Siman 168 is a siman of qualification: it lays down almost no new prohibition, but asks each time whose the loan is. Yet the three instruments it uses to answer — agency, risk-bearing and sale — are each the subject of a dispute among the Rishonim that the Aharonim did not close. Nine are taken up here, and each is followed to its end.

1. אין שליחות לעובד כוכבים — the gemara states it, Rashi narrows it, Rabbeinu Tam extends it

חקירה — The question. The gemara concludes אין שליחות לגוי. Two readings are possible, and they differ not in degree but in kind. (a) It is a rule of law, cutting both ways: a non-Jew is never a Jew’s agent, neither to lighten nor to make stricter. (b) It concerns Torah agency only, and the Sages could reverse it where it would lighten. Rabbeinu Tam holds the first, Rashi the second.
« בִּשְׁלָמָא סֵיפָא, לְחוּמְרָא. אֶלָּא רֵישָׁא: כֵּיוָן דְּאֵין שְׁלִיחוּת לְגוֹי, אִיהוּ נִיהוּ דְּקָא שָׁקֵיל מִינֵּיהּ רִבִּיתָא » (בבא מציעא ע״א ע״ב)

The Shach gives the second reading its most explicit formulation, and states its mechanism: this agency is not instituted by the Torah but by the Sages, and for stringency alone.

« כלומר דשלוחו של אדם כמותו ואע״ג דקי״ל דהיינו דוקא בישראל אבל לא בעובד כוכבים » (ש״ך יו״ד קס״ח ס״ק י״א)

מחלוקת. The Tur reports the two Rishonim in one sentence, and does not name them neutrally: Rashi explains the baraita, Rabbeinu Tam explains otherwise. He then rules with the second — and the next line will draw the Beit Yosef’s objection.

קושיא — The Beit Yosef’s objection. Whence does the Tur know that this is his father’s conclusion? In his Pesakim the Rosh sets out both views without deciding; and in his responsum he writes that one cannot decide leniently.

תירוץ — The answer the Mehaber gives by his conduct. The Mehaber does not cite Rabbeinu Tam: he writes אסור in seif 6, and only the Rama adds ויש מקילין. So the Mehaber read the Rosh as the Beit Yosef reads him — without a conclusion — and followed Rashi. The Rama too rules with Rashi but tolerates the other by custom, and repeats it throughout the siman.

יסוד — The foundation, and it governs the reading of the whole siman. The Mehaber follows Rashi; the Rama follows Rashi and lets Rabbeinu Tam live. A simple map results: wherever the siman forbids, one must ask whether the prohibition rests on agency — for then Rabbeinu Tam permits, and custom followed Rabbeinu Tam. The Rama says so himself in seif 9, on lending against a Jew’s books: אין למחות ביד הנוהגין להקל.

נפקא מינה. Seif 9 gives the most concrete: a Jew hands his own books to a non-Jew to pawn with another Jew, and the lender recognises them. For Rashi it is forbidden — the non-Jew is the owner’s agent. For Rabbeinu Tam it is permitted, and even lekhatchila: הואיל ויד עובד כוכבים באמצע. The Rama reports both and does not protest against the custom.

2. והפטר — a word the Mehaber omitted, and three ways of explaining it

Seif 3 copies Rav Huna bar Manoah’s ukimta, but removes one word from it and adds another. Here are the two texts side by side.

« הָכָא בְּמַאי עָסְקִינַן – כְּגוֹן דַּאֲמַר לֵיהּ: הַנִּיחֵם עַל גַּבֵּי קַרְקַע וְהִיפָּטֵר » (בבא מציעא ע״א ע״ב)
« וכן אם העמידו אצל העובד כוכבים ואמר הניחם על גבי קרקע וכן עשה ונסתלק ולקחן השני משם מותר » (שו״ע יו״ד קס״ח:ג)
חקירה. What does the word והפטר do in the ukimta? (a) It releases from liability: without it, money laid on the ground remains at the first Jew’s risk, and the act is still his. (b) It releases nothing: it only says withdraw, do not stand there as though you might take it back. (c) It is not restrictive: laying it on the ground suffices, and the word adds nothing.

The Beit Yosef holds the third reading, and proves it from silence: neither the Tur nor the Rambam repeats the word.

קושיא — The Shach refuses, and his proof comes from civil law. In Choshen Mishpat, one who says to his debtor “throw me my debt” keeps the risk until he adds והפטר. Why should it be otherwise here?

And he sets aside the argument from the Rambam’s silence by a reasoning worth following: the Rambam did not omit the word but the whole case — because the gemara itself dismissed it as obvious and replaced it with Rav Papa’s ukimta.

תירוץ — The Taz’s reading, a third route and not a compromise. The Taz grants the Beit Yosef that there is nothing to release, and grants the Shach that the word is not superfluous. His solution: והפטר speaks not of risk but of presence. The first Jew must depart; if he remains, one cannot say he laid it down, since he could take it back.
« לא נתכוונו להפטר מן האחריות דלא אכפת לן בזה אלא לאפוקי שלא יניחנו על מנת שיחזור ויקחם » (ט״ז יו״ד קס״ח ס״ק ד)

And here is why this reading is the strongest of the three: it explains a word the Mehaber added. Both the Tur and the Shulchan Arukh write וכן עשה ונסתלק — “and he did so and withdrew.” That ונסתלק looks superfluous; for the Taz it is the exact rendering of the gemara’s והפטר. The Tur omitted nothing at all — he translated.

נפקא מינה. A Jew lays the money before the non-Jew and stays there while the second Jew takes it. For the Beit Yosef: permitted, laying it down suffices. For the Shach: forbidden, absent an express release. For the Taz: forbidden too — but for an entirely different reason, one corrected by walking away, not by pronouncing a formula. The Baer Hetev records both views against each other.

3. רבית קצוצה או מדרבנן — the Rambam alone against the majority of decisors

Seif 6 and seif 1 resemble each other feature for feature; seif 6 too forbids its last branch. But the gravity of the prohibition is not the same, and here the Rambam parts from everyone.

מחלוקת — and it is head-on. The Rambam writes רבית קצוצה: Torah interest, which the beit din extracts. The Shach writes that most decisors hold nothing of the sort: the prohibition there is rabbinic, since it rests only on the agency instituted by the Sages. And he names the Rambam.

The Shach’s position is consistent to the end, and it illuminates the whole siman. If the prohibition of seif 6 rests only on rabbinic agency, it cannot be from the Torah: the Sages do not extend a Torah prohibition, they add one of their own. He had already said so on seif 1, on the branch of the passage before the non-Jew — לא הוי ר״ק — and he specifies the line: there is stipulated interest only where the money left the first Jew’s hand as a loan.

קושיא. But then how can the Rama’s gloss on seif 1 write דהוי רבית קצוצה? And how can the Tur say as much?

תירוץ. The two cases are not the same at all, and the Shach shows it by giving seif 1 a reason that leaves no room for agency. There, the second Jew receives a loan from the first — the money comes to him from his hand, as a loan — and he then pays a surplus at the lender’s direction. The non-Jew is merely the recipient of the payment. Here, in seif 6, the loan comes from the non-Jew: nothing would be forbidden without the agency, and the agency is rabbinic.

נפקא מינה — and it is monetary. Does the beit din extract? In seif 1, yes: the gloss writes מפקינן מישראל ראשון. In seif 6, per the Shach, no — it is dust of interest, which the beit din does not extract (siman 161:2); per the Rambam, yes. And a second נפקא מינה, less visible: where the prohibition is only rabbinic, Rabbeinu Tam’s view carries the weight of a rabbinic doubt — which is precisely what allowed the custom to follow it.

4. הגהת מרדכי — a gloss of the Rama the Bach, Shach and Taz reject

The Rama adds a second gloss to seif 3, in the name of the Hagahot Mordechai. It is brief, it is broad, and the whole apparatus rejects it.

קושיא — the Bach’s, and it is simple. Seif 1 has just said that even a passage before the non-Jew does not suffice so long as the money leaves the first Jew’s hand. Here the money leaves exactly that hand, and it is permitted. The Bach concludes there is a scribal error in the Hagahot Mordechai.

The Shach not only agrees but adds two further proofs: a corrected copy of the Mordechai, and a reading of the gemara.

He begins by defending the gloss: one might say the non-Jew expressly declared the risk his own and made the first Jew his manager, so that the permission exists at the very moment of handing over. Then he turns: the gemara, expounding this baraita, found permission only in laying on the ground or taking and giving in hand — never in a manager.

The Taz’s expression deserves weighing: ולית נגר דליפרקיני׳ להא מילתא — “there is no carpenter who can take this matter apart.” It is a gemara idiom for a difficulty with no way out. And he adds that the Levush, who followed the Rama, did not plumb the depth of the matter. The Baer Hetev records the gloss’s complete rout.

נפקא מינה. The arrangement is common: the second Jew deals only with the non-Jew, and the first is no more than a counter handing him the money. For the Rama it is permitted — and even handing the interest to the first Jew is. For the Bach, the Shach, the Taz and the Baer Hetev it is permitted only if the first Jew first withdrew vis-à-vis the non-Jew, that is, if the money genuinely became the non-Jew’s again before departing. The difference is not slight: it decides every arrangement in which a single intermediary stays in the middle.

5. אחריות — where the bailee ends, where the borrower begins, and where the guarantor stands

From seif 10 onwards the siman asks only one thing. Seif 16 gives it its purest form, and seif 24 states it in a line.

חקירה — and it is the most useful technical question in the siman. What exactly makes the intermediary a borrower? (a) Bearing a loss. (b) Bearing the loss in the capacity of a debtor, that is, being liable for the value and not for the object. The difference is not theoretical: a bailee may be liable even for force majeure and still not be a debtor.

The Shach decides by the Sefer HaTerumot, and his formulation is remarkably precise in law.

יסוד. The line is not one of degree of liability but of its kind. A bailee answers for the object; a debtor answers for a sum. So long as the funds subsist in kind — כל זמן שיעמדו בעין — the intermediary has borrowed nothing, and the money remained the lender’s. That is why seif 16 lists the degrees of custody without its changing anything: אם שומר חנם שומר חנם אם שומר שכר שומר שכר.

The Shach at once applies the same rule to seif 22, and draws from it the line on the guarantor — the one that explains the Rama’s reference to siman 170.

קושיא — the Taz’s objection, and it is formidable. Suppose the intermediary guarantees only the interest: “so long as the non-Jew does not pay the principal, I pay you the interest.” He has guaranteed nothing of the principal. Is he a debtor?

תירוץ — the Baal HaTerumot’s answer, cited by the Taz. He is. For this guarantee has no term but the payment of the principal: so long as the non-Jew has not paid, the intermediary pays. He has therefore in fact guaranteed the principal — and the arrangement is the forbidden one.

נפקא מינה — and it holds for all modern finance. Three clauses that resemble one another and classify differently. (a) “I answer for these funds as a bailee, even for force majeure” — permitted: it is custody. (b) “If you find nothing of his, I shall pay you” — permitted: it is suretyship. (c) “So long as he has not paid, I pay” — forbidden: it is a loan. What separates them is not the sum at stake but the place occupied by the one who undertakes.

6. מכר או משכון — the great היתר of seif 18 and the condition that destroys it

Seif 18 is the economic heart of the siman, and its permission rests on a single word: sale.

« ובלבד שיאמר לו הריני מוכר לך כל כח וזכות ושעבוד שיש לי על משכון זה ואין לי עסק עמך ולא לך עמי » (שו״ע יו״ד קס״ח:י״ח)

The Rama lightens by one degree: the sale need not be stated, it is presumed. Then by a second degree, and there everything turns.

קושיא — and the Taz opens it with a formula all his own. If the whole permission depends on the transaction being a sale, how could a sale coupled with an obligation to reconvey remain a sale? The gemara itself says otherwise, and the Shulchan Arukh repeats it in siman 174.

The Taz’s proof is a living memory. He cites, from a responsum of the Teshuvot Maimoniyot, a case in which Rabbeinu Tam himself had to pawn a non-Jew’s pledge — and the formula he required. If a mere condition sufficed, why would Rabbeinu Tam have surrendered his right for nothing?

And yet he saves the custom — by a route entirely other than sale. The Shach cites the Rosh in the Baal HaIttur’s name: wherever the pledge was not acquired by the first Jew — that is, where the non-Jew did not say קנה מעכשיו — the pledge remained in the non-Jew’s power. The second Jew therefore receives nothing from the first’s hand: his pledge is a non-Jew’s, and the interest he takes issues from a non-Jew’s property. The permission is no longer a sale but a statement of fact.

מחלוקת — and the Nekudot HaKesef rule against the Taz. The Shach himself, in his own commentary on the Taz, sets aside the stringent conclusion and confirms the custom through the Rosh and the Baal HaIttur.

נפקא מינה. The first Jew said קנה מעכשיו to the non-Jew, or the local custom allows selling the pledge after a year: then the pledge is in his estate, and the Baal HaIttur’s reasoning falls. In that case the express sale is required — and a sale without a condition of return. The Shach says so in his own words. It is the only configuration in which the Taz and the Shach agree in demanding the full form.

7. אגר נטר — the Taz against the Levush, and the Nekudot HaKesef against the Taz

The Levush, relying on the sale of seif 18, permitted one further arrangement. The Taz reports it, then demolishes it — and it is the most closely argued page of the siman.

The Levush’s arrangement. A Jew holds a non-Jew’s pledge for a hundred and pawns it with a second Jew for a hundred and fifty; the interest he will pay the second does not exceed what the non-Jew pays him. The Levush permits: since he sold the whole pledge to the second, what he received in excess is an interest-free loan.

קושיא — and the Taz at once refuses the notion of a free loan. Had he borrowed from the second only the sum lent to the non-Jew, he would have paid nothing at all; if he pays, it is for the excess. The “free loan” does not exist: it is only a way of naming what is paid for.

And here is the proof, the most tightly built thing in the siman. The Taz goes back to Rav Papa’s טרשא: he sold his beer at the dear season’s price on credit, justifying himself by saying he lost nothing by waiting. Rav Sheshet answered him: do not follow your own account, follow theirs — had they money they would pay today’s price. From this the Taz draws the principle: foregone profit suffices to constitute a wage of waiting.

יסוד — and the Taz concludes with a קל וחומר. The טרשא is a sale, whose interest prohibition is only rabbinic, and even there foregone profit counted. Here it is a loan, whose prohibition is from the Torah. His conclusion admits no appeal.

In the טרשא, the seller sells his goods for more than they are worth at the moment — hence the interest. Here he sold the pledge: what he later takes back is not a surplus but the price of his own pledge, which he is buying back.

חקירה — and it now appears that the disagreement is not about אגר נטר. Both accept the Taz’s principle: foregone profit is a wage of waiting. They differ on a prior question — is there here a distinct transaction to be characterised? For the Taz: yes, a loan of fifty is added to the sale, and the surplus pays for the waiting on that fifty. For the Nekudot HaKesef: no, there is only a sale and its repurchase, and what is paid is a price, not a wage.
נפקא מינה. A creditor assigns a claim of a hundred for a hundred and fifty and undertakes to buy it back later at a higher price. For the Taz the arrangement splits in two, and the increase pays for the waiting on the fifty. For the Nekudot HaKesef the transaction is single and the price is a price. And note that the Shach here writes וכן המנהג פשוט — the second time in this siman that he sets custom against a reasoning he only half refutes.

8. אין זכיה לעובד כוכבים — the gemara’s last attempt, and the admission that replaces it

The gemara, having set aside agency, attempts a last route: failing agency, there may be acquisition on another’s behalf, as with a minor.

The Shach marks its practical limit: what is forbidden is to convey to a non-Jew through a third party; one route remains open, and it is simple.

קושיא — the Beit Yosef’s, and the Taz makes a whole chapter of it. The Mordechai, in the Raavya’s name, permits a Jew to tell the lender “this pledge is a non-Jew’s,” or “I convey it to you in his stead.” But if the pledge is in fact the Jew’s, how could that be permitted? And if one answers that the non-Jew acquires — the gemara has just said there is no acquisition for a non-Jew.

The Beit Yosef answers that the pledge has the status of a guarantor; the Bach answers by admission — the Jew concedes the pledge is the non-Jew’s, and admission is worth a hundred witnesses. The Taz refuses the first because the lender is in fact paid out of the Jew’s property, and the second because a lie does not lift a prohibition.

תירוץ — the Taz’s answer, and it changes the nature of the act. There was never any question of acquisition for the non-Jew. The Jew who hands over his pledge does not convey it to the non-Jew: he sells it to the lender under a resolutive condition — “if such-and-such a non-Jew pays you principal and interest, you shall return the pledge.” This is not a loan on a pledge but a conditional sale. And a sale has no need of a third party’s acquisition.

And the Nekudot HaKesef bring back the admission. The Shach maintains the difficulty is none: once the man has conceded, his concession is worth a hundred witnesses and the non-Jew acquired by it. He refers to seif 13, where the Mehaber expressly writes that witnesses avail nothing against a prior admission. One then sees the dispute running through two seifim: the force of הודאת בעל דין in matters of prohibition — and not of property alone.

For the Nekudot HaKesef the admission holds, and the lender may take the interest so long as the truth is not established; for the Taz the admission lifts nothing, and the only licit route is the conditional sale. The Mehaber, in seif 13, sides with the admission — but at once adds that if the truth becomes known the interest is forbidden again and the contriver is called רשע.

9. לא שביק היתירא ואכיל איסורא — a presumption, and the Taz’s doubt about his own age

The siman ends on a question of proof, and the rule governing it is not a rule of law but a presumption about people.

חקירה. On what does this presumption rest? (a) On probity: a Jew does not choose the forbidden when the permitted is open to him. (b) On knowledge: a Jew knows a permitted route exists, and will have followed it. The two usually coincide — but they part as soon as one doubts that the permitted route is known.

The Taz chooses the second, and proves it from a precedent the sugya of the prozbul supplies: the Rosh, he says, denied his contemporaries the presumption “I had a prozbul and lost it,” because they no longer knew what a prozbul was.

יסוד — and the Taz draws a consequence he applies to his own age. A presumption drawn from human conduct is no inert piece of law: it holds so long as the conduct is such. Where the prohibition of interest has become so common that no one heeds it, the presumption no longer carries.

מחלוקת — the Shach draws the boundary differently. He speaks not of the age but of the state of the record: the presumption operates only where nothing has been established. Once it is proved that interest was taken, no plea saves him — not even that of orphans’ money or the charity fund.

On the last branch — a lender holding a bond — the Shach leaves the question open, and says so. He sets against the Beit Yosef the principle אין אדם משים עצמו רשע, which would prevent the borrower from being believed, and ends with a צ״ע. The Nekudot HaKesef, for their part, send the Taz back to the Beit Yosef.

נפקא מינה. The lender concedes taking a surplus and asserts the arrangement was licit; the borrower denies it. By the letter of the seif the lender is believed without an oath. For the Taz the beit din must first ask him which licit route he followed, and administer an oath if the answer is unclear. For the Shach everything changes once anything establishes the taking. Three regimes of proof for a single seif — and on them the siman closes.
