1. The axiom: what is forbidden is an order of recovery

Nobody pays a penny more, and yet it is interest. The whole of siman ק״ע rests on this paradox: what makes the guarantee unlawful is not a sum but the order in which the lender gets paid. Claimed first, the surety becomes a creditor — and a creditor for a sum that contains interest.

The Mehaber writes the reason into the body of the rule itself, which he rarely does:

« שכיון שבדיניהם תובע הערב תחלה נמצא הערב תובע את ישראל ברבית שהערב חייב בה לעובד כוכבים » (שו״ע יו״ד ק״ע:א)
« כי בדיניהם הלוה דוחה את המלוה על הערב שממנו יתבע החוב » (ט״ז יו״ד ק״ע ס״ק ד)

2. The 3 reflex questions

Three questions in order, and any guarantee finds its place.

Who is the lender, who is the borrower?
Non-Jewish lender → seif 1. Jewish lender and non-Jewish borrower → seif 2, stricter.
Who is claimed first?
The borrower → there is no prohibition. The surety, or either at will → we enter the Rashi–Rashba dispute.
Has payment already been made?
No → the question is one of permission. Yes → the question is one of recovery, and the Rama does not recover.

4. The three figures of surety

Three terms often confused, on which the whole siman depends.

5. רבית קצוצה and אבק רבית — what the court recovers

The difference between the two regimes is not one of moral gravity: it is a difference of court. רבית קצוצה is recovered at law; אבק רבית is not. The whole controversy of the siman reduces to which of the two we are in.

6. Seif 1: surety given to a non-Jewish lender

What is forbidden. To sign for a Jew borrowing at interest from a non-Jew, once the lender may claim the surety before the borrower.
What is permitted. The very same signature, if the lender has undertaken to claim the borrower first — and, per the Rama, if the local custom is to claim that way.

The Rama’s condition is a condition of fact, not a formula. It requires knowing how the debt is actually recovered — what the contract says, and what the creditor does.

7. Seif 2: surety given for a non-Jewish borrower

Seif 2 is the longest of the siman, and almost all of it is the Rama’s. Five clauses, in the order of the text.

The 5 golden rules

  1. What forbids is not a sum but an order of recovery.
  2. The Mehaber’s way out is procedural: that the surety not be claimed first.
  3. The Rama’s “nowadays” gloss carries a factual condition, to be verified and not assumed.
  4. Seif 2 is stricter than seif 1, the interest there being collected by a Jew.
  5. The undertaking is never the offence; the payment is — that is the Nekudot HaKesef’s key.

The 4 classic pitfalls

  1. Thinking seif 2 is the mild mirror of seif 1. It is graver, because a Jew collects the interest there.
  2. Reading the Rama’s gloss as a blanket permission for the age. He expressly tied it to local custom.
  3. Confusing guaranteeing the principal alone, which the Rama permits, with guaranteeing the interest alone, on which the Levush, the Taz and the Noda BiYehuda set limits.
  4. Taking the Rama’s “permitted” for leave to undertake. The Nekudot HaKesef read it as leave to perform.
