The line of psak of the siman. Three prohibitions, and two ways of examining them. For the כתובת קעקע one looks at the act: was there a gash and a filling with a substance that marks? If so, the prohibition is constituted without any motive having to be established; if one of the two is missing, there is no penalty — which says nothing about the prohibition. For the שריטה and the קרחה one looks at the motive: a dead person, or an idol for gashing. Outside of that the gemara expressly exempts, and the gloss on seif 6 even permits.
The cases of this siman present themselves today in forms the sources do not name — cosmetic ink, permanent make-up, medical marking, gestures of mourning. Each first requires an establishment of the facts: was there a gash and a filling, or only one of the two; is there a wound that explains the mark; was the act done for a dead person. These are questions of fact, and they are put to the Rav together with the facts.

2. כתובת קעקע — what makes the prohibition, and where it begins

What the seif requires is technical, and the Rambam derives from it the exemption of each act taken alone. The Chakh adds in the name of the Bach that the order changes nothing.

And the exemption of the one to whom it is done holds only for the penalty: the Chakh derives from the following siman that a prohibition remains even without assisting, and the Ba’er Hetev repeats it without reservation.

The Pit’hei Teshuva, for his part, treats of the penalty and not of permission: he concludes that real letters are required, one sufficing, and is careful to say that the permission of seif 3 might lift only the penalty.

3. אפר מקלה — the mark that explains itself

The seif permits, and the reason is not that the mark disappears — the Taz writes the opposite. What permits is that the wound makes the motive visible.

4. שריטה על מת — the motive, the means, and the two views

Seif 5 sets out the two motives and the asymmetry of the means; seif 6 removes the condition of presence; seif 7 leaves two views facing each other.

The Chakh gives the practical division on this last point: the one who forbids speaks only of the act done for the dead; done over the Torah of a great man who has gone, it remains permitted. The Ba’er Hetev repeats it word for word.

The gloss on seif 6 permits for another grief, and that is the Beit Yosef’s reading of the Tur. The Bach does not accept it, and the Chakh reports his opposition, naming it last; the Ba’er Hetev reports only him.

6. קרחה — the measure, the count and the warning

The penalty is measured; the prohibition is not. Seif 9 gives a gris, then two hairs, then a view forbidding from a single hair. And the gloss on seif 12 adds an instruction that depends on no measure: to warn, lest one come to it.

7. הנעשה בחבירו — the actor and the one who assists

Seif 11 settles the case where the act is done to another, and makes the one who lends himself an actor as soon as he acts knowingly. The Perisha, reported by the Chakh, extends the same division to tattooing.

8. מקרים בני זמננו — contemporary cases

The tattoo

The act unites both components of seif 1 in a single motion. Seif 2 exempts the one to whom it is done, and the Chakh at ס״ק ד establishes that a prohibition remains even without assisting. The sources of this siman settle the act; they say nothing further, and we shall not go beyond what they carry.

A mark that is not writing

The Pit’hei Teshuva reports the Me’il Tsedaka’s question: does the penalty require letters? He concludes that it does, one letter sufficing. This concerns the penalty; on the prohibition he pronounces nothing further, and on the contrary recalls that a rabbinic prohibition may remain where the penalty falls away.

A mark made in the course of treatment

This is the case of seif 3, and the Taz gives it in its broadest version: even hard ash, whose trace persists after healing. The criterion is the Chakh’s — the wound proves the motive. Whether a given situation falls within this frame is a question of fact.

The gestures of grief

Striking oneself until blood flows: two views at seif 7, and the Chakh draws the division. Tearing out one’s hair: below the measure there is no penalty, and the gloss on seif 12 nonetheless asks that one be warned. Wounding oneself for a grief other than a death: the gloss on seif 6 permits, the Bach maintains a prohibition.

Seif 11 holds both liable when both act knowingly, and only one when the other is inadvertent. Seif 4 and the Pit’hei Teshuva at ס״ק ב treat the particular case of the slave, and the Pit’hei Teshuva specifies which slave is meant.

What the siman leaves to the Rav. Three questions of fact, always the same: does the act have both its components; is there a wound or a treatment that explains it; and was the act done for a dead person. The law itself stands in one line — the body is not to be marked, and mourning opens no right over it.
Note: the Admur HaZaken did not write a Shulchan Arukh on Yoreh De’ah. This level 4 is a level of psak — Chakh, Taz, Ba’er Hetev, Pit’hei Teshuva, Tur, Beit Yosef and Rambam — not a “Daat HaRav.” The Nekudot HaKesef do not comment on this siman, and nothing is therefore quoted from them here; they are found elsewhere in Yoreh De’ah, at siman 174 as at siman 176.
