Siman 160 — The severity of the prohibition of interest, and how far one must guard against it

Twenty-three seifim — the Shulḥan Arukh announces it itself: ובו כ״ג סעיפים. This is the siman that founds the whole block on lending at interest, which runs to siman 177: not a single case, but the categories every following siman will use — how many prohibitions, who transgresses them, what is recovered in court and what is not, and how far vigilance must reach when nothing has been stipulated. One must be careful about interest, and several prohibitions were stated concerning it. The siman opens not with a definition but with a count: this is not one sin but a bundle — and the mishna distributes its prohibitions over five people.

Who transgresses the prohibition of interest — the lender alone?

No. The seif names four people, the mishna counts five, and the Shach adds a sixth. The lender transgresses them all — six according to the Rambam; the borrower three, and only in Torah-level interest, as the Rama’s gloss expressly states; the guarantor and the witnesses one; the scribe is added by the Sages in the mishna; and the Shach joins to them the broker and anyone who assists either party, under “before the blind”. What is the difference between רבית קצוצה and אבק רבית?

Fixed interest is that which was cut and stipulated in advance — seif 14 defines it explicitly. It is forbidden by the Torah, and the court extracts it from the lender and returns it to the borrower. Dust of interest is what resembles interest without having been stipulated: it is rabbinically forbidden, and it is not recovered in court — neither from the lender nor from the borrower. Note: “dust” does not mean “light”. Seif 6 lays down a full prohibition, and ends with those two words. For the application to your situation, consult your Rav.

May the borrower give a little more of his own accord, as thanks?

Seif 4 forbids precisely this case: nothing was stipulated, the borrower gives of his own accord at repayment, and does not say it is for interest. The Shach explains why: wherever the surplus can be attributed to the loan, it looks like interest, and that is enough. The Ḥavot Daat is lenient only after the fact — one who has already received and later discovered the surplus need not return it; accepting it remains forbidden. A greeting, a favour, a piece of information: is that really interest?

Yes, and this is what the mishna calls רבית דברים. The verse says “interest of anything that is lent at interest”, and the baraita concludes that even speech is forbidden. Seifim 10 to 12 give three forms: teaching the lender or his son, greeting him first, asking him for information. The test is constant: what was already done before the loan continues, what begins with it is interest. Seif 7 adds that what is seen — dwelling in his courtyard, using his servants — is forbidden in any case. For the application to your situation, consult your Rav.

May one invest the money of a communal fund or of orphans?

Seif 18 permits, for orphans’ money, for a fund consecrated to the poor, for a Talmud Torah or for the synagogue, all rabbinic interest — never fixed interest. The Rama’s gloss calls the contrary practice מנהג טעות, and the Shach testifies that he never met the lenient custom in any place he was. The Noda BiYehuda explains why and describes the form in which he himself acted: a written investment contract expressly stating that the money is orphans’.
