Siman 166 runs to three seifim — the Shulchan Arukh announces it itself: ובו ג׳ סעיפים. Not one sum is added to the principal. Here interest takes the shape of work one has done, of lodging one does not pay for, of rent charged below its value. This is the siman that shows interest to be not a matter of money but of benefit drawn from the loan.

1. The Mehaber’s text — the three seifim

The siman reads in three movements, and their order is one question narrowing. Seif 1 states what a lender does not do, and what obtains if he has already done it. Seif 2 changes one thing and one only: the benefit was spoken. Seif 3 no longer speaks of the prohibition but of its judicial outcome — what the court takes back, and what it does not.

Seif 1 — what a lender does not do, and what obtains after the fact

המלוה לחבירו לא יעשה מלאכה בעבדו ולא ידור בחצרו. ובו ג׳ סעיפים:

Title of the siman: one who lends to his fellow may not have his slave do work, nor dwell in his courtyard; and it contains three seifim.

One who lends to his fellow may not have his slave do work, even if the slave is idle; he may not dwell in his courtyard for free; and he may not rent from him for less — even in a courtyard not held for rental (the edition’s gloss: meaning, one that is not set up to be rented out) and with a man who is not in the habit of renting. And if he has already dwelt there: since the courtyard is not held for rental, he need give him nothing, not even to discharge his duty before Heaven — and even if he is a man who is in the habit of renting. And according to the Rambam, even if he is a man not in the habit of renting, it is אבק רבית, and he must return it if he comes to discharge his duty before Heaven.

Seif 2 — when the benefit was stipulated

He said to him: “lend me and dwell in my courtyard” — if it is held for rental, this is רבית קצוצה; and if it is not held for rental, this is אבק רבית.

Gloss of the Rama: and this precisely where he spoke without specifying; but if he said to him “dwell in my courtyard in exchange for the loan”, then even if it is not held for rental it is like רבית קצוצה — for once he said to him “in exchange for your money”, it is as though he had rented it out to him from now (Beit Yosef in the name of the disciples of the Rashba).

And if he lent to him, and after a time demanded his debt, and the borrower said to him “dwell in my courtyard”: some say this is only אבק רבית, and some say it is רבית קצוצה — and that is where he says so to him at the moment he grants him an extension.

Gloss of the Rama: and the same holds for any interest that comes to a person without having been stipulated from the outset: this very dispute applies to it, whether it is אבק רבית or קצוצה.

Seif 3 — deducting the rent from the debt

Where it is אבק רבית: some say that even if he has not yet repaid him, and the borrower demands that the value of the rent be deducted from his debt, we do not deduct for him; and some say that we do deduct for him.

Gloss of the Rama: and the latter reasoning is the essential one (it is the reasoning of the Rosh, the Tur, Rabbenu Ephraim and the Rashba). One who received money as a loan from someone, and who also studies with his son, and stipulated with him that he give him his expenses for this — although he would give him the expense even without a loan, since he studies with his son — it is nonetheless forbidden, for this is like “lend me and dwell in my courtyard”, which is forbidden even where it is not held for rental (in the Mordechai, chapter Eizehu Neshech, in the name of a responsum of the Maharam and the Maharik, root 119); and the same holds in every like case. However, if he gives the money as a gift, and if the borrower wishes he may keep it for himself and not pay him, it is permitted — even though he pays him afterwards. One who has no need to borrow money and does so only for the lender’s benefit, and to whom the lender says: “build up this ruin for yourself, and whatever you spend on it is upon me to repay you; and as long as I do not repay you, dwell in it for free” — this is permitted, since there is no loan here at all, only an act done for the lender’s benefit (Beit Yosef in the name of the Baal HaTerumot).
Three seifim, one question asked three times. What a lender does not do (seif 1); what obtains when the benefit was spoken in advance (seif 2); and what the court does with what has already been taken (seif 3). Nowhere does the Mehaber write the reason for the prohibition — the mishnah writes it in three words.

2. The mechanism — how interest passes without a single coin changing hands

We picture interest as a surcharge: a hundred lent, a hundred and ten returned. This siman never speaks of a surcharge. It speaks of a lender who sleeps at his debtor’s house, who puts his slave to work, who obtains rent below the market price. Nothing is added to the principal, and yet the mishnah calls this interest.

The reason is that the prohibition does not bear on money but on the benefit drawn from the loan. The lender has put his money out of his own hand; whatever he receives in exchange for that waiting is a price paid for time. Whether that price is a coin, a night’s lodging or a day’s work changes nothing of its nature.

The proof lies in the Taz, and it is striking: the very same act, done the day before the loan, was not merely permitted but welcome.

And there the difficulty of the siman begins. If interest is a benefit, one must know what counts as a benefit. Two questions decide it, and the whole siman turns on them.

First question: has the lender taken something that costs? A courtyard held for rental — חצר דקיימא לאגרא — loses rent when it is occupied. A courtyard not held for rental loses nothing: its owner would have collected nothing in any case. The gemara raises precisely this distinction, and answers that it is not enough to permit.
« אִי מִמַּתְנִיתִין, הֲוָה אָמֵינָא: הָנֵי מִילֵּי בְּחָצֵר דְּקַיְימָא לְאַגְרָא, וְגַבְרָא דַּעֲבִיד לְמֵיגַר. אֲבָל חָצֵר דְּלָא קָיְימָא לְאַגְרָא, וְגַבְרָא דְּלָא עֲבִיד לְמֵיגַר – אֵימָא לָא, קָא מַשְׁמַע לַן » (בבא מציעא ס״ד ע״ב)
Second question: was the benefit spoken? A loan followed by an occupation is not the same as a loan conditioned upon the occupation. The gemara sets the two formulas against one another — הלוהו ודר בחצירו and הלויני ודור בחצרי — and the whole siman is their ordering.

A point missed one time in two. That the courtyard is not held for rental permits nothing. Seif 1 says exactly the opposite: the prohibition holds even there. The distinction serves only after the fact — to know what is recovered, never to know what is permitted.

3. Background — the mishnah, the gemara, the Tur and the Beit Yosef

The mishnah of the chapter Eizehu Neshech gives the siman in one sentence, and its reason in three words:

« הַמַּלְוֶה אֶת חֲבֵירוֹ לֹא יָדוּר בַּחֲצֵרוֹ חִנָּם, וְלֹא יִשְׂכּוֹר מִמֶּנּוּ בְּפָחוֹת – מִפְּנֵי שֶׁהוּא רִבִּית » (בבא מציעא ס״ד ע״ב)

The gemara adds the novelty: what is not paid for outside a loan is paid for once there has been a loan.

« אַף עַל פִּי שֶׁאָמְרוּ הַדָּר בַּחֲצַר חֲבֵירוֹ שֶׁלֹּא מִדַּעְתּוֹ – אֵינוֹ צָרִיךְ לְהַעֲלוֹת לוֹ שָׂכָר. הִלְוָהוּ וְדָר בַּחֲצֵירוֹ – צָרִיךְ לְהַעֲלוֹת לוֹ שָׂכָר » (בבא מציעא ס״ד ע״ב)

It then asks what Rav Nachman adds beyond the mishnah, and answers by raising the distinction of the courtyard:

« אִי מִמַּתְנִיתִין, הֲוָה אָמֵינָא: הָנֵי מִילֵּי בְּחָצֵר דְּקַיְימָא לְאַגְרָא, וְגַבְרָא דַּעֲבִיד לְמֵיגַר. אֲבָל חָצֵר דְּלָא קָיְימָא לְאַגְרָא, וְגַבְרָא דְּלָא עֲבִיד לְמֵיגַר – אֵימָא לָא, קָא מַשְׁמַע לַן » (בבא מציעא ס״ד ע״ב)

A second version of the same statement changes the case, and the gemara measures the distance between them:

« מַאן דְּאָמַר הִלְוָהוּ – כׇּל שֶׁכֵּן הַלְוֵינִי. וּמַאן דְּאָמַר הַלְוֵינִי – אֲבָל הִלְוָהוּ לָא. מַאי טַעְמָא – כֵּיוָן דְּמֵעִיקָּרָא לָאו אַדַּעְתָּא דְּהָכִי אוֹזְפֵיהּ – לֵית לַן בַּה » (בבא מציעא ס״ד ע״ב)

The page closes on a deed, not on a rule: Rav Yosef bar Chama would seize his debtors’ slaves and have them work — and his son Rava reproached him for it.

« רַב יוֹסֵף בַּר חָמָא תָּקֵיף עַבְדֵי דְאִינָשֵׁי דְּמַסֵּיק בְּהוּ זוּזֵי, וְעָבֵיד בְּהוּ עֲבִידְתָּא » (בבא מציעא ס״ד ע״ב)

The Tur restates it all in the order of the siman, and it is with him that the views take the names of their authors:

4. The key concepts of this siman

רבית קצוצה — stipulated interest Interest agreed between the parties. It is forbidden by the Torah, and the court recovers it from the lender to return it to the borrower. The Rambam gives the rule together with its opposite:
« שְׁטָר שֶׁכָּתוּב בּוֹ רִבִּית בֵּין קְצוּצָה בֵּין שֶׁל דִּבְרֵיהֶם גּוֹבֶה אֶת הַקֶּרֶן וְאֵינוֹ גּוֹבֶה אֶת הָרִבִּית. קָדַם וְגָבָה הַכּל מוֹצִיאִין מִמֶּנּוּ הָרִבִּית קְצוּצָה » (רמב״ם הלכות מלווה ולווה פרק ד׳ הלכה ו׳)
אבק רבית — the “dust of interest” What the Sages forbade lest one come to Torah-level interest. It is forbidden, but the court does not recover it: neither from the borrower to the lender, nor from the lender to the borrower.
« אֲבָל אֲבַק רִבִּית שֶׁהוּא מִדִּבְרֵיהֶם אֵינוֹ גּוֹבֶה מִן הַלּוֶֹה לַמַּלְוֶה וְאֵין מַחֲזִירִין אוֹתוֹ מִן הַמַּלְוֶה לַלּוֶֹה » (רמב״ם הלכות מלווה ולווה פרק ד׳ הלכה ו׳)

חצר דלא קיימא לאגרא — a courtyard not held for rental A courtyard its owner does not put out to rent. Occupying it costs him nothing tangible. The edition itself glosses this inside the text:
« אפילו בחצר דלא קיימא לאגרא (פירוש שאינה עומדת להשתכר) וגברא דלא עביד למיגר » (שו״ע יו״ד קס״ו:א)
גברא דלא עביד למיגר — a man not in the habit of renting One who pays no rent in any case: he would not have housed himself for money. The benefit he draws is therefore not a benefit he would have paid for. The two conditions are cumulative — the courtyard and the man — and the Shach recalls it:
« הוא חצר דלא קיימא לאגרא וגברא דלא עביד למיגר הוי אבק רבית » (ש״ך יו״ד קס״ו ס״ק ג)
הלוהו ודר against הלויני ודור בחצרי Two formulas, two regimes. In the first the loan came before and the dwelling followed; in the second the dwelling is the condition of the loan. The gemara measures the gap exactly:
« מַאן דְּאָמַר הִלְוָהוּ – כׇּל שֶׁכֵּן הַלְוֵינִי. וּמַאן דְּאָמַר הַלְוֵינִי – אֲבָל הִלְוָהוּ לָא. מַאי טַעְמָא – כֵּיוָן דְּמֵעִיקָּרָא לָאו אַדַּעְתָּא דְּהָכִי אוֹזְפֵיהּ – לֵית לַן בַּה » (בבא מציעא ס״ד ע״ב)
לצאת ידי שמים — to discharge one’s duty before Heaven What a court cannot compel but conscience can. That is where the dispute of seif 1 runs: on the first view there is not even this; on the Rambam’s view there is.
« ואם דר בו כבר כיון דחצר לא קיימא לאגרא אין צריך לתת לו אפילו לצאת ידי שמים ואפילו אם הוא גברא דעביד למיגר ולהרמב״ם אפילו אם גברא דלא עביד למגר הוי אבק רבית וצריך להחזיר אם בא לצאת ידי שמים » (שו״ע יו״ד קס״ו:א)
מנכינן ליה — deduction When the debt is not yet paid, may the borrower ask that the rent be subtracted from what he owes? All of seif 3 is this question, and the Taz gives the reasoning against:
« שאם אתה מנכה לו הוה כאילו אתה מוציא ממנו ודומה למשכנתא שבסי׳ קע״ב בהג״ה שאין לסלקו בלא מעות » (ט״ז יו״ד קס״ו ס״ק ה)
רבית מאוחרת — late interest The benefit given after repayment, on account of money that had been tied up. The Rambam defines it, and the notion returns in seif 2’s debate over the moment of stipulation:

7. The Rambam — הלכות מלווה ולווה, and not הלכות עבודה זרה

Since siman 159 the relevant Rambam has changed treatise: these are no longer the laws of idolatry but הלכות מלווה ולווה. Our siman lies almost entirely in the sixth chapter, and there the Rambam does what the Mehaber does not: he gives the general rule first, and then our case as its application.

The rule: what is stipulated is Torah law; the rest is rabbinic
