1. The axiom: two prohibitions, one verse

The starting point:

The verse והיית חרם כמוהו makes whatever one draws from the idol a thing “like it”. It addresses Israel. Hence two regimes: for the Jew, the idol’s price is the idol — forbidden by nature, to everyone; for the non-Jew, the price is nothing — except that one sometimes does not know what he will do with it, and it is then kept aside: מוקצין לאלילים.

Hence the axiom: whenever the siman forbids, ask whether it forbids by the verse or by the concern. The verse never falls; the concern falls as soon as one knows.

The verse’s source, in the Gemara:

« אָמַר קְרָא: ״וְהָיִיתָ חֵרֶם כָּמֹהוּ״, כֹּל שֶׁאַתָּה מְהַיֶּה מִמֶּנּוּ הֲרֵי הוּא כָּמוֹהוּ » (עבודה זרה נ״ד ע״ב)

💡 The marker: אסורים for the Jew, מוקצין for the non-Jew. Two words, two prohibitions — and only the second has an “unless one knows”.

2. The 3 reflex questions

1. Who sold the idol? A Jew — or a non-Jew selling a Jew’s idol (Shach): the price is forbidden, full stop. A non-Jew selling his own: go to 2.
2. Does one know why he sold? For his needs — to pay a debt, to live —: permitted, even if he sold it to be worshipped. One does not know: set aside for idols, forbidden (Mechaber, Nekudot HaKesef) — except the Mordechai reported by the Taz.
3. Did the money arrive after the idol left his hands? Sale on credit, resale before payment: permitted after the fact — to others. To the seller, no (Rosh, Rabbeinu Yerucham, Shach).

4. The contradiction of the sugyot and its three answers

The Gemara permits in one place and seems to forbid in two others. The Rosh asks the question; three Rishonim answer.

« אֲמַר לְהוּ רַב נַחְמָן: מִסְתַּבְּרָא דְּמֵי עֲבוֹדָה זָרָה בְּיַד גּוֹי מוּתָּרִין » (עבודה זרה ס״ד ע״א)

⚖ What to retain

The Beit Yosef says it: ודברי רבינו הם כשיטת הרא״ש. The Mechaber writes ידוע — a condition of knowledge: that is Rabbeinu Tam.

5. Siman 132: the Taz against the Nekudot HaKesef

Seif 1 refers to the end of siman 132, where only the known case is forbidden, and where the Mordechai permits receiving the money unless he said “wait”. The Taz sees a contradiction:

« ואם אמר לו קודם שימכור המתן לי עד שאמכור אלילים או יין נסך שיש לי ואביא לך אע״פ שהוא סתם יינם ומכר והביא לו הרי זה אסור מפני שהישראל רוצה בקיומו כדי שיפרע ממנו חובו » (שו״ע יו״ד קל״ב:ז)
« ס״ס קל״ב משמע דדוקא בידוע ודאי שמכרה לקנות צרכי עבודת כוכבים אסור ואפשר שסמך על מ״ש כאן אמנם במרדכי פרק א״מ כתב מותר לקבל הדמים אם לא אמר המתן עד שאמכור אליל » (ט״ז יו״ד קמ״ד ס״ק ב)

The Nekudot HaKesef answer, and the Baer Hetev reports them:

« עמ״ש שם שיש לחלק בין יי״נ לעבודת כוכבים » (נקודות הכסף יו״ד קמ״ד)
« ובנה״כ כתב שיש לחלק בין יי״נ לעבודת כוכבים וכ״כ שם בסי׳ קל״ב ע״ש » (באר היטב יו״ד קמ״ד ס״ק ב)

The distinction is the Derisha’s, which the Shach cites at siman 132: one does not presume that a non-Jew buys wine again with the price of wine.

« אבל הדרישה בסימן קמ״ד חילק בין עבודת כוכבים ליי״נ דביי״נ לא חיישינן מן הסתם שלקחו לחזור ולקנות בו יי״נ » (ש״ך יו״ד קל״ב ס״ק ל״ח)

⚖ What to retain

Libation wine (siman 132): forbidden only if one knows he sells in order to buy again, or if he said “wait”. Idol (siman 144): forbidden as soon as the motive is unknown — Mechaber, Nekudot HaKesef; permitted according to the Mordechai reported by the Taz.

6. The sale on credit: Rabbi Elchanan, the Ri, and the penalty

Tosafot give two rules: Rabbi Elchanan requires that the non-Jew has resold; the Ri is content that he has drawn it to himself.

« ומכאן דקדק הרב רבי אלחנן הלכה למעשה שאם יש ביד ישראל יין נסך ועבודת כוכבים ודברים האסורים ומכרן לעובד כוכבים בהקפה ומכרם העובד כוכבים לאחר קודם שיתן לזה הישראל הדמים שהדמים מותרין בדיעבד ואע״פ שהאיסור עדיין ישנו בעולם » (תוספות עבודה זרה ס״ב ע״ב ד״ה יאות הן עבדין)
« ועוד הוסיף רבינו יצחק שאפי׳ לא מכרם העובד כוכבים אלא כיון שמשכם אצלו קודם שיתן הדמים דקי״ל » (תוספות עבודה זרה ס״ב ע״ב ד״ה יאות הן עבדין)

The Mechaber writes Rabbi Elchanan here, and the Ri at siman 132 — the Taz and the Shach note it:

« ואם לקח העובד כוכבים היין תחילה ואחר כך נתן המעות לישראל יש מי שאומר שאף על פי שלבעל היין שמכרו אסורים בהנאה לאחרים מותרים » (שו״ע יו״ד קל״ב:א)
« וכ״כ הטור והש״ע דין זה ריש סימן קל״ב כאשר הבאתי שם המראה מקום מזה וא״כ תימה על הש״ע שלא פסק כאן להיתר רק במכרן לאחר » (ט״ז יו״ד קמ״ד ס״ק ג)
« משמע הא כל שלא מכרם אסורים ומשמע אפילו לאחרים והיינו כדעת הר״ר אלחנן דלא כר״י ובר״ס קל״ב הביא דעת ר״י בשם יש מי שאומר דלאחרים מותרים וק״ק » (ש״ך יו״ד קמ״ד ס״ק ג)

And the penalty: permitted to others, never to the seller —

« ברבינו ירוחם משמע להדיא דוקא לאחרים אבל לאותו ישראל לעולם אסורים משום קנס וכן משמע באשר״י ר״פ בתרא דעבודת כוכבי׳ ואפשר גם דעת המחבר כן » (ש״ך יו״ד קמ״ד ס״ק ד)
⚠ The reading trap. “The money is permitted” does not mean “permitted to the seller”. The Shach reads Rabbeinu Yerucham and the Rosh: to others, yes; to that Jew, never — משום קנס. The Mechaber himself writes it at siman 132: לבעל היין שמכרו אסורים בהנאה לאחרים מותרים.

7. The 5 golden rules

  1. The price of a Jew’s idol is the idol. Forbidden to all, by the verse — והיית חרם כמוהו.
  2. The verse does not concern the non-Jew. His money is permitted, even if he sold so that it be worshipped (Taz, Shach).
  3. The idol remains its owner’s. A Jew’s idol sold by a non-Jew: price forbidden (Shach ס״ק א).
  4. One must know. If one does not know why the non-Jew sold, the money is set aside for idols — and the concern bears on the idol, not on wine (Nekudot HaKesef).
  5. The sale on credit frees the money — for others. Resold before payment, the money replaces nothing; but the seller does not benefit from it (Shach, Rosh, Rabbeinu Yerucham).

8. Mnemonic — the “דמים” memory aid

ד דְּמֵי אֱלִיל בְּיַד יִשְׂרָאֵל — forbidden — the money is the idol.
מ מָכְרָהּ עוֹבֵד כּוֹכָבִים — permitted — the verse does not concern him, even if he sold it to be worshipped.
י יָדוּעַ — one must know he sold for his needs; otherwise, set aside for idols.
ם מְכָרָם לְאַחֵר — the sale on credit: resold before payment, the money is permitted — to others.

9. The 4 classic pitfalls

  1. Believing that future worship forbids the price. No: אפילו מכרה כדי לעבדה — the non-Jew who sells his idol so that it be worshipped leaves permitted money.
  2. Reading siman 132 like siman 144. There wine, here the idol; there one must know in order to forbid, here one must know in order to permit (Nekudot HaKesef).
  3. Confusing Rabbi Elchanan and the Ri. Seif 2 requires resale; siman 132 is content with meshichah. The Mechaber wrote both — the Shach and the Taz wonder at it.
  4. Giving the money of seif 2 to the seller. Permitted to others; to the seller, a penalty (Shach ס״ק ד).
