1. גויל ואזכרות — what the scroll transmits, and what it does not

↩ Detailed explanation (level 1)
The starting point, and it is technical The seif does not say the vow is badly worded: it says it has no object. The Taz puts it in four words — דדעתו אגוילים שבה — and the Shach in five. Parchment is holy without being vowed: no one consecrated it by a word. A vow of attachment was therefore uttered upon nothing.
What, in the scroll, is indeed a vowed thing The Shach, at ס״ק ג, reports the Raavad and the Ran: it is not the hides but the קרבנות ואזכרות that make the difference — “for through the writing and the preparation for holiness they are holy.” Holiness born of a human act is what makes a דבר הנדור.

2. מחתא אארעא ונקיט לה בידיה — the two states of the Sefer Torah

↩ Detailed explanation (level 1)
The sugya as the Beit Yosef reports it Two braitot seemed to contradict one another — “he has said nothing” on one side, “his words stand” on the other. Rav Nachman answers with a material fact: depending on whether the scroll lies on the ground or is held in hand, the man’s mind goes to the parchment or to the Names.
And here is what the Tur makes of it The Tur writes expressly והיא מונחת ע״ג קרקע — which the seif leaves implicit. Then he states the symmetry: the book held in hand without the formula, or the formula without the book, each produce a vow, and then even the ת״ח must seek a release.

3. שהרי כתוב בה איסור — two reasons for one prohibition

↩ Detailed explanation (level 1)
Two reasons, and they do not coincide (א) The Mehaber, following the Rambam: שהרי כתוב בה איסור — the very word of prohibition is written in the Torah, and it is to that word that one who says “by what is written in it” refers. (ב) The Raavad and the Ran, as reported by the Shach: because there are in the Torah קרבנות ואזכרות, which are like a vowed thing. This is not the same reasoning: the first rests the vow on a word, the second on a holiness.
Nafka mina — and the Shach draws it himself, twice If the reason is holiness and not the word, then (1) one who says expressly “I vow by the Names in it” has vowed, all the more so, even though he has no thought of the written prohibition; and (2) one who vows by part of the sheets has vowed, even if those sheets bear neither prohibition nor vow, so long as they bear offerings or Names. Both consequences are impossible on the Mehaber’s reason: sheets on which the word is not written would say nothing.

4. ת״ח ועם הארץ — the reason for the distinction, and what remains of it

↩ Detailed explanation (level 1)
The reason for the distinction, as the Rosh and the Ran give it It is not a question of honour but of knowledge: the ת״ח knows that, not having said “by what is written in it,” he swore upon the parchments; the עם הארץ is not expert in all this, and would come to treat lightly even the case where he did swear “by what is written in it.”
Nafka mina — and the Shach closes it The Shach, at ס״ק ב, refers to siman 205 and writes that in our time all are judged as עמי הארץ. The Ba’er Hetev repeats it, naming him. The distinction of the seif therefore keeps its theoretical value — it explains why a release is sought — but it no longer separates anyone.

5. נדר או שבועה — the Rambam in two places, and the Raavad’s objection

↩ Detailed explanation (level 1)
The difficulty: the Rambam wrote the same thing twice In הלכות נדרים he deals with the vow: “one who vows by the Torah… has said nothing.” In הלכות שבועות he deals with the oath and sets out exactly the same distinction: without the formula, the mind goes to the parchment, and there is no oath. Yet our sugya speaks of a נדר. The Raavad, in his objections to chapter 12 of הלכות שבועות, protests: the matter holds for the vow, not the oath, and he proves it from the Yerushalmi.
The Ran’s answer: both are true The Ran, as reported by the Beit Yosef, refuses to choose. The Rambam read our sugya as speaking of the oath — since it says דעתיה אאזכרות שבה, which is the language of an oath — and the Yerushalmi as speaking of attachment by vow; and his phrase is famous: ושניהם אמת.
Ḥakira: why the oath cannot escape as the vow does (א) If the obstacle is the object. The vow fails because parchment is not a vowed thing; the oath needs no vowed thing — it binds the man. The argument therefore does not touch it, and this is the reading of the Tosafot, the Rosh and the Tur as the Taz reports it: even for an oath, (ב) If the obstacle is intention. Then the question is what the man meant in pointing at the book, and the answer is the same for vow and oath — this is the Rambam’s reading. The Taz notes that the seif follows the Rambam here.

6. לענין מעשה — when a conclusion of the Beit Yosef becomes the printed text

↩ Detailed explanation (level 1)
What the Beit Yosef saw in his own day The Beit Yosef’s conclusion is not a deduction from the sugya: it is a reaction. He had seen men swear falsely by the Torah and excuse themselves by our very braita. He therefore writes that in our day nothing is relaxed: held or not, the formula said or not, scholar or layman, a release is always needed. And he adds a reason that is not one of law: such men “cause the students of the Torah to be hated in the eyes of the common people.”
Nafka mina — a rule for judges The Taz is not content to lament: he draws a procedural instruction from it. A court administering an oath should not use the formula “I swear by the Sefer Torah,” for one who says it might afterwards declare himself permitted by saying his mind was on the parchment — unless he places his hand on the scroll, and then he falls under the seif. The Ba’er Hetev repeats the rule at ס״ק ג.

7. ספר תורה פסול — the Pitchei Teshuva’s question

↩ Detailed explanation (level 1)
The question, and it is a modern one The Pitchei Teshuva reports the responsum of the Har HaCarmel: an oath is imposed on someone upon a Sefer Torah missing a word, a letter, a sheet. Is it still an oath on a Sefer Torah? And — the graver question — is it permitted to render the scroll defective on purpose for that? His answer has two parts: it is forbidden to do so, and in any case it avails nothing, for it remains an oath on a Sefer Torah.
And the Noda BiYehuda’s answer, which shifts the question The Pitchei Teshuva then reports the Noda BiYehuda’s answer to a ruler who asked whether a Jew may swear falsely when the scroll he holds is invalid. His answer does not stand on the ground of the scroll at all: it is forbidden to swear falsely even holding no book whatsoever, and the custom of placing a book in the hand of the one swearing is only to awe him and remind him of the punishment. Put that way, the question of the defective scroll ceases to exist.
