1. The axiom: a debt in kind has no amount
The starting point:
A debt of a hundred coins is worth a hundred on the day it is contracted and on the day it is paid. A debt of a se’ah of wheat is worth four on the first day and five on the second — or three. A claim denominated in a commodity is a claim without an amount.
Hence the axiom: the whole of siman 162 consists in giving an amount back to a debt that has none. Three devices achieve it, and everything else follows.
The two sentences that carry the whole siman:

2. The 3 reflex questions
1. What is being lent? A current silver coin — nothing to discuss, it is permitted. Anything else — וכן כל דבר — and the question arises.

4. The three ways out, and what each repairs

The safest of the three is the first. It depends neither on what the borrower owns, nor on the state of the market, nor on what the parties know: it transforms the debt itself. It is also the one Hillel always required, and the Rambam gives it as the default rule — לא ילוה אותן עד שיעשה אותן דמים.

The mechanism, and its extension to any quantity:
The commonest trap: thinking that “having the means to buy” equals “having”. The Shach expressly excludes it, and the decisors agree. The Taz alone, at ס״ק ב, comes close — but for the gold coin, not for produce, and the Baer Hetev at once notes the difficulty.
6. שער שבשוק — two conditions, and one clause that voids it

The reason for this permission, and two extensions from the Taz:
The clause that voids it: if the lender stipulates that he will not accept payment before the date. The Baer Hetev adds that he need not even mention a rise — refusing early payment suffices. And the יש לו permission withstands it.
7. The aris — a test of fact, not of status

The test is not “sharecropper or not”, it is “dismissible or not”. Where the sharecropper must provide the seed, the owner may dismiss him so long as he has not: the advance remains an advance on the division. Where the owner provides it, once the sharecropper is installed he is no longer dismissible — and the advance becomes a loan again.
8. The litigation: who proves what

The Taz explains why proof is needed here, whereas elsewhere a deed suffices to swear and collect; the Nekudot HaKesef find his answer forced and give a simpler one:

10. Golden rules, mnemonic, traps and flash card
Five golden rules
- A debt in kind is forbidden so long as it has no amount. Fixing the cash value makes it lawful.
- Coin is excepted because it measures and is not measured — but only so long as it is current.
- Owning a little suffices for much; owning the means to buy suffices for nothing.
- The market rate replaces ownership only if it is fixed and both know it.
- The prohibition being rabbinic, it is not repaired before a court — which makes prior care all the more necessary.
Mnemonic — three questions. Did you price it? (עשיית דמים) · Does he have some? (יש לו) · Is it sold in the market? (שער שבשוק). In that order.
The classic traps
- Thinking that an operation with no stipulated profit must be lawful. Here nothing is stipulated and it is nonetheless forbidden.
- Confusing “he can afford it” with “he has it”. The Shach (ס״ק ה) expressly excludes it.
- Thinking an option clause protects the lender. It exposes him: it is the gloss’s קרוב לשכר ורחוק להפסד, made worse per the Pitchei Teshuva.
- Applying the sharecropper’s regime to any farm worker. The test is the power to dismiss him, not his title.
- Extending יש לו from one kind to another. The gloss to seif 5 forbids it even at an equal rate.
