1. הדין העולה — the line of psak of the siman

The line of psak. The siman reduces to four decisions, and each is a clause of the text. (1) A permitted thing, known to be permitted, from which one has taken to abstaining with the intention that it be forever, is treated as a vow — and one occasion suffices. (2) One is released from it before three, opening with regret. (3) One who abstained by error accepted nothing; and it is this opinion, not the stricter one, which the Rama declares to be the custom. (4) What a community has taken up, even without deliberation, binds its members and their offspring.
This siman is the most applicable of the block, and that is precisely why it does not apply itself: all its variables are facts about oneself — what one knew then, what one had in mind then, what custom is in question. None of these three is a question of memory, and the third even decides whether a release is possible at all. For application to your own situation, consult your Rav.

2. שני התנאים — what makes a custom bind

What is decided. Two conditions, cumulative. (1) He must have known the thing to be permitted — that is והיודעים בהם שהם מותרים, and the Shach specifies at ס״ק א the motive one must then suppose: מחמת סייג וגדר ופרישות. (2) And, at the moment he began, his intention must have been to do it forever.
The second condition is the one that is missed: it is not elapsed time that binds but the intention at the beginning. A man who did the thing for twenty years without ever having meant to keep it forever does not fall under the seif; a man who did it once meaning that, does. For application to your own situation, consult your Rav.

3. שלושה וחרטה — the form of the release, and its limit

What is decided. The form is that of a release from a vow: ג׳ שיתירו לו, and one opens with חרטה — the regret of having conducted oneself so as a vow. But the Shach, at ס״ק ד, brings from the Maharshal a limit the seif does not state and which is decisive: this path holds only for what a part of the people has taken up. What all Israel has received,
Before even asking how to be released, one must therefore establish what custom is in question: his own, his community’s, or one received by all Israel. The third case falls outside the regime of release according to the Shach and the Ba’er Hetev. For application to your own situation, consult your Rav.

4. מחמת טעות — the custom that does not bind

The point, and it is settled — but after a divergence one must know. The body of the seif says that one who abstained believing the thing forbidden accepted nothing, and the Shach, at ס״ק ה, specifies the situation: he had been in doubt, and it is now established that the thing is permitted. He adds an extension: likewise if he believed it more gravely forbidden than it is. But the seif then reports the Rashba’s opinion, which inverts the division: error is released before three; and what was knowingly taken up is never released. The exact wording of that opinion is the Beit Yosef’s, concluding that the Ran agrees with the Rashba. The Rama decides in five words:
Do not turn this clause into a way out. Whether one believed the thing forbidden then, and not today, is a question of fact about oneself — and the Shach frames it narrowly: he speaks of one who was in doubt, and for whom the matter later became clear. For application to your own situation, consult your Rav.

5. לכתחילה — the two sentences to say at the outset

What is decided. This is the most useful passage of the siman, and it is prescriptive: one who wishes to adopt a practice of סייג ופרישות shall say at the outset two things — that he does not accept it upon himself by vow, and that he does not intend to do it forever but only this time, or the times he shall wish. Both, for these are the seif’s two conditions. The Pitchei Teshuva, at ס״ק ג, refers on this point to the Magen Avraham.
This holds for anything one decides to add: a practice in prayer, a dietary restriction, a year-end resolution. The seif does not say to refrain from restraining oneself — it says to do so knowing what one is doing. For application to your own situation, consult your Rav.

6. מחמת שאינו בריא — health, and the Pitchei Teshuva’s narrow door

The point, and it calls for precision. The seif takes health as its very example, and does not thereby release: three men are needed. The Shach explains why the comparison with Orach Chayim does not hold — there the custom itself contained the exception, here But the Pitchei Teshuva, at ס״ק א, reports from the Dagul Mervava a distinction that changes practice: the Mehaber speaks of one who wishes to go back entirely and never resume his custom; but one to whom some ailment has come, who wishes to eat today and will afterwards resume his practice, א״צ התרה.
The Dagul Mervava’s door is narrow, and must be read for what it is: it aims at a one-off suspension with a return to the custom, not an abandonment. The Pitchei Teshuva refers further, at ס״ק ב, to the Shach and to another responsum. A question of health is therefore settled neither on this paragraph nor on any other read alone. For application to your own situation, consult your Rav.

7. קבלת הרבים — the community, the offspring, and the son

What is decided. Seif 2 binds the community, its offspring, and one who comes to settle there — and this even without deliberation, by the mere fact of practice. On the reach of the word זרעם, the Pitchei Teshuva brings at ס״ק ה a sourced and important precision: in the name of the Zikhron Yosef, the son is bound by his father’s practice only in what he himself practised since coming of age, his parents having accustomed him to it — and that is how the seif must be read. If the son never began to conduct himself so, he is not bound. At ס״ק ד he reports another question: a community that followed the lenient opinion may agree to forbid, and there is no מוציא לעז upon the earlier ones in that — but he notes at once that the Magen Avraham seems to say otherwise.
Two cautions. First, the Zikhron Yosef’s answer answers one question — what the son must take up — and does not transpose itself to others. Second, the Pitchei Teshuva leaves two opinions facing one another at ס״ק ד without deciding. A question of family or communal custom is a question for a Rav, not for reasoning. For application to your own situation, consult your Rav.

8. העובר לגור — moving house, and the Shach’s psak

The point, and it remains disputed. The seif releases one who comes to settle elsewhere from the customs of his former town, if he has no intention of returning. The Shach opens his ס״ק ח with תימה, sets against it what the same Mehaber writes in Orach Chayim 468 following the Rambam, proposes to distinguish according to whether he means to settle where he is going, then writes וצ״ע. And he finally concludes in his own name: ולענין דינא, one always follows the custom of the place where one means to settle, in both directions. The Ba’er Hetev repeats this conclusion.
Three things combine here, and none is simple: the intention to settle, the custom of the new place, and the custom of the old. The Shach himself wrote וצ״ע before concluding. This is exactly the sort of question that is put, and put in full, to a Rav. For application to your own situation, consult your Rav.

9. מפני המחלוקת — the reservation that dominates all

What is decided. This is the reservation that runs through the whole siman and prevails over the others: where there is cause to fear a dispute, nothing is changed — אסור בכל ענין שאין לשנות מפני המחלוקת. The Shach lays it down at ס״ק ז in the name of the Rosh, then repeats it at ס״ק ח, in parentheses, at the very moment he concludes in favour of leniency: even to be lenient, one does not change. The Ba’er Hetev repeats it twice.
This reservation is the one that most often decides in practice, and it depends on none of the preceding reasonings: a man may be entirely released from his custom and nonetheless have to keep it in public. A Rav sees that; a reader does not. For application to your own situation, consult your Rav.

10. מה שאין בסימן זה — what is not found here, and what will not be written

What is not in this siman. The Taz does not comment on this siman. His commentary on Yoreh De’ah passes from siman 213 to siman 215, and there is therefore here no entry of his — and none has been fabricated to fill a column. What he says on related matters is read at siman 213 and siman 215. The Nekudot HaKesef likewise do not comment on this siman; they are read on simanim 209, 210, 211 and 215. As for the Aruch HaShulchan, it is not accessible to us for this siman. The consequence must be stated plainly: on 214 the essential lies with the Shach and the Pitchei Teshuva, that is, with the Acharonim — all the more reason to advance here no line of psak not resting on a cited entry.

A practice taken up long ago, which one would like to drop

Three preliminary questions, in this order. Did he then know the thing to be permitted? Did he, at the beginning, intend to keep it forever? And what custom is this — his own, his community’s, all Israel’s? The third decides whether a release is possible at all, according to the Shach at ס״ק ד. For application to your own situation, consult your Rav.

A year-end resolution

The seif gives the procedure before beginning, and it comes to two sentences: this is not a vow, and this is not forever. Said at the outset, they make the whole siman unnecessary. Said afterwards, they do nothing to it. For application to your own situation, consult your Rav.

One does not feel able to keep one’s custom this year

This is the very example of the seif, and it requires three men. But the Pitchei Teshuva, at ס״ק א, distinguishes in the name of the Dagul Mervava between abandoning for good and suspending once with the intention of resuming — and for the latter he writes א״צ התרה. The distinction is real, and it is narrow. For application to your own situation, consult your Rav.

A family custom one has never oneself practised

Seif 2 binds “them and their offspring,” but the Pitchei Teshuva, at ס״ק ה, reports from the Zikhron Yosef that the son is bound only by what he himself practised since coming of age, his parents having accustomed him to it — and that this is how the seif must be read. A sourced answer, and one question at a time. For application to your own situation, consult your Rav.

Settling in a town with different customs

Seif 2 deals with exactly this, the Shach opens it with תימה and closes it with a psak: one follows the place where one means to settle, in both directions. But he keeps the reservation about dispute, and the Ba’er Hetev repeats it: where changing would cause quarrel, one does not change, even to be lenient. For application to your own situation, consult your Rav.

A community that wishes to tighten a custom

The Pitchei Teshuva, at ס״ק ד, reports from Rabbi Eliyahu ben Chaim that it is in its power, and that there is no מוציא לעז על הראשונים in it — but he notes at once that the Magen Avraham seems to say otherwise, and refers to a third responsum. Two opinions facing one another with no arbitration: the sign that one must not decide oneself. For application to your own situation, consult your Rav.
