1. שאלה ומעשה — the line with which the siman opens

The text, and the only source the Rama gives it The seif forbids no act: it says that one does not enquire. And the source assigned to it is a verse that describes no deed.

Ḥakira: what does תמים תהיה forbid? (א) An act of a particular kind — surrendering oneself to a science of the future — and the prohibition would then be of the same nature as that of augury, only lighter. (ב) No act at all: it is a demand of bearing, resting only on the consulting itself, and incommensurable with the prohibition of acting. The Shakh holds (ב), and says so in the very sentence in which he names the other register.

Nafka mina (1) The sick man. If (ב), the question reopens: nothing is done, nothing is effected — that is the next section. (2) Enquiring of demons about a theft. Seif ט״ז permits it, and the Shakh gives a ground that is exactly (ב). (3) The table on the night of the circumcision. Conversely: no consultation, no act of sorcery — and seif י״ז nevertheless forbids, because of a sentence. This third case shows that the Shakh’s line is not a line of severity but a line of kind.

The yessod, and it comes from the gemara itself. Seif ה forbids gathering beasts by an incantation, and the Shakh adds that a protective intention changes nothing. He writes “ש״ס” — and it is Sanhedrin, where Abaye draws exactly this consequence. The act is judged for what it is, not for what is wanted through it: the exact counterpart of the line laid down at the first sק, where speech is judged for what it is and not for what it produces.

2. החולה — four positions and one closing clause

The ma’hloket, in the order in which the Shakh builds it. (1) He first reads in the Piskei Maharai — the very source of the gloss — that since the only obstacle is תמים תהיה, a sick man might consult. The Beit Yosef reports that reading in the author’s own name. (2) The Maharshal, after a long discussion, concludes the opposite way, and sets two precise exceptions. (3) The Beit Yosef, in the name of the Zohar, holds it a great prohibition even for a sick man — and the Shakh brings all three without explicitly deciding.

The Mishkenot Yaakov’s kushya, reported by the Pit’hei Teshuva. On what does the Zohar rest in holding consultation of a sorcerer a great prohibition? If on the view, in the gemara, that a ben Noah too is commanded concerning sorcery, then the Zohar follows a position the halakha does not follow. And if that position falls, there remains only the prohibition of speech and תמים תהיה — precisely what the Shakh had laid down at the first sק.

And a fourth voice, which the Ba’er Hetev places in parentheses. It disputes not the law but the fact: it holds that what the Torah forbade was the sorcery of ancient times, and that what is practised today is empty. The argument is of another order than the preceding three — it does not move the line, it denies that anything stands on the wrong side of it — and the Ba’er Hetev marks this by setting it apart.

Nafka mina The Maharshal alone of the four states cases. (1) Danger to life: permitted. (2) Danger to a limb only: forbidden — and that is a ’hidush, for elsewhere danger to a limb often suffices. (3) Illness that came through sorcery, accident or an evil spirit: permitted. The Ba’er Hetev sums up the scale in one line, and the Pit’hei Teshuva adds his own, which ends in the clause the Rama uses at seif ט״ז.

3. אמירת הטעם — the stated reason, and what stays in the heart

The gloss, and what it moves The seif forbids slaughtering a hen that crowed like a rooster. The gloss permits the same act, on a condition that bears neither on the act nor on the intention but on speech: that he not say why. And the Shakh reports that the observed custom goes further still.

The Taz’s kushya, which he raises against himself. If silence about the reason suffices to permit, why should it not suffice in the cases listed at the head of the seif? One whose bread fell from his mouth and who refrains from setting out while saying nothing ought to be permitted as well — and the seif nowhere says so.

The Taz’s terutz, in two strokes. (1) Here there is before him a change of nature — a hen crowing like a rooster — which is the case in none of the earlier examples. (2) And there is in the man a measure of dread. It is that dread, and not the augury, that the permission carries: he is left to act, provided he states nothing.

And the question the Pit’hei Teshuva raises in the Taz’s place. The Taz asked whether one may act while saying nothing. The Pit’hei Teshuva asks the reverse: one who says nothing and refrains — who holds back from his affairs because of these portents — is he permitted? The Shiltei Giborim answers yes, since it is fitting for a man to reckon with what people are concerned about. But the Pit’hei Teshuva at once brings the Tosafot on Bava Metzia, who ask of just such a practice whether it is not augury — and draws from it a difficulty he raises not only against the Shiltei Giborim but against the Rama of our seif.

Nafka mina, and the Pit’hei Teshuva takes it from a concrete case. At sק 4 he brings the question put to the Hatam Sofer about a builders’ practice — and the answer is twofold. The Hatam Sofer first explains the reasoning of those who follow it, which removes it from pure augury. He then concludes that it is better not to attach oneself to such things, which are mentioned neither in the Talmud nor among the poskim. The conclusion therefore rests not on the classification but on the bearing — which is this siman’s own manner.

4. סימן לעתיד — and the Rambam’s apparent contradiction

The ma’hloket as the gloss sets it. May a man set himself a sign concerning something to come — “if such a thing happens to me, I shall do this”? The Tur and the Radak permit it, on the example of Eliezer and Yonatan; the Rambam and the Semag forbid it. The gloss brings both and does not arbitrate — it closes with a sentence that is not a ruling.

A kushya on the Rambam, and it lies in his own chapter. At halakha ד the Rambam counts among the forbidden one who sets himself signs for the future, like Eliezer the servant of Avraham — the very example on which the Tur relies to permit. At halakha ה he permits the house, the animal, and the verse asked of a child. How do the two stand together?

Terutz, and the Rambam gives it himself in halakha ה. The criterion he states has three members: he did not direct his acts by the sign, he did not refrain from acting, and he made himself a sign about a thing that had already happened. The last member is decisive: the retrospective sign — the house that has brought me fortune since I bought it — commands nothing. The prospective sign, on the contrary, binds a future act, and it is that one halakha ד ranks with ניחוש. The Shakh sets aside the case of Eliezer and Yonatan in another way, by referring to the Levush and the Bach: they are different.

Nafka mina, and it is wider than it looks. The Shakh, at sק 5, is not content to permit asking a child for his verse: he reads in the Rama and the poskim that one may even act upon it, for the future, “for it counts somewhat as prophecy”. The Taz says the same at sק 3, and the Ba’er Hetev repeats the Shakh. The permission thus ceases to be merely retrospective — and that is exactly the point halakha ד of the Rambam seemed to close.

5. לשון הקודש ולשון לעז — the Bach against Rashi, and the Shakh’s answer

Rashi in the name of his teacher, and the Rama who records it The seif forbids one who whispers over a wound to read a verse thereafter. The gloss restricts: this is forbidden only in the Holy Tongue. That is, it is the Name borne by the tongue of Torah, and not the content of the verse, that makes the prohibition.

The Bach’s kushya, reported by the Shakh. In Perek Kira, Abaye teaches that “matters of holiness” may not be said, even in a secular tongue, in a bathhouse or a privy. Therefore, says the Bach, what is forbidden in the Holy Tongue is forbidden in a secular tongue too; and he adds that the poskim did not report Rashi’s position.

The Shakh’s terutz, and it is unusually sharp. The Bach’s proof bears on something else. “Matters of holiness” means a holy subject — a ruling, a word of Torah — which one does not say in an unfit place, and the tongue changes nothing there. Here it is not the subject that is at issue but the Name: and a Name in the Holy Tongue is a Name, while in a secular tongue it is no Name at all. The Shakh gives a proof that decides the matter: one is permitted to erase a name written in a secular tongue. He nevertheless concludes that one should be careful in all one can — and that where one cannot, one cannot.

6. הרקיקה — the order of the two acts

A kushya on the Taz’s reason. The Taz gives the reason for the heaviest penalty: mentioning the Name of Heaven over a spittle is an affront. But one also spits before “ואנחנו כורעים”, and the Name is mentioned afterwards — why is that not the same affront?

The Taz’s terutz. There, everyone knows that the spitting is directed at idolatry, and that the Name mentioned afterwards is on the contrary the honour of Heaven. The two acts therefore do not bear on the same object. Here, on the contrary, the spitting and the verse both bear on the wound — and the second takes up what the first left.
« ועל כן אין להקשות ממה שנוהגין ברקיקה קודם ואנחנו כורעים דשם הכל יודעין שהרקיקה היא לבזיון הגילולים של עובדי כוכבים והיא כבוד שמים שמזכיר אח״כ » (ט״ז יו״ד קע״ט ס״ק ה)
And a ma’hloket about the order of the two acts. Rashi reads that only one who whispers after spitting is forbidden. The Tur writes “he mentions the Name of Heaven and spits”, implying that the prohibition holds even when the spitting comes second. The Taz notes the gap; the Ba’er Hetev sums it up. The difference is not theoretical: it decides half the real cases.

Nafka mina — the reach of the middle degree. The seif says: if he does not spit, “there is at least a prohibition”. The Taz specifies at sק 7 that this holds even without mentioning the Name, and for any illness, not for a wound alone. The Shakh, at sק 10, draws the counterpart: when one reads a verse without a Name, even with spitting there is only a prohibition — and he takes the occasion to set aside the Levush’s reading, which located the affront in spitting on the verses themselves.

7. רפואת הגוף ורפואת הנפש — and the two subjects of seif י״ב

The yessod, and it is the Taz who states it. Words of Torah were not given to heal the body but to heal the soul. The Rambam says it first, and it is what separates seif ט from seif י: the stricken child needs healing, the healthy man needs only protection. The Shakh extends the rule to the sick adult, and himself refers to the next seif.

A kushya on seif י״ב, and it is plain to see. The seif opens by permitting healing by an amulet, and continues by saying that it is “only to protect oneself from falling ill, but not to be healed by them”. The two members contradict each other word for word. How are they to be read?

Terutz — and it is not a reading, it is the source. The seif copies a responsum of the Rashba, which the Beit Yosef gives in full. There one sees that the two members do not speak of the same object: the first permits healing by an amulet containing Names; the second deals with amulets containing verses, and it is to those, and those alone, that “only to protect” refers. The restriction then follows exactly the Taz’s principle: it is words of Torah that do not heal the body. And the Rashba adds a third regime — writing — which is the Taz’s at sק 9.

(1) Danger to life lifts the prohibition: the Taz says so explicitly for the stricken child, and the Pit’hei Teshuva reports it from the Be’er Sheva for the woman in labour. But the same Pit’hei Teshuva at once brings the view that restricts — not because the prohibition stands, but out of regard for the honour of the scroll. (2) At sק 5 he adds a criterion of another order: what is done far from the sick person, and he himself notes that the proof requires study.

8. אוחז את העינים — מעונן or מכשף, and two competing solutions

The seif, and the Tur’s position that precedes it The seif forbids the אוחז את העינים without saying under what heading. The Tur places him under the מעונן and writes that there is only a prohibition here, without lashes — because he does nothing.

A kushya on the Rambam, and “many have raised it”. In the laws of the מעונן the Rambam writes that the אוחז את העינים is of that kind, and is flogged. In the laws of the מכשף he writes that he receives makat mardut, since the prohibition stated of the sorcerer is a לאו carrying judicial death, for which one is not flogged. The two passages contradict each other; and there remain, notes the Beit Yosef, two further difficulties: why flog in the first place, since there is no act? And why, in the second, need the reason of a לאו carrying judicial death?

First terutz — the Beit Yosef’s. There is no contradiction, because there is no absence of act: every אוחז את העינים does something, or he would seize no one’s eyes. What the Rambam denies is that he performed the wondrous act he is seen to perform — not that he did nothing at all. He would therefore deserve two floggings, one as מעונן and one as מכשף, and it is only from the second that he is exempt, for the reason the Rambam gives in its place.

Second terutz — the Taz’s, and it holds another line. The Taz does not rescue the act: he accepts that there is none, and holds that the Rambam flogs all the same, because in the eyes of the onlookers he performs an act. He gives a precedent: one who muzzles an animal by voice is flogged, though he did nothing with his hands, since through his voice the animal threshed without eating. Then he lays down the distinction that divides the two texts: the אוחז את העינים of the מעונן makes it appear that he himself performs a wonder; that of the מכשף makes it appear that through this man something happened — the cucumbers uprooted from the field. The first falls under the לאו of מעונן and is flogged; the second under that of מכשף and is not.

If what is aimed at is the appearing to perform a wonder, then illusion produced by tricks and by quickness of hand falls fully within it, with no sorcery at all in play — and that is what the Shakh reports from the Bach in the name of the Rambam, and what the Ba’er Hetev repeats. The Pit’hei Teshuva draws from it, at sק 7, three distinct consequences about wedding illusionists: the one who performs, the one who commissions, and the one who watches.

The yessod, and the Shakh reports it from the Levush. These are not procedures but holy Names, to which the Creator gave power; one who acts through them shows the greatness of the Name. That is why the permission is lekhatehila — and that is also why it is conditioned: one must engage in them in holiness and purity, and for the need of sanctifying the Name or of a great mitzva.

The Shakh writes that this is not found in our generations, and that even in their times Yeshayahu was punished for it. Here the siman shows its own shape: a permission entire in law, and closed by bearing.

The Ramah infers that one who fumigates to join it to himself is liable as a בעל אוב. The Beit Yosef does not see what the בעל אוב has to do here, and writes that the words must be deleted.

The Shakh’s kushya on the Beit Yosef, and it comes from the gemara. In the chapter of the Four Deaths, Ulla establishes that the בעל אוב of the mishna in Keritot is one who fumigates to a demon. Rava objects that such a man is an idolater, and corrects: it is one who fumigates in order to bind. It emerges from the gemara itself, therefore, that “one who fumigates to a demon” was indeed proposed as a בעל אוב — which the Beit Yosef declared to be beside the point.

And the Ramah, who took up Ulla’s wording as it stands, must therefore also say “as an idolater”.

Nafka mina, and it is the Shakh who names it. It bears not on the penalty but on the status. Liable as an idolater, the man becomes a מומר for the whole Torah — with all that this entails at simanim 2 and 119. Liable as a בעל אוב, he is מומר in one matter only. The entire discussion, which seemed to turn on a textual reading, issues in a difference of standing. The Pit’hei Teshuva refers to this sק and adds a responsum.

The gemara, and the two halves of its sentence Rav Zutra bar Toviya in the name of Rav teaches that one who learns a single thing from the מגוש is liable to death. And the gemara itself, a few words later, derives from this the meaning of the word: were the מגוש a sorcerer, one would have no answer to the verse “you shall not learn to do” — from which it is derived that one does learn, in order to understand and to rule.

The Shakh writes that this reading is forced and holds to his own. It is the last line of his commentary on the siman, and he ends it as he began: by separating what one learns from what one does.

The Shakh lays it down at the first sק, returns to it at sק 20 to permit, at sק 23 to permit again, and at sק 22 to distinguish two statuses. The Taz displaces it once — at the אוחז את העינים, where what counts is no longer the act but what the eyes receive — and that exception is worth remembering.
