1. The axiom: it is not the worship that makes the idol, it is the hand

The starting point:

The siman never asks whether a thing was worshipped — it asks whether the hand of man had a part in it. And it lays down two conditions, not one: אין בו תפיסת יד אדם, no hand took hold of it, and ולא עשהו אדם, no man made it. Whatever escapes both — the mountain, the water, the tree that grew of itself, the animal — stays permitted in benefit, even when worshipped.

Hence the axiom: faced with a worshipped thing, look for the hand, not for the worship. Prostration alone does nothing; an act of the hand does everything.

The Mehaber’s rule, its verse in the Taz, and its source in the Rambam:

💡 The marker: two words never to confuse. נעבד — worshipped — does not forbid what man did not make; מעשה — an act of the hand — forbids even what man did not make.

2. The 3 reflex questions

1. Did man make the thing so that it be worshipped? A house built for worship, a stone quarried to be worshipped, a tree planted for it — the ashera: forbidden entirely, and from the making itself, with no prostration.
2. If not: did the hand act upon it for worship? Digging pits in the ground, slaughtering the animal, exchanging it for an idol — forbidden. Merely bowing — nothing: neither mountain, nor water, nor tree, nor animal becomes an idol by prostration.
3. Did the hand only add, or only place? Added — plaster, engraving, grafting: נוטל מה שחידש, one removes the addition and the rest is permitted. Placed — the idol set in the house, on the stone, under the tree: the support returns to permission as soon as it leaves.

4. The three triads of the mishna: three houses, three stones, three trees

The mishna in Avodah Zarah arranges the same triptych three times: what was made for worship, what was renewed for it, and what merely carried it. The Tur and the Beit Yosef spell it out:

💡 Read the column, not the row. The three rows say one thing about three materials. What changes from row to row is not the ruling but the object; what changes from column to column is everything.

One reservation of the Shakh, in the name of the Ran, on the third column of the “tree” row: it applies only to a tree planted expressly to bear the idol; otherwise it need not even be removed.

5. The three degrees of the hand: making, renewing, acting upon

עשה — making. The thing is man’s work, and he made it so that it be worshipped. All of it is forbidden, and from the moment of making. This is the house built for worship, the stone quarried for it, the tree planted for it.
חידש — renewing. The thing already existed, and the hand only added to it for worship: plaster, engraving, grafting. Only the addition is forbidden — נוטל מה שחידש — and the rest is permitted.
עשה בו מעשה — acting upon. The thing is not man’s work, and he added nothing to it: he only acted upon it for worship. Digging the ground, slaughtering the animal, exchanging it. It is forbidden — provided it is his, or the agent is a non-Jew, an apostate, or one who was warned.

Who removes what — and whom nullification helps

Beneath נוטל מה שחידש lies a distinction the seif does not state and the three nosei kelim state with one voice: it is the Jew who must remove everything, since nothing is nullified in his hands; a non-Jew nullifies by removing very little.

The Bavli does not know which of the two amoraim permits; the Yerushalmi says so expressly, and Rabbi Yoḥanan — named there as the one who forbids — is its author. The doubt falls away.

7. The 5 golden rules

  1. Prostration does not make an idol. What man neither made nor touched stays permitted in benefit, whatever the worship was — אע״פ שנעבד הרי זה מותר בהנאה.
  2. But an act of the hand forbids. Dug ground and a slaughtered animal are not man’s work, and they are forbidden: עשה בו מעשה.
  3. The permitted may carry the forbidden. The mountain stays permitted, its plating and accessories do not; the tree stays permitted, what it yields from the worship onward does not.
  4. Only the addition is removed. Where the hand merely added, only the addition is forbidden — and it is the Jew who must remove it all, the non-Jew nullifying with very little.
  5. No one forbids what is not his. Except a non-Jew, an apostate, and one who accepted a warning; and a Jew does not forbid even by a complete slaughter.

8. Mnemonic — the “תפיסה” memory aid

ת תְּפִיסַת יַד אָדָם — the single criterion: neither made by man nor touched by him for worship.
פ פֵּרוֹת וּשְׂרִיגִים — the tree stays permitted, but what it yields from the worship on is forbidden.
י יָד שֶׁחִידְּשָׁה — plaster, engraving, grafting: נוטל מה שחידש, and the rest is permitted.
ס סִילְּקָה · הוֹצִיאָהּ — what merely bore the idol returns to permission once it is gone.
ה הֶחֱלִיף — an exchange for an idol is forbidden; the exchange of the exchange is disputed.

9. The 4 classic pitfalls

  1. Taking “worshipped” to mean “forbidden”. This is the error the first line of seif 1 corrects: a worshipped mountain stays permitted, and so does the animal.
  2. Reading the tree like the house. A house built and then worshipped is forbidden — detached then reattached; a tree planted and then worshipped is not, its roots making it attached from the outset (Ran, Shakh ס״ק ג). Rashi grants this only to a seed, not to a cutting.
  3. Taking “public” as a restriction. The Shakh and the Levush: the word comes from the gemara and restricts nothing for ordinary use — a private spring attached to the ground is permitted too; the distinction bears only on libations.
  4. Forgetting to ask who acted. A Jew does not forbid his fellow’s animal, even by a full slaughter; a non-Jew forbids it with half an organ. And for the dug pits: the Tur still requires prostration, the Rambam as the Beit Yosef reads him does not — the Mehaber writes like the Rambam.

7The earth itself is not forbidden, but an act done in it for worship — digging pits, ditches and caves — forbids it.
8Living beings are not forbidden, even by prostration; an act, even of one organ, forbids them — and only a non-Jew forbids what is not his, to which are added the apostate and one who accepted a warning.
9Animals exchanged for an idol are forbidden; those exchanged for those animals are permitted — and some forbid these as well.
