1. The axiom: interest is measured by benefit, not by loss

Nothing is added to the principal, and it is interest all the same. The whole of siman 166 lies in that paradox: the Torah does not forbid impoverishing the borrower, it forbids charging for time. Lodging, a day’s work, a reduction in rent are prices like any other.

The mishnah says it in three words, and the Mehaber does not even repeat them — he has no need of them:

« הַמַּלְוֶה אֶת חֲבֵירוֹ לֹא יָדוּר בַּחֲצֵרוֹ חִנָּם, וְלֹא יִשְׂכּוֹר מִמֶּנּוּ בְּפָחוֹת – מִפְּנֵי שֶׁהוּא רִבִּית » (בבא מציעא ס״ד ע״ב)
« ואי לא הלוה לו היה מותר דניחא למריה דההוא עבד שלא ילמוד דרך הבטלה כדאיתא בח״מ סימן שס״ג מ״מ הכא דהלוהו מחזי כרבית » (ט״ז יו״ד קס״ו ס״ק א)

2. The 3 reflex questions

Three questions to ask in order, and they suffice to place any case at all.

Was there a loan?
Where there is no loan there is no interest — that is the case of the ruin, at the end of seif 3. It is not a loophole: the Rama requires that there be truly no debt.
Was the benefit spoken?
Spoken in advance → seif 2, the regime of stipulation. Not spoken → seif 1, the regime of actual use.
Is the thing rented out?
It is → the court can act. It is not → it does not act, and the question becomes one of conscience.

The trap of seif 1. Many read “a courtyard not rented out” as a permission. It is the reverse: it is the aggravation. The clause says the prohibition holds even there. The distinction serves only afterwards, for restitution.

5. רבית קצוצה and אבק רבית — the single difference

The two terms differ neither in moral gravity nor in permission: both are forbidden. They differ in one thing only — what the court may do.

6. Seif 1: what one does not do, and what obtains after the fact

Seif 1 reads in two halves that must never be conflated.

לכתחלה — from the outset, before any use

Lechatchila — three prohibitions, and no condition at all. The slave’s labour even when idle, free dwelling, rent below value. The decisive word is אפילו: this holds even where no one loses anything.
« המלוה את חבירו לא יעשה מלאכה בעבדו אפילו הוא בטל ולא ידור בחצרו חנם ולא ישכור ממנו בפחות » (שו״ע יו״ד קס״ו:א)

בדיעבד — after the fact, once he has dwelt there

Bedi’avad — and there everything depends on the courtyard. If it is not rented out, the Mehaber first gives the view that there is nothing to return, not even before Heaven; then the Rambam’s.
« ואם דר בו כבר כיון דחצר לא קיימא לאגרא אין צריך לתת לו אפילו לצאת ידי שמים ואפילו אם הוא גברא דעביד למיגר ולהרמב״ם אפילו אם גברא דלא עביד למגר הוי אבק רבית וצריך להחזיר אם בא לצאת ידי שמים » (שו״ע יו״ד קס״ו:א)
« כלומר אע״ג דלכתחלה בכל ענין אסור מיהו אם בדיעבד דר בו כיון דחצר לא קיימא לאגרא והוא בענין שאם לא הלוהו לא היה חייב לתת לו שכר מחמת שדר בו » (ש״ך יו״ד קס״ו ס״ק ב)

7. Seif 2: what was said, and when it was said

Seif 2 poses two successive questions: what was said, and when.

What. A neutral formula — “lend me and dwell” — and the regime follows the courtyard. A formula naming the counterpart — “dwell in exchange for your money” — and it is קצוצה even on a courtyard not rented out, says the Rama, for the word made the courtyard a rented one.
« אמר ליה הלוני ודור בחצרי אי קיימא לאגרא הוי רבית קצוצה ואי לא קיימא לאגרא הוי אבק רבית » (שו״ע יו״ד קס״ו:ב)
« ודוקא בסתם אבל אם אמר לו דור בחצרי בשכר הלואה אפי׳ לא קיימא לאגרא הוי כרבית קצוצה דמאחר שאמר לו בשכר מעותיך הוה ליה כאלו השכירו לו עכשיו » (שו״ע יו״ד קס״ו:ב)
When. Stipulated at the handing over of the money: קצוצה in every view. Granted later, when the lender gives an extension: two views, and the Shach writes that most see קצוצה there.
« ואם הלוהו ואחר זמן תבע חובו ואמר לו הלוה דור בחצרי יש אומרים שאינו אלא אבק רבית ויש אומרים שהוא רבית קצוצה והוא שיאמר לו כן בשעה שמרויח לו זמן » (שו״ע יו״ד קס״ו:ב)
« וכן הוא הסכמת רוב הפוסקים » (ש״ך יו״ד קס״ו ס״ק ח)

8. Seif 3: the deduction, and its limit

Seif 3 no longer defines, it proceeds. The rent has been consumed, the debt is unpaid, and the borrower asks for the subtraction.

Two lines of reasoning stand opposed. To deduct, says the first view, is to recover — and אבק רבית is not recovered. To deduct, says the second, is not to recover: the lender holds nothing; one merely stops paying him.

« היכא דהוי אבק רבית יש אומרים שאפילו אם לא פרעו עדיין ותובע הלוה שינכה לו מחובו שיעור השכירות לא מנכינן ליה ויש אומרים דמנכינן ליה » (שו״ע יו״ד קס״ו:ג)
« שאם אתה מנכה לו הוה כאילו אתה מוציא ממנו ודומה למשכנתא שבסי׳ קע״ב בהג״ה שאין לסלקו בלא מעות » (ט״ז יו״ד קס״ו ס״ק ה)

The 5 golden rules

  1. What is received because one lent is interest, in whatever form.
  2. The absence of loss permits nothing: it decides only the question of restitution.
  3. What was said is recovered; what was not said is not.
  4. The rent of a courtyard held for rental remains due as an ordinary debt, even where the interest is not recovered.
  5. Where there is no loan there is no interest — but there must truly be no loan.

Mnemonic — ד־ק־נ

ד דיבור — Was the benefit spoken? → seif 1 or seif 2

ק קיימא לאגרא — Is the thing rented out? → קצוצה or אבק

נ ניכוי — Is the debt still running? → we deduct, says the Rama

The 4 classic pitfalls

  1. Believing that “the courtyard is not rented out” permits. It never permitted anything from the outset.
  2. Confusing unrecovered interest with unowed rent: the Shach writes that the rent remains due.
  3. Believing seif 2 concerns lodging only. The Rama expressly generalises it to any interest not stipulated at the outset.
  4. Reading the deduction of seif 3 as a right of the lender. It is the borrower who asks for it, and that is why the Rama grants it to him.
