1. הדין העולה — the rule that emerges

« אין הולכין בחוקות העובדי כוכבים (ולא מדמין להם) (טור בשם הרמב״ם) » (שו״ע יו״ד קע״ח:א)
« אֶלָּא יִהְיֶה הַיִּשְׂרָאֵל מֻבְדָּל מֵהֶן וְיָדוּעַ בְּמַלְבּוּשׁוֹ וּבִשְׁאָר מַעֲשָׂיו כְּמוֹ שֶׁהוּא מֻבְדָּל מֵהֶן בְּמַדָּעוֹ וּבְדֵעוֹתָיו. » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק י״א הלכה א)

The siman’s line of ruling. The obligation comes first: to be distinct from them in one’s dress and in the rest of one’s deeds. The prohibition serving it bears not on every resemblance but on two things — a usage marked by licentiousness, and a usage adopted with no reason, where a trace of worship may sleep. Whatever has a useful reason, or is done out of honour, is permitted, and the Rama says so plainly. Hence the four practical rulings: (1) a garment is judged by what it means, not by where it comes from; (2) the hair is aimed at only in the named forms; (3) a building is judged by its purpose; (4) one close to the government is wholly exempt.
This siman comes before us today as everyday questions — a garment, a haircut, a date everyone marks, a gesture at table. Each first requires an establishment of the facts: what the usage means here and now, and whether it has a reason. Neither is read in a book. For the application to your situation, ask your Rav.

2. מלבוש — what one wears

« ולא ילבש מלבוש המיוחד להם ולא יגדל ציצת ראשו כמו ציצת ראשם » (שו״ע יו״ד קע״ח:א)
« וכל זה אינו אסור אלא בדבר שנהגו בו העובדי כוכבים לשם פריצות כגון שנהגו ללבוש מלבושים אדומים והוא מלבוש שרים וכדומה לזה ממלבושי הפריצות » (רמ״א יו״ד קע״ח:א)

What practice retains (1) A garment peculiar to them as a sign of belonging is forbidden. (2) A garment whose meaning is licentiousness is forbidden, and the Rama gives his period’s example. (3) A usage of dress with no reason is forbidden. (4) A garment with a function — a uniform, work clothes, protection — is permitted, and the Rama says so expressly. (5) What is done out of honour is permitted, and the gloss ends on that example.
« שאין דרך הצנועים להיות אדומים בלבושם וצבע השחור הוא דרך צניעו׳ והכנעה » (ש״ך יו״ד קע״ח ס״ק ג)

And the point the Shach leaves in צ״ע No one disputes the Rama’s rule. But the proof the Maharik brings for it — from Rashi on Chullin — is questioned by the Shach in the name of his father and teacher: the story took place in a time of persecution, when changing one’s clothes is permitted in any case. The Shach concludes צ״ע. In practice one follows the gloss; but anyone who would stretch it to say that a Jew has, in ordinary times, no obligation to be distinct in his dress runs into the Rambam and into the first line of the gloss itself.

3. שער — the hair

« ולא יגלח מהצדדין ויניח השער באמצע ולא יגלח השער מכנגד פניו מאוזן לאוזן ויניח הפרע » (שו״ע יו״ד קע״ח:א)
« לֹא יִלְבַּשׁ בְּמַלְבּוּשׁ הַמְיֻחָד לָהֶן. וְלֹא יְגַדֵּל צִיצִית רֹאשׁוֹ כְּמוֹ צִיצִית רֹאשָׁם. וְלֹא יְגַלֵּחַ מִן הַצְּדָדִין וְיַנִּיחַ הַשֵּׂעָר בָּאֶמְצַע כְּמוֹ שֶׁהֵן עוֹשִׂין וְזֶה הַנִּקְרָא בְּלוֹרִית. וְלֹא יְגַלֵּחַ הַשֵּׂעָר מִכְּנֶגֶד פָּנָיו מֵאֹזֶן לְאֹזֶן וְיַנִּיחַ הַפֶּרַע מִלְּאַחֲרָיו כְּדֶרֶךְ שֶׁעוֹשִׂין הֵן. » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק י״א הלכה א)
Three readings, and what they leave in common What is settled in all three: the cut with shaved sides and the hair left in the middle is forbidden, and that is the בלורית the Rambam names; and so is the front shaved from ear to ear with the hair behind. What separates them lies in the sentence’s first member: the Bach and the Prisha see there hair grown for beauty in the manner of maidens; the Taz sees the never-cut hair of fighting men; the Beit Yosef sees only an announcement of the bellorit. The Baer Hetev reports the last two without choosing.

And the missing word The Taz at ס״ק ב and the Baer Hetev at ס״ק א both note that the seif lacks the word מלאחריו, which is found in the Rambam. Without it the clause no longer describes an identifiable cut; with it, it describes exactly the one the Rambam named. Whoever applies this clause must therefore read it whole.

4. בנין — what one builds

« ולא יבנה מקומות כבנין היכלות של עבודת כוכבים כדי שיכנסו בהם רבים כמו שהם עושים » (שו״ע יו״ד קע״ח:א)
What is forbidden, and what is not The Bach, whom both the Shach and the Baer Hetev report, restricts: buildings made for their council, their affairs and their courts are not within the prohibition, and may be built after those halls. The Taz goes the other way, on the Raavad’s words: both readings being possible, one must forbid on either. In practice the question turns on the purpose of the place and on what its form says to whoever sees it.
« אבל כגון אותם העשוים לועד שלהם להתיעץ על עסקיהם ולמשפט אין איסור לבנות כתבנית אותם היכלות. » (ש״ך יו״ד קע״ח ס״ק ב)

5. קרוב למלכות — the exception, and its reach

« מי שהוא קרוב למלכות וצריך ללבוש במלבושיהם ולדמות להם מותר בכל: » (שו״ע יו״ד קע״ח:ב)

The word בכל, and what it permits The seif does not say “the garment is permitted to him”: it writes מותר בכל. The Rambam at the source specifies the case — one who must sit before their kings and for whom it would be a disgrace not to resemble them — and names two things, the garment and shaving the front. The Taz explains by what mechanism the sages could permit: the Torah having specified nothing, the measure is theirs. The permission is therefore real, and it is bound to a necessity of office, not to convenience.

6. שלחן ופת — seif 3 in practice

« מי שאכל ושייר פתיתין על שלחנו לא יביא פת שלימה ויניח על השלחן: » (שו״ע יו״ד קע״ח:ג)
« משום שנאמר העורכים לגד שלחן פירוש לשם עבודת כוכבים אבל בפתיתין לחוד יש מצוה להניחם שיהא מוכן לעני: » (ט״ז יו״ד קע״ח ס״ק ו)
Three rulings, and they hold together (1) What is forbidden is bringing a whole loaf to set beside the crumbs after the meal. (2) A whole loaf that was already there need not be removed — the Shach writes so, leaning on Rashi and on the Beit Yosef in Orach Chayim, who reports from the Zohar that it is even good to bless over a whole loaf set there from the outset with that intention. (3) Crumbs left alone are no failing but a mitzva: they stay ready for a poor man.

The whole loaf on Shabbat night The Levush wished to forbid it by analogy with the seif. The Taz answers that the analogy does not hold: the word “Gad” is a term of fortune, and the Shabbat loaf is set for the honour of the day, whose honour lies in the two loaves — all the more since it is already set on the table straight from the oven, before nightfall. His conclusion carries no reservation: there is no prohibition in it at all. The Baer Hetev reports both positions.

7. ליל המילה — the table, the meal, the bed

« יש מקומות שנהגו לערוך שלחן ולשום עליו מיני מאכל בלילה שלמחר מלין תינוק ויש בזה איסור משום העורכים לגד שלחן » (רמ״א יו״ד קע״ח:ג)
« אבל לערוך מטה למזל התינוק יש מתירין » (רמ״א יו״ד קע״ח:ג)
What is forbidden, what is not, and what is no mitzva (1) Setting a table and placing foods on it to remain so, on the night before the circumcision: the gloss forbids it as setting a table for Gad. (2) Making a meal that night: the Shach writes that there is no prohibition in it, the prohibition bearing only on foods set down and left so. (3) But that meal has no standing of a mitzva: the Pitchei Teshuva says it in so many words, and refers to the responsa Ḥavot Yair and Shevut Yaakov. (4) Setting a bed for the child’s fortune: some permit, and the Taz gives the reason — it is the table that is written in the verse.

8. מקרים בני זמננו — contemporary cases

A garment or fashion from elsewhere

The gloss’s two questions arise in order: is there a mark of licentiousness, and is there a reason? What has a function — work clothes, a uniform, protection, recognized convenience — is permitted, and the Rama says so in his own words. What is worn for nothing, and means only belonging, falls under the second sign. A question for a Rav.

A haircut

The seif speaks not of length but of two named forms, and the Taz adds a third reading. What the three readings share is settled; what separates them requires a decision. The missing word noted by the Taz and the Baer Hetev must be restored before applying the second clause. A question for a Rav.

A communal building

The question is not style but purpose and what the form announces. The Bach permits council and court buildings built on their model; the Taz, on the Raavad’s words, forbids on both possible readings. A question for a Rav.

A public office requiring a dress

This is the case of seif 2, and the permission there is complete. The Rambam gives its two conditions: the necessity of appearing, and the disgrace that would follow from not resembling them. It is therefore not a matter of convenience. A question for a Rav.

The loaf on the table after the meal

The act aimed at is precise: bringing a whole loaf and setting it beside the crumbs. A loaf already there need not be removed, crumbs alone are a mitzva, and the Shabbat-night loaf has nothing to do with the seif according to the Taz. A question for a Rav.

The night before a circumcision

A table laid with foods left is forbidden by the gloss; the meal is not, according to the Shach; and it has no standing of a mitzva, according to the Pitchei Teshuva. The bed set for the child’s fortune is reported as permitted by some. A question for a Rav.

The Nekudot HaKesef

The Nekudot HaKesef do not comment on this siman; they are found elsewhere in Yoreh De‘ah, among them siman 174 and siman 176. None of their words is therefore invoked here, and none will be formed for the needs of a table.
