1. שורש האיסור — interest where nobody pays anything

No money changes hands. A third man signs a paper, and the Torah sees interest in it. The whole siman flows from how one accounts for that paradox.

The gemara does not say the surety pays interest: it says he takes it — איהו ניהו דקא שקיל מיניה רביתא. That is the decisive shift. Once the surety has satisfied the lender he is no longer a third party: he has become the borrower’s creditor for a sum that includes interest. The Tur gives this a purely mechanical image.

Ḥakira: does the prohibition target the act of standing surety, or the payment that follows? (א) The act. To sign is already to enter a mechanism in which a Jew will claim interest from a Jew; the undertaking is flawed from birth. (ב) The payment. Undertaking is nothing; what is forbidden is paying the interest and then recovering it. So long as the borrower pays himself, nothing has happened.
Nafka mina (1) May one sign a guarantee one is certain never to be called upon to honour? On (א) no, on (ב) yes. (2) A surety who has already paid and been reimbursed: on (א) the prohibition was complete at signature, on (ב) only at the moment of reimbursement. The Nekudot HaKesef will settle this point with rare sharpness — and section 5 is where we shall read them.

2. רש״י נגד הרשב״א — how far the prohibition of standing surety reaches

The Mehaber permits “if the non-Jew undertook not to claim the surety first”. It remains to know what “first” means: before any recourse against the borrower, or merely not as of right?

The dispute, as the Beit Yosef reports it

For Rashi the permission is narrow: the lender must bind his own hands and reach the surety only after exhausting the borrower. For the Rashba it is broad: it suffices that the borrower remain reachable. The difference is the right to choose: Rashi forbids it, the Rashba allows it.
The Beit Yosef’s position, and the division it makes The Beit Yosef does not decide the dispute: he distributes it across two moments. Lekhatchila we teach like Rashi; bediavad the money stays where it is, because a doubt of law is settled by possession.

Yesod. This division — stringency in teaching, leniency in judgment — is no soft compromise: it is the proper form of a ספיקא דדינא in matters of interest. One teaches the safer view; one strips nobody on a doubt.

3. צד אחד ברבית — קצוצה or אבק, and why everything turns on it

At the moment of signature nothing is certain: perhaps the borrower will pay, and the prohibition will never come about. That “perhaps” has a name in the ריבית block, and everything else depends on it.

The Taz’s difficulty with Rabbenu Yitzchak Korkos The Tur reports that R. Yitzchak Korkos obliges the borrower to reimburse the surety everything he laid out, interest included, since the loss came from him. The Tur refuses. The Taz asks: whence does R. Korkos hold the prohibition is only lekhatchila, when the gemara speaks of interest that is taken?

The Taz’s answer: everything hangs on צד אחד ברבית R. Korkos holds the suretyship to be interest that is merely contingent at its birth; and for the authorities who hold צד אחד ברבית to be rabbinic, such interest is only אבק רבית. Hence his leniency: in אבק רבית what has already been given is not recovered, and here there is even a loss to repair.

The Taz does not stop there. He refers to siman קע״ד · 174, where the Mehaber ruled that צד אחד ברבית is רבית קצוצה — and infers, against R. Korkos and against the Rama, that the interest the surety paid is recovered in court.

Nafka mina (1) Is interest already reimbursed to the surety recovered? Yes for the Taz, no for the Rama. (2) May the surety demand reimbursement of the interest he paid? Yes for R. Korkos, no for the Tur and the Rama. (3) Is a guarantee almost certain to be called upon still a צד אחד ברבית? The Taz suggests not: once the forbidden side materialises, the name קצוצה attaches.

4. ואי כבר פרע — the Rama against the Beit Yosef and the Taz

The Rama closes seif 1 with a six-word sentence, given as his own reasoning — סברת הרב. It provoked one of the sharpest controversies of the ריבית block.

The Rama’s text

Against him: the Beit Yosef as the Shach reports him, and the Taz by a talmudic proof
« מבואר מדבריו דבערב שלוף דוץ אפי׳ כבר פרע לו הרבית מוציאין מידו שלא כדעת הרב » (ש״ך יו״ד ק״ע ס״ק ב)
« על כן נראה לע״ד ברור דרבית דאורייתא יש כאן כל שיש איסור ברור בהאי ערבות » (ט״ז יו״ד ק״ע ס״ק א)
The Taz’s proof deserves to be followed step by step. The gemara objects to a baraita derived from a verse that the surety “takes the interest”. If this were merely אבק רבית — rabbinic — the objection would collapse: the baraita permitted only as regards the Torah. That the gemara treats the objection as decisive therefore proves the interest here is biblical.
The Shach’s defence in the Nekudot HaKesef The Shach answers in his s"k 2 that the gemara speaks only of the ערב שלוף דוץ — where the surety simply replaces the borrower — and that nothing follows from it for ordinary suretyship. He adds, in the Nekudot HaKesef, that the Taz’s objection is not new.

Nafka mina The Baer Hetev poses the question in a practitioner’s terms: must a surety who has been reimbursed his interest return it? He records the split — the Taz recovers, the Shach and the Nekudot HaKesef do not — without deciding.

5. ערב בעד הקרן לחוד — the Taz’s צ״ע and the Nekudot HaKesef’s answer

In seif 2 the Rama permits standing surety for the principal without the interest, or the interest without the principal. The Taz devotes to these few words one of the longest ס״ק in all of Yoreh De‘ah, and leaves it in צ״ע.

The Rama’s text
« ואם הישראל ערב לו בעד הקרן ולא בעד הרבית אלא יש לו ליקח הרבית מן העובד כוכבים או להיפך שערב לו בעד הרבית ולא בעד הקרן מותר » (שו״ע יו״ד ק״ע:ב)
The Taz’s difficulty The Taz notes three things. First, the Rama’s wording seems to permit even in the forbidden case of the ערב שלוף דוץ. Second, the source he invokes — the Hagahot Ashri in the name of Raavya — speaks only of בדיעבד, of a man who has already transgressed. Third, guaranteeing the interest of a loan made to a third party looks exactly like the forbidden case of siman ק״ס · 160, where the borrower arranges that another pay the interest in his stead.

The Nekudot HaKesef’s answer — and it is the summit of the siman The Shach reverses the question. There never was a prohibition on undertaking; the prohibition is only on performing — that is, on paying the interest. To say “I shall give you interest” is no offence; to give it is. Accordingly, when the Rama writes “permitted”, he does not mean it is permitted to contract the guarantee: he means it is permitted to honour it, since what will be paid is only principal.

Yesod. This answer redistributes the whole siman. It answers at once the ḥakira of section 1: the Shach holds firmly to the second horn — the prohibition lies in the payment, not in the signature. And it explains why the Rama, at the end of seif 1, does not recover interest already paid: what is done is done, and the undertaking itself was never the offence.
Nafka mina The Baer Hetev draws the practical consequence: even one who guaranteed principal and interest may honour his signature, provided he pays only the principal.

6. ערב בעד הרבית לחוד — the Levush, the Shach and the Noda BiYehuda

Guaranteeing the interest alone looks like the lightest of undertakings. The Levush, in the name of the Ba’al HaTerumot, shows it is in fact the heaviest.

The Levush’s objection If the surety must pay interest as long as the debtor has not repaid, he cannot compel the debtor to pay — and it even suits him that the debt run on. Liability for the principal therefore rests on him too. The Levush puts it by reversing the case: it is like a borrower telling the lender, “as long as I give you a dinar a month, you cannot press me for the principal”.

The Shach’s answer The Shach grants the reasoning but denies its application. In the Ba’al HaTerumot’s case the surety expressly undertook to pay interest as long as the money was in the non-Jew’s hands: there indeed the principal is on him. Where no liability for the principal rests on him at all, the matter falls back under the benign rule of הילך זוז והלוה לפלוני.

The Taz: an objection of method

The Noda BiYehuda: the exact dividing line Reported by the Pit’hei Teshuva, he offers the distinction that reconciles everyone: the Rama permitted only for a fixed term and a fixed amount of interest. Where the undertaking runs without limit, as long as the debtor does not pay, the Levush’s and the Taz’s objection stands — and it is forbidden.

7. משכונו של עובד כוכבים — the Bach, the Taz and the settled custom

The Rama adds a second permission, again given as his own reasoning: if the lender holds a pledge belonging to the non-Jew, the Jew may guarantee the interest. The Bach and the Taz object; the Shach sees in it the settled practice.

The Rama’s text

The Rama’s reasoning is one of attribution: when a loan rests on a pledge, it is no longer the person who borrows but the object that answers. The lender does not rely on the surety, he relies on the pledge — and the interposed Jew is therefore not the true borrower.
The Bach, followed by the Taz: קרוב לשכר ורחוק להפסד

The Nekudot HaKesef’s answer The Shach sets the objection aside in two words — במשכון שאני — and opposes to it what in matters of interest is often worth more than an argument: a settled and unchallenged practice.

Nafka mina In his s"k 8 the Shach distinguishes two pledges readily confused: the one a broker brings from a non-Jew so that a Jew may lend upon it, and the one already pledged to a first Jew and passing to a second. The first is permitted; the second is saved only by an express sale.

8. ערב שלא בשעת מתן מעות — the kinyan, the זקיפה and the Chatam Sofer

The last clause of the siman is the most technical, and the heaviest in consequence: a Jew has the pledge returned or the non-Jewish surety released, and takes their place. What does he owe?

The Rama’s text, and its limit
« צריך לשלם לו כל הקרן והרבית שעלה עליו עד אותו היום אבל לא הרבית שיעלה עליו מכאן ואילך » (שו״ע יו״ד ק״ע:ב)

Why is the future interest not owed? Because at the moment this Jew undertakes, the money is already out: he is an ערב שלא בשעת מתן מעות, and such a guarantee does not of itself bind. The Shach explains why he is nonetheless bound for the principal: it was on his word that the pledge was returned, which makes him like a surety from the first moment.

The Chatam Sofer on זקיפה The Rama ends with זקיפה: if the non-Jew has folded principal and interest into a single debt, all becomes principal. The Chatam Sofer, reported by the Pit’hei Teshuva, draws a consequence upstream: where a Jew borrows ten and immediately obligates himself for twelve, another Jew may stand surety — for what he guarantees, in the law of the debt, is entirely principal.

Yesod, and the close of the siman. The eight disputes of this siman reduce to a single alternative, set out in the first section: does the prohibition lie in the surety’s act or in the payment he makes? The Taz holds to the act — hence his consistent stringency, to the point of recovering in court interest already paid. The Shach holds to the payment — hence his consistent leniency, to the point of writing that the guarantee in itself carries no prohibition at all. The Rama, in practice, follows the second.
