Siman קמ״ז — the name of the idol

The halakha as practised: what is not said, what may be said, and the one point where the Rama is not followed

This level puts in order what the siman requires in practice. It does not rest on the Shulḥan Arukh HaRav — the Admur HaZaken did not write a Yoreh De‘ah — but on the Shakh, the Taz, the Ba’er Hetev and the Pitḥei Teshuvah, each cited in its place.

This page sets out the halakha as the poskim of this siman fixed it. It does not replace a Rav’s ruling: for application to a real situation, consult your Rav.

1. שורש הדין — the root: what the mouth does not produce

The baseline Two things do not leave a Jew’s mouth: a vow or an oath uttered in an idol’s name, and the idol’s name itself. The first carries lashes; the second is forbidden without penalty, but also without exception — the Meḥaber writes בין לצורך בין שלא לצורך.

Where the penalty exactly falls The Rambam says it unambiguously, and it explains the Meḥaber’s double wording:

2. מה שמותר לומר — what remains permitted to say

Three permissions, written as such

The two limits to retain (1) A festival name that is a man’s name may be said, but not in the honorific formula the non-Jews attach to it — that is the very condition of seif 2. (2) The permission of Scripture’s names is not limited to the Meḥaber’s four examples: the Shakh extends it to all the written names.

The prohibition, and the one accommodation reported

What Rabbenu Tam adds, via the Beit Yosef

The Gemara’s prohibition bore on entering the partnership. Once the partnership is made, taking the oath so as not to lose one’s money is permitted:

« וכתבו התוס׳ והרא״ש בשם ר״ת שאם כבר נשתתף עמו מותר ליקח ממנו שבועה קודם שיפסיד ממונו » (בית יוסף יו״ד קמ״ז)
What is practised One does not provoke a non-Jew’s oath by his idol. Where there is real loss and the situation is one of rescue, the Pitḥei Teshuvah reports the Radbaz: one may ask him to swear without oneself naming the idol — “swear to me”, and he swears by whatever he wishes. The condition is not incidental: it is what keeps the name out of my mouth.

4. אלהים ולא אלהיך — the siman’s point of psak

The Rama on one side, the Taz, the Baḥ, the Shakh and the Ba’er Hetev on the other

« מותר לומר לעובד כוכבים אלהיך יהיה בעזרך או יצליח מעשיך » (שו״ע יו״ד קמ״ז:ה)

The line of psak This is the only place in the siman where the Aḥaronim did not follow the Rama’s gloss, and they did so with one voice: the Taz after checking the source, the Baḥ who “fixed it thus for the halakha”, the Shakh who reports the Baḥ and expressly sets aside the Levush, the Ba’er Hetev who takes up both. The wording to use is therefore אלהים יהיה בעזרך — and יצליח מעשיך, which names no one, raises no difficulty for any of them. The wish of success remains permitted; what falls is the possessive.

5. שיתוף — the reference to Oraḥ Ḥayim 156, and what remains of it

What the siman refers elsewhere Seif 3 ends with a cross-reference, and the Shakh and the Ba’er Hetev do no more than repeat it: the law of partnership with a non-Jew is treated in Oraḥ Ḥayim 156 and Ḥoshen Mishpat 182.

What the Pitḥei Teshuvah concludes from it He reports the Rama’s reasoning for leniency, then the Noda BiYehudah’s refutation, then his own division: the truth is with the Noda BiYehudah, but it is not the Rama’s intent.

What to do with it Our siman does not decide the question of shituf: it refers. What it fixes for its own part is narrower and firmer — not to provoke the oath. The rest belongs to siman 156 of Oraḥ Ḥayim, and the Pitḥei Teshuvah’s warning is worth keeping as it stands: the received formula “non-Jews are not commanded about association” does not carry from one context to another.

7. מקרים בני זמננו — contemporary cases

Naming a deity in conversation, a class, an exam Seif 1 targets mention as such, “for a purpose or with no purpose”. The names Scripture wrote are outside the field (seif 4), and the Shakh counts them all. For what is not written there, the question stands as the siman poses it, and the practical answer depends on the case: consult your Rav.
The names of days, months and festivals This is exactly seif 2: festival names that are also men’s names. The Meḥaber does not forbid them; his condition bears on the manner — not to say them in the formula of dignity the non-Jews attach to them.
An oath a non-Jew must take in a monetary matter Seif 3 forbids provoking it. Rabbenu Tam, reported by the Beit Yosef, permits taking the oath when the partnership is already made and the property would be lost. The Radbaz, reported by the Pitḥei Teshuvah, adds the condition of form: do not name the idol.
Wishing success to a non-Jewish colleague or neighbour Permitted. The wording the poskim adopted is “אלהים יהיה בעזרך” — or simply a wish of success, “יצליח מעשיך”, which names no one. What the Taz, the Baḥ, the Shakh and the Ba’er Hetev set aside is the possessive “your god”.
Joking about an idol or a cult Seif 5 permits it expressly, and the Gemara in Megillah makes it the one permitted mockery. The permission bears on the idol, not on the person.

8. מה שאין הסימן מכריע — what this siman does not decide

Three things remain out of this siman’s reach, and it is better to name them than to guess them. (1) The law of partnership with a non-Jew: seif 3 refers to it, it does not decide it. (2) The question whether non-Jews are commanded about association: the Pitḥei Teshuvah reports it, judges it settled by the Noda BiYehudah, and nevertheless refuses to ascribe it to the Rama. (3) The status of names that are neither men’s names nor Scripture’s names — the siman gives the rule, not the list.
A reminder: the Shulḥan Arukh HaRav does not cover Yoreh De‘ah — the Admur HaZaken did not write it. This Level 4 is a level of psak, resting on the Shakh, the Taz, the Ba’er Hetev and the Pitḥei Teshuvah. The Nekudot HaKesef do not comment on this siman.
