Siman קמ״ז — the name of the idol

1. The axiom: what comes out of the mouth, and what comes from Scripture

The starting point:

The siman speaks neither of the idol nor of its worship: it speaks of its name. What is forbidden is what my mouth does with it — swearing by it, pronouncing it, causing another to pronounce it. What is permitted is what Scripture has already done with it — the names it wrote, and the mockery of which the prophet gave the model.

Hence the axiom: at each line, ask where the word comes from. If it comes from my mouth, it is in question; if it comes from the verse, it is covered.

💡 The marker: לוקה for the oath, ואסור for the mention. Two words of the Meḥaber, two regimes.

2. The 3 reflex questions

1. Is it an undertaking or a word? Vow or oath: lashes (seif 1). Mere mention: forbidden, but without penalty — and “whether for a purpose or with no purpose”.
2. Does the word come from Scripture? Bel, Nebo, Gad, Baal Tsefon and the other written names: permitted (seif 4, Shakh ס״ק ב). A name it did not write: no.
3. Who is speaking? I: seifim 1, 2, 4, 5. Another, through me: seif 3 — and then do not name the idol yourself (Pitḥei Teshuvah ס״ק א, in the name of the Radbaz).

4. The revuta of “even”: Beit Yosef, Taz, Meḥaber

The Beit Yosef objects that the Tur misplaced his “even”. The Taz shows that it carried two teachings. The Meḥaber, for his part, wrote the wording the Beit Yosef called for.

What to retain — the prohibition of mention admits no exception for need. The Taz adds a reason that reaches beyond the letter: using the name as a landmark נראה כמו שנותן בה ממש.

5. Gerama: the Rambam, Rabbenu Tam, the Radbaz

Seif 3 bears not on my speech but on the speech I provoke. The braita derives it from the second half of the verse, and the Beit Yosef gives the reading.

« והתורה אמרה לא ישמע על פיך לא ישמע בגרמא שלך » (בית יוסף יו״ד קמ״ז)
« וְאָסוּר לִגְרֹם לַאֲחֵרִים שֶׁיִּדְּרוּ וְשֶׁיְּקַיְּמוּ בְּשֵׁם עֲבוֹדַת כּוֹכָבִים » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ה׳ הלכה י״א)
« וכתבו התוס׳ והרא״ש בשם ר״ת שאם כבר נשתתף עמו מותר ליקח ממנו שבועה קודם שיפסיד ממונו » (בית יוסף יו״ד קמ״ז)

The practical line — one does not provoke the oath; where the loss is real, one says “swear to me” without naming, and the other swears by whatever he wishes.

Seif 3’s reference to Oraḥ Ḥayim 156 opens the most debated question in the siman: are non-Jews commanded about association?

This is the siman’s one maḥloket, and it turns on a suffix.

« מותר לומר לעובד כוכבים אלהיך יהיה בעזרך או יצליח מעשיך » (שו״ע יו״ד קמ״ז:ה)
« ואמירה זו דאלהיך נראה שהוא איסור גמור שמחזיק ידי עובדי אליל » (ט״ז יו״ד קמ״ז ס״ק ב)
« והב״ח כתב דדוקא אלהים יהיה בעזרך מותר אבל אלהי״ך אסור ודלא כהעט״ז » (ש״ך יו״ד קמ״ז ס״ק ג)

⚠️ The pitfall — the Rama was not contradicted on the substance — wishing a non-Jew success remains permitted — but on the wording. The Taz, the Baḥ, the Shakh and the Ba’er Hetev want אלהים יהיה בעזרך, without the suffix.

8. The 5 golden rules

  1. Vowing or swearing by an idol’s name carries lashes; mention is forbidden, but without penalty.
  2. Mention is forbidden “whether for a purpose or with no purpose”: there is no exception of necessity.
  3. A festival name that is also a man’s name may be said — but not in the non-Jews’ formula of dignity.
  4. One does not make a non-Jew swear by his idol; where the loss is real, one says “swear to me” without naming.
  5. The names Scripture wrote may be said, and mockery of the idol is permitted.

9. Mnemonic — the five words of the siman

Five seifim, five words — in the order of the siman:

The oath, the festivals, the causing, Scripture, the laugh. The first two govern my mouth, the third another’s mouth, the last two give speech back.

10. The 4 classic pitfalls, and the final flash card

  1. Thinking mention is permitted “for a purpose”. The Meḥaber writes expressly the opposite.
  2. Thinking lashes apply to mention. The Rambam places them only on the vow and the oath.
  3. Thinking seif 2 forbids festival names. It permits them; what it forbids is the formula of dignity.
  4. Thinking the Rama was set aside on the substance of seif 5. He was set aside on one word — אלהיך.
