber chose: he writes ודווקא שהדבר ידוע, a condition of knowledge, not of timing. That is Rabbeinu Tam, through the Rosh and the Tur.

3. סוף סימן קל״ב — the Taz against the Nekudot HaKesef

Seif 1 itself refers to the end of siman 132. The Taz goes there, and does not find the same rule.

What siman 132 says — Rav Nachman’s baraita, with its second half:
« ישראל שהיה נושה בעובד כוכבים מנה והלך ומכר אלילים ויין נסך והביא לו דמיהם הרי זה מותר » (שו״ע יו״ד קל״ב:ז)
« ואם אמר לו קודם שימכור המתן לי עד שאמכור אלילים או יין נסך שיש לי ואביא לך אע״פ שהוא סתם יינם ומכר והביא לו הרי זה אסור מפני שהישראל רוצה בקיומו כדי שיפרע ממנו חובו » (שו״ע יו״ד קל״ב:ז)
Kushya — the Taz There, only the case where one knows he sold in order to buy idols is forbidden; here, doubt suffices. And the Mordechai permits receiving the money so long as he did not say “wait until I sell the idol”.
« ס״ס קל״ב משמע דדוקא בידוע ודאי שמכרה לקנות צרכי עבודת כוכבים אסור ואפשר שסמך על מ״ש כאן אמנם במרדכי פרק א״מ כתב מותר לקבל הדמים אם לא אמר המתן עד שאמכור אליל » (ט״ז יו״ד קמ״ד ס״ק ב)
The Taz himself, at siman 132, had noted the difference reading it the other way round:
« ומבואר בסימן קמ״ד דאפי׳ מספק יש לחוש שמא מכרה לצורך קניית עבודת כוכבים » (ט״ז יו״ד קל״ב ס״ק י״א)
Terutz — the Nekudot HaKesef The Shach answers in a word: one must distinguish libation wine from the idol.
« עמ״ש שם שיש לחלק בין יי״נ לעבודת כוכבים » (נקודות הכסף יו״ד קמ״ד)
The Baer Hetev reports it:
« ובנה״כ כתב שיש לחלק בין יי״נ לעבודת כוכבים וכ״כ שם בסי׳ קל״ב ע״ש » (באר היטב יו״ד קמ״ד ס״ק ב)
And the Shach, at siman 132, had named the author of the distinction — the Derisha:
« אבל הדרישה בסימן קמ״ד חילק בין עבודת כוכבים ליי״נ דביי״נ לא חיישינן מן הסתם שלקחו לחזור ולקנות בו יי״נ » (ש״ך יו״ד קל״ב ס״ק ל״ח)
Why the distinction holds. Siman 132 speaks of a non-Jew who sells wine in order to pay; we do not presume he will buy wine again with the money — wine is bought to be drunk, not to be poured in libation. Siman 144 speaks of an idol; one who sells an idol may well wish to acquire another, and the money is then מוקצה from the moment of doubt. The Taz reads the two simanim as one rule and sees a contradiction; the Nekudot HaKesef read in them two objects and two concerns.
Nafka mina A non-Jew pays a debt with the proceeds of a sale whose motive is unknown. If it was wine he sold: permitted (Taz, Mordechai; and the Nekudot HaKesef agree, since the concern does not bear on wine). If it was an idol: forbidden by doubt according to the Mechaber and the Nekudot HaKesef; permitted according to the Mordechai reported by the Taz, unless he said “wait”. Level 4 draws the line from here.

4. הקפה — Rabbi Elchanan against the Ri, and the Mechaber against himself

Seif 2 does not come from the chapter on the idol’s price, but from a remark of Tosafot on the fruits of shemitah. Two masters derived from it two rules of different scope.

Rabbi Elchanan: the non-Jew must have resold
« ומכאן דקדק הרב רבי אלחנן הלכה למעשה שאם יש ביד ישראל יין נסך ועבודת כוכבים ודברים האסורים ומכרן לעובד כוכבים בהקפה ומכרם העובד כוכבים לאחר קודם שיתן לזה הישראל הדמים שהדמים מותרין בדיעבד ואע״פ שהאיסור עדיין ישנו בעולם » (תוספות עבודה זרה ס״ב ע״ב ד״ה יאות הן עבדין)
The Ri: it suffices that he drew it to himself
« ועוד הוסיף רבינו יצחק שאפי׳ לא מכרם העובד כוכבים אלא כיון שמשכם אצלו קודם שיתן הדמים דקי״ל » (תוספות עבודה זרה ס״ב ע״ב ד״ה יאות הן עבדין)

Kushya — the Taz and the Shach The Mechaber reported the Ri’s extension at siman 132; why does he permit here only the case of resale?

Chakira: why is the Ri content with meshichah? Because he reasons along (א): the money is forbidden only if it replaces an idol of the Jew; and once the non-Jew has drawn the object to himself, the object is his, and the payment that follows replaces nothing — that is the reasoning of the harlot’s fee, כיון שלא היה ברשותה בשעת הביאה. Rabbi Elchanan demands more: that the forbidden thing no longer be in the buyer’s hands — that is how the Nekudot HaKesef formulate it at siman 132:
« דאדרבה הרבה פוסקים חולקים כמו שמפורש בתוס׳ ואשר״י פרק בתרא דעבודת כוכבים בשם הר״ר אלחנן דמוקי להך דשביעית דדוקא שאין האיסור ביד הקונה » (נקודות הכסף יו״ד קל״ב)
Nafka mina The non-Jew drew the goods to himself, did not resell them, and pays. According to the Ri the money is permitted; according to Rabbi Elchanan, forbidden — and, the Shach notes, forbidden even to others. The Mechaber writes both opinions under two formulas of reservation (יש אומרים here, יש מי שאומר there); the Shach ends with וק״ק and leaves the difficulty open. His practical decision is at siman 132, and level 4 reports it.

5. קנס — permitted to others, forbidden to the seller

Seif 2 says הדמים מותרים without saying to whom. The Shach reads in Rabbeinu Yerucham and the Rosh a restriction the Mechaber did not write.

The Taz, at siman 132, gives the source of the penalty: the Rosh learns it from one who sells orlah and betroths a woman with the price — she is betrothed, so the price is permitted to others; but to the seller himself it is forbidden, because he would benefit from the idol’s price.
« אלא דהרא״ש כתב שם דהמעות אינם מותרים רק לאחר אבל לא לו דנהנה מדמי עבודת כוכבים ויליף לה ממי שמכר ערלה וקידש אשה בדמיה שהיא מקודשת אבל לו עצמו המעות אסורין » (ט״ז יו״ד קל״ב ס״ק ג)
And he faults the Mechaber for placing the יש מי שאומר on the permission, which is an explicit talmudic ruling, instead of on the seller’s prohibition:
« ואין שייך על זה יש מי שאומר אלא על האיסור לעצמו היה לו לכתוב יש מי שאומר » (ט״ז יו״ד קל״ב ס״ק ג)
Chakira: is the penalty a rule of the object or a rule of the person? If the money had become an idol — (א) — it would be forbidden to all. If it is permitted to all except the seller, then it has not become an idol: the seller’s prohibition is personal, a penalty — משום קנס. Seif 2 is therefore, for the Rosh and Rabbeinu Yerucham, the proof that money arriving after meshichah is not חליפין; and that what remains forbidden to the seller is not the verse’s prohibition but a sanction of the Sages.
Nafka mina The money of the sale on credit may be given, lent, spent by a third party. The seller himself, according to the Shach, must not benefit from it. The Mechaber wrote מותרים without more; the Shach thinks he might accept the restriction, but wonders at his silence. At siman 132 the Mechaber himself had written it: שאף על פי שלבעל היין שמכרו אסורים בהנאה לאחרים מותרים.

6. יסוד הסימן — הדמים כמוה, והחשש כמוקצה

כלל הסימן :
שני איסורים בסימן, ואינם דומים זה לזה. דמי האליל ביד ישראל — אסורים מן הכתוב, והיית חרם כמוהו : המעות נעשו כאליל, ואין הדבר תלוי בדעתו של אדם. דמי האליל ביד עובד כוכבים — אין הכתוב מדבר בו כלל, ואינם אסורים אלא מחשש, מוקצין לאלילים ; ולפיכך הכל תלוי בידוע. ומכאן סעיף ב׳ : כשבאו המעות אחר שיצא האיסור מיד המוכר — או מיד הקונה, לר״ר אלחנן — אין כאן חליפין, והדמים מותרים ; ומה שנשאר אסור למוכר עצמו אינו מן הכתוב אלא קנס.
Three lines to take away. (1) For the Jew the money is the idol; for the non-Jew it is merely suspect — and the suspicion falls when one knows. (2) The contradiction of the sugyot is resolved by Rabbeinu Tam, whom the Tur and the Mechaber follow: money paid for a debt, permitted; money still in his hands with no known motive, set aside for idols. (3) The sale on credit frees the money because it no longer has anything to replace — for others according to all, for the seller not, according to the Rosh and Rabbeinu Yerucham.
