1. שורש הפסק — what the siman decides, and what it does not address

Before any application one must know what this siman does not say. It says nothing about the kashrut of a medicine, nothing about medical competence, nothing about relations with a non-Jew in general — all that belongs to other simanim. It says three things, and they never mix: (1) from whom one accepts treatment when the illness is grave; (2) whether a remedy may be taken from what belongs to a cult; (3) whether a remedy may be made of what the Torah forbids.

The reason is written out in full — דחיישינן לשפיכת דמים — and it governs the reading of the whole of seif 1: every exception in it is a reduction of risk, not an indulgence. Expertise, payment, the absence of anything vital at stake: three ways of saying that the healer has something to lose.

This map gives the state of the sources, not a decision in a case. The siman touches health and sometimes life: the characterisation of a real situation — its gravity, its urgency, the existence of an alternative — calls for a Rav, and the diagnosis for a physician.

3. הרופא — recognised expertise, and payment

On the minor procedure, the sources do not agree. The Shakh (ס״ק א) sets out both camps without deciding: the Mehaber, with Rashi, the Rif and the Rambam, on one side; the Rosh, the Tur, Tosafot in the name of Rabbenu Tam, the Ran, Rabbenu Yeruham and the Agudah on the other. The Baer Hetev (ס״ק א) reproduces this presentation. The Rama’s gloss on bloodletting greatly reduces the practical scope of the disagreement, without extinguishing it.
Two points in this section are not read off a page. The first: what, in a contemporary health system, corresponds to מומחה לרבים — the Pit’hei Teshuva (ס״ק ב) shows that the very definition is disputed. The second: the minor procedure, on which the Rishonim divide. A question for a Rav.

4. ספק חי ספק מת — the doubt, certain death, and the min

The rule is counter-intuitive and must be remembered in the right direction. While a chance of life remains, one does not entrust; when death is certain, one does. The Taz explains why this is no contempt for the life that remains: in both cases one acts for the patient’s benefit, abandoning the certain death to take the doubt.

And the rule reverses for the min and the apikoros, where what is at stake is no longer the body:

Nothing in this section transposes by itself to a real case: what “certain to die” means is a medical question as much as a halakhic one, and the Pit’hei Teshuva (ס״ק א) shows, through the Chatam Sofer’s responsum, how completely the characterisation decides everything. A question for a Rav, and for a physician.

The Chatam Sofer does not merely say there is danger: he shows that the reason of seif 1 turns round in this very case. The physician is indeed a craftsman, but he compromises nothing by letting a patient die who came to him on those terms — מעיקרא אדעתא דמיתה נחית. Then he adds the decisive reason: what is demanded of her is a transgression of her religion, and that is as idolatry itself.

Here the siman is at its harshest, and one must see why. Everywhere else mortal danger eases the rule; here it does not — אסור אפילו אם יודע שודאי ימות. The reason lies in what the gemara says of the min: what is at risk there is not life. And the Rambam completes the explanation by saying of the permitted incantation that it heals nothing: so it is not a medicine that is refused, it is an acknowledgement.
The characterisation of a contemporary practice — what it names, what it presupposes, what it asks one to believe — is never supplied by the text, and the seif makes the prohibition depend on what one knows. A question for a Rav.

6. מים ואילן של אליל — the designated remedy

The seif’s criterion is what the healer says; the Bach adds what his words let be understood, and the Shakh concludes that the Mehaber himself concedes it. Deciding whether, in a given case, a designation is significant is exactly the kind of assessment that is asked of a Rav.

Three conditions run through every permission in this seif, and all are written. (1) The mouth stays shut: ובלבד שלא יאכל וישתה האיסור. (2) The remedy must be known, or attested by an expert — and the Shakh (ס״ק כ) as well as the Baer Hetev (ס״ק י) refer for this to Orach Chayim. (3) The permitted route is sought first, even at the cost of some delay, so long as there is no danger.
Two questions remain open in the sources themselves. The first, the Mishneh LaMelech’s: is a food good in itself, swallowed without pleasure, “outside the manner of enjoyment”? It stays in doubt, and the Noda BiYehudah forbids in practice. The second: whether a given case is or is not a place of danger — a medical question as much as a halakhic one. A question for a Rav, and for a physician.

8. מקרים בני זמננו — contemporary cases and summary

Case 1 — Surgery or major treatment entrusted to a non-Jewish practitioner

This is the case of seif 1, and it turns on a single question: is the practitioner a מומחה לרבים? The Shakh (ס״ק ג) gives the criterion — a craftsman does not ruin his craft — the Rama adds that practitioners of a given procedure are held expert in it, and that where there is payment בכל ענין מותר, וכן נהגו להקל; the Shakh (ס״ק ו) defends this reading and the Baer Hetev (ס״ק ג) records it. But what “expert recognised by the public” means in a given health system is not in the text, and the Pit’hei Teshuva (ס״ק ב) shows that the definition itself is disputed.

Case 2 — A medicine recommended and sold by the same person

Seif 1 separates these two acts exactly: the advice may be followed, the sale may not. The Shakh gives both reasons — the fear of being contradicted by others (ס״ק ד) and what a seller is capable of (ס״ק ה); the Baer Hetev (ס״ק ב) joins them. The distinction has not aged, and it is worth stating as it stands: advice and commercial interest are not judged together.

Case 3 — A patient one would entrust to an institution that requires a transgression

This is exactly the Chatam Sofer’s question in the Pit’hei Teshuva (ס״ק א), and his answer is complete: even granting that there is mortal danger and that one might feed the patient a forbidden thing, it remains forbidden to hand her over there, because what is demanded of her is a transgression of her religion — and that is as idolatry itself. He adds the reason of seif 1 turned round: the healer compromises nothing by letting her die, since she came on those terms.

Case 4 — A treatment whose active ingredient is a forbidden substance

Two questions, in this order and never together. Is there danger? If so, the permission is broad — except the three the Rambam names. If not, how is it taken? Outside the manner of enjoyment it is permitted, with the Shakh’s two limits (ס״ק י״ג); in the manner of enjoyment, not. And the Pit’hei Teshuva (ס״ק ו) recalls that the Mishneh LaMelech leaves in doubt the case of a good food swallowed without pleasure, and that the Noda BiYehudah forbids in practice.

Case 5 — The same remedy exists in a permitted form, but one must wait for it

The Rama’s gloss answers directly, and it is the most operative clause in the siman: nothing forbidden is permitted if the cure can be effected with a permitted thing, even if one must wait a little — since there is no danger in the matter. The final condition matters as much as the rule. The Pit’hei Teshuva (ס״ק ה) goes the same way in reporting that where there is danger, one must act without delay.

Case 6 — A patient who refuses to have a prohibition transgressed for him

The Radbaz, in the Pit’hei Teshuva (ס״ק ד), answers without qualification: there is no piety in this, the patient is guilty of his own life, and he is fed by force. The same ס״ק gives the reverse rule for his word: when it prevails over the physician’s — “I need to eat” — and when it yields — “that remedy will harm him”, says the physician.

Case 7 — A “healing” practice by formula, invocation or name

The seif permits what one does not understand and forbids what one does: a plain incantation passes, one known to name an idol does not — even at the cost of life. The Rama adds that one does not learn it either. And the Rambam, in permitting an incantation over a bite, stresses that it avails nothing: what is at issue is therefore never efficacy, but what one acknowledges by accepting it.

Case 8 — A preparation containing a derivative of non-kosher wine

The Pit’hei Teshuva (ס״ק ז) reports a decision of this kind: the Shemesh Tzedakah permitted a man with heart disease a preparation containing vinegar made from a non-Jew’s wine, for several reasons — among them that heart disease may be a matter of danger and that the vinegar is foul-tasting. The reasoning is instructive: it combines the characterisation of danger with the state of the substance, exactly the two axes of seif 3.

The siman speaks of health and in places of life: the gravity of a condition, the standing of a practitioner, the nature of a practice, the existence of a permitted route — none of this is supplied by the text. The Shulchan Arukh itself refers to an expert: וכל חולה שמאכילין (לו) איסור צריכים שתהא הרפואה ידועה או על פי מומחה. For the halakhah, a Rav; for the diagnosis, a physician.
