1. הדין העולה — the rule that emerges from the siman

The siman’s line of psak, in one sentence. The siman separates two acts — asking and doing — and the A’haronim’s line never loosens the prohibition of doing, while it loosens that of asking only at the threshold of danger to life. Wherever a permission remains — the sign, the incantation over a man in danger, the amulet, Sefer Yetzira, the question about a theft — the same A’haronim close it with a rule of bearing, and not with a new limit in law.

2. שאלה — consultation, and the question of the sick man

What the seif and the gloss forbid Four categories: those who gaze at the stars, lots, and — in the gloss — diviners, readers of omens and sorcerers. The source is single: תמים תהיה.

The question of the sick man — and it remains open. The Shakh reports four positions and does not explicitly decide. The Ba’er Hetev sums up the strictest; the Pit’hei Teshuva defends the most lenient and nevertheless closes with a clause of caution. The Maharshal’s two exceptions are the only genuinely operative formulations of the siman on this point.

3. ניחוש וסימן — what one may follow

What is permitted, and on whose authority. Seif ד permits treating house, child and wife as a sign; the Shakh explains at sק 4 that these are markers and not auguries, and adds a measure of caution drawn from Rashi — if one does not succeed, let him not make too much of a habit of it. At sק 5 he goes further and permits even acting on the verse recited by the child, and the Taz says the same at sק 3. The Ba’er Hetev, at sק 3, repeats the Shakh without reservation.

What remains disputed: the stated reason, and the inner court. The gloss of seif ג permits the act if the reason is not stated; the Shakh observes at sק 3 that the custom goes further still. The Taz considers at sק 2 extending the permission to the earlier cases and draws back. And the Pit’hei Teshuva, at sק 3, leaves open the question of one who says nothing but refrains: he brings a view that permits it and a source that seems to contradict it, and raises the difficulty against the Rama himself.

4. לחש במקום סכנה — the two breaches

The two breaches, and they are not of equal force. Seif ו permits an incantation over a scorpion’s bite, even on Shabbat, because the man is in danger and his mind is feared to become deranged — and the seif itself says the thing avails nothing. Seif ז permits “binding” a pursuing snake, and the Shakh there invokes the general rule of saving a life. The Taz draws a consequence wider than the case: where the saving of a life depends on a transgression, a man may perform it himself.

What the breach does not cover. The Shakh, at sק 7, expressly sets aside a protective intention as a ground of permission: one who gathers beasts by an incantation, even so that they do no harm and even directing them to a desert place, is forbidden. The difference from seifim ו and ז lies in one point: there, a man is in danger at that moment.

5. פסוקים וקמיעות — healing, protecting, writing

The principle, and it governs five seifim. Words of Torah were not given to heal the body but to heal the soul. The Taz states it at sק 8 and draws two consequences: the healthy man may read for protection — hence the bedtime Shema — and danger to life permits even being healed by them. The Shakh extends the rule to a sick adult.

The three regimes of the amulet, and they are in the seif’s source. Seif י״ב copies a responsum of the Rashba which the Beit Yosef gives in full, and the division is explicit there. (1) Healing by an amulet containing Names: permitted. (2) Carrying an amulet containing verses: permitted for protection, not for healing one who already has a wound or an illness. (3) Writing verses in an amulet: forbidden, and the Taz gives the reason at sק 9.

What the Pit’hei Teshuva adds, and he is closest to us. At sק 6 he reports that one permits placing a Torah scroll on a woman in hard labour and reading verses over her, because there is danger to life; then the view that restricts — not because the prohibition stands, but out of regard for the honour of the scroll, which is to be brought only to the door of the chamber. At sק 5 he reports a responsum forbidding a remedy performed far from the sick person, and himself notes that the proof requires study. For practical application, consult your Rav.

6. המתים — the cemetery and the adjuration

The cemetery, and why the custom stands. The definition of seif י״ג holds in three joint acts: to starve oneself, to spend the night in the cemetery, and to do so for that precise purpose. The Shakh reports at sק 15 that a responsum of the Maharah saw something of this order in vows to go to the cemetery, and that the Bach replied that the custom has long been established and there is no prohibition in the matter. The Ba’er Hetev, at sק 9, brings both without adding.

The adjuration: what is permitted, and what is permitted only per some. To adjure the sick man in his lifetime to return after his death: permitted, says the seif without reservation. To adjure after death: the parenthesis reports views permitting it provided the adjuration is addressed to the spirit and not to the body, against the Beit Yosef. The Shakh brings the Darkhei Moshe, who sets aside the Beit Yosef’s objection, and defends the distinction against the Levush. The seif itself does not make a ruling of it: it gives it in parentheses, as a view.

7. אחיזת עינים וספר יצירה

Illusion: the prohibition and its real reach. The seif forbids without reservation. And the practical point is the one the Shakh stresses at sק 17, repeated by the Ba’er Hetev at sק 10: the prohibition presupposes no sorcery. Appearance, tricks, quickness of hand are all included. This is what makes this seif the most current in the siman.

Sefer Yetzira: an entire permission, and a bearing that closes it. The Tur writes that it is permitted to act ab initio, and the seif adds that this holds even for performing an act. The Shakh, at sק 18, gives the ground — these are holy Names — then the conditions: holiness, purity, and the need of a sanctification of the Name or of a great mitzva; and he writes that this is not found in our generations. The Ba’er Hetev sums up at sק 11 and concludes: he who refrains shall be blessed. To quote the permission without that clause is to quote half the source.

8. שדים, הקטרה ולימוד — the last three seifim

Demons: the narrowest permission in the siman, and its clause. The work of demons is forbidden. There is one who permits enquiring of them about a theft, and the Shakh gives the ground at sק 20: because he performs no act — the Ba’er Hetev repeats it at sק 12. The gloss then reports a still wider view, permitting by adjuration in every case, and closes it on its own authority, citing the Beit Yosef.

The incense, and why seif י״ח depends on seif י״ט. Seif י״ח reports a view forbidding fumigation of the house with a fragrant herb, except to remove a bad smell. The Shakh gives the reason in four words at sק 21: it appears like fumigating for a demon. It is therefore a prohibition of appearance, and the way out the seif leaves removes it by giving the act its ordinary purpose.

The last seif, and the two clauses the Shakh works on. (1) One who fumigates to a demon: the Shakh concludes, after a long discussion, that he is liable as an idolater, and draws a consequence of status — he is then a מומר for the whole Torah, and not for a single matter. The Pit’hei Teshuva refers to this sק. (2) One who learns from the אמגושי: the Shakh writes that in his view one may learn from a sorcerer in order to understand and to rule, and that the severity of the seif aims at a narrower case. It is the last line of his commentary on the siman.

9. The apparatus of this siman — and what is not in it

The siman is served by four commentaries, and by them alone: the Shakh places twenty-three sק in it, the Taz ten, the Ba’er Hetev twelve and the Pit’hei Teshuva eight — fifty-three entries for nineteen seifim. Two seifim receive none: seif י, which permits the healthy man to read verses, and seif י״ז, on the table of the night of the circumcision.

The Nekudot HaKesef do not comment on this siman. They are found elsewhere in Yoreh De‘ah — this site cites them for example at simanim 174 and 176 — but they carry no entry here. No line of this level is therefore attributed to them, and no table has a column in their name.
The Arukh HaShulchan is not cited on this siman: its text is not accessible to us here. And the Admor HaZaken’s Shulchan Arukh does not cover Yoreh De‘ah — which is why this level 4 is called Halakha lema’asse and not “Daat HaRav”.

10. מקרים בני זמננו — contemporary cases

An astrologer, a drawing of lots, a “reading”

This is seif א in its letter: the stars and lots are named there, and the gloss adds diviners. The question of the sick man alone remains open in the sources, and the Pit’hei Teshuva closes it with a clause of caution. For practical application, consult your Rav.

A psalm for a sick person, an amulet worn

The line is the Taz’s at sק 8 and the Shakh’s at sק 12: words of Torah protect and do not heal. Danger to life overturns this entirely. And for amulets, the Rashba’s responsum given by the Beit Yosef separates the three regimes cleanly. For practical application, consult your Rav.

A conjuring act at a celebration

The Pit’hei Teshuva treats exactly this case at sק 7, and draws three distinct consequences from it: the performer, the one who commissions, and the one who watches. The Shakh, at sק 17, had already set aside the argument that it is not sorcery. For practical application, consult your Rav.

A practice received from a family

The Pit’hei Teshuva treats one at sק 4, and the manner of his answer is what should be retained: the Hatam Sofer first explains the reasoning of those who follow it, which removes it from pure augury, and nevertheless concludes that it is better not to attach oneself to what is mentioned neither in the Talmud nor among the poskim.
