The title of the siman says it: דיני דברים החוצצים בטבילת כלים — the laws of things that interpose in the immersion of vessels. The Shulchan Arukh announces ובו ט׳ סעיפים, and these nine hold two questions. The first five ask: is something stuck to the vessel? The next three ask: did the water get everywhere? The last exempts one from immersing what will not remain.

8. Summary and comprehension questions

1. The text of the Shulchan Arukh — the nine seifim

The siman reads in three blocks. Seifim 1 to 5 treat what is stuck to the vessel: the substance, the general rule, then the handles. Seifim 6 to 8 treat water that does not enter: the mouth downward, the swollen belly, the narrow neck. Seif 9 stands alone: it exempts one from immersing what is to be cut away.

Seif א — pitch and mor on a glass vessel

Title of the siman: the laws of things that interpose in the immersion of vessels; and it contains nine seifim.

These interpose in vessels: pitch and mor (some explain: bitumen; and some explain: mastic, or musk) on a glass vessel, whether within or without.
The siman does not open with a rule but with a case. The mishnah it is drawn from (מקואות פ״ט מ״ה) names two substances and one material: pitch, mor, glass. The whole siman turns on whether this case is a leniency about glass — only these two stick to it — or a stringency: even these two, tolerated elsewhere, are forbidden here. Level 2 returns to this at length.

Seif ב — the general rule: what one minds, and the greater part

Anything that people are generally particular about interposes; and if not, it does not interpose — unless it covers the greater part of the vessel. (Rambam, chapter 3.)

Gloss: soot stuck to a cauldron on the outside is like the wall of the vessel and such is its way — it does not interpose (Beit Yosef, end of siman 120, in the name of the Rosh).
Here is the rule, and it has two thresholds. What one minds interposes even over a small area; what one does not mind interposes only if it covers the greater part. The Taz, at ס״ק א, ties this rule expressly to the immersion of persons in siman 198, and recalls that it is rabbinic: by Torah law one needs the greater part and the particularity together.

Seif ג — handles not meant to remain

Handles of vessels that are not meant to remain fixed — for instance if he inserted them not in their proper way, or did not insert them entirely, or inserted them entirely and they broke — interpose.
The handle is not the vessel — unless it becomes it. A handle well inserted and meant to stay is one body with the vessel and does not interpose. The three cases of the seif are the three ways that union fails: badly inserted, half inserted, inserted and then broken. In all three he will have to remove it — and that is what makes it an interposition.

Seif ד — the broken handle that still serves

All handles of vessels that broke — such as the handle of the sickle and of the knife — if they still serve something of their original work, they do not interpose; and if not, they interpose.
The measure is not length but use. A handle shortened by a break is still a handle so long as one can still work with it; it becomes an interposition only when it must be replaced. The Beit Yosef brings the tosefta from which the seif is drawn, and the Arukh HaShulchan puts it in a word: what does it matter to us whether the handle is short or long, so long as it serves.

Seif ה — the sickle: the rim, the reed and the resin

A sickle whose handle broke: from the rim inward it does not interpose, because it is like a hidden place; from the rim outward, if it still serves something of its work it does not interpose, and if not it interposes. If he bound it with a reed or with a cord, that interposes; if he glued it with resin, it does not interpose.
Three distinctions in one seif. First the place: what is inside the socket is a hidden place, and a hidden place of a vessel does not interpose. Then the use, as in the previous seif. Finally the repair, and it is the finest of the three: reed and cord are temporary, so the object remains two objects; resin is permanent, so the object becomes one again.

Seif ו — the vessel immersed mouth-down, and a vessel within a vessel

A vessel whose mouth he turned downward and which he put into the water: if its mouth is somewhat narrow and he did not turn its mouth upward, the immersion is invalid, because the water will not reach its base — even if he submerges it entirely.

Gloss: it is permitted to immerse a vessel inside a vessel if the mouth of the outer one is as wide as the spout of a skin-flask (Tur), and he shall take care that the inner vessel be loose within the outer one (Mordechai, end of the tractate of idolatry). Therefore he shall not wedge knives into a pail and immerse them, for the immersion will not be valid at their tips (Issur ve-Heter, rule 58). Likewise, if the inner vessel is heavy and rests inside the outer one, the immersion will not be valid at the place where it rests. And see above siman 201 seif 9.
The most debated seif of the siman, and its gloss more so. The body of the seif says that trapped air keeps the water from reaching the base — but it adds somewhat narrow, and that word opens a dispute that level 2 unfolds: the Beit Yosef, the Bach, the Taz and the Nekudot HaKesef do not agree about a wide vessel. The gloss adds three precautions for a vessel immersed inside another: the width of the mouth, the looseness, and the weight.

Seif ז — the vessel narrow at both ends

A vessel narrow at this end and at that and wide in the middle: the water does not reach it on every side until he tilts it on its side.
The same obstruction in another form. Here the mouth is not downward: it is the shape of the vessel — two necks and a belly — that holds the air. The remedy is that of the mishnah (מקואות פ״י מ״א): tilt it in the water until the air escapes.

Seif ח — the narrow mouth: fill it, or wait

Every vessel whose mouth is narrow (narrower than the spout of a skin-flask) must be held in the water until it fills, or he shall fill it before putting it into the mikveh. (Issur ve-Heter, ibid.)
A small printed gloss that is in truth a correction of the text. The words narrower than the spout of a skin-flask are given in small type; yet the Shach at ס״ק ז and the Taz at ס״ק ח both write כצ״ל — “thus it should read”. So the seif does not say merely “narrow” but “narrower than the spout of a skin-flask”; and the Shach gives the reason: for the vessel itself, a lesser opening suffices to make the connection.

Seif ט — the long handle that is to be cut

Handles of vessels that are long and that he intends to cut down: he immerses up to the place he intends to cut, and that suffices him.
What is to be cut is already cut. The seif exempts one from immersing the surplus length of a handle that is to be shortened. One question the seif does not raise remains: the place of the cut itself, which the water does not touch — does it not interpose? The Taz at ס״ק ט answers in a word — it is a hidden place — and the Arukh HaShulchan devotes two full seifim to the question.

2. Where the rule comes from — the mishnah, the Rambam, the Tur and the Beit Yosef

The siman is almost entirely an ordering of two chapters of the mishnah — the ninth and the tenth of tractate מקואות — as read by the Rambam, then by the Tur, then by the Beit Yosef. These two mishnayot carry seif 1 and seif 2:

Seifim 3, 6, 7 and 9 come from the following chapter, and often word for word:

One detail worth keeping from now. The mishnah of seif 9 carries a dispute between the first opinion and Rabbi Yehuda; the Shulchan Arukh rules like the first opinion. But in the gemara of חולין the same division is reported in the name of Rabbi Meir against the sages — and we ordinarily rule like the sages. The Arukh HaShulchan notes the gap and writes וצ״ע קצת. Level 2 returns to this.

Seif 2 refers expressly to “Rambam, chapter 3”. Here are the halakhot from which the seifim of the siman are drawn:

The Rambam says “חמר” where the mishnah and the Shulchan Arukh say “מור”. That is the variant the parenthesis of seif 1 records — some explain: the ḥemar — and which the Taz at ס״ק ב decides otherwise, referring to the ערוך: mor in the sense of myrrh. The Arukh HaShulchan writes that the mor is a sticky bitumen resembling pitch.

The Tur and the Beit Yosef

Two readings of one mishnah. For Rashi and the Tur the case of glass is a leniency: glass is so smooth that nothing else adheres to it, and only pitch and mor stick and are minded. For the Semag in the name of Rabbenu Yitzchak it is a stringency: even pitch and mor, tolerated on other vessels because it is usual to coat them, interpose on glass. The Bach writes that in practice one is stringent, and the Arukh HaShulchan concludes that we take the stringency according to both explanations.

3. The vocabulary of the siman

חציצה — interposition — whatever comes between the mikveh water and the surface of the object. Two thresholds: what one minds, even over a little; what one does not mind, if it covers the greater part.
מקפיד — one who minds — the measure is not dirt but attention: what one wants gone. The Arukh HaShulchan specifies that the way of the world decides, and so does the individual’s own particularity, in both directions.
רובו ומקפיד — the greater part and particularity — the Torah measure. The sages added two: the greater part without particularity, and the lesser part with it.
בית הסתרים — hidden place — a recess the water does not reach. In vessels the Rosh and Rabbenu Shimshon derive from the tosefta that we do not worry about interposition there at all; the Tosafot on חולין require that it at least be fit for water to enter.
שפופרת הנוד — the spout of a skin-flask — the measure of opening by which one water joins another. The gloss requires it for the outer vessel; the Shach at ס״ק ז specifies that for the vessel itself a smaller opening suffices.
שחרורית — soot — the black of smoke deposited on a cauldron. The gloss calls it “like the wall of the vessel” on the outside; the Taz at ס״ק ג infers that on the inside it interposes if one minds it.
קתא — socket — according to the Taz at ס״ק ה, the hollow metal part, of a piece with the vessel, into which the wooden handle is driven. The handle broken inside that socket is the Tur’s case.

The Nekudot HaKesef — one entry, and it contradicts the Taz

This is the Shach’s answer to the Taz, and it bears on ס״ק ו. The Taz had written that “the words of the Beit Yosef are right” for a wide vessel without a large cavity. The Nekudot HaKesef answer that it is not so: the Shulchan Arukh wrote somewhat narrow, and were it as the Taz says, even a very wide mouth would be at issue; moreover this too is tested — even very wide, the water does not pass to its base when it is set on its mouth.

The Pitchei Teshuva

The Pitchei Teshuva carries no entry on this siman. We therefore do not cite it here and do not fill the column: the neighbouring siman, 203, carries two, and there they will be read.

6. The Arukh HaShulchan — thirteen seifim on this siman

The Arukh HaShulchan devotes thirteen seifim to this siman. His division is not that of the Shulchan Arukh: he is cited here by his seif number, and matched by content, never number against number.

The two readings of the mishnah on glass

Particularity: the world’s and the individual’s

The question he puts to the Rama’s gloss

The handle: when it is one body, when it is an obstacle

The vessel mouth-down, and the joining of the waters

The place of the cut, and the hidden place of vessels

His question on the gemara’s version

A vessel within a vessel: the mouth and the weight

Why this source matters here. It is the first time in this section that the Arukh HaShulchan is available to us on a siman of Yoreh De’ah. He does not merely restate the Shulchan Arukh: he puts to the Rama’s gloss a question no one else puts, he leaves two points open — soot over the greater part, and the gemara’s version — and he decides the dispute of seif 6 in the Taz’s direction. On the next siman he will not be available to us, and we shall not cite him there.

7. Modern practical cases

Case 1 — A new drinking glass bought from a non-Jew

Seif 1 speaks of precisely this material. A stuck label, a residue of glue, a trace of paint: glass is the vessel about which the decisors are strictest, because cleanliness is minded there. Remove before immersing, not after.

Case 2 — A pot blackened by fire

This is exactly the soot of the gloss: on the outside it is like the wall. The Taz infers that on the inside, where one is particular, it interposes. And the Arukh HaShulchan leaves open the question of the greater part.

Case 3 — A knife whose handle is loose

This is the case of seifim 3 to 5. So long as the handle holds and he does not intend to redo it, it is one body with the blade. Once it must be removed to be refitted it becomes an interposition — and a temporary fix, tape or string, repairs nothing: it is the reed of seif 5.

Case 4 — A bottle or a carafe with a narrow neck

Seifim 7 and 8 are written for this object. Fill it with water first, or hold it immersed until it fills, and tilt it so the air escapes. The Shach at ס״ק ז adds that even a wide mouth, if water does not enter at once, requires the same precaution.

Case 5 — Immersing several pieces at once in a basket

The gloss of seif 6 and the Shach at ס״ק ו answer this in detail: the basket must let the water through, the pieces must not sit one upon another, and knives are not wedged into a pail. The Shach does permit setting them side by side, and even many together.

Case 6 — A piece too heavy, resting at the bottom of the container

The gloss says so, and the Arukh HaShulchan at seif 13 draws the hardest consequence: the weight is not saved by the leniency of the mouth. Where the heavy piece presses, neither it nor the one bearing it has been validly immersed.

8. Summary of siman 202

The siman in one sentence: a vessel’s immersion is valid only if the water touches its whole surface — hence two obstructions, the substance stuck to it (seifim 1 to 5) and the trapped air (seifim 6 to 8), and one exemption for what is going to disappear (seif 9).
Three things to keep. One — the measure of interposition is particularity, not dirt; and the greater part interposes even without it. Two — a handle is one body with the vessel so long as it is meant to remain in it; once it must be removed it interposes. Three — air obstructs just as a substance does: a vessel immersed mouth-down is not immersed.

Comprehension questions

  1. Is seif 1 a leniency about glass or a stringency? Give the two readings, their authors, and the conclusion of the Bach and the Arukh HaShulchan.
  2. Seif 2 sets two thresholds. Which of them is from the Torah, and what is the source of the distinction?
  3. Why does a well-inserted handle not interpose, when it is of a different material from the vessel?
  4. The reed interposes and the resin does not, though both repair the same break. Explain, with the Shach at ס״ק ב.
  5. The word “somewhat” in seif 6 is the most debated word of the siman. Who wrote it, who contests it, and what do the Nekudot HaKesef answer?
  6. The Shach at ס״ק ז and the Taz at ס״ק ח both write כצ״ל on seif 8. What are they emending, and why does it change the halakha?
  7. Seif 9 exempts one from immersing what is to be cut off. Two different answers explain why the place of the cut does not interpose: which, and whose?
