1. גוף החיוב — on what does a debt denominated in coin bear?

Rav Hisda answers “yes” twice to absurd hypotheses: even if the new coin is broad as a sieve, as a platter. The answer is not a quip: it establishes that the obligation bears on the monetary unit, not on the quantity of metal it contains.

Hakira: does the obligation bear on the coin or on its value? (א) On the coin. What was lent is a thing determined by its name — a zuz — and one returns a zuz, whatever it has become. This is the immediate reading of Rav Hisda’s two “yes”-es. (ב) On the value. What was lent is a purchasing power that the coin merely measures; naming it is a shorthand. On this reading every variation ought to be corrected — and the objection והא קא זיילין פירי would be irresistible. Yet it prevails in one case only.
Rav Ashi’s answer decides for (א), with one reservation If the obligation bore on value, every fall would be corrected; if it bore purely on the coin, none would. Rav Ashi corrects only one: the one the coin itself caused. So it is (א) — the debt is in coins — plus a rule peculiar to ribbit: the lender may not pocket an enrichment brought to him by the change in the coin.

What the division presupposes It presupposes that one can say of a fall in prices where it comes from. That is far from obvious: prices fall for a thousand reasons at once. But the halakha is not asking for an economic analysis; it asks whether the lender’s enrichment is attributable to the loan. An abundance of crops is attributable to no one; a heavier coin is attributable to the very thing that was lent.
A third case, which the gloss adds The gloss deals with a fall due to the new coin without its weight having increased — and there it says he gives the new coin. The Shakh explains at ס״ק ו that the fall then comes from the coin’s חריפות, its ease of circulation. The Beit Yosef reports the same distinction in the name of the Maharil.

Nafka mina Three causes of a fall, three regimes. The coin’s weight: one deducts. The market: one does not. The ease of circulation of a new coin of equal weight: the gloss says he gives the new coin — that is, here too one does not deduct. The dividing line therefore does not run between “what comes from the money” and “what comes from elsewhere”, but more narrowly between what comes from the metal and everything else.

Hakira: is the fifth a measure of fact or a tacit term? (א) A measure of fact. The Rosh: recasting costs a fifth, so below it there is no real gain. The Rashba: coins of one and the same minting already vary by a fifth, so below it there is no appreciable difference. In both cases the threshold describes the world. (ב) A tacit term. The Mordechai: מסתמא דעת הלוה כך — that is what the borrower had in mind. The threshold then describes nothing: it states the presumed content of the undertaking.
Nafka minot (1) A place or time where recasting would cost far less: on the Rosh the threshold should fall, on the Mordechai it does not move. (2) A perfectly regular minting, where coins no longer vary among themselves: the Rashba’s reason falls, the Rosh’s stands. (3) A borrower who had expressly said the opposite: the Mordechai’s reason no longer applies, the other two remain. The Shakh, giving all three without deciding, leaves these three cases open.

4. פלפול הט״ז — the Derisha, the Levush, and the Nekudot HaKesef’s reply

The Derisha’s question on the Rosh’s reason The Rosh says that melting down the new coin would lose a fifth, hence there is no gain. But the old coin, had it been melted, would have cost the same loss! The reasoning compares a melted coin with an intact one, and the comparison looks lame.

The Taz rejects the Derisha’s answer The Derisha answers that the borrower may say: I would not have melted my silver, I would have spent it as it was. The Taz writes that he finds no sense in it: why treat the old coin as intact and the new one as destined for the crucible? And in passing he dismisses the Levush, who mixed the Rosh’s reason with the Rashba’s.

The Taz’s teruts: reconstructing the gemara’s difficulty For the Taz, the difficulty והא קא שבח לענין נסכא does not say that the metal is worth more in itself. It says that the borrower can make, out of the new coin, an old coin just like the one he received — and a piece of silver will be left over. That remainder would be the gain. And the answer is that the remainder is eaten by the waste of smelting and the smith’s wage.

The Nekudot HaKesef’s reply The Shakh answers in one line, and does not argue with the Taz’s reconstruction: he denies its starting point. The Derisha’s text was corrupt; restored, it says exactly what the Taz himself explained, and there was therefore nothing to object to.

What is left of ס״ק א A great deal, in fact. Take away the polemic and there remains the Taz’s reading of the nature of the gain — a remainder of silver after recasting, not an appreciation of the metal — and his criticism of the Levush, which has nothing to do with the Derisha. The Baer Hetev, at ס״ק ד, retains from the Taz only that reading, and leaves the polemic aside.

5. מנכה את כולו — why the whole increase, and not the excess

Kashya: the threshold ought to be an allowance If the fifth measures what enriches no one, then even beyond the fifth the first fifth ought not to be deducted: recasting always costs the same. One should therefore deduct only the excess.
The Taz’s teruts: an all-or-nothing rule The Taz answers by a general rule of deductions: כיון דחייב לנכות מנכה את כולו — once one is bound to deduct, one deducts the whole — and he refers to a parallel case in Choshen Mishpat. The threshold is therefore not an allowance but a trigger: below it, there is no duty to deduct; above it, the duty arises and bears on the whole.

Hakira: does the deduction repair a gain, or remove a suspicion? (א) It repairs a gain. One returns to the debtor what the lender gained: the deduction should then be exactly the measure of the gain, hence the excess alone. (ב) It removes a suspicion. Once the difference has become perceptible, the whole difference takes on the look of interest and must go; the deduction is not a calculation but a restoration. The Taz decides for (ב), and the parallel he invokes from Choshen Mishpat bears him out.

6. עבר ולא ניכה — רבית קצוצה or אבק רבית?

Why the question arises here and not elsewhere Fixed interest presupposes a stipulation: כל הלואה בתוספת כל שהוא, writes the Rambam, but the increment must still have been agreed. Here nothing was agreed: it is the sovereign who altered the coin. Those who speak of fixed interest must therefore hold that the original stipulation — “you will return me a hundred” — covers in advance whatever it becomes. Those who speak of dust of interest hold that the increment was never stipulated, and is therefore mere appearance.

The Ramban’s yesod: two prohibitions, not one The Ramban reasons in two steps. First: the increment is not interest, because interest presupposes that the payer gives it — and here he pays it against his will. Then: what is exacted against the owner’s will is ordinarily theft. Finally: the law of the kingdom makes the exaction lawful, so nothing remains. Remove any one of these three steps and one of the two prohibitions is left standing.
The difficulty: the Rama reported a contrary view elsewhere In the parallel place in Choshen Mishpat the Rama reports dissenters; and their view was attributed to responsa of the Rosh and the Rivash. The Shakh went and read them.

Two independent grounds, and a conclusion The Shakh is not content with having found the citation faulty: he gives two positive grounds. First, the Rama himself holds elsewhere that the law of the kingdom applies in every matter. Second, and this is the stronger, even the restrictive view — which limits the principle to taxes and levies attached to land — must concede that coinage falls under the same rule, since there is no more royal affair than that.

Nafka mina A decree that does not expressly bear on the payment of debts. The Shakh cites the Rivash precisely on this point: it is because the king commanded expressly, and for the whole realm and not for a private individual, that his ruling is law. An administrative practice without an enactment would not have the same force.

8. יסוד הסימן — המטבע כדבר וכמידה

A coin is two things at once: an object — a weight of silver — and a measure — the unit in which one counts. So long as the minting does not change, the two coincide and may be confused. The siman treats exactly the moment when they part.

The starting point is that the debt follows the measure: one owes a hundred, one returns a hundred, ממטבע היוצא באותה שעה, even if the coin has doubled. Rav Hisda’s two “yes”-es say nothing else. But the law of ribbit adds a condition: the lender may not pocket an enrichment the loan brings him. And if the heavier coin has made prices fall, the lender gets back money more powerful than he gave — and that he owes to the very thing he lent.

Hence the siman’s line, which is highly precise: one corrects only what comes from the object. What comes from the market — a good harvest, an abundance — is not corrected, because the lender had no hand in it. And what the sovereign has decided is not corrected either, but for the opposite reason: it is no longer the lender who takes, it is the realm that imposes.
The word of the siman is not מטבע but מחמת: everything depends on the cause.
