Siman 150 comes to three seifim — the Shulḥan Arukh announces it itself: It forbids no act of worship: it forbids what looks like an act of worship. Bending for a thorn, picking up coins, drinking at a fountain — three ordinary gestures that the place makes impossible.

8. Synthesis and comprehension questions

1. The text of the Meḥaber — the three seifim

The siman moves from the farthest to the nearest. Seif 1 fixes a distance; seif 2 governs what the body does once one is there; seif 3 reaches the mouth. And at every stage, the prohibition bears not on the act but on what it resembles.

Seif 1 — the four cubits

Title of the siman: to keep away from the road of idols, and not to bend before it; and it contains three seifim.

It is a mitzvah to keep four cubits away from the road of idols.

Seif 2 — the thorn and the coins: not to bend

If a thorn entered his foot before an idol, or coins scattered before it, he shall not bend to remove the thorn or to pick up the coins, because he would appear to be bowing to it; rather let him sit, or turn his back or his side towards the idol, and afterwards pick them up.

Seif 3 — the figured fountain, and the Rama’s three glosses

Figures that pour out water before an idol: he shall not place his mouth on theirs and drink, because he would appear to be kissing the idol. Rama’s glosses: (1) Some say that whatever is forbidden only because of appearance, as in this ruling, if there is danger in the matter — for instance if he would die were he not to drink — it is permitted to drink, and there is in this no “let him be killed rather than transgress” (Ran, first chapter of Avodah Zarah). (2) Officers or priests who have the form of idolatrous worship on their garments, or before whom a form of the sun is carried in the manner of bishops: it is forbidden to bow to them or to remove one’s hat before them, except in a way that does not appear so — like one whose coins have scattered, or that he rise before them prior to their coming, and likewise that he remove his hat and bow before their coming (Terumat HaDeshen siman 196). (3) And some are lenient in the matter, since it is known that the non-Jews themselves do not remove the hat or bow to the form of the sun, but only to the officer (ibid., in the name of R. Yosef of Fano and the Maharyu); and it is good to be stringent like the first opinion.
A siman that forbids no worship. Nothing siman 150 forbids is an act of idolatry: bending for a thorn, picking up money, drinking water. What is forbidden is the picture these gestures form in a bystander’s eyes — נראה כמשתחוה, נראה כמנשק. That is why the Meḥaber does not merely forbid: he indicates the permitted way. To sit, to turn one’s back or side — the gesture remains, the image disappears.

2. Context — the braita, Rav Ḥisda’s measure, the Rambam, the Tur

The braita of the first chapter of Avodah Zarah gives the three cases in order, and to each it attaches a permission:

The Gemara immediately asks what “it does not appear” means, and rejects the simplest reading:

The measure of four cubits comes from elsewhere in the same tractate, from Rav Ḥisda, on the verse in Proverbs:

The Rambam sets the two cases of seif 2 and that of seif 3 in two consecutive halakhot:

The Tur gives the whole siman in one sentence — and one will notice that he adds a case the Meḥaber will not take up, that of the spring:

The Beit Yosef gives the source of the whole siman, and notes what the Tur added:

Three divergences between the Tur and the Meḥaber deserve noting already at level 1, because the commentators will speak of nothing else. (1) The Tur writes the fountain בכרכים — in the towns; the Meḥaber writes בפני אלילים — before the idol. That is the Taz’s subject. (2) The Tur gives the case of the spring, with the phrase ואפילו אי מאית אי לא שתי; the Meḥaber does not take it up. (3) The Tur writes the braita’s permission expressly — placing oneself sideways; the Meḥaber puts it in seif 2 as an instruction: to sit, or turn one’s back or side.

3. The key concepts of this siman

נִרְאֶה כְּמִשְׁתַּחֲוֶהhe appears to bow. The reason of both cases in seif 2. It is not a prostration, it is its image — and the image alone is forbidden. Hence the Meḥaber’s solution: change the posture, not abandon the gesture.
נִרְאֶה כִּמְנַשֵּׁקhe appears to kiss. The reason of seif 3. Kissing the idol appears in the Rambam among the forbidden acts of honour; here it is only a matter of resembling it.
מַרְאִית הָעַיִןthe appearance in others’ eyes. The category to which the whole siman belongs. The Rama uses it expressly to set up his first gloss: what is forbidden only for this reason yields before danger.
חַדְרֵי חֲדָרִיםthe innermost chambers. The rule the Gemara cites: what the Sages forbade for appearance is forbidden even where no one sees. The Shakh applies it to our siman.
ד׳ אַמּוֹתfour cubits. The distance of seif 1. The Beit Yosef refers the whole siman to the braita of the first chapter of Avodah Zarah; the measure itself is Rav Ḥisda’s, on the verse
The only case where the Rama’s first gloss lifts the prohibition — and he states the reason: here there is no “let him be killed rather than transgress”.
הֲסָרַת הַכּוֹבַעremoving one’s hat. The subject of the Rama’s second gloss, after the Terumat HaDeshen: before a dignitary bearing a cultic image one does not uncover — except before his arrival, when the gesture visibly addresses no one.

4. Summary table — the three seifim and the permitted gestures

SituationForbiddenPermitted
Walking near an idol’s roadComing close to itKeeping four cubits from it (seif 1)
A thorn in the foot, before an idolBending to remove itSitting, or turning one’s back or side, then removing it (seif 2)
Coins scattered before an idolBending to pick them upThe same solution: sitting or turning (seif 2)
A figured fountain before an idolPlacing one’s mouth on theirs and drinkingDrinking otherwise — and, if there is mortal danger, the Rama permits (seif 3)
A dignitary bearing a cultic imageBowing, or uncovering before himRising or uncovering before his arrival (Rama, seif 3)
The right-hand column is the siman’s real lesson. At no line does the Shulḥan Arukh simply say “it is forbidden”: each time it says how to do it otherwise. The prohibition bears on an image, and an image is undone by changing posture.

5. The Shakh, the Taz and the Ba’er Hetev

The apparatus of this siman is the shortest in the whole chapter, and it is given here in full: the Shakh has two ס״ק, the Taz one, the Ba’er Hetev two. The Pitḥei Teshuvah and the Nekudot HaKesef do not comment on this siman.

The Shakh — two entries

ס״ק א — the prohibition stands even if no one sees

summary: it is written in the glosses of the Prisha that, according to what we hold — that everything forbidden for appearance is forbidden even in the innermost chambers — the same applies here: even if no one at all sees him, it is forbidden; so it is set out in the Semag siman 19, and so in the Tosafot in the first chapter of Avodah Zarah, folio 12, end of the recto, and in the Hagahot Ashri there Rabbi Yehudah in the name of the Ri is stringent; so it emerges explicitly from the Tur, and such are the words of the Meḥaber; and see what I wrote in Oraḥ Ḥayim siman 301 seif 45 and siman 305 seif 11.

ס״ק ב — outside of before the idol, in the name of the Baḥ

summary: but outside of before an idol it is permitted; and one who is stringent even outside of before an idol, may a blessing come upon him. The Shakh writes it in the name of the Baḥ.

The Taz — one entry

ס״ק א — בכרכין or בפני אלילים: two versions, two scopes

summary: in the Tur it is not written “before an idol” but “in the towns”, and so it is in our Gemara; and it emerges that even if it is not an idol but mere ornament — as is said at the beginning of siman 141, that in the towns it is customary to make them for ornament — it is nevertheless forbidden. And here, where it is the Rambam’s wording in chapter 3, it emerges that there is no prohibition except when it stands before an idol. But my father-in-law, of blessed memory, has already reported that there is in this a distinction among the Rishonim; and one must be stringent even if the figure does not stand before an idol, according to the Tur’s version.

The Ba’er Hetev — two entries

summary: he abridges the Shakh and keeps the essential — the prohibition holds even if no one sees — together with the two references to Oraḥ Ḥayim.
summary: the Taz wrote that one must be stringent even if the figure does not stand before an idol.
The two commentators read the same Baḥ in opposite directions. The Shakh draws from him that outside of before the idol it is permitted, and that being stringent is meritorious — that is, optional. The Taz draws from him that there is a divergence among the Rishonim, and that one must be stringent. The Ba’er Hetev reports both, each in its place: the stringent one at ס״ק ב, under the Taz’s name.

6. The Rambam — and why there are no lashes

The Rambam places these three cases immediately after the list of acts of honour rendered to the idol, and that placement explains the whole siman:

Kissing the idol is already a prohibition without lashes; resembling it is a step further down. The Rambam writes that one who embraces the idol, kisses it, sweeps or sprinkles before it transgresses a negative commandment, and that he nevertheless does not receive lashes, these acts not being explicitly mentioned. Our siman is one degree below: there is no kissing at all here, only the look of it.

7. Modern practical cases

Case 1 — an object dropped in a place of worship

This is exactly seif 2. The Meḥaber does not say to give up the object: he says not to bend. Sit, or turn one’s back or side, then pick it up.

Case 2 — no one is looking

The Shakh wrote it: what is forbidden for appearance is forbidden even in the innermost chambers, and therefore “even if no one at all sees him, it is forbidden”. The solution remains the same: change posture.

Case 3 — an ornamental fountain, with no idol

The Taz distinguishes the Tur’s version — בכרכין, in the towns, hence even for mere ornament — from the Rambam’s, which the Meḥaber followed — בפני אלילים. The Shakh, in the Baḥ’s name, permits outside of before an idol and praises one who is stringent; the Taz concludes that one must be.

Case 4 — thirst and danger

The Rama’s first gloss: where the only reason is appearance, and there is mortal danger, one drinks — and there is here no “let him be killed rather than transgress”.

Case 5 — uncovering before a dignitary

The Rama’s second gloss, after the Terumat HaDeshen: before one who bears a cultic image one does not uncover — except before his arrival. The Rama reports the lenient view, then concludes that it is good to be stringent like the first.

8. Synthesis of Siman 150

Three seifim, one reason. Four cubits of distance; not bending for a thorn or for coins — sitting or turning instead; not drinking mouth to mouth at a figured fountain. The Shakh adds that the prohibition holds even with no witness; the Taz, that it holds even if the figure does not stand before an idol, against the Shakh who, in the Baḥ’s name, sees in it a meritorious stringency. The Rama adds three things: danger lifts the prohibition; one does not uncover before a dignitary bearing a cultic image, except before his arrival; and — after reporting the lenient view — וטוב להחמיר כסברא הראשונה.

Comprehension questions

  1. Why does the Meḥaber, in seif 2, say how to act rather than merely forbidding?
  2. What exactly does “it does not appear” mean in the braita, and why does the Gemara reject the simplest reading?
  3. The Shakh says the prohibition holds even if no one sees. How does that square with a prohibition grounded in appearance?
  4. What difference of version does the Taz note between the Tur and the Meḥaber, and what does it change in practice?
  5. The Rama permits drinking in case of danger. On what kind of prohibition does this permission bear, and why does it not extend to everything?
