1. שורש הפעולה — a loan of wheat, or a sale of wheat?

The seif uses the word בהלוואה: “you will have wheat with me, as a loan”. And yet the Shach and the Taz both explain the rule by the fact that it is a sale. Both classifications are in the text, and the whole chapter turns on which of them governs.

Ḥakira: what exactly is being done in seif 1? (א) A sale followed by a loan. The debtor sells his wheat to the creditor at the day’s price, the payment being the debt that is extinguished; then he keeps the wheat and owes it. Then the first condition is that of a sale: the goods must exist, in full. (ב) Simply a loan of wheat. The money debt is converted and we are exactly in siman 162 — in which case a drop should suffice, and a market rate as well.
The Shach and the Taz decide for (א) — and they do so by comparison Both put the question in the form: “why do we not say here what we say at siman 162?”, and both answer with the same word — במכירה.

Nafka mina (1) The quantity required: the full measure on (א), a drop on (ב). The seif itself decides, with כשיעור מעותיו. (2) The market rate: useless on (א) — a sale bears on the thing, not its price — sufficient on (ב). The seif decides again, forbidding אפי׳ יצא השער. (3) And yet the seif writes בהלוואה: what is born of the operation is indeed a debt, and that is why the Shach (ס״ק ד) rejects the reverse device — lend first, convert later.

The difference between the two simanim rests on a property of the יש לו of siman 162: it rolls. The Taz describes that movement better than anyone, and in describing it he shows why it cannot occur here.

What the Taz describes exactly A drop is counted as made over to the lender against the drop lent. He therefore now has two, and borrows on both; then four. The base grows with the loan itself. Nothing of the sort in a sale: what is sold is sold, and a sale does not create the goods it needs.

Nafka mina A debtor who owns enough to cover half the debt. On the mechanism of siman 162 the half would generate the whole; on the rule here, the conversion holds only for what he has. The question is far from theoretical: it is the ordinary case of a supplier who has stock, but not enough.

3. אפילו לא יצא השער — Rashi’s reason, and what follows from it

The permission does not depend on the market: it depends on a transfer. The Shach and the Taz both report Rashi’s reason, and it rests on an unexpected notion — מי שפרע, the ritual curse on one who retracts from a sale not yet perfected.

Ḥakira: of what kind is the creditor’s acquisition? (א) A real acquisition. The wheat has passed, and only meshikha is lacking; the proof is that a seller who retracts incurs מי שפרע. The rise therefore occurs in the creditor’s estate — Rashi’s words: כי מייקרי ברשותיה מייקרי. (ב) A quasi-acquisition, sufficient for interest alone. Nothing has passed in the law of property; simply, the undertaking is firm enough that the price is no longer an exposure. The Taz indeed adds a second motive — אוזולי קא מוזיל גבי, the seller gave him a keen price — which is not a motive of acquisition at all.
Nafka mina The wheat perishes before delivery. On (א) it perished in the creditor’s hand and he loses his claim; on (ב) the debt survives. And likewise if a third party seizes it. The seif does not decide — but the reason one adopts does.

4. ואם לאו אסור — does money count? the Taz alone against all

This is the most disputed question in the siman, and it has a rare feature: the one who argues for leniency himself refuses to draw a practical consequence from it.

The two camps The Shach, with the Beit Yosef, the Darkhei Moshe and the Bach: wheat is needed, money does not count. The Taz: Rashi writes “he has nothing in hand with which to buy”, the Rosh writes explicitly “he has neither money nor wheat”, the Tur puts in the debtor’s mouth “I have no money”, and the gemara itself has him answer “I have wheat” — which presupposes he has no money. Hence money would have sufficed.

The difficulty the Taz must first remove If money suffices here, why does siman 162 permit on the market rate alone even when the borrower has nothing? The answer is the Rosh’s, and it is the key to the pair of simanim.

And the conclusion, which is not one The Taz completes his demonstration and stops short: what I have written, he says, is for theory and not for practice, so as not to be lenient against a stringent view. The Baer Hetev records both positions and that reservation — and that settles the matter.

Nafka mina (1) A debtor liquid in cash but with no stock. Per the Shach the conversion is forbidden; per the Taz’s theory, permitted. In practice the Taz’s own reservation closes the door. (2) A debtor with neither: forbidden for all, and the only case where both camps agree on the outcome. (3) And the reading of the Rambam decides indirectly: he writes אותו המין, which aims at the kind and not at the means.

5. מעמידין מלוה על גבי פירות — Rava’s three lessons, and the Ran’s threshold

Rabbi Oshaya’s beraita does not merely give the rule: Rava draws three principles from it, and all three are found, one by one, in the three seifim of the siman.

One principle per seif מעמידין מלוה על גבי פירות grounds seif 1: a debt may be stood upon produce, and the objection “it is not like an issar that came into his hand” does not hold. הוא דיש לו is the condition, and it is the entire seif. מה לי הן מה לי דמיהן permits the cascade of seif 2 — wheat may be counted in wine — and it returns at seif 3 to decide whether one may pay in money what was owed in produce.
The Ran’s threshold: what tips the balance The Ran, reported by the Beit Yosef and taken up by the Taz, distinguishes by the origin of the money. If the money had not been lent but paid for the wheat, one may then price the wine without having any — it is produce against produce. The condition is not to convert the wheat into a sum: once it is זוקף into a money debt, one falls back into the regime of the loan.

Nafka mina The same financial product, built two ways. (1) The client pays in advance for a delivery at the day’s price, then converts his wheat claim into a wine claim though the seller has no wine: permitted, if the wheat remains the support. (2) The client lends, and the debt is then converted: forbidden without goods, and forbidden too to stipulate in advance that failing payment produce will be taken at the day’s rate. One economic outcome, two regimes — and the difference lies in the first act.

6. הערמת רבית — its nature, and what the court does with it

Rav Safra’s beraita uses two words which, side by side, say everything: מותרין — permitted — and ואסור לעשות כן — and it is forbidden to do so. The question of the chapter is how much that second prohibition weighs.

Ḥakira: is ha’aramat ribbit a prohibition, or a matter of conduct? (א) A prohibition of a lower degree than avak ribbit. Nothing was taken that was not due; the transaction is faultless in its elements, and only its shape is prohibited. Then, once done, there is nothing to return — and that is exactly the Rambam’s word: שאפלו אבק רבית אין כאן. (ב) A species of avak ribbit. The shape is what counts: a man received ninety and returns a hundred, and that fact is not erased because the steps were lawful. That is the position of the Ramban and the Rosh, which the gloss reports.
Three voices, and a conclusion from the Beit Yosef The Mehaber, following the Rambam, writes that the creditor recovers a hundred at law. The Tur reports the Ramban and the Rosh: it is avak ribbit, and nothing is extracted, neither from borrower to lender nor from lender to borrower. The gloss sets both views side by side. And the Beit Yosef, in the last line of his commentary on the siman, decides: since the Rashba agrees with the Rambam, so we hold.

Nafka mina (1) Does the court make the ten be returned? Rambam and Beit Yosef: no, the creditor keeps a hundred. Ramban and Rosh: nothing moves, in either direction. (2) The Shach (ס״ק י) adds a consequence that holds on both views: even on the stringent view the debtor may pay in wheat — he simply cannot be compelled to, for that would be a way of extracting from him what one cannot take.

7. התנו מתחילה — the degree, and the dispute over the interval

The gloss adds two things: what the operation becomes if the buy-back was agreed in advance, and that even payment in produce no longer saves it. Two Acharonim at once qualify, each from a different side.

The Bach qualifies the word, the Taz the moment The Bach: the decisors’ language suggests a likeness of characterised interest, not characterised interest itself — on which view the court makes nothing be returned. The Taz: the seif’s prohibition bears only on an operation done at one stroke; after an interval, the buy-back is a complete leniency.

The Nekudot HaKesef refuse the Taz — and the argument is exact The Taz rested his leniency on siman 174. The Nekudot HaKesef answer: there it was a sale, and the buyer genuinely consumes the produce; here the man began by asking for a loan, and those words are not erased by time. The shape remains, and with it the ha’aramat ribbit — or the avak ribbit per the Ramban.

And the Chatam Sofer tightens further The Pitchei Teshuva reports from him a reading of the seif: the words כמו שהוא השער are not descriptive but restrictive — at the rate, and not below it. The seif therefore assumes the wheat was given at its price; had it been given below, the debate would fall away.

Nafka mina A sale and a buy-back a week apart, in a setting where the first act was a request for a loan. Per the Taz: a complete leniency. Per the Nekudot HaKesef and the Baer Hetev who reports them: the ha’aramat ribbit remains. The question is not how much time separates the two acts — it is whether the initial words still bind them together.

8. יסוד הסימן — why money lent first hardens everything

The seven chapters come back to one fact. In siman 162 the commodity was lent; here money was lent, and the commodity comes only afterwards. That simple order changes three things.

The yesod A money loan already made is a fact that does not erase itself. Everything that comes after bears its mark: the conversion must rest on real and complete goods, no rate replaces the goods, and a buy-back-at-less shape remains forbidden even if each of its steps is lawful. The last line of the Nekudot HaKesef says it in a few words — דא״ל תחלה הלוני מנה: because he began by saying “lend me a maneh”.
And this prepares the rest of the block. Siman 173 will deal with what may be agreed upon goods, siman 175 with פוסק על שער שבשוק in its own right, and siman 177 with the arrangement that lets capital work without lending — the heter iska. Our siman is the point at which one sees clearly why such arrangements are needed.
