1. שלושה לאווין — what holds tattooing, gashing and baldness together

The Tur names the same category twice. He opens on tattooing by saying it is a custom of the nations, and he says it again for baldness and gashing. The motive is therefore single — but it is not written in the verses, and that is what will matter.

Ḥakira: what unites these three prohibitions? (א) The motive. They are practices of the nations, and the Torah puts away what resembles them — this is the Rambam’s reading, who places all three in his chapter of חוקות הגויים. (ב) The object. It is the body of the Jew that is at stake: it is not his to inscribe as he pleases, and mourning grants no such right. The Beit Yosef draws this second reading from the verse itself — בנים אתם לה׳: it is because they are sons that it is forbidden to them.

Nafka mina. (1) If the motive is imitation, a practice that had ceased among the nations ought to be relaxed; if it is the body, nothing changes. (2) The Taz of the next siman will draw precisely this consequence for the פאות, and will set the Tur against the Rambam on that very point. Here the Chakh uses the first motive to explain the permission of ash — the wound proves he is not doing this after the customs of the nations — which shows that the motive of imitation is not ornamental: it does work.

The Rambam defines by two acts, and derives from that the exemption of each taken alone.

Kushya. If writing and incising are two necessary acts, the order ought to matter: one who dyes first and gashes afterwards has not “written and then incised,” but the reverse.
Terutz of the Bach, reported by the Chakh at the first ס״ק and by the Ba’er Hetev. These are not two successive acts but two components of a single result: a lasting mark inscribed in the flesh. The order is therefore immaterial, and the Shulchan Arukh in fact writes it in the reverse order from the Rambam — he gashes, then he fills.

3. שם עבודת כוכבים — Rabbi Shimon against the Sages, and what remains of the dispute

The dispute of the mishna. The Sages hold one liable as soon as there is writing and incising; Rabbi Shimon ben Yehuda in the name of Rabbi Shimon requires that he write a name, and the gemara specifies which: a name of idolatrous worship.

And the practical consequence is nil, which is the point. The Beit Yosef says it expressly: even for Rabbi Shimon it is forbidden to write any writing at all; what is lacking is the penalty, not the prohibition. The Tur therefore rules like the Sages without having to refute anyone — he is liable for whatever he writes — and the Shulchan Arukh does not even mention the dispute.

4. אפר מקלה — from Rav Malkia’s prohibition to Rav Ashi’s permission

Two Amoraim, and the Shulchan Arukh keeps only the second.

The Beit Yosef explains why: Rav Ashi is the later. And the Taz pushes the permission to its hardest case — not merely soft ash, but hearth ash which is hard, which hollows out the place of the wound, and whose mark is still visible long after the wound has healed.

Nafka mina, and it lies in the reason itself. If the permission rested on the mark fading, hard ash would be excluded. The Taz shows that it does not: what permits is that the wound is there — מכתו מוכיח עליו. The criterion is therefore not the durability of the mark but the evidence of the motive. The Chakh puts it in his own words.

5. הרושם על עבדו — an exemption the gloss closes again

An exemption, and a gloss that closes it again. Seif 4 exempts one who marks his slave so that he should not flee; the Rama adds on his own view that a priori it is nonetheless forbidden.

The Pit’hei Teshuva asks which slave is meant, and the answer shifts the line. In the name of the Noda BiYehuda: the seif speaks of a slave who was circumcised and immersed — and so is partly bound by the mitzvot; a slave bought by a Jew who was neither circumcised nor immersed does not fall under the prohibition, just as it is permitted to gash the flesh of a Canaanite.

6. מכה בידו — the dispute of the Ramban and the Rosh on the Rabbi Akiva episode

The dispute of seif 7, and each side bears a name. The Ramban permits striking with the hand until blood flows; the Rosh is astonished at it.

Kushya of the Rosh, and it is strong. Since gashing is forbidden both by hand and by implement, how should a blow struck by hand be permitted? The distinction between gashing and striking does not coincide with that between hand and implement.

Terutz of the Tosafot, reported by the Tur and taken up by the Taz. The episode of Rabbi Akiva proves nothing, because he was not striking himself for the dead but for the Torah that was departing with him. The dispute then reduces to the reading of the episode, and the Chakh draws from it the practical line: the one who forbids aims only at the act done for the dead.

7. צער אחר — the Beit Yosef, the Bach, and what the Rama wrote

The Beit Yosef reads the Tur and concludes a permission. The Tur writes that one who gashes himself for another grief is exempt; the Beit Yosef answers that the word is not meant strictly — there is not even a prohibition. The Rama carries this reading into the gloss on seif 6.

The Bach opposes it, and the Chakh reports both.

Nafka mina. The Ba’er Hetev reports only the Bach — without the Beit Yosef’s reply — which gives the strict reading a weight the Chakh had already given it by naming it last.

8. ביד ובכלי — the reversal the gemara imposes on the beraita

The beraita says one thing, and the gemara makes it say the reverse.
« עַל מֵת, בֵּין בַּיָּד בֵּין בִּכְלִי – חַיָּיב, עַל עֲבוֹדָה זָרָה, בַּיָּד – חַיָּיב, בִּכְלִי – פָּטוּר » מכות כ״א ע״א
« אֶלָּא אֵימָא: בַּיָּד – פָּטוּר, בִּכְלִי – חַיָּיב » מכות כ״א ע״א
The yesod, and it explains the asymmetry of seif 5. For the dead, the verse speaks of the act — to gash — and it matters not with what. For idolatry, the verse describes a precise practice, that of the prophets of Baal: and they gashed themselves after their manner, with swords and lances. What is aimed at is therefore not the fact of wounding oneself but the ritual form of the act — and that form Scripture gives with an implement.

9. שיעור קרחה — three tanna’im, and a prohibition with no measure

Three tanna’im on the measure, and the Shulchan Arukh keeps two.
« וְכַמָּה שִׁיעוּר קׇרְחָה? רַב הוּנָא אוֹמֵר: כְּדֵי שֶׁיֵּרָאֶה מֵרֹאשׁוֹ. רַבִּי יוֹחָנָן אוֹמֵר מִשּׁוּם רַבִּי אֶלְעָזָר בְּרַבִּי שִׁמְעוֹן: כִּגְרִיס » מכות כ׳ ע״ב

And the last clause of the seif is no longer a measure. The Tur writes that a prohibition exists even for a single hair. The Beit Yosef seeks whence this is drawn and proposes the case of plucking a white hair from among black ones; at the same time he raises a difficulty about the Rosh’s two hairs — for if there is no liability, there are no lashes to give.

Nafka mina, and it is the most practical in the siman. One who tears out a few hairs in the emotion of bereavement does not reach the measure of liability. The gloss on seif 12 nonetheless says he must be warned — and its reason is not liability but the risk of coming to it.

Seif 11 makes the one who lends himself an actor. And the Perisha, reported by the Chakh at the last ס״ק, extends the rule to the כתובת קעקע: the same division between intentional and inadvertent holds there.

The yesod of the siman. Three marks, and three regimes of counting — but one principle: it is the act that is counted, and the number follows what was done, not what was felt. Five gashes for one dead: five. One gash for five dead: five — because the verse adds לנפש, and every soul counts. One baldness for five dead: one only — because the verse did not say so there. The siman never measures grief; it counts gestures.

And the following siman takes up the third term of this one. At siman 181 · קפ״א the Shulchan Arukh treats of the פאות — hair again, but this time with no dead and no mourning: what is counted is no longer the number of gestures but the place on the head and the implement in the hand.
