1. The axiom: what is forbidden is charging for time

The lender returns the field and takes back his hundred: he has taken nothing extra. But he has eaten ten harvests, and those harvests are the rent of the time his money was out. The whole siman consists in knowing at what price this transaction is taken out of lending and brought into leasing or sale.

The Mehaber writes the dividing line at the end of seif 1:

« שמאחר שאין כח ביד המלוה לגבות מחובו כלום ולהחזיר הקרקע ללוה אינו אלא שכירות » (שו״ע יו״ד קע״ב:א)

2. The 3 reflex questions

Can the lender collect his debt?
No, never → משכנתא דסורא, permitted whatever the yield. Yes → a deduction is needed, or the impossibility of removing him.
Is there a yearly deduction?
Yes, however small → permitted. No → permitted only where one cannot remove him, per Rashi and the Rosh; forbidden per the Rashba.
Can the lender lose?
Yes → the adjustment holds. No — a lien on other properties, transfer of the fire risk → everything collapses.

5. The Rambam’s three משכונות

The Rambam arranges the material in three degrees, and his grid remains the clearest in the block: it decides by the type of property and by the presence of a deduction.

The Rama, following Rabbenu Tam, does not adopt this distinction: with a deduction everything is permitted, field or house. One who wishes to follow the Rambam will add a deduction even where custom dispenses with it.

6. אחריות — the clause that undoes everything

What forbids. Any clause that shields the lender: a written lien on the borrower’s other properties, transfer of the fire or collapse risk against payment.
What does not forbid. The mere fact that the lender may in law be paid out of other properties: the Shach specifies that the prohibition targets only the case where a second pledge is immediately at his disposal. And a small sum against a light repair remains permitted.
« וכל זה לא מיירי אלא כשאחריות המשכונות על המלוה אבל כשהלוה כותב לו אחריות על שאר נכסיו ולא יוכל להגיע למלוה שום הפסד אסור » (שו״ע יו״ד קע״ב:א)

The 5 golden rules

  1. Consuming the fruits of a pledged property is interest, unless the transaction ceases to be a loan.
  2. Only three forms take it out: דסורא, נכייתא, and the impossibility of removal per Rashi and the Rosh.
  3. The size of the deduction is immaterial; its existence is not.
  4. Any clause that shields the lender from loss cancels the adjustment.
  5. After the fact the fruits consumed are not deducted — except those consumed after a protest.

Mnemonic — נ־א־ס

נ נכייתא — Is there a deduction? → permitted or אבק רבית

א אחריות — Can the lender lose? → the adjustment holds or falls

ס סילוק — Can the borrower remove him before term? → Rashi’s regime or the Rashba’s

The 4 classic pitfalls

  1. Thinking a token deduction does not suffice. It does — the Shach writes it may be less than the biblical rate for an ancestral field.
  2. Thinking a lien on the borrower’s other properties is a harmless precaution. It is the clause that forbids the whole arrangement.
  3. Applying here the deduction the Rama grants in siman קס״ו · 166. The Shach explains why it does not hold in a משכנתא.
  4. Reading “there is no difference between the two places” as complete equality. The Shach corrects: the difference bears on the rank of the prohibition.
