This siman is almost wholly a siman of ruling: it does not reason, it classifies. Twenty-seven cases, and one line running through them all — whose is the loan? This level follows it end to end, naming at each cut the decisor who makes it.

Note on method. The Admur HaZaken did not write a Shulchan Arukh on Yoreh De’ah: this level is not a “Daat HaRav” but a level of ruling, resting on the ש״ך, the ט״ז, the נקודות הכסף, the באר היטב, the פתחי תשובה and the רמב״ם — each cited in its place. It sets out what the decisors hold, not what should be done in an actual case. For application to your situation, consult your Rav.

Siman 168 does not say whether a transaction is interest: that was said by simanim 161 to 167. It says whose it is when a non-Jew stands in the circuit. And it says it by one question, which the Rambam formulates as a principle.

What this siman does not rule on. It treats neither היתר עסקא (siman 177), nor suretyship in itself (siman 170), nor the sale of debts (siman 173) — it expressly refers to each. Nor does it treat the prohibition of lending to a non-Jew beyond bare subsistence, which the Rambam lays down and this siman presupposes.

3. שליחות — the line of ruling, and what the Rama left standing

The line of ruling, in three propositions. (1) There is no agency for a non-Jew; but the Sages upheld it for stringency, and the Mehaber follows that view — which is why he forbids in seifim 1, 5, 6 and 9. (2) The prohibition that follows is only rabbinic, says the Shach in the name of most decisors, against the Rambam. (3) The Rama rules with the Mehaber, and lets the contrary view stand where custom followed it — three times in this siman.

In practice. The Rama’s formula — אין להקל רק במקום שנהגו להקל — is not a general permission. It is local and declaratory: it does not create the leniency, it records that it exists. Where the custom is not established, the Mehaber’s rule applies in full.
The point where the decisors unite against the Rama. The second gloss of seif 3 — permitting where the second Jew deals only with the non-Jew, the first being a mere counter — is refused by the Bach, endorsed in that refusal by the Shach, and rejected by the Taz as not being the halakha. The Baer Hetev records the consensus. In practice this branch is not relied upon.

4. אחריות — the practical rule, and the three standard clauses

The practical rule, and the one most often needed. From seif 10 onwards the question is neither intention nor circuit: it is on whom the loss falls if the borrower repays nothing. That one is the lender; the money is his; and if he is a Jew while the borrower is one too, the interest is forbidden.

The Shach, in the Sefer HaTerumot’s name, gives the definition to remember — and above all, also the definition of what does not constitute a debtor’s liability.

The surest way of shifting the burden, and the Rama gives it plainly. Let the pledge be worth the sum lent. Then the lender never needs to turn against the intermediary Jew, and the question no longer arises. The Shach puts it another way: let the lender say expressly איני משתעבד לך כלל.

Community leaders. The Rama permits by analogy to a guardian of orphans — and writes himself that there is no clear permission. The Taz explains why leniency was nonetheless adopted: the loan is for a mitzvah, and the non-Jew knows he is lending to the community. The Pitchei Teshuva reports the Chatam Sofer’s responsum on a community that borrowed to build a shelter for poor travellers, and which upheld the leniency. One limit stands firm: the interest may not be shifted onto part of the community.

5. מכר המשכון — how the היתר of seif 18 is done, and where it stops

How the היתר is done. The first Jew sells the second every right he has in the pledge, and says so: הריני מוכר לך כל כח וזכות ושעבוד שיש לי על משכון זה ואין לי עסק עמך ולא לך עמי. From then on the second has no dealings with the first: he holds a claim against the non-Jew, and the interest charged on it is a non-Jew’s.

The Rama records that in practice nothing is said and the sale is presumed, adding that such is the widespread custom.

The dispute, and it must be known before relying on the custom. The Taz refuses the Rama’s last extension — the one admitting even a condition of reconveyance — because a sale conditioned on return is no sale: פסק זה נ״ל תמוה. The Shach has exactly the same difficulty; but he upholds the custom by another route, that of the Rosh and the Baal HaIttur, and the Nekudot HaKesef restate it against the Taz.

What to take from this in practice. The custom holds because the pledge remained in the non-Jew’s power. It therefore ceases to hold once the pledge has passed into the first Jew’s estate — if he was told קנה מעכשיו, or if local usage lets him sell it after a period. In that case the express sale is required, and a sale with no obligation to reconvey. The Shach says so in his own words.

The two limits of seif 18, and they are not negotiable. (1) זקיפה: if the first Jew has already merged principal and interest into one figure, the whole has become a Jew’s money and the arrangement is unusable. (2) Credit debts: no mode of acquisition transfers a claim against a non-Jew; an express release is required, in the terms the seif gives.

6. מראית העין — when a licit transaction remains forbidden

A second prohibition, not handled like the first. In seifim 22, 23 and 24 the transaction is licit in substance — the risk is the non-Jew’s, the money is his — and it is forbidden nonetheless, because what one sees is a Jew lending to a Jew at interest. Checking licitness therefore does not suffice: one must also check what the thing looks like.

The only lifting is notoriety — and the Shach gives its measure, which is more demanding than one imagines.

In practice. Explaining the situation to the parties lifts nothing. What lifts the prohibition is that the role be publicly known: a non-Jew’s guardian over all his property (seif 24) and one whose recognised trade it is (seif 23). The Taz gives the reason, and it is common sense: where the role is known, nobody mistakes the source of the money.

7. תחבולות רשעים — the boundary, and the words that cross it

The boundary, and it is absolute. All the permissions of this siman presuppose that the non-Jew is genuinely a party. Where he is only scenery — the need is the Jew’s, the interest comes from his pocket, and he set the rate — the Shulchan Arukh uses a word it almost never uses: תחבולות רשעים היא זו. And no interest at all is taken.

The Shach says exactly where the line runs, and it is a matter of words spoken.

And a rule of conduct, which the Rama lays down in seif 13. One who builds the disguise knowing it false — who borrows in a non-Jew’s name knowing the pledge is his own — is called רשע. The Shulchan Arukh does not merely say the interest is forbidden: it names the man.

The recapitulation in six lines. (1) The question is always: whose is the loan? (2) The Mehaber follows Rashi and upholds agency by stringency; the Rama adds custom to it. (3) The prohibition that follows is only rabbinic, against the Rambam. (4) From seif 10 onwards everything follows the אחריות — and it is a debtor’s, not a bailee’s or a guarantor’s. (5) The היתר of seif 18 is a sale, with two limits: זקיפה and credit debts. (6) And nothing crosses the boundary of seif 19.
A last remark, bearing on the very reading of the siman. This siman is headed קסח-קסט: this edition treats simanim 168 and 169 together, and the Tur at 169 carries only a cross-reference. What one would look for at 169 is here.
