A hundred coins were lent. Meanwhile the sovereign struck a new, heavier coinage. The borrower returns a hundred coins — but those hundred are no longer the same. Has he returned more than he received, and has the lender thereby taken interest? The siman is a single seif, and its answer turns on one distinction: does the change come from the coin, or from the market?

1. The text of the Mehaber — the single seif

The siman has only one seif — the Shulhan Arukh says so itself: ובו סעיף אחד. But that seif contains six propositions of the Mehaber and four of the gloss, and each settles a distinct case. We therefore read it clause by clause.

The seif — the full text

דין המלוה על המטבע והוסיפו עליו. ובו סעיף אחד:

Title of the siman: the law of one who lends on the coin and it was added to; and it contains a single seif.

One who lends his fellow on the coin, and its weight was increased: if produce became cheaper because of the increase, he deducts for him the measure of the increase, even if they added to it any amount at all. And if produce did not become cheaper because of the increase, he deducts nothing, but gives him of the coin current at that time. When is this said? When they added up to a fifth of it — for instance, if its weight was four and they made it five; but if they added more than a fifth, he deducts for him the whole increase, even though produce did not become cheaper. And the same law applies to one who lends on the coin and it was reduced.

Gloss: and see in Choshen Mishpat siman 74 from when he may return the coin he lent him, even though it has been withdrawn. And if produce became cheaper because of the new coin and they did not add to it, he gives him the new coin (gemara). And where a new coin was made and we do not know whether a fifth was added or subtracted, we rely on non-Jewish craftsmen expert in the matter, when they speak unguardedly, or on the public officers appointed for it (Beit Yosef in the name of Sefer HaTerumot). And if the king decreed that whoever pays shall pay in the new coin, we follow the king’s decree, for the law of the kingdom is law; and there is in this neither interest nor the prohibition of theft (Beit Yosef in the name of the Ramban, and see ס״ק ח) and see Choshen Mishpat siman 74.
Two words deserve notice in the text. The gloss’s cross-reference appears, in the edition we copy, as בח״ה; the Shakh, for his part, writes explicitly that the reference is to Choshen Mishpat, at the end of siman 74. We copy the spelling as it stands and give the reference as the Shakh reads it.

The whole rule lies in two words: מחמת התוספת. The Mehaber does not ask whether prices fell; he asks whether they fell because of the added metal. A fall due to the market — a good harvest, an abundance — gives rise to no deduction at all, and the Shakh says so plainly at ס״ק ג. The debt bears on the coin, not on what it buys.

The threshold of a fifth is no arbitrary indulgence: it is the cost of recasting. One who wished to melt the new coins down to make old ones would lose, in the waste of smelting and the smith’s wage, about a fifth — so that below that threshold the surplus metal enriches no one. The Rosh says so, and the Beit Yosef reports it.

2. Background — the sugya, the Tur, the Beit Yosef

The seif is the shaping of a single question put by Rava to Rav Hisda, in the chapter הגוזל עצים of Bava Kamma. The question before it already concerned a coin withdrawn from circulation:

He said: yes. He said: even if it is like a platter? He said: yes. But produce becomes cheaper! Rav Ashi said: we look — if the fall is due to the coin, we deduct; and if it is due to the market, we do not deduct.
Rav Hisda’s two answers — “yes”, “yes” — first say something radical: the debt bears on the coin, however outsized it has become. Only afterwards, on the objection והא קא זיילין פירי, does Rav Ashi introduce the one limit: when the change in the coin itself makes prices fall, there is a real gain, and it is deducted. The seif takes up exactly that division.

The Tur orders the matter and adds an extension the Mehaber does not take up:

The Beit Yosef gathers three reasons for the threshold of a fifth, and one question of restitution:

And so wrote the Rashba in a responsum, adding another reason: because it is established for the Sages that even within a given minting there are coins heavier by up to a fifth. And the Mordechai wrote that the borrower’s ordinary intention is thus: that if the coinage changes, nothing shall be deducted for him up to that measure. […] If the increase was more than a fifth, or produce became cheaper because of the coin, and he transgressed and accepted it: the Sefer HaTerumot writes that some say it is fixed interest and some that it is dust of interest, and that it is not taken back from him; and the Rambam’s view, in chapter 6, is like the one who says it is dust of interest.

And on the gloss, the Beit Yosef gives the two passages that ground it:

The Ramban’s sentence reported by the Beit Yosef is the key to the last member of the gloss: without the royal decree the increment would be not interest but theft — since it is exacted against the will of the one who pays. But the law of the kingdom makes the exaction lawful; so neither remains. That is why the gloss writes ואין בזה לא משום רבית ולא משום איסור גזל — two prohibitions set aside, not one.

3. The vocabulary — to be laid down once and for all

מַטְבֵּעַthe minted coin. A piece of metal whose weight and fineness are guaranteed by authority. The whole difficulty of the siman comes from a coin being at once a quantity of metal and a unit of account: the debt bears on the unit, but interest is measured on the metal.
נִסְכָּאbullion. The metal apart from any minting. The Rosh measures the borrower’s gain by asking what would remain if the new coin were melted down: and almost nothing would remain, because recasting costs about a fifth.
טִיבְעָא · תַּרְעָאthe coin · the market. The two possible causes of a fall in prices, and Rav Ashi’s whole ruling lies in separating them: אי מחמת טיבעא זיל — we deduct; ואי מחמת תרעא זיל — we do not. In the language of the study hall this is the question of yoqra ve-zola, dearness and cheapness: a movement in the price of things is not a movement in the debt.
חוֹמֶשׁa fifth. The threshold, and it is twofold: below it, no deduction at all even though the metal has increased; above it, deduction of the whole increment — and not merely of the excess, as the Taz makes clear at ס״ק ב.
מְסִיחִין לְפִי תֻּמָּןthose who speak unguardedly. The mode of proof adopted by the gloss when it is not known by how much the coinage changed: two experts are questioned separately, outside any judicial setting, so that they have no interest in shaping their answer.
עַרְכָּאוֹתthe public officers. The officials appointed over the coinage. The gloss grants them probative force here because they answer for their office — not because one defers to their halakhic judgement.
דִּינָא דְּמַלְכוּתָא דִּינָאthe law of the kingdom is law. The principle by which the gloss settles the case where the sovereign has legislated on the mode of payment. The Shakh, at ס״ק ח, gives it the longest demonstration in the whole siman, and concludes that monetary matters fall under it without dispute.
רִבִּית קְצוּצָה · אֲבַק רִבִּיתfixed interest · dust of interest. The first is of the Torah and is recovered in court; the second is rabbinic and is not. The question arises here for one who received without deducting what he ought to have deducted: the Beit Yosef reports both views, and the Rambam holds it to be dust of interest.

The table reads in two invisible columns. The first four rows bear on the metal — what the coin weighs. The last three bear on the law — who may establish the fact, and what the sovereign may decide. Between them one row is decisive: that of the market, which never gives rise to a deduction.

The Shakh — eight entries

ס״ק א — which kind of loan is meant

« כלומר שמלוה לו בענין שחייב ליתן לו המטבע היוצא ועל הדרך שנתבאר בחושן משפט סוף סי׳ ע״ד » (ש״ך יו״ד קס״ה ס״ק א)

summary: the Shakh begins by noting that the source cited for the dissenters does not say what is attributed to it — the Rosh does not write that, and the Rivash writes expressly the opposite. Then he gives two grounds for his conclusion: first, the Rama himself holds elsewhere that the law of the kingdom applies in every matter; second, even those who restrict it to taxes and levies attached to land concede that monetary affairs fall under the same rule. His conclusion is plain: in matters of coinage the law of the kingdom is law — and such is the law.
ס״ק ח is a textbook case of source-checking. The Shakh does not argue with the reported position: he goes and reads the cited responsa, finds that one says nothing of the kind and the other says the opposite, and notes it — וצ״ע. The practical conclusion comes afterwards, and rests on two independent grounds.

The Taz — three entries

summary: the Beit Yosef, in the name of the Rosh, gives the reason — there is no gain in respect of bullion, for if he returned it to bullion he would lose the fifth in the waste of smelting and the smith’s wage. The Derisha objects: but had he melted the silver of his own loan he would have lost as much! and answers that the borrower may say: I would not have melted my silver, I would have spent it as it was. The Taz writes that this does not seem right to him — why treat the old coin as intact and the new one as melted? He also dismisses the Levush, who opened with the Rosh’s reason and closed with the Rashba’s. And he reconstructs the gemara’s real difficulty: the borrower would say that from the new coin he could remake the old one and keep a piece of silver — and the answer is that the smelting and the smith’s wage would eat up the whole gain.

ס״ק ב — beyond a fifth, he deducts the whole

« ולא סגי בנכוי עד החומש דכיון דחייב לנכות מנכה את כולו דוגמא לזה איתא בהמוכר פירות ובח״מ סי׳ רכ״ט אם בא לנכות מנכה את כולו » (ט״ז יו״ד קס״ה ס״ק ב)
summary: and it does not suffice to deduct up to the fifth, for once he is bound to deduct he deducts the whole; a like case is found in the chapter HaMokher Perot, and in Choshen Mishpat siman 229: once he comes to deduct, he deducts the whole.

ס״ק ג — the Tur extends from loan to trade

« בטור סיים וכן הדין אם נושאים ונותנים כו׳ פי׳ דלאו דוקא דרך הלואה אלא הוא הדין דרך משא ומתן » (ט״ז יו״ד קס״ה ס״ק ג)
« וכלל בזה שני דברים האחד אם הוסיפו או פחתו על המשקל דהיינו שהזקק ניתוסף או נפחת והשני שנעשה שינוי לענין עירוב עם נחושת » (ט״ז יו״ד קס״ה ס״ק ג)
summary: the Tur concluded “and so too if they trade” — that is, not only in a loan but also in ordinary trade; and he included two things there: first, if weight was added or removed, that is, if the fine silver was increased or diminished, and second, if a change was made as to the alloy with copper.

The Nekudot HaKesef — one entry, and it defends the Derisha

The Nekudot HaKesef are the Shakh’s notes on the Taz. Here they aim at ס״ק א: the Taz had found the Derisha unintelligible. The Shakh answers that the Derisha’s text was corrupt, gives the correct reading, and concludes that there was nothing to object to.

« כן צ״ל וכ״ה בדרישה וגם דעת הדרישה כמו שפירש הוא ואין כאן השגה עליו ודו״ק » (נקודות הכסף יו״ד קס״ה)
summary: so must one read, and so it is in the Derisha; and the Derisha’s view is indeed as he himself explained, and there is here no objection against it.
The note is short and its bearing large: half of the Taz’s long ס״ק א is built on a faulty reading. The Nekudot HaKesef do not refute the Taz’s reasoning on the gemara — they withdraw the objection that served as its starting point.

The Pithei Teshuva makes only two cross-references here, and both to responsa. That is a sign that the rule of the siman was not contested after the Shakh — but that its application to real currencies went on raising questions, century after century.

6. The Rambam — הלכות מלווה ולווה, chapter 4

The Mehaber’s seif here is almost a word-for-word reproduction of one halakha of the Rambam. Comparing the two texts is instructive: the Mehaber adds nothing, he only omits the case of the ketuba.

summary: one who lends his fellow on the coin, and likewise one who writes for his wife in her ketuba a known coin whose weight he specified, and its weight was increased: if produce became cheaper because of the increase, he deducts the measure of the increase, even if they added any amount at all; and if it did not become cheaper because of the increase, he deducts nothing, but gives him of the coin current at that time. When is this said? When they added up to a fifth, for instance if its weight was four and they made it five; but if they added more than a fifth, he deducts the whole increase, even though produce did not become cheaper. And the same law applies to one who lends on the coin and it was reduced.
The Rambam’s mention of the כתובה is no detail: it shows that the rule is not peculiar to a loan. It is a general rule about obligations denominated in coin, of which a loan is only one case — the one where the difference can be read as interest. The Taz observes this in his own way at ס״ק ג, extending the rule to ordinary trade.

Note the siman’s address in the Rambam: the simanim of this block refer to הלכות מלווה ולווה, and this one precisely to chapter 4, halakha 11. Chapter 6, which defines אבק רבית, serves only to characterise the case where one did not deduct what was due.

7. Contemporary practical cases

Case 1 — A debt denominated in a currency that has been replaced

This is the case of the seif in its most direct form. The starting principle is firm: the debt bears on the coin, and one pays ממטבע היוצא באותה שעה. The question is never “what is it worth today?” but “does the change come from the coin or from the market?”. Ask your Rav.

Case 2 — Prices rose a great deal between the loan and the repayment

The seif knows only a fall due to the coin. The Shakh, at ס״ק ג, expressly excludes variation coming from the market: אע״פ שהוזלו מחמת השער … אינו מנכה לו. A change in purchasing power without any change in the money itself therefore does not belong to this siman — and what the halakha makes of it elsewhere is a wholly different question. Ask your Rav.

Case 3 — The authorities laid down by law how old debts are converted

This is exactly the hypothesis at the end of the gloss. The Ramban, reported by the Beit Yosef, sets aside both prohibitions: not interest, since the increment is exacted against the payer’s will, and not theft, since the law of the kingdom is law. And the Shakh concludes at ס״ק ח that monetary matters fall under this principle without dispute. Ask your Rav.

Case 4 — It is not known by how much the coinage actually changed

The gloss gives the procedure: experts are questioned, separately and outside any context of litigation — במסיחין לפי תומן — or one relies on the public officers appointed over the coinage. This is a rule of proof, not of substance; it establishes the fact, after which the rule of the seif applies. Ask your Rav.

Case 5 — The creditor collected without making the due deduction

The Beit Yosef reports both views — fixed interest or dust of interest — and notes that the Rambam holds the second; the Shakh repeats the double opinion at ס״ק ב. The consequence is plain: on one view the sum is recovered in court, on the other it is not. A doubt left open by the sources is not closed on a study page. Ask your Rav.

8. Summary of Siman 165

In one sentence: a debt denominated in coin is paid in the coin that is current, and the only difference corrected is the one that comes from the metal of the coin — beyond a fifth, or below it if the metal itself made prices fall; what comes from the market is never corrected, and what the sovereign has decreed is neither interest nor theft.
