A first approach to Siman 215, six seifim at the heart of נדרים. Siman 213 asked what a vow does not catch, for want of substance; this one asks the reverse — how a vow catches what the Torah commands. Someone says קונם סוכה שאני יושב, and he is barred from sitting in his own sukkah. Then the siman turns to the commonest case: he vowed to fast, and a Shabbat falls within the period. Finally it sets the limit — a vow takes on a positive command, not on a prohibition — and reports the contrary view. These are rules למעשה: every real case goes to a Rav.

📑 Study plan

1. What is this siman about?
2. The seifim, one after another, clause by clause
3. The key concepts
4. Where these seifim come from: the Mishna, the Gemara, the Rambam, the Tur, the Beit Yosef
5. The commentaries, cited entry by entry
6. The table of seifim
7. Practical cases
8. Comprehension questions

1. What is this siman about?

A vow (נדר) does not bind the person: it forbids a thing. One who says קונם over a loaf does not bind himself; he makes that loaf forbidden to him, as an offering would be. An oath (שבועה) does the reverse: it binds the man to an act or an abstention.

From this difference the whole siman follows. An oath cannot impose itself against a mitzva, because a man already bound by the Torah has nothing left with which to bind himself. But a vow meets no obstacle: it bears on the object, and the object was not yet forbidden. That is why vows take effect on a matter of mitzva — one can make the sukkah forbidden to oneself.

The siman unfolds this rule over six seifim: the textbook case (seif 1), its application to fasting when a Shabbat falls in the period (seifim 2 to 4), its limit — a vow does not take on what is already forbidden (seif 5) — and the contrary view (seif 6).

The siman in two halves. Seifim 1 to 4: the vow takes on the mitzva — so one does not override it, one has it released. Seifim 5 and 6: how far? On a positive command, yes; on a prohibition, no — and one view says yes.

2. The seifim, clause by clause

Here are the six seifim, each first in full — as the source gives it, parenthetical glosses and the Rama’s glosses included — and then broken down clause by clause.

Seif 1 — the vow takes hold of the sukkah and the lulav

The seif states the rule of the siman and at once shows it at work on two mitzvot: he said קונם of the sukkah and of the lulav, and the prohibition holds. The Rama’s gloss adds an altogether different question: is this man also punished?

Vows take effect on a matter of mitzva
The rule of the siman, and it runs against instinct: a man’s word can forbid him what the Torah commands. Siman 213 said what a vow fails to catch for want of substance; this one says it catches even a matter of mitzva.
How so? He said: קונם — the sukkah I sit in, the lulav I take
Two formulas chosen for their shape: he does not say “I swear not to sit”, he names the object. Everything that follows in the siman turns on that difference.
he is forbidden to sit in the sukkah and to take the lulav
The vow prevails: not that he is exempt from the mitzva, but that the object is now forbidden to him, and one does not feed a man what is forbidden to him. That is the reason the Taz will give in ס״ק א.
Gloss: and some say that he would be flogged for having vowed to annul the mitzvot
The Rama changes the question. No longer “does the vow hold?” — it does — but “what of the man?”. A first view sees here a נדר שוא punishable by flogging.
and his vow is released for him, and he performs the mitzva (Mordechai, beginning of Shevuot Shtayim, in the name of Rabbenu Ḥananel)
Here is the practical conduct, and it shapes the whole of level 4: the vow holds, so it is not ignored — it is released, and only then is the mitzva performed.
and some say there is no flogging for a vain vow, only for a vain oath
The second view, resting on the very distinction the Taz draws: an oath binds the person — it can be vain; a vow forbids an object — it is not.
(Mordechai, found in the name of Raavia, the Ran and the Rosh in Nedarim, and see Beit Yosef siman 236) — and this is the main [ruling]
וכן עיקר: the Rama rules like the second view. The Shakh, at ס״ק ה, does not contradict him — but adds that disciplinary blows (מכת מרדות) remain possible.
Seif 1 in a word. A vow that names the object of a mitzva takes effect, and the object becomes forbidden. The thing to do is therefore not to override it but to have it released — and then the mitzva becomes possible again. The Rama’s question remains: is such a vow also a punishable offence? He rules that it is not.

Seif 2 — he vowed to fast, and a Shabbat falls within the period

The first application, and a practical one. A man vowed to fast for a set period and finds that it contains days on which one does not fast. The seif does not say the vow lapses: it says the vow is released, and how.

He vowed to fast for a known period, and Shabbatot, Festival days and Rashei Ḥodashim fell within it
Three kinds of day, and seif 4 will show they are not equal: Shabbat and Festival are of the Torah, Rosh Ḥodesh too in its way, Ḥanukka and Purim are rabbinic — and that is where everything will turn.
his vow is released for him, and they open [the door] for him with those very days
The technical word is פותחין: the sage seeks a door — a consideration the man did not have in mind and which, had he had it, would have kept him from vowing. Here the door is the honour of those days.
for they say to him: had you borne in mind that these days would fall within this period, you would not have vowed
The exact wording of the door. It asks him not what he wants now, but what he would have said then — and that is what uproots the vow from its source.
and the whole vow is released
A decisive clause, and the Shakh gives its reason at The door concerns only the festive days — and yet the entire fast falls, ordinary days included.
Seif 2 in a word. The vow to fast did take effect, festive days included; but it is not left to operate — one comes before a sage, who opens with the honour of those days, and the whole vow falls with them.

Seif 3 — “I vow” or “I accept a fast”: two formulas, two regimes

The seif limits the previous one, and this is the most useful distinction in the siman: everything depends on the formula used. A vow proper requires release; a mere acceptance of a fast requires none, because it never took hold of those days at all.

In what case was it said that release is needed? Where they accepted it in the language of a vow, saying: קונם the eating of such and such days is upon me
The formula of a true vow: it names the thing (the eating of those days) and lays it upon him. This is exactly the form of seif 1 — קונם plus the object.
but if he expressed it only in the language of accepting a fast, it overrides neither Shabbat nor Festival nor Rosh Ḥodesh, nor Ḥanukka and Purim — and he needs no release
The Taz, at ס״ק ג, gives the underlying reason: one who says “I accept a fast” binds himself — that is the shape of an oath, and an oath does not take effect on a matter of mitzva. Note that Ḥanukka and Purim are expressly included here: seif 4 will say the opposite for the vow formula, and therein lies the whole difficulty of the siman.
and even if he accepted upon himself to fast on Shabbat and Festival only
The word אפילו has drawn much ink: the Ba’h objects that it ought to say all the more so. The Shakh answers him at length at ס״ק ח, and the Taz at ס״ק ד.
(and see Ora’h Ḥayim siman 418)
A cross-reference printed in the body of the Shulchan Arukh in small type. It is copied as it stands, as the rule of transcription requires.
Seif 3 in a word. Ask first what words were said. “קונם the eating of these days” is a vow: it takes effect and requires release. “I accept a fast” is not a vow upon an object: it does not take hold of the days on which one does not fast, and there is nothing to release.

Seif 4 — vowing to fast on a Festival, and the limit of Ḥanukka

The seif draws the consequence of seif 1: in vow language, even expressly aiming at Shabbat does not void the vow. Then it stops short at Ḥanukka and Purim — and that last line is the knot of the siman, which the Shakh will untie at ס״ק י״א.

One who accepts upon himself, in the language of a vow, to fast on Shabbat and Festival — the vow takes effect
The exact counterpart of seif 3. It is not the intention that decides but the form: the same intention, said in vow language, produces a prohibition.
and likewise one who vows to fast on Sunday, or Monday, all his days, and a Festival or the eve of Yom Kippur falls on them: he must fast — and needless to say, Rosh Ḥodesh
This is the enduring vow: not a closed period but a weekday “all his days”. The Shakh will see in it the key to the whole siman.
but if Ḥanukka and Purim fall on them, his vow is void
A reversal. The Shakh gives its reason at ס״ק י: מפני שהם מדבריהם וצריכין חיזוק — being rabbinic, they need reinforcement, and the Sages have the power to prevent the vow from taking effect.
(and see Ora’h Ḥayim siman 570, which did not rule so)
The Shulchan Arukh flags that it diverges from its own Ora’h Ḥayim. The Shakh devotes the longest note of the siman, ס״ק י״א, to reconciling the two — and his argument is one word: here the vow is perpetual, there it is of finite duration.
Seif 4 in a word. In vow language every fast holds — Shabbat, Festival, the eve of Yom Kippur, Rosh Ḥodesh — except Ḥanukka and Purim, which the Sages shield. And the Shulchan Arukh itself warns that it ruled otherwise in Ora’h Ḥayim: this is a point one does not settle alone.

Seif 5 — the limit: the vow takes on a positive command, not on a prohibition

The longest and most theoretical seif of the siman. It bounds the rule: a vow takes effect on a positive command in any of its forms, but not on a prohibition. The reason is simple: what is already forbidden is not free — there is nothing for the vow to bite on.

That vows take effect on a matter of mitzva — that is specifically in a positive command
The seif returns to the rule of seif 1 in order to bound it. All that follows is the map of that frontier.
whether it contains a bare positive command, or a positive in its fulfilment and a prohibition in its annulment
A fine yet broad distinction: even a mitzva coupled with a prohibition (matza, for instance) stays on the positive side, and the vow takes hold of it.
and there is no difference in this between a prohibition that comes of itself and one he brought upon himself
איסור הבא מאליו: a prohibition of the Torah. איסור הבא ע״י עצמו: one the man made for himself by an earlier oath. The rest of the seif will give the example.
but on an ordinary prohibition it does not take effect — neither in annulling it nor in fulfilling it
The bound, and it is symmetrical: neither to lift the prohibition nor to thicken it. Seif 6 will report a contrary view.
How so? He said: eating נבילה is upon me — the vow does not take effect upon him
The textbook case. The נבילה is already forbidden to him: his vow has nothing to forbid, and falls empty.
and the same for a prohibition he brought upon himself: e.g. he said “an oath that I shall not eat this loaf”, then went back and said “this loaf is upon me” — he is liable only once, namely for בל יחל of the oath
The oath has occupied the place; the vow that comes after finds nothing free. This is the heart of the mechanism, and the Taz will return to it at ס״ק ו to show when it ceases to apply.
and likewise if he said “an oath that I shall not drink”, then said “I am hereby a nazir”, and drank: he is liable only once, for בל יחל of the oath — but not for the nezirut
The Pit’hei Teshuva, at ס״ק ב, will dwell at length on this example: taken literally it ought to be wrong, nezirut being an איסור כולל.
unless he is released from the oath — for then the nezirut takes effect upon him
A remarkable consequence, which the Shakh specifies at ס״ק י״ג: the nezirut then takes effect retroactively, למפרע. What had not taken hold was simply waiting for the place to be vacated.
and the vow does take effect on one who swore that he would sleep or that he would drink — even though its annulment involves a prohibition
An obscure clause, and the Taz at ס״ק ו gives its reading: the oath was positive (“I shall sleep”), and the vow comes to forbid. The two do not overlap — they oppose — and so the vow finds room.
Seif 5 in a word. A vow takes hold of what is free. A positive command leaves the object free: the vow forbids it. A prohibition has already taken it: the vow finds nothing. An earlier oath took it likewise — unless it took it in the opposite direction.

Seif 6 — the contrary view: the vow takes even on a forbidden thing

The seif opens with וי״א, “and some say” — that is, it disputes seif 5. The Taz, at ס״ק ז, indeed maintains that it is no seif at all: the ו of וי״א was taken by the copyist for the numeral of the sixth seif.

And some say that if he vowed [to abstain] from forbidden things — such as נבילות and טריפות — the vow takes effect, and if he eats them he transgresses בל יחל
The exact opposite of seif 5. The Shakh, at ס״ק י״ב, defends the Mehaber’s manner against the Ba’h: to set out the Rashba’s view first and then the וי״א is the ordinary way of the Shulchan Arukh.
but if he attached another thing to them, it is not caught — for his intent is only the original prohibition, since he is “one who attaches to a forbidden thing”
Here the two views meet: even for one who lets the vow take on a נבילה, it cannot serve as an anchor for another prohibition. The Shakh notes this at ס״ק ט״ו.
but a thing forbidden by rabbinic law, which he forbade upon himself in the language of a vow and to which he attached another thing — that one is caught by the vow and forbidden
A decisive distinction, and it explains why: what is forbidden only rabbinically remains, as regards the Torah, a free thing — so a vow can settle on it and then serve as an anchor.
Gloss: one who vows or swears not to eat מצה on the night of Pesa’h — מצה עשירה is not included
The Rama ends on a question of the reach of words — and that is already siman 216. Why? Because on the night of Pesa’h “מצה” means only the מצה with which one discharges the mitzva, and מצה עשירה is not among them.
but if he vowed not to eat מצה all year, it is possible that מצה עשירה is included (Rivash, brought by the Beit Yosef at the end of siman 236)
The same word, two reaches, according to when it is said. This is exactly the principle siman 216 will unfold over twelve seifim. Note the אפשר: the Rivash himself is not categorical.
Seif 6 in a word. One view lets the vow take even on what is already forbidden — but nobody allows it to serve as an anchor. And the Rama’s gloss already opens onto the next siman: what a word denotes depends on when it is said.

3. The key concepts of this siman

The vow. It does not bind the man: it forbids a thing to him, treating it as an offering. Hence it can reach the object of a mitzva.
שבועה — The oath. It binds the person to an act. It therefore does not take on a mitzva: the man is already bound. This is the reason the Taz gives at ס״ק א.
מצות לאו ליהנות נתנו — Mitzvot were not given for enjoyment. The direct consequence, at the Shakh’s ס״ק ב: one who forbids the benefit of the sukkah may still sit in it — sitting in a sukkah is not, halakhically, a benefit.
דבר שאין בו ממש — A thing without substance, on which a vow does not take — that is siman 213. Here the Shakh, at ס״ק ג, shows why the difficulty does not arise: the formula קונם סוכה שאני יושב names the object.
The “door”. A consideration the vower did not have in mind and which, had he had it, would have held him back. Here, the honour of Shabbat and the Festivals (seif 2).
נדר שהותר מקצתו הותר כולו — A vow released in part is released in whole. The Shakh gives it at ס״ק ו as the reason for והותר כל הנדר in seif 2.
לשון נדר · לשון קבלת תענית — The two formulas of seif 3, and the whole practice of the siman depends on them. “קונם the eating of such days” is a vow, which takes effect and is released. “I accept a fast” is neither vow nor release.
צריכין חיזוק — What “needs reinforcement”. The Shakh at ס״ק י: Ḥanukka and Purim being rabbinic, the Sages gave them the force to prevent the vow from taking effect.
מתפיס בדבר האסור — One who attaches to a forbidden thing. Seif 6 says it: even if the vow took hold of the נבילה, it cannot serve as an anchor for another prohibition.

4. Where these seifim come from

The Gemara — Nedarim 16b: the verse that grounds the distinction

The whole rule of the siman rests on a derivation in the Gemara. One does not swear to transgress mitzvot, for it says לא יחל דברו — but he may profane it for the things of Heaven. A vow bears on the object, and the verse does not reach it in the same way.

The Mishna — Nedarim ch. 2: a vow bears on what has substance

The Mishna gives, just before, the contrast the Shakh will invoke at ס״ק ג. “קונם that I shall not sleep” has no substance — and yet the Mishna holds him under בל יחל; that is exactly the difficulty of siman 213, and the Shakh answers here that our formula does name an object.

The Rambam — Hilkhot Nedarim, chapter 3

The Rambam opens chapter 3 with the four differences between a vow and an oath, and the third is our siman. He then gives the textbook case — and note that he names the מצה of the Pesa’h night, the sukkah and the tefillin, where the Shulchan Arukh takes the sukkah and the lulav.

The Tur and the Beit Yosef

The Tur gives our siman almost in the words of the Shulchan Arukh, and at once adds the Ramban — whence the distinction of seif 3 between the two formulas. The three ways of reconciling the sugya in Nedarim with that in Taanit, which the Taz will unfold at ס״ק ג, are already here.

5. The commentaries of the siman, entry by entry

The commentaries on this siman number forty entries: seventeen ס״ק of the Shakh (eighteen paragraphs — ס״ק י״א carries two), seven of the Taz, twelve of the Ba’er Hetev, two of the Pit’hei Teshuva, two of the Nekudot HaKesef. We cite them all, in order, summarising none. The Arukh HaShulchan is not cited: it is not accessible to us for this siman. Neither are the Pri Ḥadash, the Biur HaGra and the Be’er HaGolah.

This is the principal commentary of the siman, and by far: seventeen entries, two of them full dissertations — ס״ק ח on the word אפילו, ס״ק י״א on the contradiction with Ora’h Ḥayim 570.

ס״ק א — a vow, not an oath

ס״ק ב — “הנאת סוכה עלי”: leave to sit, and why

ס״ק ג — why this is not a דבר שאין בו ממש

ס״ק ד — the Derisha: even an explicit vow is released

ס״ק ה — no flogging — but disciplinary blows

ס״ק ו — why the whole vow falls

ס״ק ח — the word אפילו, and the Ba’h’s objection

ס״ק ט — the vow holds — and yet it is released

ס״ק י״א — the great note: Ora’h Ḥayim 570 against this seif

ס״ק י״ב — the Ba’h against the Mehaber’s order in seif 5

ס״ק י״ג — the nezirut takes effect retroactively

ס״ק י״ד — the contrary view and its two consequences

ס״ק ט״ו — that clause holds for both views

ס״ק ט״ז — does the מתפיס בדבר האסור still need a שאלה?

ס״ק י״ז — מצה עשירה: permitted without release — but the מצה itself

Seven entries, two of them decisive: ס״ק א, which gives the underlying reason for the whole siman, and ס״ק ג, which unfolds the three ways of reconciling Nedarim and Taanit.

ס״ק א — why the vow prevails and the oath does not

ס״ק ב — against the Perisha: release works in every case

ס״ק ג — the three ways of reconciling Nedarim and Taanit

ס״ק ד — the word אפילו; then a vow on future profit, and the month of Nissan

ס״ק ה — cross-reference to the difficulty of ס״ק ג

ס״ק ו — “that he would sleep”: a vow running counter to the oath

ס״ק ז — read וי״א — and there is no sixth seif

The Ba’er Hetev

Twelve entries. The Ba’er Hetev is here an abridgement of the Shakh and the Taz, and is valuable for that very reason: it shows what the A’haronim retained of each discussion.

ס״ק א — the Shakh and Taz on the sukkah in brief; and a vow not to marry

ס״ק ב — the Derisha, reported

ס״ק ג — the disciplinary blows

ס״ק ה — the Ba’h’s objection and the Shakh’s answer, abridged

ס״ק ו — he is released — and even compelled

ס״ק ז — the long entry: Ora’h Ḥayim 570, the Levush, Nissan

ס״ק ח — the retroactive nezirut

ס״ק ט — the Taz on “that he would sleep”

ס״ק י — who decides between the views of seif 5 and seif 6

ס״ק י״א — the Shakh’s reservation about the שאלה

The Pit’hei Teshuva

Only two entries, but the second is substantive: it asks how the nezirut example in seif 5 can be correct.

ס״ק א — a vow not to marry: two works to consult

ס״ק ב — the nezirut case is only an example — and presumes no איסור כולל

The Nekudot HaKesef (נקודות הכסף) — ב׳ entry

The Nekudot HaKesef are the Shakh’s reply to the Taz. Here they have two entries, both on the Taz’s

Entry א — the referral to the Shakh on the Taz’s difficulty

Entry ב — what the Ba’h and the Hagahat Perisha had already said

6. The table of seifim

The whole siman in a grid: the seif, the clause, and what it says.

SeifThe clause of the Shulchan ArukhWhat it says
Vows take effect on a matter of mitzva
He said: קונם — the sukkah I sit in, the lulav I take
א « אסור לישב בסוכה וליטול לולב » (שו״ע יו״ד רט״ו:א) he is forbidden to sit in the sukkah and to take the lulav
Gloss: and some say that he would be flogged for having vowed to annul the mitzvot
א « ומתירין לו נדרו ומקיים המצוה (מרדכי ריש שבועות שתים בשם ר״ח » (רמ״א יו״ד רט״ו:א) and his vow is released for him, and he performs the mitzva (Mordechai, beginning of Shevuot Shtayim, in the name of Rabbenu Ḥananel)
א « וי״א דאין מלקות בנדר שוא רק גבי שבועת שוא » (רמ״א יו״ד רט״ו:א) and some say there is no flogging for a vain vow, only for a vain oath
א « מרדכי מצא בשם ראבי״ה ור״ן ורא״ש בנדרים ועב״י סימן רל״ו) וכן עיקר » (רמ״א יו״ד רט״ו:א) (Mordechai, found in the name of Raavia, the Ran and the Rosh in Nedarim, and see Beit Yosef siman 236) — and this is the main [ruling]
He vowed to fast for a known period, and Shabbatot, Festival days and Rashei Ḥodashim fell within it
ב « מתירין לו נדרו ופותחין לו בהם » (שו״ע יו״ד רט״ו:ב) his vow is released for him, and they open [the door] for him with those very days
ב « שאומרים לו אילו שמת על לבך שיפגעו בתוך הזמן הזה אלו הימים לא היית נודר » (שו״ע יו״ד רט״ו:ב) for they say to him: had you borne in mind that these days would fall within this period, you would not have vowed
ב « והותר כל הנדר » (שו״ע יו״ד רט״ו:ב) and the whole vow is released
ג « במה דברים אמורים שצריך התרה כשקבלו בלשון נדר שאמר קונם אכילת ימים כך וכך עלי » (שו״ע יו״ד רט״ו:ג) In what case was it said that release is needed? Where they accepted it in the language of a vow, saying: קונם the eating of such and such days is upon me
ג « אבל אם לא הוציאו אלא בלשון קבלת תענית אינו דוחה לא שבת ויו״ט וראש חודש ולא חנוכה ופורים ואינו צריך התרה » (שו״ע יו״ד רט״ו:ג) but if he expressed it only in the language of accepting a fast, it overrides neither Shabbat nor Festival nor Rosh Ḥodesh, nor Ḥanukka and Purim — and he needs no release
ג « ואפי׳ לא קבל עליו להתענות אלא בשבת ויום טוב בלבד » (שו״ע יו״ד רט״ו:ג) and even if he accepted upon himself to fast on Shabbat and Festival only
ג « ועיין בא״ח סימן תי״ח » (שו״ע יו״ד רט״ו:ג) (and see Ora’h Ḥayim siman 418)
One who accepts upon himself, in the language of a vow, to fast on Shabbat and Festival — the vow takes effect
ד « וכן הנודר לצום יום ראשון או ב׳ כל ימיו ופגע בהם יו״ט או ערב יום כפור חייב לצום ואין צריך לומר ר״ח » (שו״ע יו״ד רט״ו:ד) and likewise one who vows to fast on Sunday, or Monday, all his days, and a Festival or the eve of Yom Kippur falls on them: he must fast — and needless to say, Rosh Ḥodesh
ד « אבל אם פגע בהם חנוכה ופורים נדרו בטל » (שו״ע יו״ד רט״ו:ד) but if Ḥanukka and Purim fall on them, his vow is void
ד « ועיין בא״ח סי׳ תק״ע דלא פסק כן » (שו״ע יו״ד רט״ו:ד) (and see Ora’h Ḥayim siman 570, which did not rule so)
That vows take effect on a matter of mitzva — that is specifically in a positive command
ה « בין שיש בה עשה גרידא בין שיש עשה בקיומה ולא תעשה בביטולה » (שו״ע יו״ד רט״ו:ה) whether it contains a bare positive command, or a positive in its fulfilment and a prohibition in its annulment
ה « ואין הפרש בזה בין איסור הבא מאליו לאיסור הבא ע״י עצמו » (שו״ע יו״ד רט״ו:ה) and there is no difference in this between a prohibition that comes of itself and one he brought upon himself
ה « אבל על מצות לא תעשה דעלמא אינו חל בין בביטולו בין בקיומו » (שו״ע יו״ד רט״ו:ה) but on an ordinary prohibition it does not take effect — neither in annulling it nor in fulfilling it
He said: eating נבילה is upon me — the vow does not take effect upon him
ה « והוא הדין לאיסור הבא ע״י עצמו כגון שאמר שבועה שלא אוכל ככר זה וחזר ואמר ככר זה עלי אינו חייב אלא אחת דהיינו משום בל יחל דשבועה » (שו״ע יו״ד רט״ו:ה) and the same for a prohibition he brought upon himself: e.g. he said “an oath that I shall not eat this loaf”, then went back and said “this loaf is upon me” — he is liable only once, namely for בל יחל of the oath
ה « וכן אם אמר שבועה שלא אשתה וחזר ואמר הריני נזיר ושתה אינו חייב אלא אחת דהיינו בל יחל דשבועה אבל דנזירות לא » (שו״ע יו״ד רט״ו:ה) and likewise if he said “an oath that I shall not drink”, then said “I am hereby a nazir”, and drank: he is liable only once, for בל יחל of the oath — but not for the nezirut
ה « אא״כ נשאל על השבועה שאז חל הנזירות עליו » (שו״ע יו״ד רט״ו:ה) unless he is released from the oath — for then the nezirut takes effect upon him
ה « והנדר חל על מי שנשבע שיישן או שישתה ואע״פ שיש בביטולו לא תעשה » (שו״ע יו״ד רט״ו:ה) and the vow does take effect on one who swore that he would sleep or that he would drink — even though its annulment involves a prohibition
ו « וי״א שאם נדר מדברים האסורים כגון נבילות וטריפות חל הנדר ואם אוכל מהם עובר בלא יחל » (שו״ע יו״ד רט״ו:ו) And some say that if he vowed [to abstain] from forbidden things — such as נבילות and טריפות — the vow takes effect, and if he eats them he transgresses בל יחל
ו « אבל אם התפיס בהם דבר אחר אינו נתפס שאינו דעתו אלא בעיקר האיסור דהוי ליה מתפיס בדבר האסור » (שו״ע יו״ד רט״ו:ו) but if he attached another thing to them, it is not caught — for his intent is only the original prohibition, since he is “one who attaches to a forbidden thing”
ו « אבל דבר שאסור מדרבנן ואסרו עליו בלשון נדר והתפיס בו דבר אחר נתפס בנדר ואסור » (שו״ע יו״ד רט״ו:ו) but a thing forbidden by rabbinic law, which he forbade upon himself in the language of a vow and to which he attached another thing — that one is caught by the vow and forbidden
ו « הגה הנודר או הנשבע שלא לאכול מצה בליל פסח אין מצה עשירה בכלל » (רמ״א יו״ד רט״ו:ו) Gloss: one who vows or swears not to eat מצה on the night of Pesa’h — מצה עשירה is not included
(ריב״ש מביאו ב״י ס״ס רל״ו » (רמ״א יו״ד רט״ו:ו) but if he vowed not to eat מצה all year, it is possible that מצה עשירה is included (Rivash, brought by the Beit Yosef at the end of siman 236)

7. Practical cases

Five situations, taken in the order of the siman. Each closes on the same referral: actual conduct belongs to the Rav.

Case 1 — an undertaking taken against a mitzva

Someone said, in anger or in self-severity, that he forbids himself some matter of mitzva. The siman does not say “that is nothing”: it says the vow holds and the object is forbidden to him. The conduct is therefore that of seif 1 and of the Shakh at ס״ק ט: one comes before a sage, has it released, and performs the mitzva — the Shakh even writing that it is right to compel him. Whether what was said constitutes a vow is not for oneself to decide: ask your Rav.

Case 2 — “I forbid myself the benefit of…”

The wording changes everything. The Shakh, at ס״ק ב, distinguishes: קונם סוכה שאני יושב forbids the sukkah, but הנאת סוכה עלי does not, because מצות לאו ליהנות נתנו — and the Ba’h extends it to the shofar from Ora’h Ḥayim 586. These are distinctions of wording, and the exact wording of what was said is established before a Rav, not from memory.

Case 3 — a fast accepted, and a Festival falls within it

This is the commonest case in the siman, and the first question is not “must he fast?” but “what words were said?”. In the language of simply accepting a fast, seif 3 is clear: nothing took hold of those days and there is nothing to release. In vow language, seif 2 sends him before a sage, who opens with the honour of those days — and the whole vow falls. Ask your Rav.

Case 4 — Ḥanukka, Purim, and the open divergence

Seif 4 declares the vow void when Ḥanukka or Purim fall on the vowed day. But the Shulchan Arukh itself refers to Ora’h Ḥayim 570, דלא פסק כן, and the Rama writes there that the custom is not like the Rambam. The Shakh devotes his longest note to this, at ס״ק י״א, proposing to distinguish a perpetual vow from one of finite duration. This is a point of open divergence: it is not settled on a page.

Case 5 — forbidding oneself what is already forbidden

Someone declares forbidden to himself what the Torah already forbids. Seif 5 says the vow does not take; seif 6 reports that it does. The Shakh, at ס״ק י״ב, shows the first view to be the Rashba’s and the second Rashi’s, Tosafot’s and the Tur’s; the Ba’h prefers the second, the Shakh defends the first, the Ba’er Hetev records both at ס״ק י. What is settled is that it cannot be used to forbid another thing. The rest requires a Rav.

8. Comprehension questions

  1. Why does a vow take effect on a matter of mitzva while an oath does not? Give the Taz’s exact reason at ס״ק א.
  2. What distinction does the Shakh draw, at ס״ק ב, between “קונם סוכה שאני יושב” and “הנאת סוכה עלי”?
  3. Siman 213 says a vow does not take on a How does the Shakh remove the objection at ס״ק ג?
  4. The Rama rules there is no flogging for a vain vow. What does the Shakh add at ס״ק ה, and on whose authority?
  5. Why, in seif 2, does the whole vow fall and not only the festive days?
  6. What is the difference between “לשון נדר” and “לשון קבלת תענית”, and what practical consequence does seif 3 draw?
  7. The Ba’h objects to the word אפילו in seif 3. What exactly does he object to, and how does the Shakh answer at ס״ק ח?
  8. Seif 4 declares the vow void for Ḥanukka and Purim. What is the reason, and who gives it?
  9. The Shulchan Arukh itself refers to Ora’h Ḥayim 570 “which did not rule so”. What distinction does the Shakh propose at ס״ק י״א?
  10. What limit does seif 5 set, and what view does seif 6 set against it?
  11. According to the Taz at ס״ק ז, why is there no sixth seif in this siman?
  12. The Rama ends with מצה עשירה. Why does the answer change between the night of Pesa’h and the rest of the year?
