1. The axiom: one attaches, and it is the term of attachment that decides

The axiom. A vow by comparison is worth only what the thing compared to is worth. The parchment of a Sefer Torah is holy, but no one vowed it: the attachment therefore falls into a void. Naming what is written in it, or holding the scroll, changes the object — and the vow takes hold.
Three consequences. (1) A vow “by the Torah” does not take effect. (2) A release is nevertheless required, because the layman does not know why it does not. (3) The oath is not concerned: it binds the man, not the object.

2. The three reflex questions

1. Is it a vow or an oath? An oath — a release in every case, and one goes no further. A vow — next question.
▼
2. Did he say “by what is written in it,” or hold the scroll? Yes to either — a true vow. No to both — he has said nothing.
▼
3. And so, is a release needed? Following the Shach at ס״ק ב: yes, since all today are judged as עמי הארץ.

3. Master table — the seif clause by clause

SeifThe clause of the Shulchan AruchWhat it decides
א
A vow by the Torah does not take effect
א
The scholar needs not even a release
א
The layman must seek one — and the reason is stated
א
“By what is written in it”: that is a vow
א
The scroll held in hand is equivalent to the formula
א
An oath by the Torah always requires a release
א
The attribution: Beit Yosef, as regards practice

4. The grid of cases — does the vow take effect, and what must be done?

The caseVerdictSource
Scroll at rest, formula not said, and he is a ת״חNothing — and nothing to doשו״ע יו״ד רי״ב:א
The same, and he is an עם הארץNothing — but a release is requiredשו״ע יו״ד רי״ב:א
And today?All judged as עמי הארץש״ך יו״ד רי״ב ס״ק ב
He said “by what is written in it”A true vow
He was holding the scrollA true vow
He said “I vow by the Names in it”A vow — all the more so, per the Shach
He vowed by part of the sheetsA vow, if they bear offerings or Names
He swore by the TorahA release in every case

5. The two reasons for the prohibition, and what separates them

WhoThe reasonWhat it yields
The Mehaber, following the Rambam
The word of prohibition is written in the Torah
The Raavad and the Ran, via the Shach
The offerings and the Names are like a vowed thing
Nafka mina 1
Vowing expressly by the Names — a vow, all the more so
Nafka mina 2
Vowing by sheets without the word — still a vow

6. The vocabulary of the siman

TermMeaningWhere it operates
גוילThe parchment of the scrollThe reason for “he has said nothing”
The mentions of the Divine NameThe Raavad and Ran’s reason for the vow taking effect
A thing forbidden by a man’s wordThe condition of attachment
By what is written in it”The formula that turns it into a vow
He took it in his hand”The act equivalent to the formula
Levity toward vowsThe reason for the layman’s release
התרהThe releaseRequired here although no vow took effect

7. Golden rules, mnemonic and classic pitfalls

The golden rules. (1) Parchment is not a vowed thing: a vow “by the Torah” falls into a void. (2) Three words or one gesture suffice to raise it. (3) A release is required even where nothing took effect. (4) The oath does not enter this calculation.
Pitfall 1 — “therefore I am free.” That is exactly the use the Beit Yosef saw made of this braita, and which he calls a profanation of the Name. The seif itself closes the door with its final parenthesis.
Pitfall 2 — believing the ת״ח / עם הארץ distinction still applies. The Shach, at ס״ק ב, writes that today all are judged as עמי הארץ; the Ba’er Hetev repeats it. The seif’s exemption has no practical use.
Pitfall 3 — conflating the two reasons for the prohibition. They do not yield the same cases. On the Mehaber’s reason, sheets on which the word is not written would say nothing; on that of the Raavad and the Ran, they suffice. The Shach says so expressly.
