This level sets out a ruling; it does not issue one. Siman 167 is short, but the whole contemporary regime of the היתר עסקא rests on what its two conditions mean exactly — and that is where the Acharonim part company.

באיזה אופן מותר להלות מעות בתנאי שיתעסק בו לריוח. ובו סעיף אחד:
מלוה אדם לחבירו מנה על תנאי שיתעסק בו לריוח המלוה עד שיהא שני מנים ויהיה באחריות המלוה עד אותו זמן ולכשיהיו שני מנים יחזרו שני המנים למלוה ומשם ואילך יהיה כל הריוח ללוה ובלבד שיתן שכר עמלו עד שיהיו ב׳ מנים ואם התנה עמו מתחילה אפילו בכל שהוא שהתנה לתת לו בשכר עמלו סגי: הגה והוא הדין איפכא שמלוה לו תחילה לצורך הלוה ואחר כך יעסוק בו לצורך המלוה ונותן לו (בית יוסף):

The siman does not say what interest is, nor how one lends licitly: that is settled from siman 160 onwards. It settles a question of structure: on what conditions does money handed over to be traded with for the profit of the one handing it over escape the character of a loan? Two conditions, and both are in the seif.

The siman gives a criterion, not a form. A contemporary deed is judged by what its clauses actually produce — who loses, who is paid, what must be proved — and not by its heading. Ask your Rav.

The six lines of this table are the seif itself, with nothing added. All that follows in this level is the unfolding of two of them — the second and the fourth.

3. אחריות המלוה — the condition that is not negotiable

This is where practice is decided. The Taz states the basis of the permission, then draws the consequence: whoever moves the risk destroys the permission itself.

Line of ruling. The arrangement stands so long as the loss, should it come, is the lender’s. The Taz expressly refuses the Derisha’s proposal — paying the manager to assume the risk — and the Ba’er Hetev reports that refusal plainly. The practical consequence is easy to state and demanding to keep: any clause guaranteeing the capital to the provider, however drafted, must be examined from this angle. Ask your Rav.

4. שכר עמלו — the wage, its measure and its moment

The second condition. It is brief in the seif, and its measure has been read two ways.

Line of ruling. The seif writes the initial stipulation; the Prisha, reported by the Shach and the Ba’er Hetev, dispenses with it. Where two readings coexist and the precaution costs nothing, the deed is drafted so as to satisfy both: the wage is stipulated, and it is paid. Ask your Rav.

5. תנאי שטר עיסקא — what may be written, and what may not

The Shach devotes his first ס״ק to the evidentiary clauses. He gives three rules, and the Taz adds a fourth.

Line of ruling. Two distinct limits, and a deed may satisfy one while breaching the other: the Shach’s bears on the object of the clause — capital, not profit — the Taz’s on the quality of the witnesses. A contemporary deed is therefore read twice. Ask your Rav.

6. הערמת רבית — the Levush’s device and the two Acharonim’s disagreement

The Taz ends his ס״ק with a device of the Levush, and the Shach answers him in his Nekudot HaKesef. The two great Acharonim of the siman, and they do not conclude alike.

Line of ruling. The disagreement is not about the rule — both forbid הערמת רבית — but about whether the sale is real. A divergence of that kind between the Taz and the Shach over the characterisation of a fact is not settled on a study page: it is settled on the facts, and by a Rav. It is worth noting that the Shach himself refers twice to siman 177, where the written regime of the עסקא is set out.

7. מקרים בני זמננו — contemporary cases and summary

Case 1 — An investment contract in which the capital is guaranteed

This is the siman’s central question in its commonest form. Guaranteeing the capital moves the risk to the manager; the Taz then writes פקע ממנו שם הפקדון ונעשה מלוה. Ask your Rav.

Case 2 — The manager is paid to accept the guarantee

That is exactly the Derisha’s view, and the Taz refutes it: the payment does not offset the transfer of risk, it consumes it. The Ba’er Hetev reports the disagreement plainly. Ask your Rav.

Case 3 — The contract provides for witnesses to establish a loss

Permitted on the capital, per the Shach — but the Taz requires the witnesses to really know the business. Two checks, not one. Ask your Rav.

Case 4 — The contract requires witnesses to establish the absence of profit

The Shach dismisses it in three words: שזהו רבית גמור. On the profit it is a solemn oath, not witnesses. Ask your Rav.

Case 5 — An ordinary loan carrying the same clauses

The Shach excludes it expressly: outside a שטר עיסקא, where the interest would be Torah-level, even the clause on the capital falls. Ask your Rav.

Case 6 — A purely token remuneration of the manager

The seif allows it, provided it was stipulated at the outset; the Prisha dispenses with that. The precaution is to write the stipulation in. Ask your Rav.

Case 7 — Working for your former lender after repaying him

That is the gloss’s reverse order, and the Raavad saw in it a difficulty of deferred interest. The Beit Yosef answers with a wage, however small — hence the gloss’s last three words. Ask your Rav.

Case 8 — Selling goods cheaply to the man you have just asked for a loan

That is the Levush’s device, and it is the site of the disagreement between the Taz and the Nekudot HaKesef. Ask your Rav.
