1. שורש האיסור — a hand one fears, or a regime of suspicion?

The siman opens with a prohibition whose reason is written out in full — and that is precisely why it is hard. If we fear that he will kill, everything should depend on what he stands to lose; if we hold a regime of suspicion, nothing should. The sugya itself hesitates between the two, and every dispute in the siman is born of that hesitation.

The Tur writes the reason, and it is blunt
« כל מכה וחולי שיש בהם סכנה שמחללין עליהן שבת אין מתרפאין מהן דכיון שחשודין על שפיכות דמים ודאי יהרגנו » (טור יו״ד קנ״ה)
What does the siman guard against? (א) A risk of fact. The healer may kill, and a grave illness supplies him with cover; the prohibition then follows the risk exactly, and whatever reduces the risk lifts it — expertise, payment, the fact that there is nothing left to lose. (ב) A regime of suspicion. They are חשודים על שפיכות דמים, and that status is not negotiated case by case; what lifts it is not a calculation of risk but an exception of the halakhah — the expert, whom the gemara names expressly.
Three consequences, and they are the three disputes of the siman. (1) Bloodletting: on the risk reading a scratch poses no problem; on the suspicion reading it does — and that is the Shakh’s debate (ס״ק א). (2) Payment: it reduces the risk and does not touch the status — hence the Rama against the Maharshal. (3) Expertise: is it of the man or of the act? — hence the Pit’hei Teshuva’s question (ס״ק ב).

2. ריבדא דכוסילתא — three states, or two?

The gemara sets aside the reading “with danger / without danger” because of Rav Yehudah, and substitutes “his body / his animal”. Rabbenu Tam refuses to choose: he keeps both by opening a third state, and from this come two opposed readings of the Mehaber.

Two readings of the Mehaber’s silence. The Mehaber writes only the first case — the dangerous illness. The Shakh infers that for him, absent danger, everything is permitted, like Rashi, the Rif and the Rambam; the Rosh and the Tur, for their part, retain Rabbenu Tam’s third case and forbid even a mere scratch. The Tur says so himself, and names both camps.

The reason for the third state, and it is counter-intuitive The lighter the wound, the better the killer is covered: no one will attribute a death to the incompetence of a man who merely let blood. It is therefore the absence of technique that makes the act dangerous.

Nafka mina A minor procedure, with nothing vital at stake and no particular skill. On the Mehaber’s reading as the Shakh gives it: permitted. On the view of the Rosh, the Tur, Tosafot in the name of Rabbenu Tam, the Ran, Rabbenu Yeruham and the Agudah: forbidden. The Rama does not decide head-on, but his gloss on bloodletting removes almost all the ground from the dispute — and the Baer Hetev (ס״ק א) sums up the positions.

The Taz explains why the Tur wrote “a Jew let his blood” The question looks like a detail; it is not. Read it as “a non-Jew let his blood” and the case becomes ordinary and the Tur’s rule has no object; by setting it with a Jew, the Tur isolates exactly the state in which there is neither illness, nor danger, nor craft — Rabbenu Tam’s third state.

3. בשכר ובחנם — wage against reputation

This is the longest passage in the siman, and a disagreement between giants on a point of method: may one permit by a calculation the gemara raised and then set aside? The Rama permits; the Maharshal and the Bach are astonished; the Shakh devotes the largest ס״ק in the siman to showing that the gemara did not set aside what they think it did.

The Maharshal’s question Three grievances in one sentence: the Talmud speaks without distinguishing; we say גדולה השנאה, so that hatred would outweigh interest; and most authors do not distinguish. The Bach follows him.

The Shakh’s answer, in three arguments (1) The Talmud did distinguish: it itself raises “for a fee / for free”, and Rashi gives the reason — he does not kill because he fears the loss of his wage. That the sugya then preferred another reading of the mishnah does not abolish the principle: otherwise it should have asked why payment would change anything. (2) “Great is hatred” has no place here: we are not speaking of a non-Jew who hates this man, but of any non-Jew; what forbids is the suspicion of bloodshed, not a personal enmity. (3) And the argument from the authors turns round: when they write that the healer fears he will יקפח פרנסתו, they mean not this patient’s fee but his future practice — so that a wage lost outright is a fortiori a reason to permit.

4. חיי שעה — why the doubt is stricter than the certainty

This is the strangest line in the seif, and it is perfectly logical: while he may live, one does not hand him over; when he will certainly die, one does. The difficulty lies elsewhere — in Yoma, a brief span of life justifies desecrating the Sabbath. The Taz brings Tosafot’s answer, and it is remarkably economical.

The question In Yoma one clears the rubble on the Sabbath for a brief span of life — so it is taken into account. Here it is not. Would one concept carry two measures?

Tosafot’s answer, in the Taz There are not two measures but one: in both cases we act for his benefit. In Yoma, doing nothing certainly kills him; here, refusing to hand him over certainly kills him. So it is not the brief span of life that is weighed — it is the only path that leaves a chance. The Taz puts it in a sentence: we abandon the certain death and take the doubt.

What then becomes of the brief span of life? (א) A value set aside. It counts for less than a chance of cure, and may be sacrificed for a hope. (ב) A value never set aside, but served differently. It counts fully — and precisely because it counts, one chooses the only path that might prolong it. Tosafot’s wording, עבדינן לטובתו, leans to the second.
Nafka mina — and the gemara supplies it itself The min. There the dying man remains forbidden אפילו לחיי שעה, and the Rosh gives the reason in the Beit Yosef: heresy draws a man after it. Proof that setting aside the brief span of life is not a devaluation of that life but a calculation of what benefits it — and where the risk is no longer the body, the calculation reverses. That is exactly what the seif does with the apikoros.

5. מומחה לרבים — is expertise of the person or of the act?

The gemara gives the permission without defining it, and the Shakh defines it in five words. But two texts pull the definition in incompatible directions: the Rama’s gloss, which deems expert everyone who performs a given procedure, and the Beit Yaakov cited by the Pit’hei Teshuva, which hangs the expertise on the person rather than the act.

The Rama’s gloss makes expertise a property of the act It does not say that this practitioner is expert: it says that this procedure is one in which all practitioners are expert. Expertise becomes a property of the technique, not of the man — and the Taz (ס״ק א) shows that this is how the Tur read it.

The Beit Yaakov’s question, reported by the Pit’hei Teshuva He infers from Tosafot that one who is expert in other illnesses is permitted even for this one, and that one who is expert only in this one is not. That is exactly the reverse of intuition — and it is consistent with the siman’s logic: what protects is not competence but the reputation he has to defend.

The Pit’hei Teshuva’s answer: he refuses the second half Nothing is proved from Tosafot, he says, and the Rama’s gloss runs against it — since it deems expert whoever performs that procedure, requiring nothing further. And he draws a methodological consequence: what was written in the Beit Yaakov’s name at the start of siman 154 is thereby also refuted.

6. הזכרת שם אלילים — what he says, and what he lets be understood

Seif 2 makes the prohibition depend on something seif 1 did not know: the healer’s words. The Mehaber takes them literally — did he name the idol or not? The Taz shows that the Tur added a second condition; the Derisha and the Bach add the implication; and the Shakh concludes that even the Mehaber concedes it.

The Taz reconciles the Tur with himself On one side the Tur forbids as soon as the idol is named; on the other he requires that he say he has no other cure. The Taz resolves: the name alone does not forbid, for it serves only to locate the place; there must in addition be a claim that the cure exists only there.

The Bach reverses the criterion: no longer what he says, but what he lets be understood Two paths, and they cross. If those waters are the more common and he says “take of these”, the designation is significant: why these? And if no others exist and he adds “which are the idol’s”, the mention is superfluous — therefore deliberate. Permission remains only where both negations meet.

The Shakh brings the Bach back inside the Mehaber’s reading The Bach declared himself דלא כהש״ע; the Shakh answers that the Mehaber himself seems to concede it — and the Derisha too. The divergence is therefore not one of rule but of formulation: the Shulchan Arukh writes the plain case, and the implicit case falls under it of itself. The Baer Hetev (ס״ק ה) transmits it in this form.

And the end of the seif opens a second dispute The Mehaber reports ויש אוסרים: even without a mention, even “bring leaves” without more. The Beit Yosef gives the source — the Yerushalmi of the chapter Ein Ma’amidin, against the Yerushalmi of the chapter Shemonah Sheratzim. The Shakh (ס״ק י״א) decides: the agreement of the decisors is like the first view.

The Mehaber permits the סתם case there precisely because one does not know what is named; the Bach, here, refuses to stop at what is named and goes back to what is meant. The two passages treat one problem from two ends, and that is what makes seif 1 more lenient than seif 2 — on speech, not on substance.

7. שלא כדרך הנאתן — the measure of seif 3

Seif 3 leaves the non-Jew and lays down a mechanism: two axes that cross, and two prohibitions that refuse to be caught in the grid. The open question is not whether the measure holds, but what it measures — the nature of the food, or the manner in which it is taken.

The sugya, and the episode that yields the measure

The Shakh sets two limits the seif does not state The first: the permission of the non-enjoyment manner holds only for the need of a cure; without that need it falls. The second: it concerns only prohibitions of benefit; for a prohibition of eating the regime is already wider. Two one-word limitations that change the reach of the seif.

What does “the manner of enjoyment” measure? (א) The thing. A food mixed with something bitter, or very hot, is no longer the food the Torah forbade — that is the case the Rambam describes. (ב) The act. What counts is the manner of taking: swallowing without tasting, applying instead of eating. The Mishneh LaMelech poses exactly this alternative on a good food eaten gluttonously — and leaves it in doubt.

The Noda BiYehudah closes the practical door Even taking the lenient view, it remains forbidden to swallow a Torah prohibition as a remedy where there is no danger. The theoretical doubt stands; the conduct is settled.

Nafka mina A preparation swallowed without being tasted, containing a Torah prohibition, with no danger. On the first branch, everything depends on the preparation itself; on the second, the manner would suffice. The Mishneh LaMelech leaves it in doubt, the Noda BiYehudah forbids in practice — and the Rama, upstream, already requires that the permitted route be sought first.

And the Rama’s gloss adds a whole class Rabbinic prohibitions of benefit fall outside the grid: one is healed by them even without danger and even in the manner of enjoyment, the only barrier remaining the mouth. The Shakh (ס״ק ט״ז) explains the permission of wine by a fact — the nations of this time are not idolaters — and (ס״ק י״ז) immediately restores a limit: the bath is for a sick person, not for a healthy one.

8. יסוד הסימן — three seifim, three regimes

כלל הסימן :
שלושה סעיפים ושלושה דינים נפרדים, ואין אחד מהם נמדד במידת חברו. סעיף א׳ נמדד בחשבון : מה יש למרפא להפסיד — ומשום כך המומחיות מתירה, השכר מתיר, וּודאי מיתה מתיר בעוד שהספק אוסר. סעיף ב׳ נמדד בדיבור : לא במה שהחומר הוא אלא במה שנאמר עליו — ומשום כך מים של אליל מותרים בשתיקה ואסורים בהזכרה. וסעיף ג׳ נמדד בחפץ ובמעשה : אם יש סכנה, ואם נלקח כדרך הנאתו. ובשלושתם קו אחד : מה שהנפש בו נדחה מפני הנפש, ומה שהאמונה בו אינו נדחה — ומשום כך אמר הסעיף אבל אם יודע שמזכיר שם אלילים אסור אפילו אם יודע שודאי ימות.
Three lines to take away. (1) What seif 1 weighs is not the healer’s goodness but what he has to lose — hence expertise, payment, and the reversal in the case of the dying man. (2) What seif 2 weighs is not the substance but the speech; and the Bach, through the Shakh, adds what the speech lets be understood. (3) What seif 3 weighs is the thing and the act, in two successive questions — and the Rama’s gloss closes it all with a rule valid for all three: nothing forbidden is permitted while a permitted route remains open.
