1. מה עושה המנהג — a vow, an acceptance, or a prohibition in itself?

↩ Detailed explanation (level 1)
The seif uses a comparison, not an identification The seif’s word is כאילו — “as though they had accepted it by vow.” It is not a vow: it is something treated as a vow. The distinction is not verbal, as the rest of the siman will show: that “as though” leaves room for an opinion that holds it to be graver than a vow.
Ḥakira: whence does custom draw its force? (א) From a tacit acceptance. The man, abstaining knowingly, willed to bind himself; the custom is only the proof of his will. Then the seif’s two conditions explain themselves: he must have known the thing permitted (else he willed nothing) and have aimed at forever (else he willed only once). And then he is released as from any vow. (ב) From a prohibition of its own. The braita derives the prohibition from the verse לא יחל דברו without speaking of intention, and the Rashba concludes that there is no release at all. The seif’s word כאילו leans toward the first path; the opinion it then reports toward the second.

2. אי אתה רשאי להתירן בפניהם — the braita, and what the sugya takes away from it

↩ Detailed explanation (level 1)
The braita, and its apparent scope Taken alone, the braita is very broad: one has no right to permit before them what others have made a prohibition for themselves. It serves, moreover, in the sugya of Nedarim, to prove that there exists a rabbinic בל יחל — that is, it is cited as a case where one is bound without a vow.
But the sugya in Pesachim cuts it back — and the case of Beit She’an remains In Pesachim, Rav Chisda restricts the braita: בכותאי עסקינן. And the Tosafot and the Rosh at once ask how, in that case, Rabbi could permit the whole town of Beit She’an on the sole testimony that Rabbi Meir had eaten a leaf of vegetable there — when its inhabitants had indeed conducted themselves in it by prohibition, and his own brothers reproached him for it.
The Ri’s answer: knowledge makes all the difference The Ri, in his Megillat Setarim, answers: the braita speaks only of things they knew to be permitted and in which they chose to restrain themselves. But if they abstained by error, believing the thing forbidden, one may permit it to them openly. And at Beit She’an it was indeed an error: they believed they were in the Land of Israel. This answer is, word for word, the structure of seif 1 — the condition

3. הירושלמי — two readings, and they cross

↩ Detailed explanation (level 1)
The Yerushalmi, and the two ways of reading it The Yerushalmi sets two men against one another in two parallel formulas: he who did not know and erred — נשאל ומתירים לו — and he who knew — נשאל ואין מתירים לו. Everything turns on what that it is not permitted to him means. (א) The Rosh: it means the sage does not permit it to him of itself, as an error one corrects; but he may release him by regret, as for any vow. (ב) The Rashba: it means there is no release at all, such conduct having been accepted like the prohibitions of the Torah, which have no release ever.
Nafka mina — and the seif carries both, then the Rama decides The seif does something remarkable: it first gives the Rosh’s reading — error is not a vow — and then, under ויש מי שאומר, the Rashba’s reading, which inverts the division: for him error is released before three, and knowingly undertaken conduct is not released at all. The two opinions therefore do not merely give different results: they rank the two men in reverse order. And the seif’s wording is the very one the Beit Yosef uses in concluding that the Ran, in his second reading, agrees with the Rashba. Five words of the Rama close the debate.

4. דעתו לנהוג כן לעולם — the condition of intention

↩ Detailed explanation (level 1)
The condition, and its source The clause היה דעתו לנהוג כן לעולם is not in the Talmud: it comes word for word from the responsum of the Maharam of Rothenburg in the name of Rabbi Yehuda HaKohen. And the same responsum gives its corollary, which surprises: It is therefore not repetition that binds, but the intention to persist.
Nafka mina — and it is the most practical in the siman If the initial intention is the criterion, then one can act beforehand. The seif at once draws its counsel from this, and it requires two distinct declarations: that it is not a vow, and that it is not forever. The first removes the qualification, the second the condition. The Pitchei Teshuva, at ס״ק ג, refers to the Magen Avraham on how to say it.
And the limit the Maharshal places on release The Shach, at ס״ק ד, brings from the Maharshal a restriction the seif does not state, and he rests it on the very wording of the braita: it says ואחרים נהגו בו איסור — others, that is, a part and not the whole. Release by regret therefore holds only for a custom taken up by a part of the people. What all Israel has received is released by no path at all. The Ba’er Hetev repeats it in his name.

5. מחמת שאינו בריא — the Shach’s contradiction, and its resolution

↩ Detailed explanation (level 1)
The kushya, and it is the Shach’s own — or rather of “someone” he reports Here the Rama let the Mehaber stand without a gloss: a release is therefore needed even for one who is unwell. Yet the same Rama writes, in Orach Chayim, that on the fasts of Behab or of the ten days of repentance, if a circumcision occurs, it is a mitzvah to eat — and no release is needed, “for the custom was not to fast in such a case.” Why not say here likewise: the custom was not to fast when one is ill?
The answer, and it bears on what one had in mind The Shach answers that it is no difficulty, and his answer is fine: there, the custom itself contained the exception — it was customary to eat when a circumcision occurred, so that whoever fasts already does so knowing that he will eat in that case. Here, by contrast, לא אסיק אדעתיה: it had not entered his mind that he might not be in good health. The exception was therefore not in his custom, and a release is needed.
Nafka mina — and the Shach draws it himself, on a third text The same explanation, says the Shach, accounts for a third passage: the Rama writes in Orach Chayim 551 that those who have the custom not to eat meat from Rosh Chodesh Av are permitted at a mitzvah meal — and it appears that they do not even need a release. Why? Because there too the custom never covered that case. The rule that emerges is therefore: what the custom never purported to cover need not be released. And that is exactly the door the Pitchei Teshuva will reopen at ס״ק א.

6. מנהג חשוב ומנהג גרוע — the Rosh and the Tosafot against the Bach

↩ Detailed explanation (level 1)
The Rosh’s division, and what the Bach sets against it (א) The Rosh and the Tosafot, as reported by the Shach at ס״ק ז: one must distinguish a מנהג חשוב — taken up by the people of the place with a talmid chacham among them — from a מנהג גרוע, which the people of the country took up of themselves. For the latter, one is bound to conform only in their presence, and only before ordinary folk. (ב) The Bach objects on two counts: that the Tur is stricter, and above all that the distinction ניתן לשיעורים — it has no measure, one cannot say which custom is important; one therefore goes stringently, and does not distinguish between scholar and layman either.
And the clause that dominates the whole debate Whatever the outcome of the division, the Rosh adds a reservation which the Shach reports at once and which prevails in practice: if there is cause to fear a dispute, it is forbidden in every case, for one does not change on account of dispute. It is the very principle of the chapter Makom Shenahagu, which the Rambam restates at the end of

7. אין דעתם לחזור — the Shach’s תימה, and his psak

↩ Detailed explanation (level 1)
The Shach’s תימה, and it bears on the Mehaber against himself The Shach opens his ס״ק ח with the word תימה. Here the Mehaber follows the Rivash — himself drawing on the sugya of Chullin about Rabbi Zeira, and resting on the path of the Tosafot, the Rosh, the Ran and the Tur — and releases the newcomer from the customs of his former town. But in Orach Chayim 468, the same Mehaber copies the Rambam from the end of הלכות יום טוב, from which it appears that even one who has no intention of returning retains the stringencies of the place he left.
The proposed answer, and it does not satisfy its author The Shach proposes to distinguish two situations that the phrase אין דעתו לחזור covers: one who does not mean to return but does not mean to settle where he has gone either, and one who means to settle there. Orach Chayim 468 would speak of the first, our seif and Orach Chayim 574 of the second. Then he writes וצ״ע — he leaves the question open.
And the psak, which he ends by giving in his own name Having left the contradiction open, the Shach concludes ולענין דינא: according to the Rosh and those who follow him, one always follows the custom of the place where one means to settle, whether toward leniency or toward stringency. And he keeps the reservation: where there is fear of dispute, nothing is changed, even toward leniency. The Ba’er Hetev repeats this conclusion almost word for word.
