Ḥakira: what does the verse forbid? (א) The act of adornment. Forbidden is every gesture by which a man adorns himself as a woman adorns herself — the prohibition lies in intention and purpose, לנוי וליופי. (ב) The result of indistinction. Forbidden is what makes a man no longer distinguishable from a woman — the prohibition lies in the effect produced on another’s eye.
Nafka mina (1) Underarm hair, which no one sees: on (א) it is forbidden where it is a woman’s act; on (ב) it should not be forbidden at all — and indeed it is forbidden only rabbinically. (2) A single garment, while the rest of the dress betrays who wears it: on (א) it is an adornment and forbidden; on (ב) there is no indistinction. The gloss rules for the prohibition. (3) A garment worn against rain: on (א) there is no adornment and the Taz permits; on (ב) the Bach forbids, since they walk together unrecognized. Both sides of the ḥakira are thus represented in the commentaries.

And the siman holds both together The Taz, at ס״ק ו, does not choose between the two sides: he ranks them. What makes one indistinct — a garment — is from the Torah and carries lashes; what is only an invisible adornment — underarm hair — is forbidden only rabbinically. The criterion he gives is explicit: דאינו ניכר בפרהסיא. The ḥakira is therefore resolved not by eliminating a side but by ordering them: (ב) founds the higher degree, (א) the lower.

2. תער ומספרים — the Tur’s three opinions, and the Taz who is of none

« המעביר שער בית השחי ובית הערוה אפילו במספרים כעין תער היו מכין אותו מכת מרדות » (שו״ע יו״ד קפ״ב:א)
The dispute, as the Tur reports it Rabbenu Tam holds the law is the same everywhere on the body: the razor is forbidden, scissors are permitted. A second opinion distinguishes: scissors are permitted only on the other limbs; at the underarm and the pubis they too are forbidden. And the Tur concludes that such is the ruling of the Rosh, his father. The seif follows this second opinion — hence אפילו במספרים כעין תער.

And the Taz, who is of neither The Taz opens his comment with a reference to the Beit Yosef, at the end of the previous siman, in the name of Rabbenu Yona: from it, everywhere on the body the razor is forbidden. And he himself notes that this position coincides with none of the opinions the Tur reports here — והוא דלא כמאן בדעות שהביא הטור כאן. The wording is strong: he does not say the Tur omitted an opinion, he says an opinion exists outside his survey.

Nafka mina The seif’s permission concerns the other limbs, and it is given with scissors. The Shach closes it in a word at ס״ק ג — in the manner of a razor, but not with a razor — and the Taz says the same at ס״ק ב. There remains the question the Taz opened at ס״ק א: the other limbs with a razor. The seif does not treat it; the line of Rabbenu Yona, reported by the Beit Yosef, would forbid it.

3. לכתחילה והחברים — the reach of the gloss

« בד״א במקום שאין מעבירין אותו אלא נשים כדי שלא יתקן עצמו תיקון נשים אבל במקום שמעבירין אותו גם האנשים אם העביר אין מכין אותו: » (שו״ע יו״ד קפ״ב:א)

Two additions, and they do not run the same way The seif had said only that where men do it too, he is not struck — a wording that leaves the question of lechatchila open. The gloss closes it: ואפילו לכתחילה שרי. The Shach at ס״ק ב and the Baer Hetev at ס״ק ב both specify the exact reach of those three words: they hold where men also remove it, and nowhere else. Then the gloss adds a second clause running the other way: the ḥaverim refrain in every place.

What the חברים are here The gloss does not say a doubt remains in the law: it has written “permitted even at the outset”. It adds a conduct. Two readings are possible, and the gloss does not decide: either the ḥaverim take account of the opinion forbidding everywhere, or they hold that even permitted, this act is not of their measure. The first makes their abstention a stringency of law; the second, a measure of conduct.

4. מראשו ועד רגליו — the Shach’s ל״ד

« מי שמגלח כל שיער שבו מראשו ועד רגליו י״א שמותר לו לגלח גם של בית השחי ובית הערוה: » (שו״ע יו״ד קפ״ב:ב)
« כתבו הגאונים מי שמגלח כל שער שבו מראשו ועד רגלו שמותר לו לגלח גם של בית השחי ובית הערוה דכיון שמגלח כל גופו אין זה יפוי אדרבה ניוול הוא אלא שלשם רפואה מגלח » (טור יו״ד קפ״ב)
Difficulty: the seif contradicts the previous siman The seif writes מראשו ועד רגליו. Yet the preceding siman forbids rounding the head and destroying the beard: a man cannot shave his head in the sense this seif seems to say. The permission would then rest on an impossible case.
The Shach’s answer, in the name of the Prisha It is not exact: “from his head” does not mean the hair of the head but the top of the body. One must read from the top of his body to the bottom of his body. The correction is not merely one of reading: it saves the seif by making it a real case — a man who, for treatment, removes the hair of his whole body.

The Beit Yosef, and the Shach’s formula
« שמותר כו׳. דודאי לרפואה קמכוין דאי ליפוי אדרבה ניוול הוא לו ואפשר דאפילו במפרש דליפוי קא עביד לא משגחינן ביה אלא אמרינן ודאי לרפואה קעביד. ב״י וכ״כ הב״ח אלא שנראה מדבריו כחולק אמפרש דליפוי קעביד ע״ש: » (ש״ך יו״ד קפ״ב ס״ק ה)

Ḥakira: what decides, the act or the declaration? (א) The declared intention. Since the prohibition lies in the purpose, one who declares he acts for beauty forbids it to himself by his word. (ב) The nature of the act. Shaving the whole body is objectively a disfigurement; a declaration cannot turn a disfigurement into an adornment, and so it is not heeded. The Shach writes ואפשר — he proposes (ב) without imposing it; and he adds that the Bach seems to diverge on this very point.
Nafka mina, and it runs through the whole siman On (ב) the measure is never the actor’s word but the act’s objective meaning — and that explains why seif 4 permits one who suffers without demanding any declaration of him, and why seif 1 is measured by the usage of the place and not by what each has in mind. On (א) one would have to examine intention each time, which the siman never asks.

6. לחוך בידו ובבגדו — Rashi, the Tosafot and Rabbi Tarfon

« אסור לחוך בידו בשער בית השחי ובית הערוה כדי להשירו אבל מותר לחוך בבגדו להשירו: » (שו״ע יו״ד קפ״ב:ג)
« אסור לחככו בידו כדי להסירו אבל מותר לחככו בבגדו להסירו » (טור יו״ד קפ״ב)
The sugya is in tractate Nazir, in the chapter of the two nazirs, and the seif comes directly from it. Rashi there comments on the question what of scratching? naming only the underarm; the Tosafot in the same place write that the rule holds for the underarm and the pubis. From that gap is born a discussion that the Taz and the Shach conduct almost word for word in parallel.
The Bach’s position Since Rashi named only the underarm, the pubis must be forbidden in any case — and for another reason than ours: thought. The Bach leans on Rabbi Tarfon’s word in the chapter כל היד. The permission of the garment would then hold for the underarm alone.

Two refutations, one of the Shach, one of the Taz The Shach writes that he looked at Rashi in that place and finds nothing of the kind; that Rashi named one of the two and the other follows; that the Tosafot say so expressly; and that from Rabbi Tarfon’s word there is no proof, since on the contrary it is said there that with a thick cloth it is permitted, a thick cloth not warming. The Taz conducts the same demonstration and presses it further: in the preceding question too Rashi named only the underarm, though the question certainly concerned the pubis as well — proof that he names one for both.

And the demonstration the Taz adds alone The Taz takes on Rabbi Tarfon’s word itself: it cannot be taken strictly, for then the praise of Rabbi — called “the holy” because he never put his hand below his belt — would be no distinction at all, everyone being bound to it. He also dismisses the easy answer, then reads the Rambam in Hilkhot Issurei Biah: two propositions are set there separately, one with the word forbidden and the other without — a sign that the second is only an added measure of holiness.

What the sugya decides, and what it leaves The Shach and the Taz arrive at the same place: the rule of seif 3 holds for both places, and the garment is permitted in both. But they do not arrive by the same road, and the Taz goes further — he touches the status of Rabbi’s conduct, and expressly distinguishes what is a prohibition from what is a measure of holiness. That distinction overruns the siman: it is the same as that of the ḥaverim of seif 1.

7. מלקות או מדרבנן — the dividing line of ס״ק ו

« ואפילו באחד מן הבגדים אסור אף על פי שניכרים בשאר בגדיהם שהוא איש או אשה » (רמ״א יו״ד קפ״ב:ה)
Difficulty A single garment, worn by someone whose remaining dress clearly marks him as a man or a woman, misleads no one. Why does the gloss forbid it, and why does the Beit Yosef make it a case of lashes, while underarm hair — which is a genuine woman’s grooming — is only a rabbinic prohibition?
The Taz’s answer, and it is the siman’s yesod What decides is not that one is deceived but that the difference be visible. A garment of the other sex is a public fact, and in that it comes under the verse; underarm hair is not visible in public, and therefore is forbidden only rabbinically. The Taz writes the word: דאינו ניכר בפרהסיא.

And the Taz’s precision at ס״ק ה Seif 5 ends with אלא נשים — where only women wear. The Taz reports in the name of the Bach, in the name of the Maharshal, the symmetrical case: where even women do not remove it, one who removed it is not flogged. The rule is thus doubly local — it follows usage in its absence as in its presence.

8. היתרי הב״ח — two permissions, and what remains of them

« לא תעדה אשה עדי האיש כגון שתשים בראשה מצנפת או כובע או תלבש שריון וכיוצא בו » (שו״ע יו״ד קפ״ב:ה)

The Bach’s two permissions The first: the prohibition bears only on one who puts on the other sex’s garment in order to resemble them, by way of adornment; one who wears it to shield himself from sun or cold is not included. The second: even when one seeks to resemble, the prohibition bears only on what is made for adornment. The Shach reports both and writes that the Bach’s words are not so compelling.

What the Shach retains, and the limit he sets The Shach does not dismiss the Bach, he bounds him. His two permissions, he says, hold only for women’s groomings — a jewel, an adornment. But one who actually puts on a woman’s clothes to the point that he is no longer recognized as a man, and conversely, is forbidden in every manner. The Shach’s limit is exactly the Taz’s criterion at ס״ק ו: what is seen.

9. פורים ושמחת חתן — three voices, and one conclusion

The Yereim, whom the Shach quotes in full

Three positions (1) Rabbi Eliezer of Metz, in the Sefer Yereim, forbids even temporarily and in jest, for Scripture did not distinguish — and he writes that he wrote this precisely because he had seen it done at weddings. (2) The Rama, in Orach Chayim, writes that the custom permits for the joy of Purim, though some forbid — and the Taz reports it. (3) The Bach forbids, leaning on the Yereim; and the Taz concludes with a phrase that is not a ruling of law but a counsel: whoever heeds the one who forbids, blessing will come upon him.

And the reason the Taz gives The Taz does not merely report: he gives the reason for the stringency, and it is not a reason of law — for there are many stumblings, Heaven forbid, when they walk together with no distinction between a man and a woman. That sentence points back exactly to side (ב) of the ḥakira of chapter 1: what is at stake is indistinction, and its effect.

10. צבע ומראה — the asymmetry of seif 6

« אסור (לאיש) ללקט אפילו שער אחד לבן מתוך השחורות משום לא ילבש גבר » (שו״ע יו״ד קפ״ב:ו)
« וכן אסור לאיש לצבוע (שערות לבנות שיהיו) » (שו״ע יו״ד קפ״ב:ו)
« שחורות אפילו שערה אחת וכן אסור לאיש להסתכל במראה » (שו״ע יו״ד קפ״ב:ו)
« הַמְלַקֵּט שְׂעָרוֹת לְבָנוֹת מִתּוֹךְ הַשְּׁחוֹרוֹת מֵרֹאשׁוֹ אוֹ מִזְּקָנוֹ מִשֶּׁיְּלַקֵּט שַׂעֲרָה אַחַת לוֹקֶה מִפְּנֵי שֶׁעָדָה עֲדִי אִשָּׁה. וְכֵן אִם צָבַע שְׂעָרוֹ שָׁחוֹר מִשֶּׁיִּצְבַּע שֵׂעָר לְבָנָה אַחַת לוֹקֶה. » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק י״ב הלכה י)
The single direction of the dyeing The Taz at ס״ק ז and the Baer Hetev at ס״ק ה give the reason and its reverse: white dyed black is a woman’s comeliness, and that is why it is forbidden; but the opposite — black hair dyed white — is permitted even at the outset. The asymmetry confirms the Shach’s reading: the prohibition bears not on the act of dyeing but on making oneself handsome in a woman’s manner.
« שערות לבנות שיהיו שחורות. שזהו נוי אשה אבל איפכא שהיו שחורות וצבע אותם לבנות שרי אפילו לכתחלה כ״כ ב״י ובטור יש כאן טעות סופר: » (ט״ז יו״ד קפ״ב ס״ק ז)
« לבנות. שזהו נוי אשה אבל איפכא שהיו שחורות וצבע אותם לבנות שרי אפילו לכתחלה כ״כ ב״י: » (באר היטב יו״ד קפ״ב ס״ק ה)
And a textual note the Taz alone makes The Taz ends his ס״ק ז with five words: ובטור יש כאן טעות סופר. The Tur, as we read it, reports the Rambam on one whose hair was black and who dyed it white, and writes that he is liable — the exact opposite of what the Taz and the Beit Yosef establish. The Taz does not argue the position: he declares the text faulty.
« וכ״כ הרמב״ם גבי צבע מי ששערו שחור וצבעו לבן חייב אפי׳ בשער אחד: » (טור יו״ד קפ״ב)
And the tumtum, where the gloss and the Shach do not say the same thing The gloss writes that the tumtum and the androgynos are forbidden to wrap themselves as a woman. The Shach, at ס״ק ח, adds the second half of the Rambam’s rule: and they shall not shave their head like a man. The reason lies in the nature of the case: their sex is a doubt, and so they are bound on both sides at once. The Shach refers to the Kol Bo and to halakha 10 of the Rambam, which he traces to the fourth chapter of Bikkurim.
