Siman 212 — Vowing “by the Torah” (דין הנודר בתורה)

A single seif: one who vows by the scroll has said nothing — and the whole siman lies in the “but”

✦ ❖ ✦

A first approach to Siman 212, which consists of one single seif. Someone takes hold of — or points to — a Sefer Torah and says: “these fruits are forbidden to me like this.” Has he vowed? The Shulchan Aruch answers that he has not, and the reason is technically precise: a vow by comparison only operates upon a thing that is itself vowed, and the parchment of a scroll is not such a thing. But the seif does not stop there, and that is where everything is decided: one who is not a scholar must nonetheless have it released; one who said “by what is written in it” has truly vowed; one who took it in his hand is judged as though he had said so; and one who swore by the Torah must, in every case, be released. These are rulings למעשה: any real case is brought to a Rav.

📑 Plan of study

1. What is this siman about? The scroll, the parchment, and the Names
2. The seif, clause by clause
3. The key concepts: גויל, אזכרות, דבר הנדור, נדר and שבועה
4. Where this seif comes from: the gemara Nedarim, the Rambam, the Tur, the Beit Yosef
5. The commentators: the nine entries, cited one by one
6. The table of the four situations
7. Practical cases
8. Comprehension questions

1. What is this siman about? (one seif)

A vow is not made by saying “I forbid this to myself.” It is made by attaching — מתפיס — one thing to another: these fruits are to me like such a thing. And the device operates only if the thing named is a דבר הנדור, a thing rendered forbidden by a man’s word: an offering, a consecration. Attaching to something the Torah itself forbids — a דבר האסור — produces nothing at all.

The siman applies that rule to one particular object, and the result is surprising: the Sefer Torah. One who vows “by the Torah” — pointing to the scroll and saying “these fruits are to me like this” — has said nothing, because in pointing at the object his mind rests on the parchment (גויל), and parchment is not a vowed thing. But three words suffice to change that — במה שכתוב בה, “by what is written in it” — and the vow takes hold; and it suffices that he hold the scroll in his hand for him to be judged as if he had said them.

The siman in one sentence. A vow “by the Torah” is worth nothing as a vow — and yet the Shulchan Aruch refuses to draw a permission from that. The ordinary man is still sent to a sage; one who named the contents, or held the book, has genuinely vowed; and one who swore by the Torah is never released without a dissolution.

2. The seif, clause by clause

Here is the seif in full — exactly as the source gives it, including its closing parenthesis — and then broken down.

Seif 1 — one who vows by the Torah

The seif states its rule, then its four limits: the ordinary man, the contents named, the book held in hand, and the oath.

One who vows by the Torah — for example if he said: these fruits are to me like this — has said nothing
The formula is one of attachment: פירות אלו עלי כזו, “these fruits are to me like this.” It fails not for want of intention but for want of an object: the term of comparison is not a vowed thing.
and he needs no release if he is a תלמיד חכם
The scholar knows why he has vowed nothing, and he is let go. The exemption therefore rests on knowledge, not on privilege.
but if he is an עם הארץ he needs a release, so that vows not be treated lightly
The reason is stated in so many words, and it is not a reason of law: It is not that his vow took effect — it is that he is not to learn to release himself.
and if he vowed by what is written in it, it is forbidden — for a prohibition is written in it
Three words overturn everything. The Mehaber gives his own reason: שהרי כתוב בה איסור — the issar is written in it, that is, the very language of vowing. The Shach, at ס״ק ג, will show that the Raavad and the Ran give another.
if he took it in his hand and vowed by it, he is like one who vowed by what is written in it
The hand is worth the word. To hold the scroll is already to name its contents: the mind of one who holds it no longer rests on the parchment.
but one who swears by the Torah needs a release in every case; and see further at siman 237
The closing parenthesis changes subject: from the vow to the oath. An oath does not operate by attachment — it binds the man, not the object — and so the parchment argument does not save him. It is taken from the Beit Yosef, as the second parenthesis indicates.
Beit Yosef, as regards practice
The attribution is part of the printed text: it says that the preceding clause is not a halakha of the Mehaber but the practical conclusion he had drawn in his Beit Yosef. We copy it as it stands.

3. The key concepts of this siman

גויל — the parchment — The prepared hide on which a Sefer Torah is written. It is an object of value and sanctity, but it is not a vowed thing: no one consecrated it by a word.
אזכרות — the Names — The mentions of the Divine Name written in the scroll. According to the Raavad and the Ran as reported by the Shach, it is these — together with the קרבנות — that make the contents a דבר הנדור, “for through the writing and the preparation for holiness they are holy.”
דבר הנדור — the vowed thing — A thing rendered forbidden by a man’s word. Only such a thing transmits its status by attachment. Opposed to the דבר האסור, forbidden by the Torah, which transmits nothing.
נדר and שבועה — A vow forbids a thing to the man; an oath binds the man. That is why the parchment argument can void the first and leave the second intact — and that is exactly what the closing parenthesis of the seif says.
התרה — the release — The act by which a sage, or three men, dissolve a vow. Here it is required even where no vow took effect: it is a measure of education, not of repair.

4. Where this seif comes from

The seif condenses a braita in Nedarim and its sugya, two halakhot of the Rambam — and a third, placed elsewhere, which became a matter of dispute —, the wording of the Tur, and the practical remark of the Beit Yosef which eventually entered the printed text itself.

The braita and the gemara

The braita is brief and the seif follows it step by step: “one who vows by the Torah has said nothing”; Rabbi Yochanan adds that a release is needed; Rav Nachman exempts the scholar.

The Rambam — הלכות נדרים and הלכות שבועות

The seif is the Rambam almost word for word — but the Rambam wrote the same thing twice, once for the vow and once for the oath, and it is that second passage which gave rise to difficulty. It will be read at level 2.

The Tur

The Tur is more explicit than the seif on two points: he specifies that the scroll is lying on the ground, and he adds that “this נודר is not to be taken literally: it means one who swears by it, for this is not the language of a vow.”

The Beit Yosef

The Beit Yosef does three things. He reports the sugya with its decisive distinction — lying on the ground: the mind goes to the parchment; held in hand: the mind goes to the Names. He gives, in the name of the Rosh and the Ran, the reason for the difference between scholar and layman. And he concludes, as regards practice, that in our time nothing is relaxed regarding an oath by the Torah — and it is that sentence which became the parenthesis in the seif.

5. The commentators, entry by entry

The apparatus of this siman numbers nine entries: three ס״ק of the Shach, two of the Taz, three of the Ba’er Hetev, one of the Pitchei Teshuva. We cite them all, in order, without summarising any. The Nekudot HaKesef do not comment on this siman — they are found on the neighbouring simanim (209, 210, 211, 215); there is therefore nothing of theirs to cite here.

The Shach (ש״ך) — three ס״ק

ס״ק א — why “he has said nothing”: because his mind is on the parchment

ס״ק ב — and today everyone is judged as an עם הארץ

ס״ק ג — the reason of the Raavad and the Ran, and the two consequences the Shach draws

The Taz (ט״ז) — two ס״ק

ס״ק א — his mind is on the parchments

ס״ק ב — the oath: the Rambam on one side, the Tosafot, the Rosh and the Tur on the other — and a practical conclusion for judges

The Ba’er Hetev (באר היטב) — three ס״ק

ס״ק א — the same reason as the Shach, in a word

ס״ק ב — and he repeats the Shach on our own time, naming him

ס״ק ג — he joins in one entry the Shach’s ס״ק ג and the Taz’s ס״ק ב

The Pitchei Teshuva (פתחי תשובה) — one entry

ס״ק א — swearing on an invalid Sefer Torah: the Har HaCarmel and the Noda BiYehuda

6. The table of the four situations

What he didDoes the vow take effect?Release?Where it is said
He points at the resting scroll and says “like this”No — his mind is on the parchmentNo if he is a ת״ח; yes if he is an ע״השו״ע יו״ד רי״ב:א · ש״ך ס״ק א
He says “by what is written in it”YesYes — it is a true vow
He holds the scroll in his hand and vows by itYes — as though he had named the contentsYes
He swears by the TorahThe oath binds — the parchment argument does not save himYes, in every case

7. Practical cases

Case 1 — an undertaking made with the hand on the book

Someone places his hand on a Sefer Torah and undertakes never to do such a thing again. The seif teaches that the hand is equivalent to naming the contents; and the Taz, at ס״ק ב, draws precisely that one who places his hand on it “is in the same law as one holding it in his hand, mentioned here.” A Rav is to be consulted.

Case 2 — “I swore without thinking”

The parenthesis of the seif leaves no way out: for an oath, a release is needed in every case. The Beit Yosef even writes that those who take refuge in the braita “profane the Name.” One does not get out of it alone.

Case 3 — an oath before a court

The Taz, at ס״ק ב, writes that one obliged to swear should not have the oath administered in the form “I swear by the Sefer Torah,” unless he places his hand upon it. It is a rule addressed to judges, not only to the one swearing.

Case 4 — an invalid scroll

The Pitchei Teshuva reports the question in the name of the Har HaCarmel: if an oath is administered on a Sefer Torah missing a word, a letter or a sheet, does it remain an oath on a Sefer Torah? He concludes that it does — and that it is in any case forbidden to render it defective on purpose.

Case 5 — “I am not an עם הארץ”

The Shach settles the question at ס״ק ב, and his word is brief: today everyone is judged as an עם הארץ. The Ba’er Hetev repeats it at ס״ק ב, naming him. The distinction of the seif therefore has no practical application — the release is needed.

8. Comprehension questions

  1. Why does a vow “by the Torah” not take effect? Give the reason, not only the rule.
  2. The seif and the Shach, at ס״ק ג, do not give the same reason for the prohibition of במה שכתוב בה. What are they, and who holds each?
  3. The Shach draws two consequences from the reason of the Raavad and the Ran. What are they?
  4. Why does the עם הארץ need a release although he vowed nothing?
  5. What remains today of the difference between the ת״ח and the עם הארץ? Cite the entry that says so.
  6. Why does the oath not benefit from the parchment argument?
  7. The Taz, at ס״ק ב, addresses an instruction to judges. Which, and out of what concern?
  8. What does the Pitchei Teshuva answer to the question of a defective Sefer Torah?
