A loan at interest between a Jew and a non-Jew is licit. Then one of the two converts, and the loan finds itself between two Jews. What becomes of the interest? The seif answers twice, and its two answers are not symmetrical: it is not the conversion that decides, but the date of the זקיפה במלוה — the settlement of account that recasts interest as principal.

1. The text of the Mechaber — the single seif

The siman has but one seif — the Shulchan Arukh announces it itself: ובו סעיף אחד. There is no gloss of the Rama. Yet this seif contains two complete cases, their reason and its limit; we therefore read it clause by clause.

The seif — full text

דין עובד כוכבים שהלוה ברבית ונתגייר. ובו סעיף אחד:

Title of the siman: the law of the non-Jew who lent at interest and converted; and it contains a single seif.

A Jew who borrowed money from the non-Jew at interest, and the latter fixed it against him as a debt, and then converted: if it was before he converted that he fixed it against him as a debt, he collects principal and interest; and if it was after he converted that he fixed it against him as a debt, he collects the principal and not the interest. But a non-Jew who borrowed from a Jew at interest and fixed the interest against himself as a debt — even though he fixed it after he converted, [the Jew] collects the principal and the interest, so that people should not say: it was for his money that this one converted. And the Jew collects from him, after he converted, all the interest money he became liable for when he was a non-Jew.
Two cases, and an asymmetry that leaps to the eye. In the first, the date of the settlement decides everything; in the second it decides nothing — the interest is collected even if the settlement postdates the conversion. The reason is spelt out, and it is not a reason of the law of loans but of reputation: שלא יאמרו בשביל מעותיו נתגייר זה. It does not protect the lender: it protects the convert.

2. Context — the baraita, Rabbi Yosi, the Tur and the Beit Yosef

The Beit Yosef opens the siman by giving its source in a word: the whole siman is in the gemara, in the chapter איזהו נשך of Bava Metzia. The baraita sets out the two cases there, and Rabbi Yosi settles the second:

Rava said: what is Rabbi Yosi’s reason? — so that people should not say: it was for his money that this one converted.
The baraita treats the two cases alike. It is Rabbi Yosi who breaks the symmetry on the second, and the halakha follows Rabbi Yosi. The Mechaber’s seif is therefore, in its first half, the baraita, and in its second, Rabbi Yosi — with his reason copied word for word.

The Tur adds two things the Mechaber will not reproduce as such: the reason for the first case, and a disagreement about the scope of the second.

The Tur’s reason is the key to the siman: משעת זקיפה חשוב כגבוי — from the moment of the settlement, the interest is deemed collected. If it was collected while collecting it was licit, what remains is no longer interest: it is principal. Hence the date as criterion.

The Tur then reports a disagreement about what the convert-borrower pays: only what accrued before his conversion, or also what accrued after?

« וכתב הרמ״ה שאינו נותן אלא רבית שעלה קודם שנתגייר אבל לא מה שעלה לאחר שנתגייר » (טור יו״ד קע״א)

The Beit Yosef rules, and the Mechaber follows him without saying so: the seif’s last words — שנתחייב בהם כשהיה עובד כוכבים — are precisely the position of the רמ״ה, the Rambam and the disciples of the Rashba, and not that of the Rosh. The Beit Yosef’s conclusion is written into the seif, in its last clause.

Here is the Beit Yosef’s conclusion, and the reason the Rosh gave for his view:

« כן דעת הרמב״ם בפ״ה מה׳ מלוה ולוה וכ״נ שהוא דעת תלמידי הרשב״א » (בית יוסף יו״ד קע״א)

3. The vocabulary — set down once and for all

זְקִיפָה בְּמִלְוֶהthe settlement of account. The act by which creditor and debtor close the account and recast the whole — principal and accrued interest — as a new debt. It is the pivot of the siman: it is not the conversion that decides, but the date of that act.
חָשׁוּב כְּגָבוּיdeemed collected. The reason given by the Tur and the Taz: from the moment of the settlement, the interest is treated as though it had been received. Received while receiving it was licit, it does not become interest again — it has become principal.
קֶרֶן וְרִבִּיתprincipal and interest. The two masses the whole siman labours to separate. The principal is always recovered; the interest only according to the date of the settlement, and according to the direction of the loan.
גֵּרthe convert. Before his conversion, a loan at interest between him and a Jew was licit; afterwards it is not. The siman does not ask what he has become, but when the act took place.
שלא יאמרו בשביל מעותיו נתגייר זהRabbi Yosi’s reason. It is one of reputation, not of property: if the convert found himself released from a debt by the very fact of his conversion, his sincerity would be suspected. The rule therefore protects the convert — and that is why it operates only in the direction in which he would have gained.
הָרַב הַמַּגִּידthe Maggid Mishneh. The commentator on the Rambam, cited in this siman by the Shach, the Taz, the Ba’er Hetev and the Beit Yosef — all on the same sentence: by strict law he could collect, but the Sages ordained to follow the settlement stringently.
לְרַבוּתָאto say more. The Shach’s reading-key at ס״ק ב: the Maggid Mishneh named the settlement only to state the stronger case; all the more so where there was no settlement at all. It is a way of reading, and the Prisha does not share it.
עוֹבֵד כּוֹכָבִיםthe spelling of the edition. This is the form borne by the printed text from which we copy the seifim, and we copy it as it stands. In the glosses we translate “non-Jew”.

Reading the table top to bottom reveals the logic. The first three lines form a scale: the later the settlement — or the more it is absent — the less is recovered. The last three do not follow that scale at all, because they obey a different reason, which is not the settlement but the convert’s good name. And that reason has a limit of its own, which the seif’s last clause writes: what he became liable for when he was a non-Jew.

5. The Shach, the Taz, the Ba’er Hetev and the Pitchei Teshuva

The apparatus is given here in full: the Shach has three ס״ק, the Taz two, the Ba’er Hetev two and the Pitchei Teshuva one. The Nekudot HaKesef do not comment on this siman — the Shach has nothing to answer the Taz here, and indeed the two say the same thing.

The Shach — three entries, one per clause of the seif

ס״ק א — on גובה קרן ורבית: how far the recovered interest reaches

The Shach broadens the seif’s first answer, and says whom he takes it from:

« אפי׳ רבית שעלה משנתגייר דמשעה שזקפו עליו במלוה ה״ל כולי׳ קרן כמו שנתבאר בסוף סי׳ הקודם. ת״ה והאחרונים » (ש״ך יו״ד קע״א ס״ק א)
summary: even interest that accrued after his conversion — for from the hour he fixed it against him as a debt, the whole became like principal, as was explained at the end of the previous siman. The Terumat HaDeshen and the Acharonim.
The reference בסוף סי׳ הקודם is exact and checkable: the Rama’s gloss at the end of siman 170 states the same rule in another context.
« ואם זקף העובד כוכבים הקרן עם הרבית אז אפילו מה שיעלה עליו אח״כ הוי כקרן וצריך לשלם לו הכל » (רמ״א יו״ד ק״ע:ב)

ס״ק ב — on ולא הרבית: how far the forfeited interest reaches

The Shach broadens the second answer too, then reads the Maggid Mishneh in a particular way:

« אפילו רבית שעלה קודם שנתגייר. הרא״ש וטור » (ש״ך יו״ד קע״א ס״ק ב)

And the Maggid Mishneh wrote that by strict law he may collect what accrued before his conversion, but that the Sages ordained to follow the settlement stringently. And what he said, “follow the settlement stringently”, he said to state more — and all the more so if there was no settlement at all, it is forbidden even for what accrued before the conversion; and so wrote the Bach and the Ateret Zahav, and not like the Prisha.
Three layers in one entry. First the extension: even the earlier interest is forfeited. Then the source of the difficulty: the Maggid Mishneh says that by strict law one could collect it. Finally the reading: what the Maggid Mishneh named, he named לרבותא, and the absence of a settlement is more serious, not less. The Prisha read the opposite.

ס״ק ג — on אע״פ שזקפן עליו: and if there was no settlement at all?

The Shach raises the question in the second case, reports the two views, and concludes:

« וה״ה נמי לא זקפן כלל. טור ויש פוסקים » (ש״ך יו״ד קע״א ס״ק ג)
« אבל ה״ה כ׳ שי״א דלא זקפן לא וכ״נ דעת הרמב״ם ע״כ ולשון המחבר הועתק מהרמב״ם וטוב להחמיר » (ש״ך יו״ד קע״א ס״ק ג)
summary: and the same if he did not fix it at all — the Tur and some decisors. But the Maggid Mishneh wrote that some say that if he did not fix it, no; and so appears the Rambam’s view. And the Mechaber’s wording was copied from the Rambam — and it is good to be stringent.
The last sentence deserves noting for itself: the Shach reads the Mechaber’s silence through his source. The seif speaks only of the case where there was a settlement; since his wording comes from the Rambam, and the Rambam is taken to exclude the contrary case, the silence is not a permission. It is a way of reading the Shulchan Arukh, and it is worth keeping.

The Taz — two entries, and they give the two reasons

On the first clause, the Taz repeats the Tur’s reason word for word:

« שהרי קודם שנתגייר חזר כולו כקרן דמשעת זקיפה חשוב כגבוי » (ט״ז יו״ד קע״א ס״ק א)

On the second, he gives the Rosh’s reason, then recalls the Maggid Mishneh:

« ואפי׳ מה שעלה קודם שנתגייר והטעם דכיון דלא זקפן עליו במלוה קודם שנתגייר השתא דקא שקיל מיניה רביתא כו׳ כן כתב הרא״ש » (ט״ז יו״ד קע״א ס״ק ב)
« וכתב המגיד משנה דאף דמדינא מותר מכ״מ להחמיר הלכו אחר הזקיפה » (ט״ז יו״ד קע״א ס״ק ב)
summary: and even what accrued before his conversion. And the reason: since he did not fix it against him as a debt before his conversion, now that he takes from him, it is interest he takes, etc. — so wrote the Rosh. And the Maggid Mishneh wrote that although by strict law it is permitted, they nonetheless followed the settlement stringently.
The Taz and the Shach do not contradict each other here — rare enough to be worth noting, and no doubt why the Nekudot HaKesef have nothing to say about this siman. The Taz nonetheless brings something the Shach does not say: the Rosh’s reason. It is simple and strong — without a prior settlement, what the creditor takes today is interest he is taking today.

The Ba’er Hetev — two entries

The Ba’er Hetev sums up the Shach’s three ס״ק in two entries, and does so very faithfully:

The Ba’er Hetev is here the best summary of the siman: in two entries he gives the Shach’s two extensions, the Maggid Mishneh’s sentence, the Shach’s reading against the Prisha, and the conclusion וטוב להחמיר on the case where there was no settlement.

The Pitchei Teshuva — one entry, and it is a reference

The Pitchei Teshuva’s single entry on this siman settles nothing: it refers to the Ba’er Hetev, then to three collections of responsa.

« עבה״ט ועי׳ בתשובת מהר״י הלוי סי׳ נ״ב ובתשובת מהרי״ט ח״א סימן קמ״ד ובמהראנ״ח ח״ב סימן ו » (פתחי תשובה יו״ד קע״א ס״ק א)
An entry of this kind is a mareh mekomot: it indicates where the question was treated in responsa, without reporting their content. It is useful for knowing that the subject has a literature, and it does not excuse one from going to look.

The Nekudot HaKesef

The Nekudot HaKesef do not comment on this siman — there is therefore nothing of theirs to cite here. We meet them again at siman 172, where they have two entries.

6. The Rambam — הלכות מלווה ולווה, chapter 5

The seif here is an almost literal copy of a halakha of the Rambam, and the Shach says so himself at ס״ק ג: ולשון המחבר הועתק מהרמב״ם. The comparison is instructive, because it shows what the Mechaber kept — including the final limit.

Three observations. One: the Rambam sets out the two cases in the same order, with the same reason. Two: he too writes the final limit — שנתחייב בהן כשהיה עכו״ם — which shows that the position the Tur reports in the name of the רמ״ה is indeed his. Three: he says nothing about the case where there was no settlement, and it is from that silence that the Shach draws his וטוב להחמיר.

7. Contemporary cases

Case 1 — A loan at interest made before one party’s conversion

That is exactly the siman. The first question is never “who converted?” but “was there a settlement of account, and when?”. Ask your Rav.

Case 2 — The account was settled before the lender’s conversion

The seif then recovers principal and interest, and the Shach at ס״ק א adds that this holds even for interest that accrued after the conversion, because from the settlement everything became principal. Ask your Rav.

Case 3 — The account was settled after the lender’s conversion

Only the principal is recovered — and the Shach at ס״ק ב adds: not even the interest that accrued before. Ask your Rav.

Case 4 — There never was a settlement of account

The Shach concludes a fortiori that it is forbidden, against the Prisha; and in the seif’s second case he writes וטוב להחמיר. Two different answers for the two directions of the loan. Ask your Rav.

Case 5 — The borrower converted, and the lender wishes to recover the interest

The seif grants it to him, even if the settlement postdates the conversion — but for a reason that is not his own: שלא יאמרו בשביל מעותיו נתגייר זה. Ask your Rav.

Case 6 — Interest continued to accrue after the borrower’s conversion

The seif itself limits it: what he became liable for when he was a non-Jew. The Beit Yosef sets out the disagreement and concludes like the Rambam, the רמ״ה and the disciples of the Rashba. Ask your Rav.

Case 7 — An old debt brought before a beit din

This is a beit din siman: it is not settled between the parties but before a court, on dated documents. The Pitchei Teshuva refers, for that matter, to three collections of responsa. Ask your Rav.

In one sentence: when a loan at interest between a Jew and a non-Jew crosses a conversion, it is not the conversion that decides but the date of the settlement of account — except where it is the borrower who converted, for then another reason takes over, the convert’s good name, and its limit is what he became liable for while he was still a non-Jew.
