Siman 158 runs to two seifim — the Shulchan Arukh says so itself: ובו ב׳ סעיפים. It is a grave matter, and the text carries its own limits: the seven nations, the absence of war, the land of Israel at the time when most fields were Jewish, the time of the Temple. This page sets out what the sources say, with their references, hardening nothing and softening nothing.

1. The text of the Mehaber — the two seifim

Seif 1 deals with two categories joined by one rule, and it ends with a clause that restricts the second. Seif 2 deals with an altogether different category, and its main verb is in the past tense: היו נוהגין בזמן הבית להרגם.

Seif 1 — who is meant, and what follows

עובדי עבודת כוכבים להצילם מהמות. ובו ב׳ סעיפים:

Heading of the siman: those who serve idolatry, [and whether] to save them from death; and it contains two seifim.

Those who serve idolatry, of the seven nations, between whom and us there is no war; and Jewish shepherds of small cattle, in the land of Israel at the time when most of the fields belonged to Israel, and their like: one does not bring about their death, and it is forbidden to save them if they are inclined to die — for instance if he saw one of them fall into the sea, he does not raise him, even were he to pay him a wage. Therefore one is not to heal them, even for a wage, except where there is enmity (Rama’s gloss: for then even for free it is permitted, if he cannot slip away even for free — Beit Yosef in the name of the Ramban — and likewise it was permitted to test a remedy on a Canaanite slave, to see whether it would help — Tosafot and Mordekhi, chapter Ein Ma‘amidin, and in the Semag). In what case is this said? Of a Jewish sinner who stands in his wickedness and repeats it constantly, such as shepherds of small cattle who have grown loose about theft and go in their folly; but a Jewish sinner who does not stand in his wickedness constantly, and who commits transgressions for his own pleasure — such as one who eats nevelot out of appetite — it is a mitzvah to save him, and it is forbidden to stand upon his blood.

Seif 2 — the apikorsim, and the Rama’s gloss

The apikorsim — and these are those who serve idolatry, or one who commits transgressions in order to provoke: even if he ate a nevelah or wore shaatnez in order to provoke, this one is a denier; and the apikorsim — and these are those who deny the Torah and prophecy — of Israel, they used to practise in the time of the Temple to kill them. If it was in his power to kill them by the sword in public, he would kill; and if not, he would come upon them with pretexts until he brought about his killing. How? He saw one of them fall into a well, and the ladder was in the well: he would come first and remove it, saying “I am busy bringing my son down from the roof, and I shall return it to you”, and such things.

Rama’s gloss: and see in Choshen Mishpat siman 425. Apostates who give themselves over to idolatry and defile themselves among those who serve idolatry, to serve idolatry as they do — behold, they are like apostates who act to provoke, and they would lower them and would not raise them (Tosafot, chapter Ein Ma‘amidin); and nevertheless if he comes to return, they were not stringent with him, for it is hard to part from them and we fear that he may go back to his corruption (Terumat HaDeshen siman 158).
Three limitations are written into the text itself, and they must be read before anything else. (1) מז׳ עממין — of the seven nations. (2) שאין בינינו וביניהם מלחמה — between whom and us there is no war. (3) בארץ ישראל בזמן שהיו רוב השדות של ישראל — in the land of Israel, at the time when most of the fields belonged to Israel. And in seif 2: בזמן הבית, in the time of the Temple. The Mehaber does not write these words for ornament: they are the definition of the subject he is speaking about.

2. Context — the beraita, the gemara, Tosafot, the Rambam, the Tur

The beraita that Rabbi Abbahu taught before Rabbi Yochanan is the source of seif 1; it straddles two pages:

« תָּנֵי רַבִּי אֲבָהוּ קַמֵּיהּ דְּרַבִּי יוֹחָנָן: הַגּוֹיִם וְרוֹעֵי בְּהֵמָה דַּקָּה — לֹא מַעֲלִין » (עבודה זרה כ״ו ע״א)
« וְלֹא מוֹרִידִין, אֲבָל הַמִּינִין וְהַמָּסוֹרוֹת וְהַמְשׁוּמָּדִים — מוֹרִידִין וְלֹא מַעֲלִין » (עבודה זרה כ״ו ע״ב)

Before it, the gemara had raised the question of a wage, and Abaye answered by way of evasion:

« סָבַר רַב יוֹסֵף לְמֵימַר, הָא דְּתַנְיָא: הַגּוֹיִם וְרוֹעֵי בְּהֵמָה דַּקָּה לֹא מַעֲלִין וְלֹא מוֹרִידִין — אַסּוֹקֵי בְּשָׂכָר שְׁרֵי, מִשּׁוּם אֵיבָה » (עבודה זרה כ״ו ע״א)
« אֲמַר לֵיהּ אַבָּיֵי: יָכוֹל לוֹמַר לוֹ ״קָאֵי בְּרִי אַאִיגָּרָא״, אִי נָמֵי ״נְקִיטָא לִי זִימְנָא לְבֵי דַוָּאר״ » (עבודה זרה כ״ו ע״א)

And the mishnah of the midwife, which gives the regime of enmity:

« יְהוּדִית מְיַלֶּדֶת אֲרַמִּית בְּשָׂכָר, אֲבָל לֹא בְּחִנָּם » (עבודה זרה כ״ו ע״א)

On the meaning of לא מורידין, Tosafot bring the difficulty from Masekhet Soferim and resolve it by wartime:

« וי״ל דבירושלמי דקדושין מפרש דהיינו בשעת מלחמה » (תוספות עבודה זרה כ״ו ע״ב)
« ואע״פ שסתם כנענים עובדי כוכבים ומזלות הם ועוברין על שבע מצות מכל מקום אין מורידין דרבינהו בקרא להתירא » (תוספות עבודה זרה כ״ו ע״ב)

And they give the distinction that runs through the whole siman — the strong hand and the evasion:

« י״ל דמורידין היינו כשידינו תקיפה בזה״ב אבל לא מעלין אף אין ידינו תקיפה היכא דאית ליה לאשתמוטי » (תוספות עבודה זרה כ״ו ע״ב)

On healing, Tosafot read Rashi thus:

« כפ״ה דאסור לרפאות בחנם אבל בשכר שרי משום איבה » (תוספות עבודה זרה כ״ו ע״ב)

The Tur gives the siman in four clauses, and his formulation on healing differs from the Mehaber’s:

« בזמן שישראל על אדמתם כנענים שירדו לבור או למקום סכנה אין על הרואה אותם להעלותן אפילו אם יתן לו שכר » (טור יו״ד קנ״ח)
« לפיכך אין לרפאותן אפילו בשכר ואם מתיירא מהם או משום איבה מרפאין אותם בשכר אבל לא בחנם » (טור יו״ד קנ״ח)
« ומכל מקום אין מורידין אותם לבור בידים » (טור יו״ד קנ״ח)
« אבל המינין והמוסרים ומומר אוכל נבלות להכעיס והאפיקורסים מורידין אותם בידים » (טור יו״ד קנ״ח)

The Beit Yosef brings the Ramban, who broadens the permission to heal:

« אבל היכא דאיכא איבה ודאי מותר דהא תנן יהודית מיילדת הארמאית בשכר » (בית יוסף יו״ד קנ״ח)
« הלכך כיון דהיתירא משום איבה הוא בין בשכר בין בחנם נקיט עילה היכא דמצי » (בית יוסף יו״ד קנ״ח)

And he sets out, on אין מורידין, the reading the Taz will contest:

« ומשמע מדברי התוס׳ דלאו למימרא שאסור להורידם אלא היינו לומר שאינו מצווה להורידם אע״פ שהם עוברים על ז׳ מצות » (בית יוסף יו״ד קנ״ח)
« ומיהו היכא דמקיימין ז׳ מצות משמע דאסור להורידם » (בית יוסף יו״ד קנ״ח)
Three differences between the Tur and the Mehaber deserve to be noted already at level 1. (1) The Tur writes בזמן שישראל על אדמתם — when Israel was on its land; the Mehaber writes the same limitation differently, through the seven nations and through the land of Israel. (2) On healing, the Tur permits for a wage where there is fear or enmity and forbids it for free; the Mehaber writes only אם לא היכא דאיכא משום איבה, and the Rama adds, in the name of the Ramban as reported by the Beit Yosef, that for free too it is then permitted where one cannot slip away. (3) The Tur says expressly ומכל מקום אין מורידין אותם לבור בידים; the Mehaber does not take up this clause, and it is precisely on it that the discussion of the Taz and the Nekudot HaKesef will turn.

3. The key concepts of this siman

לֹא מַעֲלִין וְלֹא מוֹרִידִיןone does not raise and one does not lower. The formula of the beraita. The first term is plain: one does not rescue. The second is the whole debate of the siman: does it mean that there is no mitzvah to lower, or that it is forbidden to do so? The Beit Yosef holds the first sense, the Taz the second, and the Nekudot HaKesef reconcile them.
אֵיבָהenmity. The ground that reverses the rule on healing. Its regime comes from the mishnah of the midwife: for a wage it is permitted, because there is no other way out. The Ramban broadens it: where one cannot slip away even for free, for free too it is permitted.
שֶׁבַע מִצְוֹת בְּנֵי נֹחַthe seven commandments of the sons of Noah. The criterion the Shach introduces in ס״ק ב, in the name of the Beit Yosef and the Darkhei Moshe: where they observe them, it follows that it is forbidden to lower them. It is this criterion that the Nekudot HaKesef will urge against the Taz.
מוּמָר · מִין · אֶפִּיקוֹרוֹס · כּוֹפֵרfour words, and they are not interchangeable. The gemara debates which applies to one who eats nevelot in order to provoke; the Rambam writes אפיקורוס; the Beit Yosef quotes him with מין; and the Mehaber writes כופר. Level 2 returns to this.
בְּיָדַיִם וְסִיבּוּבwith one’s hands, and by a roundabout way. The Taz’s distinction: what is done with one’s hands, and what is done by removing a ladder. The Taz separates them; the Bach, whom he calls מו״ח, joins them.
לֹא תַעֲמֹד עַל דַּם רֵעֶךָyou shall not stand upon the blood of your fellow. The verse. The Mehaber echoes it at the end of seif 1 without naming it; the Rambam cites it expressly, and adds the words on which the whole construction rests:

This siman is short and well commented: the Shach has seven ס״ק, the Taz one but a very long one, the Nekudot HaKesef one entry — referenced to the siman alone —, the Pitchei Teshuvah four and the Baer Hetev two.

ס״ק א — on שאין כו׳ מלחמה

« אבל בשעת המלחמה היו הורגין אותן בידים דאמרינן טוב שבעובדי כוכבים כו׳ כ״פ הב״ח והביא התוס׳ שכ״כ וכ״כ ב״י » (ש״ך יו״ד קנ״ח ס״ק א)

summary: the Taz holds that ולא מורידין means that there is a prohibition; he supports this from the chapter Arba Mitot and from Rashi, and writes that a whole sugya escaped the Beit Yosef. He then states his own position precisely: there is no Torah command to remove them, the Sages said that there is a prohibition in the matter, but one who has done it is exempt. And he sets out the decisive distinction: what is done with one’s hands is forbidden; a mere roundabout act — removing the ladder — is not, since he is not acting with his hands. His father-in-law, the Bach, held that removing the ladder is included in “with one’s hands”; the Taz refutes this from the Rambam’s rule about one who removes the ladder, who is exempt from death at the hands of the court.

The Baer Hetev — two entries

The Baer Hetev gives the map of the siman in two lines. He notes that the Taz disagrees with the Beit Yosef and that the Nekudot HaKesef defend him: this is exactly the central dispute, and it turns on the meaning of two words of the beraita.

6. The Rambam — the three halakhot out of which this siman is made

The two seifim take up, almost word for word, three consecutive halakhot from the laws of the murderer and the guarding of life. The Beit Yosef says so himself.

Seif 2 comes from halakhah 10

« הָאֶפִּיקוֹרְסִים וְהֵם עוֹבְדֵי עֲבוֹדָה זָרָה אוֹ הָעוֹשֶׂה עֲבֵרוֹת לְהַכְעִיס אֲפִלּוּ אָכַל נְבֵלָה אוֹ לָבַשׁ שַׁעַטְנֵז לְהַכְעִיס הֲרֵי זֶה אֶפִּיקוֹרוֹס » (רמב״ם הלכות רוצח ושמירת נפש פרק ד׳ הלכה י׳)

On what an apikoros is, the Rambam elsewhere gives a definition in three branches:

« שְׁלֹשָׁה הֵן הַנִּקְרָאִים אֶפִּיקוֹרְסִין. הָאוֹמֵר שֶׁאֵין שָׁם נְבוּאָה כְּלָל וְאֵין שָׁם מַדָּע שֶׁמַּגִּיעַ מֵהַבּוֹרֵא לְלֵב בְּנֵי הָאָדָם » (רמב״ם הלכות תשובה פרק ג׳ הלכה ח׳)
« וְהַמַּכְחִישׁ נְבוּאָתוֹ שֶׁל משֶׁה רַבֵּנוּ. וְהָאוֹמֵר שֶׁאֵין הַבּוֹרֵא יוֹדֵעַ מַעֲשֵׂה בְּנֵי הָאָדָם » (רמב״ם הלכות תשובה פרק ג׳ הלכה ח׳)
The Mehaber reversed the Rambam’s order. In the Rambam, halakhah 10 (the apikorsim) precedes halakhah 11 (the others); in the Mehaber the order is reversed: seif 1 is halakhot 11 and 12, and seif 2 is halakhah 10. The Taz relies precisely on this order in the Rambam for his reading of אין מסבבין: the Rambam had just written, of the apikorsim, that there was a mitzvah to bring about their death, and he then says that for the others there is none.

7. What the text limits by itself

Four limitations are written into the siman, and none of them is a softening added afterwards: they are the Mehaber’s own words. (1) מז׳ עממין — the seven nations. (2) שאין בינינו וביניהם מלחמה; and the Shach, in ס״ק א, states that the regime of wartime is another. (3) בארץ ישראל בזמן שהיו רוב השדות של ישראל, for the shepherds; and the Shach explains it in ס״ק ד. (4) היו נוהגין בזמן הבית להרגם — in the time of the Temple, and the verb is in the past.
Three doors remain open in the text itself. (1) The sinner who does not persist: מצוה להצילו ואסור לעמוד על דמו. (2) Robbers by Torah law, who are raised — Shach ס״ק ג. (3) One who comes to return: the Rama writes that they were not stringent with him.

8. Summary of Siman 158

Two seifim. Seif 1 — whom it concerns: those of the seven nations with whom there is no war, and Jewish shepherds of small cattle in the land of Israel at the time when most fields were Jewish. What is said of them: one does not bring about their death, and one does not rescue them; hence one does not heal them even for a wage, except where there is enmity — and then, says the Rama in the name of the Ramban as reported by the Beit Yosef, for free as well where one cannot slip away. And one clause restricts the whole: it applies only to one who persists in his sin; one who sins for his own pleasure, it is a mitzvah to save him. Seif 2 — the apikorsim, and the verb is in the past: in the time of the Temple. The Rama adds the reference to Choshen Mishpat 425, the case of apostates, and the door of repentance. The apparatus — the Shach, the Taz and the Nekudot HaKesef debate the meaning of לא מורידין, and the Baer Hetev reports the debate.
