Siman 176 runs to eight seifim — the Shulhan Arukh announces it itself: ובו ח׳ סעיפים. Its title does not ask whether hiring is permitted, but which hiring is. For hiring and lending look alike feature for feature: a sum is handed over, another returns later. The siman teaches how to tell them apart by a single question — has something worn out? — and it puts that question in turn to money, to vessels, to a ship, to a cow, to a field and to a worker.

1. The text of the Shulhan Arukh — the eight seifim

The siman proceeds by the objects hired, from the least hireable to the most. Seif 1: money, which cannot be hired — and the narrow conditions under which it might. Seifim 2–4: movable things — vessels, ship, pot, cow — where the rent pays for real wear. Seif 5: the sum handed to the tenant, according to whether it enters the property or the trade. Seif 6: land, where rent falls due only at the end, which is what permits the discount. Seifim 7–8: a man’s labour, which follows another rule.

Seif א — money that cannot be hired, and the three degrees of liability

איזה השכרה מותרת ואיזה אסורה. ובו ח׳ סעיפים:

Title of the siman: which hiring is permitted and which forbidden; and it contains eight seifim.

It is forbidden for a man to hire out his money, saying: “I hire you ten dinars for a dinar a month.” And this applies where he hires them in order to spend them; but if he hired them in order to practise with them or to display them, and returns them to him in kind, it is permitted.

Gloss: And this only provided he accepted upon himself no more than liability for theft and loss; but if he accepted upon himself all liability, it is forbidden (Beit Yosef in the name of the Baal HaTerumot). And if the lessor accepted upon himself all liability — both for theft and loss and for accidents beyond control — some permit even hiring them out to be spent (Terumat HaDeshen 302), as below in siman 177. However if he accepted upon himself only theft and loss and not accidents, or accidents and not theft and loss, it is forbidden to hire them out to be spent (Beit Yosef in the name of Tosafot, Hagahot Maimoniyot chapter 5, Semag, Rivash 305 and 308, Terumat HaDeshen ibid., and see below). However it is only dust of interest; but if the lessor accepted no liability at all, it is fixed interest (Rivash ibid.).
Why money is not rented. To rent is to give over the use of a thing without giving over its body: the rent pays for the wear that use inflicts, and the body returns. Money does not behave so. Once handed to someone to spend, it is no longer his thing — it becomes a debt, and whatever is received beyond it is interest. The seif says it by implication: hiring money is permitted only where the money is not spent — to practise, to display — and where the very coins are returned.

Seif ב — vessels — as far as permission to sell

כלים מותר להשכירם אפילו נותן לו רשות למכרם ולעשות בהם כל חפצו רק שלבסוף יחזיר לו כלי אחר כזה (לשון רמב״ם פ״ח מה״מ די״א):
Vessels may be hired out, even giving him permission to sell them and do with them whatever he wishes, provided that in the end he returns him another vessel like it (the language of the Rambam, chapter 8 of Hilkhot Malveh, halakha 11).
The principle of hiring vessels, and its surprising reach. One may hire out a vessel while permitting the other to sell it — that is, to dispose of it entirely — provided he returns a like one at the end. What the rent pays for is therefore not the safekeeping of that object but the use of a class of objects; and this is exactly what distinguishes a vessel from money, as the Taz will show. The Shulhan Arukh copies here the Rambam’s language.

Seif ג — the ship and the copper pot

מקום שנהגו לשכור הספינה וליטול שכרה ואם נשברה שמין לו מה שפחתה ומשלם יתר על שכרה הרי זה מותר וכן מותר להשכיר סיר של נחושת וכיוצא בו ונוטל השכר ודמי מה שפחת ממשקלו וכן כל כיוצא בזה: הגה וי״א דוקא כלים כאילו דאפי׳ מה שנשאר נפחת קצת ובעד זה נוטל שכר ולכן אם נשבר משערין כמה היה שוה בשעת שבירה (ב״י בשם התוספות וכן כ׳ רבינו ירוחם והגהות אשיר״י וכן משמע לשון הטור):
Where the custom is to hire out the ship and take its rent, and if it is broken they assess for him what it has lost and he pays in addition to the rent — this is permitted. And likewise it is permitted to hire out a copper pot and the like, taking the rent and the value of what its weight has lost; and likewise for all similar cases.

Gloss: And some say: only vessels such as these, where even what remains has diminished a little, and it is for this that he takes rent; therefore if it broke, one assesses how much it was worth at the time of breaking (Beit Yosef in the name of Tosafot, and so wrote Rabbenu Yeruham and the Hagahot Ashiri, and so the language of the Tur implies).
Two cases, and the second is the stronger. The ship: one takes rent, and if the ship breaks the hirer pays the depreciation in addition to the rent. The copper pot: one takes rent, and also takes the value of the metal lost through use. The Taz will show that the second is the real novelty — in the ship the debt arises only at the moment of breaking, whereas in the pot it begins with the first use, and it is nonetheless permitted, because what remains is genuinely diminished.

Seif ד — the cow valued in money

מותר לשכור פרה ולשומה בדמים כגון שיאמר הרי פרתך עשויה עלי בשלשים דינר אם תמות וכל זמן שהיא אצלי אעלה לך סלע בחדש בשכירות (וי״א דאם תמות משערין כמה היתה שוה בשעת מיתה) (רמב״ן ורבינו ירוחם והטור):
It is permitted to hire a cow and to value it in money, for instance by saying: “behold your cow is set upon me at thirty dinars if it dies, and all the time it is with me I shall pay you a sela a month in rent” (and some say that if it dies one assesses how much it was worth at the time of death) (Ramban, Rabbenu Yeruham and the Tur).
A beast is not a sum. Fixing in advance the value of the cow “if it dies” looks very much like a loan: thirty dinars, a monthly rent, and repayment in money. The Tur explains why it is not — because it remains in the owner’s domain until the moment of death, and it also wastes away; and the cited view adds the condition that closes the matter: to assess not in advance but at the time of death.

Seif ה — two hundred zuz — into the body of the property, or into trade

המשכיר שדה לחבירו בי׳ כורים לשנה וא״ל תן ר׳ זוז שאפרנס בהם השדה ואני אתן לך י״ב כור בכל שנה הרי זה מותר מפני שאם יפרנס השדה בדינרין אלו יהיה שכרה יותר וכן אם השכיר לו חנות או ספינה בעשרה דינרין בשנה ואמר לו תן לי מאתים זוז שאבנה בהם ואציירנה ואכיירנה או אתקן בהם ספינה זו וכלי תשמישה ואני אעלה לך י״ב דינר בכל שנה הרי זה מותר. One who rents out a field to his fellow for ten kor a year, and the latter said to him: “give me two hundred zuz that I may work the field with them, and I shall give you twelve kor each year” — this is permitted, because if he works the field with those dinars its yield will be greater. And likewise if he rented him a shop or a ship for ten dinars a year and he said: “give me two hundred zuz that I may build with them and paint and adorn it, or repair with them this ship and its tackle, and I shall raise you twelve dinars each year” — this is permitted (since he spends the money on the body of the ship or the shop) (Tur). But if he said to him: “give me two hundred zuz to trade with in the shop, or to spend on the ship’s merchandise, or to hire sailors with, and I shall add to the rent” — this is forbidden.
One question only: where does the money go? Two hundred zuz handed to the tenant, and a rent that rises — the form is identical in both halves of the seif. What separates them is the destination: invested in the body of the rented property, the money improves the thing and the extra rent pays for a better thing. Used in trade, it does nothing to the thing: the extra rent then pays only for a delay. The Tur gives the exact word — בגוף השדה.

Seif ו — increasing the rent of land, and the dowry of sons-in-law

מותר להרבות בשכר הקרקע (לשון רמב״ם פ״ז מה״מ דין ח׳) כיצד השכיר לו את החצר וא״ל קודם שהחזיק בו אם מעכשיו אתה נותן לי הרי היא לך בי׳ סלעים בכל שנה ואם תתן שכר חדש בחדש הרי היא בסלע בכל חדש ה״ז מותר וכיוצא בזה בשכר האדם ג״כ מותר: הגה אבל אם כבר החזיק בו לשכור לו בי׳ סלעים לשנה אסור לומר לו תתן כל חדש סלע א׳ ואני אמתין לך המעות (ב״י בשם תלמידי הרשב״א) וכ״ש אם כבר נתחייב לו השכירות ונותן לו דבר בהמתנת המעות דאסור (הגהות אשיר״י והג״מ פ׳ א״נ ובהגמי״י פ״ח) מותר להרבות בנדונית חתנים כגון שנדר נדוניא לבתו והתנה עם חתנו שכל שנה שיניח לו הנדוניא אצלו יתן לו כך וכך שכר מותר שאין זה אלא כמוסיף לו נדוניא ודוקא כשהתנו כן קודם הנשואין אבל לא אח״כ דהוי אגר נטר (רשב״א סימן תקכ״ט וריב״ש סימן תק״ב) ועיין לקמן סימן קע״ז):
It is permitted to increase the rent of land (the language of the Rambam, chapter 7 of Hilkhot Malveh, rule 8). How? He rented him the courtyard and said to him, before he had taken possession of it: “if you pay me from now, it is yours for ten sela’im a year; and if you pay month by month, it is at a sela a month” — this is permitted. And likewise in the hiring of a person, it is also permitted.

Gloss: But if he has already taken possession of it, to rent it at ten sela’im a year, it is forbidden to say to him: “pay a sela each month and I shall wait for the money” (Beit Yosef in the name of the Rashba’s disciples). And all the more so if he has already become liable for the rent and gives him something for waiting for the money — it is forbidden (Hagahot Ashiri, Hagahot Maimoniyot chapter Eizehu Neshekh, and Hagahot Maimoniyot chapter 8). It is permitted to increase in the dowry of sons-in-law: for instance if he promised a dowry to his daughter and stipulated with his son-in-law that for every year the latter leaves the dowry with him he will give him such and such a payment — it is permitted, for this is but adding to the dowry; and this provided they stipulated so before the wedding, but not afterwards, for that would be a wage of waiting (Rashba 529 and Rivash 502); and see below at siman 177.
The rule that explains the whole siman. Rent falls due only at the end of the period. One who offers a lower rate for immediate payment therefore receives nothing for a delay: he grants a discount on rent that was not yet due. The Rama’s gloss at once draws the two limits: once possession has been taken, and all the more so once the rent has fallen due, any supplement for waiting is forbidden — and the Shakh derives the general rule: every wage of waiting is forbidden, whether the money is rent money or loan money.

Seif ז — work exchanged for greater work

אסור לומר לאדם עשה עמי מלאכה היום ששוה דינר ואני אעשה עמך בשבוע אחר מלאכה ששוה שתים:
It is forbidden to say to a man: “do work with me today worth a dinar, and I shall work with you in another week at work worth two.”
Labour is priced like goods. To exchange a day worth a dinar for a day that will be worth two is to receive a supplement for having waited. The Rambam indeed places this rule under a heading exactly symmetrical to the previous one: it is permitted to increase the rent of landit is forbidden to increase the wage of a man. The next seif will explain why the two do not follow the same rule.

Seif ח — the worker paid in advance, and the one who starts today

השוכר את הפועל בימות החורף לעשות עמו בימות הקיץ בדינר ליום ומקדים לו שכרו מעתה ושכרו שוה בימות הקיץ סלע ליום אסור אבל אם אמר לו עשה עמי מלאכה מהיום ועד זמן פלוני בדינר ביום מותר דכיון שמתחיל לעשות עמו מעתה אינו נראה כנוטל שכר מעותיו שמקדים לו:
One who hires the worker in winter to work with him in summer at a dinar a day, and advances him his wage now, while his wage is worth a sela a day in summer — it is forbidden. But if he said to him “work with me from today until such a date, at a dinar a day” — it is permitted; for since he begins to work with him now, he does not appear to be taking a wage for the money he advances him.
And the reason for the difference. The tenant of a courtyard acquires the courtyard at once; the worker does not bind himself at once — he may withdraw. An advance to a worker who does not begin is therefore a loan, and the discount on his wage is the price of the loan. Let him begin today, and everything changes: the wage is due for work under way, and the advance no longer buys time. This is the central dispute of level 2, and the Nekudot HaKesef play the decisive part in it.
The eight seifim ask a single question: does what is paid pay for a thing, or does it pay for time? Rent pays for a thing — the use of an object and the wear it undergoes. Interest pays for time. The whole difficulty of the siman is that the two look alike: in both a sum is handed over and another returns later. The criterion that separates them holds in one word: has something worn out?

2. The mechanism — what rent pays for, and why money has none

The Tur uses a remarkable phrase: to hire out one’s money “in the language of hire”. That is to say the prohibition bears not on words but on the thing: calling it rent changes nothing, because money does not have what rent pays for. The Taz, in his first ס״ק, formulates the yesod and pushes it to its extreme consequence.

פחת — wear. This is what rent pays for, and this is why hiring an object is not a loan: the object deteriorates, and the owner bears that loss. The Taz draws a consequence the seif does not state: a vessel that does not wear — silver plate, gold — may not be hired out for a fee when it is handed over in the manner of a loan and liability falls on the taker. It is then like coin.

Seif 3 pushes the principle to its limit, and the Tur explains it at length: not only the vessel that deteriorates only at the end, but also the one that begins to wear from the first moment.

The criterion, in three words. ברשות הבעלים: as long as the thing is still in its owner’s domain as regards risk — it may lose value, it wears — what is paid is rent. The day it is no longer there, when the taker answers for it in all circumstances and the owner holds only a claim, what is paid becomes interest. This is what explains seif 1 and its gloss, where everything depends on who bears the liability.

The three degrees of the gloss. (1) The lessor takes no liability: fixed interest. (2) He takes part of it — theft and loss but not accidents, or the reverse: mere dust of interest. (3) He takes all of it: some permit even hiring out money to be spent. The scale is consistent with the Taz’s yesod: the more the owner keeps the risk, the more the thing remains his, and the more what is paid resembles rent.

3. The sugya — Bava Metzia 65a

The mishna sets against each other two transactions that look identical: in both, a lower price is offered for immediate payment. One is permitted, the other forbidden — and this is seif 6 of our siman.

Everything turns on when the debt falls due. Rent is due only at the end; one who pays at once therefore pays before term, and the discount he obtains is not the price of a delay — it is the lessor who, to be paid earlier, charges less. A sale, by contrast, is paid at once: the seller who waits for the threshing waits for a sum already due, and the supplement he claims is the price of that wait. The halakha therefore looks not at the resemblance of forms but at the moment the debt becomes payable.

4. The vocabulary of the siman

השכרה — hiring. Giving over the use of a thing without giving over its body. The siman’s title does not ask whether hiring is permitted but which hiring is: that alone says that the outward form decides nothing.
פחת — wear, depreciation. The central word of the siman. What rent pays for; what money does not have; what makes the copper pot more instructive than the ship. And it is also the reason the Taz forbids hiring out a vessel that does not wear when the risk has passed to the taker.
אחריות אונסין — liability for accidents beyond control. Distinct from liability for theft and loss. The gloss of seif 1 makes their combination the criterion of the degree of prohibition, and both the Shakh and the Taz emend the gloss’s text on this point: it should read “it is forbidden to hire them out to be spent”.

צאן ברזל — “iron flock”. An arrangement in which a flock is entrusted on terms of sharing its produce, the taker answering for the value of the beasts if they die. The Rambam forbids it as dust of interest, and the Shakh explains at ס״ק 5 why our seif 4 is not the same: there the taker does not put the beasts to work, and the owner keeps no risk from the outset. It is the subject of the next siman.

אגר נטר — the wage of waiting. The generic name of interest, and it appears twice in the siman: in the gloss of seif 6, for a dowry stipulated after the wedding; and in the Shakh’s formulation at ס״ק 8, which makes it a rule without exception — every wage of waiting is forbidden, drawing no distinction between rent money and loan money.

7. The Rambam — הלכות מלווה ולווה, chapters 5, 7 and 8

This siman draws on two chapters. Chapter 7 gives the land, the invested sum, a man’s wage and the worker paid in advance; chapter 8 gives the ship, the pot and the cow. The Shulhan Arukh indeed copies the Rambam’s language twice while saying so expressly — at seif 2 and at seif 6.

Two symmetrical headings, and they are the key to the siman. The Rambam opens his halakha 8 with מותר להרבות בשכר הקרקע and his halakha 10 with אסור להרבות בשכר האדם. The two formulas differ by one word — land and man — and yet they are opposites. The reason is in the Nekudot HaKesef: the courtyard is acquired at once, the worker is not.

8. Contemporary practical cases

Case 1 — Hiring out a valuable object

Hiring out a tool, a vehicle, an appliance: the rent pays for the use and the wear, and the owner keeps the risk — this is seif 2. But the Taz warns at ס״ק 1: an object that does not wear, handed over in the manner of a loan and for which the taker answers in all circumstances, is no longer a hired object. For practice, consult your Rav.

Case 2 — The discount for paying rent in advance

A landlord offers twelve months paid up front at a rate lower than the monthly one. This is seif 6, and it is permitted — before the tenant has taken possession, because the rent is not yet owed on any account. Once possession is taken, the gloss forbids it; and once the rent is due, all the more so. A question for a Rav.

Case 3 — Works financed by the tenant

The tenant advances a sum to improve the premises and the rent is raised accordingly. Seif 5 permits it, on a precise condition the Tur formulates: that the money be spent בגוף השדה — on the property itself. If it serves working capital or wages, the extra rent pays only for a delay, and it is forbidden. A question for a Rav.

Case 4 — The advance to a contractor

A craftsman is advanced the price of his summer work at a rate lower than the summer rate. Seif 8 forbids it, because the discount is the price of the advance. The way out is in the seif itself: let him begin working today. The Nekudot HaKesef explain why this condition is not required for hiring premises. A question for a Rav.

Case 5 — Money left with a son-in-law

The gloss of seif 6 permits agreeing that a dowry left with the son-in-law bears a supplement — provided the stipulation precedes the wedding. The Taz specifies further that it means the first undertaking, that of the תנאים; once the dowry is owed, we face an ordinary debt. The Pit’hei Teshuva reports a case in which this boundary decides everything. A question for a Rav.

9. Summary of Siman 176

One sentence. Rent pays for the use and the wear of a thing that remains at its owner’s risk; money has neither wear nor owner once spent, and what is received for it is interest. Hence the whole siman: vessels may be hired, money may not; a sum invested in the rented property is permitted, one that goes into trade is not; and a discount on rent not yet due is lawful, one on rent already owed is not.
