שלא יוכל ישראל להיות ערב לישראל שלוה מן העובד כוכבים ברבית. ובו ב׳ סעיפים:

1. שורש הפסק — what this siman settles, and what it does not

This siman settles neither the rate nor the lawfulness of the loan itself: it settles the position of a third party. A loan at interest between a Jew and a non-Jew is lawful; the question here is whether a second Jew may attach his signature to it. What the siman does not settle is equally clear: it says nothing of a loan between two Jews, which belongs to the preceding simanim, nor of the משכנתא, which is the subject of siman קע״ב · 172.

A point of method peculiar to this siman: the answer depends on a fact outside the Torah — the order in which a creditor is paid under local law. One must therefore read the contract, and know what the creditor actually does, before concluding anything.

3. לכתחלה — what one does not sign, and the Rama’s factual condition

The rule is brief, and the permission that follows it briefer still. The whole practical difficulty is knowing whether one is within the permission.

The Beit Yosef, reported by the Shach and the Taz, teaches lekhatchila like Rashi: it is not enough that the lender may claim the borrower; he must be unable to claim the surety before him.

« וכתב ב״י דלכתחלה מורים דכל שיכול לתבוע לערב תחלה אסור עד שיקבל עליו שלא לתבעו עד שיתבע הלוה תחלה » (ש״ך יו״ד ק״ע ס״ק ב)

The Rama adds the presumption of his own time — and, in the same sentence, the condition that limits it.

« והאידנא מסתמא הוי כאילו קבל עליו הכי דסתם ערבות כך הוא » (שו״ע יו״ד ק״ע:א)
« ודוקא במקום שהמנהג כך שתובעין הלוה תחלה » (שו״ע יו״ד ק״ע:א)
In practice. Do not sign a guarantee on an interest-bearing loan without verifying two things: what the contract provides as to the order of claims, and what the creditor does in practice. A plain guarantee with a benefit of discussion falls within the Mehaber’s permission; a “joint and several” guarantee does not, and it is the ערב קבלן of whom the Shach writes that his status is that of the borrower.

4. בדיעבד — what the borrower repays, and what the court recovers

The guarantee was given, the debtor did not pay, the surety settled. Two questions, and they must be kept apart: what the debtor owes the surety, and what the court recovers of what has already passed.

« ואם עבר ונעשה ערב בעדו צריך לשלם כל הפסד המגיע לו על ידו » (שו״ע יו״ד ק״ע:א)
« אבל אינו צריך לתת רבית שנותן בשבילו דאין אומרים ליתן רבית » (שו״ע יו״ד ק״ע:א)

The Tur gives the reason for this refusal in one sentence, and R. Yitzchak Korkos held the opposite.

There remains what has already been reimbursed. Here the Rama and the Taz part company, and the split is still unresolved.

« ואי כבר פרע לו הרבית אין מוציאין מידו דלא גרע מאבק רבית » (שו״ע יו״ד ק״ע:א)

In practice. (1) The debtor must reimburse the surety everything the calling of the guarantee cost him — fees, penalties, damages — but not the interest as interest. (2) On what has already been paid, the Rama does not recover; the Taz recovers. The Beit Yosef, in doubt, leaves the money where it is. Before a beit din it is this last rule that decides in fact.

5. ערב לעובד כוכבים — seif 2 and its five clauses

Seif 2 reverses the scene and hardens the rule: a Jew lends, a non-Jew borrows, and the Jewish surety would be paying interest to a Jew. The Shach gives the reason in one line.

« וכן עובד כוכבים שלוה מישראל ברבית אסור לישראל להיות לו ערב » (שו״ע יו״ד ק״ע:ב)

The Rama opens five doors there, and each has its condition.

« אלא אם התנה עם העובד כוכבים שכל זמן שיש לו לפרוע לא ידיחנו אצל הערב אז שרי לקבל הקרן והרבית מישראל » (שו״ע יו״ד ק״ע:ב)
« ואם הישראל ערב לו בעד הקרן ולא בעד הרבית אלא יש לו ליקח הרבית מן העובד כוכבים או להיפך שערב לו בעד הרבית ולא בעד הקרן מותר » (שו״ע יו״ד ק״ע:ב)

The second of these doors — guaranteeing the principal alone or the interest alone — has been the most debated. The Taz leaves it in צ״ע; the Nekudot HaKesef answer in a way that changes the reading of the whole siman.

« צ״ע דעת רמ״א בזה דמשמע אפילו באיסור כגון שלוף דוץ ולפי הנראה שזה אסור » (ט״ז יו״ד ק״ע ס״ק ה)

And the Noda BiYehuda, reported by the Pit’hei Teshuva, sets the practical limit of the permission.

« אבל אם אין קצבה לדבר וכל זמן שלא יפרע העובד כוכבים יתחייב הערב זה אסור » (פתחי תשובה יו״ד ק״ע ס״ק ג)
In practice. Guaranteeing a non-Jew towards a Jewish lender requires at the least the Rama’s stipulation: no recourse to the surety while the debtor can pay. Guaranteeing the principal alone is permitted per the Rama, and the Nekudot HaKesef explain that this “permitted” bears on performance; guaranteeing the interest alone is admitted, per the Noda BiYehuda, only for a term and a rate fixed in advance. An open-ended undertaking, running as long as the debtor does not pay, falls outside the permission.

6. המשכון — the non-Jew’s pledge and the settled custom

The Rama’s last permission is also the most used in practice, and the most contested in theory.

« ודוקא בלא משכון אבל אם נותן לו משכון של עובד כוכבים בעד הקרן יכול לערב לו בעד הרבית דעיקר הלואה על המשכון » (שו״ע יו״ד ק״ע:ב)
« וכן עיקר לענ״ד » (ט״ז יו״ד ק״ע ס״ק ז)

The Shach attaches a distinction worth remembering: a pledge brought by a broker so that a Jew may lend upon it is not the same as a pledge already pledged to a first Jew and passed to a second.

« ודוקא כשערב לו בעד הרבית אבל כשערב לו בעד הקרן ג״כ אסור » (ש״ך יו״ד ק״ע ס״ק ח)
In practice. The practice — attested by the Shach in the Nekudot HaKesef and taken up by the Baer Hetev — permits the Jew to hand over a non-Jew’s pledge for the principal and guarantee the interest. The Bach and the Taz object where the pledge was already pledged to the first Jew: in that precise case, refrain.

7. מקרים בני זמננו — contemporary cases and recap

Case 1 — Co-signing a relative’s bank loan

The loan itself is not in question: the bank is not Jewish and interest is lawful to it. What is in question is the signature. Read the clause governing the order of claims. A benefit of discussion, or an obligation to pursue the borrower first: one falls within the Mehaber’s permission. A joint and several guarantee, where the bank chooses whom to pursue: that is the case the Beit Yosef teaches to avoid lekhatchila.

Case 2 — The guarantee was called and the surety paid everything

He may claim from the debtor everything the affair cost him — the principal advanced, fees, penalties — but not the interest as such: the Tur and the Rama refuse to tell anyone to hand over interest. If the debtor has nonetheless reimbursed the interest, the Rama does not make him return it; the Taz does; in a dispute, possession decides.

Case 3 — A fee paid to the guarantor

The Taz forbids where the surety alone signs the instrument to the lender, for at that moment he becomes the beneficiary’s creditor, and the fee then pays for the waiting on his money. The Nekudot HaKesef hesitate, hold that the fee pays for the undertaking and not for the waiting, and report that the practice permits it. To be checked case by case with a Rav.

Case 4 — Two partners, only one borrows

The Taz devotes a long passage to this case, and holds it to be רבית קצוצה: the lender knows only the signatory, and the second partner turns out to borrow from the first. The proper course he indicates is simple — let both borrow and both sign.

Case 5 — Guaranteeing a company’s debt to a Jewish lender

This is the configuration of seif 2 once the principal debtor is not subject to the prohibition of interest. The Rama’s stipulation is required, and the Noda BiYehuda adds that a determined term and rate are needed; an open-ended undertaking does not fall within the permission.

Case 6 — The lender entrusts me with an object of the debtor as security

This is the pledge permission, and the Nekudot HaKesef write that it is the settled custom: the non-Jew’s pledge for the principal, the Jew’s guarantee for the interest. Restriction of the Shach and the Bach: where the object was already pledged to a first Jew, the permission no longer applies.

Case 7 — Having an existing guarantee released and taking its place

This is the last clause of seif 2. He who takes the place owes the principal and the interest accrued to the day of substitution; the interest running thereafter is not his, since he was not a surety when the money was handed over. The Taz would have a kinyan change this; the Shach, in the Beit Yosef’s name, writes that even then he does not owe it.

Case 8 — The interest was folded into the principal from the outset

This is the זקיפה, and it reverses the result: all becomes principal and the surety owes it all. The Chatam Sofer draws the favourable consequence — one who borrows ten and immediately obligates himself for twelve may be guaranteed, since what is guaranteed is no longer, in law, interest.

What to bring to your Rav. The guarantee contract itself, and the answer to three questions: is the lender Jewish or not? may the creditor pursue me before the borrower? does the undertaking bear on the principal, on the interest, or on both, and for how long? These three answers place the case within the siman; without them no decision is possible.
In practice. Siman ק״ע gives no blanket permission to stand surety. It gives a conditional permission whose condition is a fact — the order in which the creditor is paid — and which the Rama expressly tied to local custom. Each case is decided on the documents, and before one’s Rav.
