Siman 161 adds no prohibition: it classifies. And that is why it is the most disputed siman of the block — for to classify, here, is to decide what the court will take back. Eight sugyot follow, in the order of the seifim.

1. גדר אבק רבית — does the frontier lie in the form, or in the stipulation?

חקירה — The question. The Rema, in seif 1, gives a criterion of form: by way of a loan, interest is of the Torah; by way of a sale, it is only dust of interest. The Mehaber, in seif 5, gives two: by way of a loan and for a fixed sum. Is this one thing said twice, or two distinct conditions?
« כללא דרבית דכל שהוא אגר נטר אסור בין שהוא דרך מקח בין שהוא דרך הלואה אלא שבדרך מקח אינו רק אבק רבית שהוא מדרבנן » (רמ״א יו״ד קס״א:א)
« רבית דאורייתא שהוא בדרך הלואה בדבר קצוב יוצאה בדיינים » (שו״ע יו״ד קס״א:ה)

If form alone sufficed, a loan yielding an advantage without any sum having been fixed would be of the Torah. The Rambam says expressly the contrary — twice, and for two different cases:

« וְאִם לֹא הֶעֱלָה לוֹ הֲרֵי זֶה אֲבַק רִבִּית לְפִי שֶׁלֹּא הִתְנָה עִמּוֹ שֶׁיַּלְוֵהוּ וְיָדוּר בַּחֲצֵרוֹ » (רמב״ם הלכות מלווה ולווה פרק ו׳ הלכה ב׳)
« הֲרֵי זֶה אֲבַק רִבִּית לְפִי שֶׁלֹּא קָצַץ בִּשְׁעַת הַלְוָאָה » (רמב״ם הלכות מלווה ולווה פרק ו׳ הלכה ג׳)
תירוץ — The answer. The two formulations do not coincide. The Rema describes the reach of the prohibition — everything that is אגר נטר — and he names the way of sale because it is the commonest way of failing both conditions. The Mehaber defines the category, and for that he needs two cumulative conditions: the way of a loan, and קציצה at the time of the loan. The Rambam is the decisive witness: both of his cases have the form of a loan and are nonetheless dust of interest, for want of a fixed sum.
One may put it thus: אגר נטר answers the question “is it forbidden?”; הלואה + קציצה answers the question “is it of the Torah, and will the court take it back?”. The whole siman is the second question, and that is why it is entitled ואיזו נקרא רבית דאורייתא.

The Pit’hei Teshuva confirms the reading and carries it far: even where there is neither a loan nor an actual sale, a wage for waiting is forbidden — and is nonetheless only dust of interest.

נפקא מינה. A creditor grants a delay and afterwards receives a supplement whose amount no one had fixed: forbidden by the first criterion, not recoverable by the second. And a loan whose sum was fixed from the outset but paid under the name of rent: forbidden and recoverable, the form changing nothing — that is seif 10.

2. פחות משוה פרוטה — a prohibition that is not recovered

Seif 1 says two things in one line, and the second is stranger than the first.

« בפחות משוה פרוטה יש איסור רבית אבל אין מוציאין אותו בדיינין » (שו״ע יו״ד קס״א:א)
מחלוקת — The dispute. The Tur reports the R”i: what is worth less than a peruta is excluded from the verse itself. The Ramah disputes: it is indeed forbidden by Torah law — only, it is not extracted through the judges. The Mehaber adopted the Ramah.
« חוץ מקרקע כגון שהלוה לו חמשה גפנות טעונות בשש וחוץ מפחות משוה פרוטה » (טור יו״ד קס״א)
« והרמ״ה כתב דאפי׳ בפחות משוה פרוטה אסור מן התורה אבל אין מוציאין אותו בדיינין עד שיהא בו שוה פרוטה » (טור יו״ד קס״א)

The Taz goes back to the source of the exclusion, then sets out the contrary view:

קושיא — The objection. Why is it not extracted? The Levush had answered: because a court does not attend to less than a peruta, as stated in Hoshen Mishpat siman 6. The Shach rejects this explanation.
« נראה דאפילו הדיינים רוצים להזדקק לישב בדין אין מוציאין אותו » (ש״ך יו״ד קס״א ס״ק ג)
« ועוד דהא כתב המחבר שם דגומרין אפילו בפחות מש » (ש״ך יו״ד קס״א ס״ק ג)
תירוץ. The Shach’s rejection forces one to look for the reason elsewhere — and it is found three seifim later. What the court does for Torah interest is not the execution of a debt but coercion under a positive commandment; and the commandment is וחי אחיך עמך, “and your brother shall live with you”. Where what is at stake is not worth a peruta, there is nothing on which the brother’s living depends — and so nothing to coerce. The prohibition itself remains entire.

נפקא מינה. A series of deductions each below a peruta. On the Levush’s reason, the question would be procedural and aggregation might settle it; on the Shach’s, it is substantive, and one must know whether each deduction or the transaction is looked at. The point is not settled here — but it is the Shach’s rejection that makes the question possible.

3. כלל ופרט — land, slaves, deeds: what the verse excludes

The words כל דבר open the siman, and the Tur at once restricted them. The Taz goes back to the mechanism: a כלל ופרט in the verse.

« והוא נלמד מכלל ופרט שיש בפסוק דבעינן גופן ממון ומטלטלין יצאו קרקעות שאין מטלטלין יצאו פחות משוה פרוטה שאין גופן ממון » (ט״ז יו״ד קס״א ס״ק א)
The Rosh gives a different reason for slaves and deeds: it is not the verse that excludes them but the nature of the transaction — one lends only what is meant to be consumed.
« וכתב הרא״ש אבל בעבדים ושטרות ליכא למעוטי דלא שייך רבית אלא בהלואה דניתן להוצאה » (ט״ז יו״ד קס״א ס״ק א)
קושיא — The Beit Yosef’s objection. But one may perfectly well lend a slave: I give you one now, you will return two later.
« והקשה ב״י דאטו עבדים ושטרות מי לא שייך בהו הלואה שנותן לו עבד אחד שיתן לו אחר זמן שנים אחרים » (ט״ז יו״ד קס״א ס״ק א)
תירוץ — The Taz’s answer. The Beit Yosef is right on the fact, and it changes nothing in law: slaves are excluded by the Torah in any case, being likened to land — that is the general rule of כלל ופרט. But they remain rabbinically forbidden.
« דמן התורה אתמעט עבדים בכל גווני שזכרנו אלא דמדרבנן אסור » (ט״ז יו״ד קס״א ס״ק א)

And along the way he sets aside two views — that of his father-in-law the Bach, who held this to be interest in the full sense, and the Beit Yosef’s “it may be”:

« וכתב מו״ח ז״ל דבזה הוה באמת רבית גמור ודבריו תמוהין » (ט״ז יו״ד קס״א ס״ק א)
« למה כתב לשון אפשר והלא ודאי אסור מדרבנן כמו שהוכחנו מן המשנה שזכרנו » (ט״ז יו״ד קס״א ס״ק א)

His proof that the rabbinic prohibition does exist is a mishna of the same chapter: exchanging labour for labour with a delay is forbidden.

« דהא אסור לומר נכוש עמי ואעדור עמך במשנה סוף פרק איזהו נשך » (ט״ז יו״ד קס״א ס״ק א)
יסוד — The foundation, and it carries far. The Taz raises the symmetrical objection against himself: if the Sages extended interest to slaves, why did they not likewise extend overreaching (אונאה)? And his answer is the principle governing the whole second half of our siman.
« ויש לומר דלא באו רבנן להוציא ממון בשביל זה נגד דין תורה משא״כ כאן לא אמרו להוציא ממון דהא בכל רבית דרבנן אין מחזירין אלא אמרו שאסור לעשות כן » (ט״ז יו״ד קס״א ס״ק א)
The Sages do not make money leave a man’s hands against Torah law. They would have done so by extending overreaching; they do not do so by extending interest — because dust of interest is never recovered. The rabbinic extension of the prohibition costs nothing in money, and that is what makes it possible. Seif 2 is therefore not merely a rule of recovery: it is the condition of possibility of the whole rabbinic edifice of this block.

The Shach, more soberly, notes only the state of the question and the practical conclusion:

« וכתב הט״ז דה״ה בעבדים שייך רבית דרבנן ובשטרות פשיטא דשייך רבית דכשמלוה לו השטר מלוה לו ממון ועיקר ההלואה הוא הממון ופשיטא שיש בו רבית גמור » (באר היטב יו״ד קס״א ס״ק א)

4. תפס לוה — the Raavad against the Rosh, and the Shach’s doubt

Seif 3 is short, and it settles an entire dispute.

« אבק רבית אם תפס לוה משל מלוה מפקינן מיניה » (שו״ע יו״ד קס״א:ג)
מחלוקת. The Raavad: dust of interest is not recovered — therefore if the borrower has paid himself from the lender’s property, it is not taken back from him. The Rosh: it is taken back, for the money was given by the borrower and belongs to the lender.
« וכתב הראב״ד נהי שאינה יוצאה אם תפש לוה משל מלוה לא מפקינן מיניה » (טור יו״ד קס״א)
« כתב אפילו תפש לוה משל מלוה מפקינן מיניה דאחר שנתנו לוה למלוה הוא שלו » (טור יו״ד קס״א)
חקירה. What exactly is said of dust of interest already paid? Two descriptions. (a) It belongs to the lender, and it merely falls to him to return it: retaken by the borrower, it is taken from another. (b) It never wholly left the borrower, only the court will not act: retaken by him, it is taken from his own. The Rosh holds the first, the Raavad the second — and the Rosh’s phrase says exactly why: דאחר שנתנו לוה למלוה הוא שלו.

The Beit Yosef notes that the Rashba and the Ran also oppose the Raavad, and reports two restrictions placed on his view:

« וכתוב בסה״ת שאף הראב״ד לא אמרה אלא במשכנתא או בזביני דמנפשיה (קאכיל לפירא) אבל רבית מוקדמת או מאוחרת דמדעתיה יהב אי תפס מפקינן מיניה » (בית יוסף יו״ד קס״א)
« וכתב הריב״ש שלא הודו לו להראב״ד אלא אי תפס לוה מפקינן מיניה » (בית יוסף יו״ד קס״א)
נפקא מינה — and it is the Shach who supplies it. The rule of seif 3 holds only where the sum is dust of interest in everyone’s view. Where the poskim dispute its nature, the borrower who seized keeps it — this is תפיסה בספק.
« נראה דוקא א״ר לכ״ע אבל היכא דיש מחלוקת בין הפוסקים אי הוי א״ר או ר״ק אין מוציאין מהלוה אי תפס » (ש״ך יו״ד קס״א ס״ק ד)
One then sees what the Rosh’s position costs and what it yields. It costs: the borrower may not take the law into his own hands. It yields: neither may the lender, and the Shach will say so on seif 5 — a lender who returned and then seized again is a thief, and there the court does descend into his property.
« נראה דאם כבר החזיר הרבית על פי ב״ד או מעצמו ואח״כ חזר ותפס משל לוה בעד הרבית יורדין לנכסיו » (ש״ך יו״ד קס״א ס״ק ח)

5. יוצאה בדיינים — coercion, or collection?

Seif 5 says two things that seem to contradict each other.

« רבית דאורייתא שהוא בדרך הלואה בדבר קצוב יוצאה בדיינים » (שו״ע יו״ד קס״א:ה)
« שהיו כופין ומכין אותו עד שתצא נפשו אבל אין בית דין יורדין לנכסיו » (שו״ע יו״ד קס״א:ה)
קושיא. If it “comes out through the judges”, why does one not descend into his property, as for any debt? And if one does not, in what sense does it come out?
תירוץ — the Beit Yosef’s answer, in the name of the Rashba and the Ran. This is not an execution: it is the coercion a court applies to bring about the fulfilment of a positive commandment.
« דהא דאמרינן יוצאה בדיינים היינו לומר דכופין אותו משום מ״ע דוחי אחיך עמך ומכין אותו עד שתצא נפשו כדי שיקיים המצוה אבל אין ב״ד יורדין לנכסיו » (בית יוסף יו״ד קס״א)
« כדין שאר מצות עשה דכתיב וחי אחיך עמך » (ש״ך יו״ד קס״א ס״ק ז)
יסוד. The return of interest is not the payment of a debt: it is the performance of a mitzva. Three consequences follow, and they occupy the rest of the siman.

(a) No seizure of property — the person is coerced, as for any positive commandment. (b) The Taz infers that a claim by the borrower is required:

« נראה דוקא אם תבעו וראיה מדברי רש״י פרק הרבית » (ט״ז יו״ד קס״א ס״ק ג)
« דכיון שאין כאן תביעה מן הלוה אין שום כפייה מהב״ד על המקבל הרבית להחזירו » (ט״ז יו״ד קס״א ס״ק ג)

(c) And if the borrower has died, the Dagul Mervava wonders whether the obligation subsists: the commandment is וחי אחיך, and the dead will not live by that money.

« כיון שעיקר חזרת רבית הוא משום וחי אחיך אהדר לי׳ כי היכי דיחיה וכיון שמת הלוה לא יבא לחיותו » (פתחי תשובה יו״ד קס״א ס״ק ו)
מחלוקת. The Taz’s thesis is contested. The Panim Meirot and the Knesset HaGedola oppose it; the She’ilat Yaavetz holds it true at least where the borrower had already waived.
« פנים מאירות ח״ב סי׳ ע״ד שחולק עליו בזה » (פתחי תשובה יו״ד קס״א ס״ק ה)

נפקא מינה. May a creditor of the lender have the interest taken back so as to be paid out of it? According to the Taz, no — there is no claim by the borrower, hence no coercion. According to those who dispute him, restitution does not depend on a claim, and the answer changes.

The Beit Yosef had taken care to say that on the principle itself all the poskim rule that Torah interest is recovered:

« משמע דקי״ל כמ״ד יוצאה וכך פסקו כל הפוסקים » (בית יוסף יו״ד קס״א)

6. לצאת ידי שמים — an obligation, or a measure of piety?

Seif 2 rules, and the Rema’s gloss at once opens a breach in it.

« אבק רבית אינה יוצאת בדיינים ואם בא לצאת ידי שמים חייב להחזיר » (שו״ע יו״ד קס״א:ב)
« מלבד רבית מוקדמת ומאוחרת אפילו לצאת ידי שמים אינו חייב להחזיר » (רמ״א יו״ד קס״א:ב)
מחלוקת. The Beit Yosef reports both views: for the Nimukei Yosef, the Rosh and the Ramban, one who comes to discharge his duty toward Heaven must return it; the Ran reports that he need not, and the Rashba writes so of interest paid after the fact.
« דבבא לצאת ידי שמים חייב להחזיר » (בית יוסף יו״ד קס״א)
« וכתב עוד שי״א שאפי׳ בבא לצאת ידי שמים אינו חייב להחזיר » (בית יוסף יו״ד קס״א)

The Rema therefore took the second view for a particular case — and the Pit’hei Teshuva reports a decisor who takes it as the general rule:

« שפסק כדעת הפוסקים דגם לצאת י״ש א״צ להחזיר » (פתחי תשובה יו״ד קס״א ס״ק ד)
חקירה. What does “bound toward Heaven” mean here? (a) A real monetary obligation that the court simply does not execute. (b) A duty of repair that is no debt at all, of which the money is only the matter.
תירוץ — and it is the Pit’hei Teshuva who shows it. Were it a debt, one who pays believing himself liable at law would be paying what he owes, and the error would be of no consequence. The Beit Yaakov says the opposite: the recipient may not accept, and must tell the payer the truth. Therefore it is not a debt.
« ואפילו אם מחזיר לו סתמא צריך להודיע שהוא פטור מדיני אדם » (פתחי תשובה יו״ד קס״א ס״ק ג)
The same division lights up seif 7: when the court does not accept from the penitent, it has not extinguished a debt — the Rivash says so expressly, the man remains bound toward Heaven.
« כתב הריב״ש דמכל מקום הם חייבים להחזיר לצאת ידי שמים והביאוהו האחרונים » (ש״ך יו״ד קס״א ס״ק י״ג)
נפקא מינה. Must one who returns say why he is returning? According to the Beit Yaakov, yes: he must inform the other that no law obliged him. A silent restitution would suggest a debt discharged, and would make the recipient accept what he has no right to accept in that way.

7. דבר מסויים — the Perisha against the Nekudot HaKesef

Two seifim rest on one word: דבר מסויים.

« לקח רבית קצוצה ומת אין הבנים צריכים להחזיר אלא אם כן היה דבר מסויים כגון פרה וטלית ועשה אביהם תשובה ולא הספיק להחזיר עד שמת » (שו״ע יו״ד קס״א:ו)
« אם בא לעשות תשובה מעצמו להחזיר הרבית אם הוא דבר מסויים מקבלים ממנו » (שו״ע יו״ד קס״א:ז)

The Shach reports, in the name of the Perisha, that the phrase is not to be taken strictly:

« כתב הפרישה דל״ד אלא כל דבר שהוא בעין כמו שגזלו » (ש״ך יו״ד קס״א ס״ק י״א)
מחלוקת — and of a rare kind: the Shach answering himself. The Nekudot HaKesef take up this ס״ק in three stages. First a remark of edition: the note stands in the wrong place.
« יש כאן טעות בדפוס וס״ק זה צ״ל לקמן בסעיף ז » (נקודות הכסף יו״ד קס״א)

Then the substantive objection:

« מיהו לפענ״ד דברי הפרישה דחוקים דדוחק לומר דדבר מסוים לאו דוקא הוא » (נקודות הכסף יו״ד קס״א)

And finally the proof, drawn from the Rambam, who uses two different words for two different regimes:

« וכן מבואר להדיא בדברי הרמב״ם פ״ד מהל׳ מלוה וז״ל הגזלנים ומלוי ברבית שהחזירו אין מקבלין מהן » (נקודות הכסף יו״ד קס״א)

תירוץ — the reason for the distinction. And here the siman closes upon itself: what separates theft from interest is the consent of the one who gave.

The borrower’s consent already explains seif 4 — that is why dust of interest is not recovered. It now explains seif 7 — that is why only an object still there is accepted from the penitent. One principle, in two places of the siman.

The Nekudot HaKesef acknowledge that one Rishon reads like the Perisha, and say so:

« ירוחם בס׳ מישרים ריש נ״ח כתב מלוה ברבית וכן גזלנים שבאו לעשות תשובה אין מקבלין מהם ודוקא שאין הגזלה קיימת או כשאין הרבית קיימת כו׳ והיינו כדברי הפרישה » (נקודות הכסף יו״ד קס״א)

The Pit’hei Teshuva names the spring of the rule — the shameful trace — and draws from it the questions of depreciation and waiver:

« הא דאמרינן דדבר המסויים צריך להחזיר משום קלון » (פתחי תשובה יו״ד קס״א ס״ק י״א)
נפקא מינה. A man wishes to return money taken as interest. According to the Perisha, it is enough that he still has it: it is accepted. According to the Nekudot HaKesef, money is not an identifiable object: it is not accepted — and the man remains bound toward Heaven, without the court lending a hand.

8. שטר שיש בו רבית — the Ramban, Tosafot, and the “לא דק”

The braita is in Bava Metzia, and the Beit Yosef notes that all the poskim rule like the Sages.

« שְׁטָר שֶׁכָּתוּב בּוֹ רִבִּית – קוֹנְסִין אוֹתוֹ, וְאֵינוֹ גּוֹבֶה לֹא אֶת הַקֶּרֶן וְלֹא אֶת הָרִבִּית, דִּבְרֵי רַבִּי מֵאִיר. וַחֲכָמִים אוֹמְרִים: גּוֹבֶה אֶת הַקֶּרֶן וְאֵינוֹ גּוֹבֶה אֶת הָרִבִּית » (בבא מציעא ע״ב ע״א)
« רַבִּי מֵאִיר סָבַר: קָנְסִינַן הֶתֵּירָא מִשּׁוּם אִיסּוּרָא, וְרַבָּנַן סָבְרִי: לָא קָנְסִינַן הֶתֵּירָא מִשּׁוּם אִיסּוּרָא » (בבא מציעא ע״ב ע״א)
« פלוגתא דר״מ וחכמים ופסקו כל הפוסקים כחכמים » (בית יוסף יו״ד קס״א)
« שטר שיש בו רבית בין של תורה בין של דבריהם גובה את הקרן לבדו והוא שיהא ניכר שהוא רבית » (שו״ע יו״ד קס״א:י״א)

The Rema’s gloss lays down the condition, and names fifteen authorities against one:

« כגון שהוא מפורש בשטר הקרן בפני עצמו » (רמ״א יו״ד קס״א:י״א)
מחלוקת — and it bears on the reason for the condition, not on the condition itself. The Taz: the interest must be written separately, failing which the witnesses would be wicked men who signed on a forbidden matter. The Shach: on the contrary, the witnesses are not disqualified — the condition comes from elsewhere.
« דאם לא כן הרי העדים פסולים דרשעים הם שמעידים שחתמו על איסור » (ט״ז יו״ד קס״א ס״ק ז)
« וגבי אפילו ממשעבדי והעדים לא נפסלו אפילו ברבית דאורייתא דלא תשימון עליו נשך לא משמע לאינשי אלא בלוה ומלוה כן כתבו התוספות והרא״ש ורוב הפוסקים » (ש״ך יו״ד קס״א ס״ק י״ז)

The Taz concludes that on this point the Rema ruled like the Ramban:

« ובזה פסק כרמב״ן » (ט״ז יו״ד קס״א ס״ק ח)
קושיא — the “לא דק” of the Nekudot HaKesef. It is the driest phrase in the siman, and it is aimed at the Taz by name.
« לא דק דאדרבה דעת הטור וש״ע ורמ״א דלא כהרמב״ן אלא כדעת התוס׳ והרא״ש ומרדכי והג״א ושאר פוסקים דהעדים לא נפסלו בכך » (נקודות הכסף יו״ד קס״א)

And they give the true reason for the condition, which has nothing to do with the witnesses:

« וכשאין רבית מפורש בשטר מודו רבנן דלא גבי הקרן דחיישינן שמא יגבה הרבית בתורת קרן » (נקודות הכסף יו״ד קס״א)
The disagreement comes down to one question: what is the court afraid of? For the Taz, of the witnesses’ validity; for the Shach and the Nekudot HaKesef, of the confusion of principal with interest. It is from this second fear that the whole seif proceeds — and it is what explains why, even when everything is written separately, the deed must be torn.
« וכל מי שבא לידו יקרע השטר דחיישינן שמא יגבה בו הרבית » (רמ״א יו״ד קס״א:י״א)
« מסיק דאפי׳ מפורש בו רבית דאורייתא חיישינן לב״ד טועין » (ש״ך יו״ד קס״א ס״ק י״ט)

The Ba’er Hetev, true to his office, sets the two readings side by side without deciding:

« הרי העדים פסולים דרשעים הם שמעידים שחתמו על איסור » (באר היטב יו״ד קס״א ס״ק י״ג)
נפקא מינה. Three, at least. (a) Are the witnesses to the deed valid for other testimony? (b) Is the deed collectible from encumbered property? The Shach says yes. (c) And if the borrower admits the principal, is it collected despite the merging of the figures?
« דגזרינן שמא יגבה הרבית בתורת קרן ומיהו היכא דהלוה מודה י״א דגובה » (ש״ך יו״ד קס״א ס״ק כ׳)
« מבואר בב״י בשם מהרי״ק דהיינו מכח השטר אבל אם לוה מודה בקרן חייב לשלם הקרן » (ט״ז יו״ד קס״א ס״ק י)

The Taz deals further with the text itself, and the Nekudot HaKesef restore the priority to the Bach:

« והטעם בהגה׳ אשר״י לפי שהוא עובר בקיומו » (ט״ז יו״ד קס״א ס״ק ט)
« כבר קדמו הב״ח בזה וכן הוא להדיא בספר התרומות שער מ״ו ריש חלק ב » (נקודות הכסף יו״ד קס״א)
יסוד — what the siman will have shown, from end to end. Between the prohibition and its enforcement there is a distance, and that distance is not a defect of the law: it is its structure. Seif 1 brings it to light (a prohibition without recovery), seif 2 names it (dust of interest), seif 5 gives its reason (a mitzva, not a debt), and seif 11 makes of it a rule of drafting — for whatever a deed does not say clearly, the court will refuse to collect.
