1. המשנה והסוגיה — three states of one text

↩ Detailed explanation (level 1)
The mishnah as it is taught Rabbi Eliezer ben Yaakov gives a formula to a man who wants to impose a vow on his fellow, and adds a proviso:
Two difficulties in a chain The first is plain sense: if the fellow hears the formula, he will not be taken in. The second is logical: if the man remembers his condition and vows anyway, he has uprooted it — and the proviso says the opposite of what it should.
Abaye’s answer: emend the text One must read The mishnah then splits into two teachings — vows of urging on one side, the Rosh Hashanah condition on the other — and our seif 2 comes out of it as it stands.
Rava’s answer: keep the text and shift the case He does remember, but he has forgotten what he stipulated about. Then the formula על דעת הראשונה אני נודר does everything, and its absence loses everything. That is our seif 3.
And a remark that is no detail The gemara relates that someone wished to expound this matter in public and was prevented. The reason is written out: The Rama’s proviso at the close of seif 1 is of the same order.

The difficulty, and it is frontal In seif 1 the disavowal prevails over the vow. In seif 2 the vow prevails over the disavowal as soon as the man remembers it. Yet in both cases he disavowed first and vowed afterwards.
The Ran’s answer, reported by the Beit Yosef In seif 1 the condition is stated at the time of the vow: he says plainly that he vows upon his condition, and one can no longer say he uprooted it. In seif 2 the two do not come together, and the word עקריה recovers its place.
The Prisha proposes a quite different criterion It is not simultaneity that decides but the specificity of the condition: “tomorrow I shall vow not to eat meat, and I annul it from now” is an annulment, because the condition aims at that vow; “if I vow…” is not.
The Taz rejects, the Nekudot HaKesef defend The Taz writes that he sees no place for this distinction, and that our seif speaks precisely of a condition made at the time of the vow. The Nekudot HaKesef answer that its place is quite visible: specifying the vow amounts to stipulating at the time of the vow. The Ba’er Hetev leaves both voices standing.
What it changes Directly: a man declares today that a particular undertaking he will make tomorrow shall be void, then makes it tomorrow while remembering. For the Taz he uprooted his condition and the undertaking stands. For the Prisha and the Nekudot HaKesef the condition stands and the undertaking falls. And the Shach, in ס״ק א, had already reported the Prisha without rejecting her.

3. בלחש או בפרהסיא — what “in a whisper” means

The source: Rabbenu Eliezer of Metz, through the Rosh His formula is the key to the whole discussion. A disavowal made in secret does not avail, because the thought is not manifest; made in public, it avails, because then things of the heart are דמוכחי.
The reading of the Ba’h and the Taz “In a whisper” means: inaudibly to his own ear. Once he has heard himself, it is speech, and the disavowal stands — as with the Shema and prayer, where hearing oneself suffices.
The Shach’s reading, and its three arguments (a) If that were so, the Rosh’s difficulty would return entire: he could have answered that the man heard himself without the other hearing. (b) The Rosh’s language says in public, not “audible”.
The ḥakira beneath the dispute What exactly does publicity repair? For the Ba’h the defect to be repaired is that the speech is not speech — and audibility answers it. For the Shach the defect is that the intention is not visible — and only publicity makes it manifest. The Rosh’s word, דמוכחי, leans to the second side; the analogy of the Shema, to the first.
And the Pitchei Teshuva rules for practice The Nekudot HaKesef had answered the Taz in two words and referred to their ס״ק ב. But the Levushei Serad, reported by the Pitchei Teshuva, brings a clear proof in the Ba’h’s favour and concludes יש להקל once he made himself audible, even if nobody else heard.

4. כל נדרי — what the gloss establishes, and what it reserves

What the gloss says, in two stages First stage: the declaration of the night of Yom Kippur counts כאילו התנו בהדיא — as though they had stipulated expressly. That is, it falls under the regime of our siman, and not under a regime of its own. Second stage, and it is just as firm: we do not rest on it to permit without going before a sage, save for a great need.
The Shach places the gloss elsewhere, and that is a consequence He writes that this gloss belongs to seif 2. If it belongs to seif 2, then the regime of the declaration is that of a condition laid down long before — and the question of remembering at the time of the vow becomes the decisive one. The Ba’er Hetev repeats this at his ס״ק ג.
Two extensions, and one reservation Extension: the declaration works for nezirut as well, although nezirut is not named there, since it is included among vows. Reservation, and it is the Shach’s at ס״ק ה: for an oath taken while holding an object, לא אתבריר לן — it is not established to us that the declaration avails.
And what the gloss does not say It does not say that past vows are annulled, nor that the declaration dispenses with a release. On that second point it says exactly the opposite. A reader who wants to know what the Shulchan Arukh establishes about כל נדרי has only these two lines, and they must be held together.

5. תוך כדי דיבור לנדר — the requirement, the study, the answer

The requirement, and its source The Tur attributes it to Rambam, and at once notes that the Rosh did not draw that distinction. The Shulchan Arukh gives it as a יש אומרים, adds the clause about the heart, and concludes that it must be reckoned with.
The Shach corrects the text His ס״ק ד is one line long, and it proposes a reading: אחר הנדר. On that reading the requirement bears on a recollection that comes after the vow, within the interval — not on a concomitant one.
The Taz’s study He sets out an internal contradiction: in seif 3 a late recollection suffices; why an immediate one here? He then copies Rambam and the Raavad, and shows that the Raavad counts the interval from the recollection, not from the vow.
And he concludes that the Shulchan Arukh should not have ruled so — but he does not rule himself: he writes
The Nekudot HaKesef’s answer, point by point (a) In seif 3 he expressly says “by my first intention”, which changes everything. (b) There, the lack of immediate recollection does not come from uprooting the condition but from not knowing its object. (c) The forced reading of Rambam is to be set aside: the plain sense is that of the Tur and the Shulchan Arukh. (d) And the clause about the heart explains itself.
What it changes A man made his condition a year ago, vows today without thinking of it, and remembers an hour later. On the letter of seif 2 the vow was void from the start. On the יש אומרים he should have remembered at once — and he did not. On the Taz reading the Raavad, it is enough that at the moment of remembering he relies on it immediately. The Ba’er Hetev reports the divergence and notes that the Nekudot HaKesef answered.

6. על דעת ראשונה — seif 3 and Rava’s reading

What the Taz pins down, and it prevents confusion In seif 3 the man does remember that he made a condition; what he does not know is what it covered. Without this point one would take seif 3 to contradict seif 2.
And that is what makes the formula necessary Since he knows a condition exists, vowing without saying anything would withdraw it. The formula על דעת ראשונה אני נודר prevents that reading; its absence confirms it.
Three states, and they must be told apart (1) He remembers nothing: seif 2, the vow falls. (2) He remembers the condition and its object, and vows anyway: seif 2, the vow stands. (3) He remembers the condition without its object: seif 3, and everything hangs on the formula. The Pitchei Teshuva, at his ס״ק ב, refers to a responsum applying this to a vow made in a dream — the subject of the preceding siman.

7. נדר שהדירו חבירו — the limit of the siman

The principle, given by the Ran in the name of the Tosafot A prior disavowal can do nothing against an oath sworn to another, and the reason is structural: it is on the other man’s intention that he swears. To annul in advance would be to annul his condition outright.
A question Rambam leaves open, and the seif closes Some Geonim held that this whole regime applies only to vows and not to oaths. Rambam reports both views. Our seif writes בשבועה או נדר — it therefore follows the second.
What it changes, and it is the most practical point in the siman An undertaking made to a person, an institution or a court does not fall within prior disavowal — and the clause of siman 210 on על דעת אחרים points the same way. The Shach adds the reservation about an oath taken while holding an object.
