יז. תלמידי חכמים שהלוו זה את זה דברים של מאכל ונתן לו יותר על מה שלוה ממנו עד חומש ה״ז מותר שהדבר ידוע שלא נתן לו אלא מתנה: הגה ויש מתירין אפילו בהתנו מתחילה כך ובלבד בדבר מועט (הגהות אשיר״י וכ״מ דעת הטור וכ״נ דעת הרב המגיד) ומכל מקום לא ירגילו תלמידי חכמים עצמם בכך מפני המון העם שלא ילמדו מהם (הגהת מיי׳ פ״ד מהל׳ מלוה וסמ״ג לאוין קצ״ג):

יט. אפוטרופוס שהלוה מעות היתומים ברבית קצוצה אם הלוה נטל לחלקו כל כך ריוח כמו שהתנה לתת להם חייב ליתן להם:

כ. אם עבר האפוטרופוס והלוה מעות יתומים ברבית קצוצה והאכיל היתומים פטורים מלשלם אפילו לכשיגדלו: הגה וגם האפוטרופוס פטור מלהחזירו (תשובת הרשב״א) וה״ה מעות של הקדש עניים או שאר מצות (ב״י בשם תשובת הרשב״א) ומיהו אין המלוה נאמן לומר דמעות של הקדש היו אלא בראייה (ריב״ש סי׳ תס״ה) ועיין לקמן סי׳ קס״ט אם אפוטרופוס מותר ללוות מעובד כוכבים לצורך יתומים:

Seif 1 names four people; the mishna names five; the Shach adds a sixth who has no proper name. This is not an enumeration but a distribution — and not all of them bear the same prohibitions.

Kashya: why is the borrower caught at all? Throughout monetary law, one who consents to harm his own property may do so. Here he may not. The Tur raises the question and settles it in a word — but that word says the borrower’s prohibition is not of the same nature as the lender’s: it is preventive.
« משא״כ בשאר דיני ממונות שאם אדם רוצה ליזוק בנכסיו רשאי אבל מפני רגילות החטא מזהיר גם בלוה » (טור יו״ד ק״ס)
Teruts: the Rama’s gloss narrows exactly where the Tur had opened If the borrower is caught only by way of prevention, then where the Torah itself does not forbid — rabbinic interest — there is nothing left to prevent under the laws of interest, and the borrower falls back under the general rule of one who causes another to sin.

Ḥakira: is the borrower’s prohibition a lav in its own right, or an instance of לפני עור? (א) A lav in its own right. The Torah wrote לא תשיך לאחיך, and the tradition understood it as a warning addressed to the borrower; he then transgresses as a borrower, and the lender’s transgression is a separate matter. (ב) An instance of לפני עור. What he does is to place the lender in a position to sin; the verse would only be the shape that prohibition takes here. The Rama’s gloss cuts through the middle: at Torah level, the first; at rabbinic level, only the second remains.
Nafka mina (1) Rabbinic interest: on (א) the borrower would still transgress something of his own; on (ב) and on the gloss, only לפני עור. (2) A lender who will lend this money to another Jew anyway: on (ב) the Penei Moshe infers there is no לפני עור left — like holding out a cup to a nazirite on the same bank of the river; the Mishneh LaMelekh disputes. (3) The witnesses: the Ḥavot Daat applies exactly the gloss’s reasoning to them.

A dispute left open: the witnesses of an oral loan If the witnesses are caught by לא תשימון, the question is what “laying” means: signing a deed, or merely being present. The Maharash leaves it in doubt; the Shiltei Giborim rules without hesitation.

2. רבית קצוצה ואבק רבית — two regimes, and what separates them

The siman does not merely forbid: it classifies. Twice it closes a seif with the name of a regime — אבק רבית in seif 6, רבית קצוצה in seif 14 — and on that name everything else depends: restitution, waiver, orphans’ money.

The sugya that fixes the line The mishna enumerates cases; the Talmud asks from where one leaves the Torah, and Rabbi Elazar supplies the operative test.

Kashya: Rabbi Yoḥanan held that even fixed interest is not recovered His reason is a scriptural juxtaposition: the lender at interest is placed alongside the murderer, and the murderer was not given over to restitution. Had that road been taken, fixed interest and dust of interest would have had the same practical regime — and there would have been not two categories but two words.

Ḥakira: is avak ribbit a lesser interest, or something else? (א) A lesser interest. The same prohibition, but the Sages alone extended it to what was not stipulated; being lighter, it is not recovered. (ב) Something else. It is not interest at all but a screen — the Torah forbade only what was cut and stipulated, and the Sages forbade what looks like it. The Shach, in ס״ק ד, uses that very word to justify seif 4: דמחזי כרבית. On (ב), non-restitution is no leniency: there is nothing to restore, since no property was wrongly taken.

Nafka mina (1) Orphans’ money (seif 18): the permission makes sense only on (ב) — the Sages built no screen where none was needed; the Rambam writes it plainly, ובנכסי יתומים לא גזרו. (2) The Ba’al HaTerumot, cited by the Shach in ס״ק לב, holds that in one case avak is recovered in court — which is intelligible only on (א). (3) The waiver of seif 5: on (א) it bears on a debt of interest; on (ב) there is nothing in avak to waive, and the debate concerns only fixed interest.

Where the siman assigns each label Seif 6 ends with אבק רבית; seif 14 ends with ורבית קצוצה הוא. The two endings are deliberately symmetrical. What separates them is neither the amount nor the moment nor the recipient: it is the ketzitza, the act of cutting the sum in advance. Seif 4 forbids what no one stipulated, no one named, and the borrower gives of himself. It is the siman’s most exposed point, and there it settles a dispute of Rishonim in a single line.

Seif 5 rests on two propositions that almost contradict each other: the words “as a gift” achieve nothing, and a waiver does. Between them lies a tipping point — the moment interest ceases to be interest and becomes a debt.

Three positions, as the Tur reports them The Geonim: a waiver never helps, for all interest is a waiver and the Torah forbade it nonetheless. The Rambam: this ruling is not correct. The Rosh: it helps, but only afterwards.

Ḥakira: what is waived, a chattel or a prohibition? (א) A chattel. Once the interest is taken, the lender holds money that is not his; it is a debt of restitution, and a debt can be waived — כדרך שמוחל הגזל. (ב) A prohibition. What the Torah forbade is the taking itself; and a prohibition is not waived, whatever consent accompanies it — this is the Geonim’s position, and their argument is strong: all interest is consented to, and the Torah forbade it anyway. The Rambam answers from elsewhere: the Sages said that one does not accept restitution from lenders at interest — which presupposes that they must restore, hence that there is a debt, hence that a waiver takes hold.

Seif 6 describes a man who sends a gift to one from whom he hopes for a loan. Nothing is said; nothing promised. Must he have specified for it to be interest? And if so, is it then fixed interest?

The mishna of Rabban Gamliel In the mishna the man says why he sends — and from that the question is born.

Ḥakira: the geder of ketzitza — a speech act, or a causal link? (א) A speech act. What makes interest “fixed” is that the price of the delay was uttered; without utterance there is only resemblance. (ב) A causal link. What makes it is that the thing be given because of the loan; the utterance is merely evidence, and a large gift is other evidence. The Beit Yosef leaves in צ״ע precisely the question that decides between the two, and the Ḥavot Daat takes it up: if the condition is a real one — the gift to be returned if the loan is refused — then it is fixed interest in everyone’s view.

Seif 8 runs to one line, and the Taz finds two difficulties in it; on both, the Nekudot HaKesef — that is, the Shach — answer him, and briefly. It is the sharpest exchange in the siman.

On the one forbidden benefit: in the end he does derive benefit from the other — agency is not the question. On the orphans: the beit din was not the only available device, the Talmud cites one of several. On the Rashba: the guardian is as the principal himself.

Ḥakira: what does אין שליח לדבר עבירה actually remove? (א) The penalty only. The principle prevents imputing the punishment of the act to the sender; the prohibition remains, and he did commit it by another’s hand. This is the Taz’s position, and he states it in so many words. (ב) The act itself. With agency gone, the act is not the sender’s: it is not “his” interest that is paid, and there is therefore no interest coming from borrower to lender. This is the position the Shach defends, and it needs the Darkhei Moshe’s distinction to stand.

Nafka mina (1) Rabbinic interest: the Mishneh LaMelekh doubts whether אין שליח לדבר עבירה may be said there, and the Sha’ar HaMelekh answers that even if agency holds, the rabbinic decree did not cover this case. (2) A non-Jewish agent: the Baer Hetev excludes the permission — such a one transgresses nothing in performing the errand, so agency holds. (3) A deed drawn in the lender’s name: the Rama forbids it even without the sender’s knowledge, for דהשטר עביד לה עיקר הלואה. (4) And in practice: the Ḥinukh Beit Yehuda follows the Levush and the Taz, and refuses to see a permission here.

Seif 17 permits what the whole siman forbids, and the gloss permits a little more. The question is what authorises it: a knowledge amounting to a finding of fact, or a trust amounting to a dispensation.

The Talmud, and the word that stayed hard Shmuel said to Avuha bar Ihi: “lend me a hundred peppercorns for a hundred and twenty, ואריך”. That last word governs the whole discussion: was there, or was there not, a prior stipulation?

Kashya of the Taz: the Beit Yosef read the responsum backwards The Beit Yosef understands from an Ashkenazi responsum that expressly stipulating “as a gift” is better than saying nothing. The Taz shows that the responsum is the Maharil’s, siman 37, and that it says the opposite: it deals with a man holding his stepson’s orphan money who lent it at fixed interest, and its last line is וכל שכן הכא דלא התנה כלום — all the more so here, where he stipulated nothing.

The Nekudot HaKesef reply: the Bach was already there On the Taz’s first astonishment — the one aimed at the Tur in ס״ק יב — the Nekudot HaKesef answer in a single line, and that line is also a way of saying the objection is not new.

Ḥakira: is the permission a finding of fact or a leniency? (א) A finding of fact. The surplus is not interest but a gift, and we know it — שהדבר ידוע. Nothing was permitted; it was merely established what the thing is. (ב) A leniency. The surplus is indeed interest, but interest that is merely rabbinic in a setting where the parties can be relied upon. The Shach, in ס״ק כד, implicitly decides for (א): both must be talmidei ḥakhamim, failing which the finding no longer holds. And the Rama’s gloss adds a reason belonging to neither: what is permitted may still be unbecoming, because of what others would learn from it.

Seifim 18 to 20 form a block, and each carries a challenge: the custom, what the orphans take, and credibility without an oath.

The sugya, and the two readings of its device The Talmud builds a device — a trustworthy man, solid assets, and a beit din. It remains to determine which of the three is indispensable.

Is a beit din required? — and the Shach on the custom The Rambam says nothing of it; Rashi and the Mordechai require it. The Rama decides by custom — and the Shach contests the custom itself, which is rare and severe: he does not say the custom is bad, he says he has never met it.

The Noda BiYehuda explains the Shach, and supplies the practical form If Rashi requires a beit din, it is because one needs the power to declare the recipient’s property ownerless — hence a court of high standing, which we no longer have. That is why the custom the Shach sought did not exist. But the main view is like those who dispute Rashi, and the Noda BiYehuda describes what he himself did: a written contract stating that the money is orphans’.

What the orphans take, when the guardian transgressed The Taz: since the wrongful act counts as never done, we treat it as though the permitted division had been stipulated — and the orphan takes half of all the profit, even beyond what the guardian had fixed. The Shach, in the Beit Yosef’s name: we do not go that far; and Rabbi Aharon Sasson goes the other way.

Kashya of the Taz: whence that an orphan is believed without an oath? The Taz shows that at siman 169 the rule is the reverse — the lender holding a deed swears and collects. And he ends by demanding proof.

The Shach’s reply, confirmed by the Nekudot HaKesef The rule is not an orphan’s prerogative: it is the rule for anyone. The Rashba responsum it comes from happened to concern an orphan, and its point lies elsewhere — one holding a deed need not swear before collecting when the other claims there is interest in it.

Ḥakira: why is avak permitted with orphans’ money? (א) Because of the orphans. A minor is not liable, and the Sages’ decree does not reach him; it is a personal dispensation. (ב) Because of the decree. The Sages did not extend their decree to orphans’ property — ובנכסי יתומים לא גזרו: this is not a dispensation but a limit of scope. The Shach, in ס״ק כט, decides for (ב) without saying so: an orphan, for this purpose, includes any adult who does not know how to handle his own property — which has nothing to do with minority and everything to do with the reason of the device.

It remains to say what holds together twenty-three such dissimilar seifim: a transgression counted in six prohibitions, a morning greeting, an orphan’s money, the value of a coin, and an artisan’s custom.

Yesod: what the siman measures The siman never measures an amount. It measures a direction: something passes from borrower to lender, and it passes because of the loan. That is why a greeting suffices, why the season of a day’s labour suffices, and why reciprocity — the siman’s last line — does not: when the two do each other turns by turns, the direction cancels. The one place the siman speaks of an amount is seif 17, and there only to say how far one may go without the direction being legible. And the one place it speaks of value is seif 21, and there only to say at what moment we measure.

What is in this siman and nowhere else Three features set it apart. (1) The prohibition catches the victim: the borrower, who pays, is warned — the Tur gives the reason and it is pedagogical. (2) It catches witnesses and a scribe, that is, people who are not parties. (3) And it carries no corporal penalty, מפני שנתן להשבון — it is the only prohibition of the block whose sanction is restitution. The three hold together: a prohibition that is not punished but repaired, and of which everyone is warned, is a prohibition aimed at the situation more than at the sin.

What the siman leaves open, and what closes later The siman closes few things itself. It refers to siman 161 for the definition of avak ribbit and Torah-level interest, to siman 166 for dwelling in the courtyard, to siman 169 for interest through a non-Jew, to siman 172 for circumvention, to siman 173 for communal needs, to siman 177 for a loan repaid by a loan — and once to Choshen Mishpat 34, as to whether the guardian becomes unfit to testify. To study 160 without following those references is to mistake categories for rules.
