A first approach to Siman 216, twelve seifim — the longest in the block of נדרים on the reach of words. The underlying question is posed by the Tur in its first line: כל הנדרים הולכין אחר הלשון, all vows follow the language. This siman treats its first branch, לשון תורה: what the word conveys of itself. Three blocks compose it — fruits and what comes from them; property, where demonstrative and possessive contend; taste, mixture and name. These are rules למעשה: every real case goes to a Rav.

1. What is this siman about?

The Tur opens this siman with the rule that governs all of it: all vows follow the language. If it is the language of the Torah, according to what the word conveys; if it is the language of men, according to how people speak in that place and at that time, and according to the vower’s intention. The Shulchan Arukh here takes the first half of that rule and gives it twelve seifim; the second half is the next siman.

The question is therefore always the same, seif after seif: how far does the word used reach? And the answer turns each time on a very small number of levers. A demonstrative — “these fruits”, “this house” — treats the thing as a consecration, and the prohibition passes to what comes from it. A possessive — “your house”, “my loaf” — describes a relation and follows ownership. A verb — “what I eat”, “what I taste” — bounds the prohibition to the act it names. A species name — “olives”, “meat” — designates nothing and carries nothing.

The rest is physics and logic: what materially persists transmits the prohibition one degree further, what has perished does not; and what can be made permitted never dilutes in a majority of its own kind.

The siman in three blocks. Seifim 1 to 3: fruits and what comes from them — exchanges, growths, liquids. Seifim 4 to 8: property, and the contest of demonstrative against possessive. Seifim 9 to 12: taste, mixture, and name.

2. The seifim, clause by clause

Here are the twelve seifim, each first in full — as the source gives it, parenthetical glosses, editorial brackets and the Rama’s glosses included — and then broken down clause by clause.

Seif 1 — “these fruits”: the vow follows the object through its transformations

The siman opens on the decisive case: a man has designated particular fruits. The Tur, at the head of the siman, gives the general reason — all vows follow the language, and when that language is the Torah’s, they follow what the word conveys. Here, designating “these fruits” treats them as a consecration: the prohibition passes to what is obtained in exchange for them and to what grows from them.

קונם — these fruits are [forbidden] to me: he is forbidden in their exchanges and in their growths
Two extensions at once, and neither is obvious: what another gave in exchange for these fruits, and what grew from them. The Shakh will specify at ס״ק א that for the Rosh the extension to exchanges applies only to the one who exchanged.
and needless to say, in the liquids that issue from them
The juice is closer to the fruit than its growth: if he is forbidden in the growth, all the more so in the liquid. Seif 12 will show that this reasoning does not hold for every formula.
and likewise he is forbidden in the growths of their growths
A contested clause. The Shakh, at ס״ק ב, notes that the Ba’h restricted it to seif 2 alone, and defends it here against him; the Taz, at ס״ק ג, derives it by a קל וחומר.
but the exchanges of their exchanges are permitted
The bound. The Taz, at ס״ק ב, wonders that the Beit Yosef did not see the Rosh, who in his rulings forbids even exchanges of exchanges; the Nekudot HaKesef answer that it is a copyist’s error, the Mishna not reading so.
and if it is a thing whose seed perishes, the growths of its growths are permitted
The physical criterion of the siman, and a very clean one: sown wheat perishes in the earth, a planted onion is still there. What materially persists carries the prohibition; what has perished no longer transmits it to the second degree.
and such is the law if he did not say “these”, but they were before him and he said: קונם, they are [forbidden] to me
It is therefore not the word אלו that counts but the designation. The Taz, at ס״ק א, draws from this a fine observation on the difference between the two halves of the seif: saying “these” implies he sees them, but not that they are set before him.
Gloss: and likewise if he said: the fruits of so-and-so, or of such a place, are קונם to me — it is as if he had said “these fruits”
A third way of designating: by owner or by place. The Shakh, at ס״ק ד, at once sets the decisive limit — saying “figs are קונם to me” names a species and does not designate: there nothing passes to exchanges or growths.
(Beit Yosef in the name of the Ran)
The source parenthesis, copied as it stands. The Ran is the dominant voice of this siman: from him come the extension to exchanges, the limit of species, and the rule of the last formula used.
Seif 1 in a word. To designate is to consecrate. Designated fruits — by “these”, by their presence, by their owner or by their place — carry with them their exchanges, their growths, their juices and, where the seed persists, the growths of their growths. What does not follow: the exchanges of the exchanges.

Seif 2 — “what I eat of them”: the verb that narrows the vow

The same object, another formula — and everything changes. One who says “what I eat of them” has not consecrated the fruits: he has forbidden an act upon them. And eating what was exchanged for them is not eating them. What recaptures the prohibition is no longer designation but material persistence.

He said: קונם, what I eat or taste of them — if it is a thing whose seed perishes, like wheat and its like, he is permitted in their exchanges and their growths
The Taz gives the reason at ס״ק ה, and it is disarmingly simple: in eating the exchange or the growth, he does not taste those fruits, and that alone is what he forbade.
and if it is a thing whose seed does not perish when sown, like garlic and onions, even the growths of the growths are forbidden
Because the original onion is still materially there: eating the growth, he does eat of it. The Taz, at ס״ק ו, dismisses the objection from nullification in a majority: it is a דבר שיש לו מתירין, which is not nullified.
and likewise the liquids that issue from them are forbidden
⚠️ The Rambam on this very point leaves the question undecided: ובין כך ובין כך משקין היוצאין מהן ספק, whence he is not flogged. The Shulchan Arukh rules it forbidden.
and likewise if he said: קונם, these fruits are [forbidden] to so-and-so — he is forbidden in their exchanges and their growths
A return to the designating formula, but aimed at a third party. The Taz explains at ס״ק ז that this is a question the Gemara left unresolved, decided here stringently; the Pit’hei Teshuva, at ס״ק א, reports that R. Shmuel Eiger objected, since the ground of דבר שיש לו מתירין fails when the third party has no power to release.
Seif 2 in a word. “What I eat of them” forbids only those fruits. Exchanges and growths become permitted again — unless the seed persists, for then the growth still contains the forbidden object. The juice, however, remains forbidden in both cases.

Seif 3 — the wife’s handiwork: the two formulas applied to one case

The seif takes the two formulas of seifim 1 and 2 and applies them to a single object — the produce of the wife’s work. The Ran explains, per the Taz at ס״ק ח, what each half adds: the first, that an object may be designated without being shown; the second, that the verb prevails even over a designation.

He said to his wife: קונם, your handiwork is [forbidden] to me — he is forbidden in their exchanges
The Shakh, at ס״ק ח, forestalls the objection of דבר שאין בו ממש: “your handiwork” means either the hands as to their work, or the produce once made — in both cases a thing with substance.
and in their growths. If he said: קונם, what I eat or taste of your handiwork — he is permitted in their exchanges and growths, for a thing whose seed perishes
The Taz, at ס״ק ח, sees a real difficulty here: the formula contains two contradictory languages — “of your handiwork” designates, “what I eat” restricts. Why not go stringently, as in seif 6? His answer: here the two do not contradict but complete each other.
but for a thing whose seed does not perish, even the growths of the growths are forbidden
The same criterion as in seif 2, applied here. And the Shakh reports in Rabbenu Yona’s name a limit of quite another order: the prohibition falls only on the portion corresponding to the wife’s labour, not on the raw material that was the husband’s.
Seif 3 in a word. The same object, two formulas, two regimes — and the added teaching is that designation does not require presence: naming a particular person’s handiwork suffices to designate.

Seif 4 — “your house”: the possessive follows ownership

A new block, the same question. We move from fruits to real property, and the word examined is no longer the demonstrative but the possessive. “Your house”: as long as it is yours. Let it leave your ownership, and the word designates nothing.

He said to his fellow: קונם, your house that I enter, your field from which I take
The formula aims at another’s house, by a possessive. This is the pivot of the whole block of seifim 4 to 8.
if he died, or sold them, or gave them to another — it is permitted
The Shakh gives the reason at ס״ק י in three words: שהרי עתה אינו ביתו. But he narrows it at ס״ק ט — sold to another, yes; sold to the vower himself, no, for he still benefits from that house by the force of the one who sold it to him.
but as long as it is in his ownership, it is forbidden
The formula lasts exactly as long as the ownership does. This is no minor clause: it is the very definition of the possessive as a term of vow.
even if he sold it and then bought it back, or it fell and he rebuilt it
The possessive aims not at that house but at “the house that is his” — and it has become his again. The Shakh, at ס״ק י״א, sets the bound: buying a wholly different house is permitted, since his intention covered only the house he had at the time.
and even if he did not rebuild it in its original place
Proof that the link is not physical but juridical: neither place nor stones are aimed at, but ownership. An exact contrast with seif 5, where the demonstrative produces the opposite.
Gloss: if he said to him: קונם, your father’s house that I enter — though the father has died it is forbidden, for all his descendants are called “the father’s house”
The Shakh, at ס״ק י״ב, draws the sharp consequence: if he sold it, it is permitted — but going to the descendants remains forbidden. He then adds a reservation against the Rama himself, since “entering into” fits people poorly.
(Mordechai, end of the first chapter of Gittin, and Even HaEzer siman 146, and see ס״ק י״ב)
The parenthesis itself refers to the Shakh’s ס״ק י״ב — a rare case where the printed source points the reader to the challenge to what it has just laid down.
Seif 4 in a word. A possessive is a description, not a designation: it follows ownership, rising and falling with it. Sold, the house leaves the vow; bought back, it re-enters; rebuilt elsewhere, it is in it still.

Seif 5 — “this house”: the demonstrative follows the stones

The term-by-term opposite of seif 4, and that is what makes it a demonstration. The demonstrative does not describe a relation: it points to an object. As long as that object exists the vow stands, whoever owns it; let it cease to exist, and the vow falls with it.

He said: קונם, this house that I enter — it is forbidden to him forever, whether he died, or sold it, or gave it to others
The Shakh, at ס״ק י״ג, cites a responsum of the Maharil drawing the harshest consequence: even a son who thus forbade himself his father’s property remains forbidden after the father’s death, מדקאמר זה — because he said “this”.
and if it fell and he rebuilt it — even in its place and to its original dimensions — it is permitted
The exact reversal of seif 4, and it is striking: there rebuilding maintained the prohibition; here it lifts it. The Shakh devotes ס״ק י״ד to a long defence of the Beit Yosef against the Ba’h on this point, drawing proof from the Yerushalmi and from the law of leases.
Seif 5 in a word. “This” points to a thing. The thing destroyed, there is nothing left to point at — even if rebuilt identically. Conversely, a change of owner does nothing to it.

Seif 6 — “this house of yours”: two words that contradict each other

And if both are used at once? “This house of yours” contains a possessive, which would follow ownership, and a demonstrative, which would follow the stones. The two give opposite results in the two scenarios — and the siman reports three positions.

He said: קונם, this house of yours that I enter — it is forbidden to him forever, whether he died, or sold or gave it to another, or it fell and he rebuilt it
The first position: stringent on both sides. The Shakh, at ס״ק ט״ו, gives the reason in a line — דמספקא לן אי תפיס לשון ראשון או לשון אחרון, we do not know which term prevails, so both stringencies are kept.
and there is one who permits where he died, sold or gave it, and forbids where it fell and was rebuilt
The second position, and the Shakh sums it up at ס״ק ט״ז in four words: דלביתך לשון ראשון דייקא ולא זה — the first term is what counts.
and there is one who forbids in this case and permits in that
The third position, symmetrical to the second: דזה דייקא ולא ביתך, the last term counts. The Taz, at ס״ק ט, presents the three voices in one movement.
Seif 6 in a word. When two designating terms contradict, one does not choose: the Shulchan Arukh first keeps both stringencies, then reports the two views that do choose, one the first term, the other the last.

Seif 7 — one who forbids what is his, and the Rama’s gloss on three responsa

The longest seif of the siman, containing three matters. First the reversal of seif 4: when it is the owner who forbids his house to another, the demonstrative no longer follows ownership. Then the son’s inheritance. Then the Rama’s gloss, reporting three responsa of the Rashba, all three on the reach of a word.

Reuven said to Shimon: קונם, this house that you enter — and he died, or sold it to another: it is forbidden
A reversal from seif 4. There the one entering vowed; here the owner forbids his own thing. The Shakh specifies at ס״ק י״ח that even without saying “in my life and after my death” it is forbidden, but that a house fallen and rebuilt is permitted as in seif 5.
for one who forbids to his fellow a thing that is his — even though it has left his ownership, it remains in its prohibition
The principle, stated outright. The Shakh adds at ס״ק י״ט, in the Ba’h’s name, a starting condition: the prohibition must begin while it is still in his ownership; saying “קונם once it leaves my ownership” produces nothing.
but if he said to him: קונם, my house that you enter — if he died, or sold or gave it to another, it is permitted
The first-person possessive behaves like the second-person one in seif 4: it follows ownership. The Shakh, at ס״ק כ, adds the converse — fallen and rebuilt, it is forbidden again, “since he said my house, and it is still his house”.
One who says to his son: you are forbidden to derive benefit from me — or swore he would not benefit from him — if he dies, [the son] inherits him, for it is as if he said: my property is forbidden to you
An application of the same principle to inheritance, taken straight from the Gemara (Nedarim 47a). נכסי is a possessive: it ceases with ownership, that is, with death.
but if he forbade him his benefit and specified “both in my life and after my death” — if he dies, he does not inherit, for it is as if he said: these properties are forbidden to you
The specification converts the possessive into a demonstrative. This is exactly the point the Taz discusses at length at ס״ק י, showing that the Tur requires this specification for death but not for sale.
(and see further, siman 223)
A cross-reference printed in the body of the Shulchan Arukh in small type, copied as it stands.
Gloss: a community that vowed that all it collected would go to building a synagogue and a study hall — half is given to each, even if not enough was collected to suffice for either
The first of the three responsa. The question is the reach of the “and”: two destinations named together are divided equally, even if the division leaves each share insufficient. The Shakh refers at ס״ק כ״א to siman 228, seif 49.
One who made his son or fellow swear not to lend his money to others without the permission of Reuven and Shimon, and one of them died: he may lend with the permission of the one — for wherever “so-and-so and so-and-so” is said, it means even one of them, until “both together” is specified
The second responsum, and it is a general rule of reading. The Shakh, at ס״ק כ״ב, notes that it does not depend on death — one suffices even if both live — then reports the Mahari Mizrahi, for whom this reasoning does not apply to vows, where one follows לשון בני אדם.
One who swore to his betrothed not to marry a woman over her, and to whom, before marrying her, a yevama fell: he may perform the levirate marriage, for “over her” applies only if he married her first
The third responsum, and the tightest: the whole decision hangs on the preposition עליה, which presupposes priority.
and he shall not marry the betrothed, unless his oath is released for him
A much-contested clause. The Shakh, at ס״ק כ״ג, reports that the Beit Yosef himself marked it צ״ע, and that in the Bedek HaBayit he emended the text to “and he shall not marry another over her” — whence he concludes דברי הרב צ״ע.
Seif 7 in a word. When it is the owner who forbids, the demonstrative survives sale and death, the possessive does not. And the Rama’s gloss shows that the same question — what does this word denote? — governs a community’s fund as much as a marriage clause.

Seif 8 — “my loaf”: the possessive again, on a movable object

The siman closes the possessive block with a case whose conclusion surprises. Reuven forbade his loaf to Shimon. The loaf reaches Shimon by gift or sale: forbidden — for it was “Reuven’s” at the time of the vow. But if it reaches him through a chain in which Reuven first ceased to own it: permitted.

He said to his fellow: this loaf of mine is forbidden to you — even if he gave it to him as a gift or sold it to him, it is forbidden to him
The Taz, at ס״ק י״ב, notes a textual point: the Beit Yosef found in his Tur the reading ככרי זו, but the older Turim have only ככרי, without the demonstrative — and that is the main reading, otherwise the case would be that of seif 7.
if he died and it fell to him by inheritance, or he gave it to another and that one gave it to him — it is permitted to him, for he said only “my loaf”, and now it is not his
The reason is stated outright: The Shakh, at ס״ק כ״ד, nonetheless wonders — should one not have feared the doubt of seif 6? — and ends with וצ״ע. The Taz answers from the reading of the older Turim.
Seif 8 in a word. “My loaf” designates by ownership. What comes from his hand remains forbidden; what reaches him after ownership has ceased does not. The Shakh leaves the question open; the Taz closes it with a textual reading.

Seif 9 — meat and wine in a dish: taste is not the thing

The third block of the siman, and the most practical. Does what is forbidden by a word extend to what has only its taste? The answer again depends on the formula, and the dividing line is the same as from seif 1: a general formula against a designating or verbal one.

He said: קונם, meat and wine are [forbidden] to me — he is permitted a dish containing meat and wine, even though they impart taste to it
A general formula: he named a species, did not designate an object. What is not meat is not meat, even with its taste. The Shakh, at ס״ק כ״ה, at once narrows it: this is by default; if the taste of meat or wine is distressing to him, we follow his intention and the taste is forbidden.
and if he said: קונם, the meat and wine that I taste, or that I eat — or if he said: קונם, this meat or this wine is [forbidden] to me — he is forbidden a dish containing the taste of [meat or] wine
Two formulas, one result: the verb “taste” reaches the taste, and the demonstrative consecrates the object, whose taste is still of it. Note the brackets [בשר או]: they are the source’s editorial brackets, copied as they stand.
Seif 9 in a word. Taste follows the word. “Meat” names a species and does not reach the dish; “this meat” or “the meat I taste” reaches the taste. And the Shakh recalls that a declared intention can overturn the default.

Seif 10 — a drop in a barrel:

A single seif, carrying a rule that reaches far beyond the laws of vows: what can be made permitted is not nullified in a majority of its own kind. A vow is by nature releasable — so its prohibition never dilutes.

This wine that he forbade himself became mixed with other wine — even a drop in a barrel, the whole becomes forbidden
The formula is one of designation — יין זה — consistent with the whole siman. The Taz, at ס״ק י״ג, sets the limit: in vinegar, nullification applies, since it is not the same kind.
because he can seek release from his vow, it becomes like a thing that has means of being permitted, which is not nullified in its own kind
The reason, stated outright, and it is the key to the Shakh’s ס״ק ג and the Taz’s ס״ק ו at the head of the siman. The Pit’hei Teshuva, at ס״ק ה, refers for this rule to siman 102.
Seif 10 in a word. What can be released does not dilute. A drop of this wine in a barrel of the same wine forbids the barrel — but in vinegar the rule ceases, the kind having changed.

Seif 11 — so-and-so’s wine, and wine turned to vinegar

The seif joins the siman’s two threads: designation by owner or place — which counts as designation, as the gloss to seif 1 already said — and the question of the moment at which the word is uttered, which decides what it covers.

One who forbids himself so-and-so’s wine, or that of such a place, has the same law as one who forbids himself “this wine”: he is forbidden a dish into which it fell and which has the taste of wine
An explicit confirmation of the Rama’s gloss on seif 1: naming the owner or the place is designating. The consequence is that of seif 9, second half.
and the same if that wine became vinegar after the vow: it is forbidden to him
Because the vow caught it while it was still wine. Later transformation does not free it — the same logic as the rebuilt house of seif 4.
but what was already vinegar at the time of the vow is permitted
And the source gives the reason in parentheses: he forbade himself wine, not vinegar. The word covers only what it denoted at the moment it was said.
(for it is wine he forbade himself, and not vinegar) (Beit Yosef in the name of a responsum of the Rashba)
Two consecutive parentheses in the printed text — the first gives the reason, the second the source. We copy both.
Seif 11 in a word. The word catches what it denotes at the moment it is said. Wine that became vinegar stays caught; vinegar that already was vinegar was never aimed at.

Seif 12 — olives and grapes: oil is not an olive

The siman closes on its cleanest case, taken from a Mishna. One who forbids himself “olives and grapes” has said nothing of oil or wine: they are other things, bearing other names. But let him add a verb or a demonstrative, and the product re-enters the prohibition.

He said: קונם, olives and grapes are [forbidden] to me — he is permitted the oil and wine that come from them
A striking contrast with seif 1, where the juice was forbidden The difference lies in the formula: there he designated, here he names a species.
even if it is new
An obscure clause, and the Shakh unties it at ס״ק כ״ז in five words: שטעמו שוה דאזלינן בתר שמא — even where the taste is identical, we follow the name and not the taste.
and if he said: קונם, the olives and grapes that I taste — or: קונם, these olives are [forbidden] to me — he is forbidden even the liquids that issue from them and a dish to which they impart taste
The same two levers as throughout the siman, united in one clause: the verb שאני טועם and the demonstrative אלו. Each suffices; together they confirm that the siman has spoken of one thing only — the reach of the word used.
Seif 12 in a word. One follows the name. “Olives” do not name oil; “these olives” or “the olives I taste” reach everything that comes from them, down to the taste in a dish.

3. The key concepts of this siman

לשון תורה — The language of the Torah — the sense the word conveys of itself. This is the rule of reading of this siman, as against לשון בני אדם, local usage, which is that of the next siman.
חילופיהן — Their exchanges: what another gave in return for these fruits. The Rosh and Tosafot forbid them only to the one who exchanged; the Ran forbids in every case, treating the fruits as a consecration.
Their growths, and the growths of their growths. The second degree follows only if the seed materially persists in the ground.
דבר שזרעו כלה — A thing whose seed perishes in the soil — wheat. Against it, אין זרעו כלה: garlic and onion, which persist. This is the physical criterion governing seifim 1 to 3.
דבר שיש לו מתירין — A thing that has means of being permitted. Since a vow can always be released, its prohibition is not nullified in a majority of its own kind — seif 10, and this is also the reason for the growths in seif 2.
לשון ראשון · לשון אחרון — The first term, the last term. When a formula contains two that contradict — “this house of yours” — the siman reports three positions: both stringencies, the first, the last (seif 6).
אזלינן בתר שמא — We follow the name. The Shakh’s phrase at ס״ק כ״ז: even where the taste is identical, it is the name of the thing that decides whether the vow reaches it.
מעשה ידיך — The wife’s handiwork. The Shakh shows at ס״ק ח that the phrase is not a דבר שאין בו ממש, and reports in Rabbenu Yona’s name that the prohibition covers only the share corresponding to her labour.
Imparting taste. The siman distinguishes a dish containing the forbidden thing from a dish that has only its taste — and the answer depends on the vow’s formula (seifim 9, 11, 12).

4. Where these seifim come from

The Tur — the general rule at the head of the siman

This is the sentence to which the whole siman reduces, and it also explains why the printed heading announces matters the siman does not treat: the Tur lays down the whole rule, of which the Shulchan Arukh here develops only the first branch.

The Mishna and the Gemara — Nedarim 59a

Seifim 1 and 2 are the Mishna, almost word for word. And the Gemara at once attaches the reason that will govern seif 10: the vow can be released, so its prohibition is not nullified.

The Gemara — Nedarim 47a: the house and the inheritance

The block of seifim 4 to 8 comes from this page. Avimi’s question is posed there in the very terms the siman will take up, and Rava’s answer is that of seif 7: the father-and-son case settles the house.

The Rambam — Hilkhot Nedarim, chapter 5

The Rambam gives our first three seifim in order, and his formula on liquids must be read closely: where the Shulchan Arukh rules them forbidden, the Rambam leaves a doubt, and infers that there is no flogging. He is also the one who gives the reason of

5. The commentaries of the siman, entry by entry

The commentaries on this siman are the densest of the block: sixty-four entries — twenty-seven ס״ק of the Shakh, thirteen of the Taz, eighteen of the Ba’er Hetev, five of the Pit’hei Teshuva, one of the Nekudot HaKesef. We cite them all, in order, summarising none. The Arukh HaShulchan is not cited: it is not accessible to us for this siman. Neither are the Pri Ḥadash, the Biur HaGra and the Be’er HaGolah.

Twenty-seven entries, the largest commentary of the block. Three are dissertations: ס״ק ב on growths of growths against the Ba’h, ס״ק י״ב on Tosafot in Eruvin and Gittin, ס״ק י״ד on the Beit Yosef and the Ba’h.

ס״ק א — the exchanges: to whom are they forbidden?

ס״ק ב — the Ba’h against the Mehaber on growths of growths

ס״ק ג — the growths are forbidden, and why they are not nullified

ס״ק ד — “so-and-so’s fruits”: the owner, not the species

ס״ק ו — are exchanges permitted even where the seed persists?

ס״ק ב — “even one of them”: R. Akiva Eiger restricts the leniency

ס״ק ג — “until it is specified to you”: two references

ס״ק ד — “a dish with taste”: the pot and נ״ט בר נ״ט

The Nekudot HaKesef (נקודות הכסף) — א׳ entry

The Nekudot HaKesef are the Shakh’s reply to the Taz. Here they have a single entry, but a sharp one: it contradicts the Taz’s

Entry א — the copyist’s error in the Rosh’s rulings

י « נתערב יין זה שאסרו על עצמו ביין אחר אפי׳ טפה בחבית נאסר הכל » (שו״ע יו״ד רט״ז:י) This wine that he forbade himself became mixed with other wine — even a drop in a barrel, the whole becomes forbidden
י « מפני שיש לו להשאיל על נדרו נעשה כדבר שיש לו מתירין שאינו בטל במינו » (שו״ע יו״ד רט״ז:י) because he can seek release from his vow, it becomes like a thing that has means of being permitted, which is not nullified in its own kind
יא « האוסר על עצמו יינו של פלוני או של מקום פלוני דינו כדין האוסר על עצמו יין זה שאסור בתבשיל שנפל בו ויש בו טעם יין » (שו״ע יו״ד רט״ז:יא) One who forbids himself so-and-so’s wine, or that of such a place, has the same law as one who forbids himself “this wine”: he is forbidden a dish into which it fell and which has the taste of wine
יא « והוא הדין אם אותו יין נעשה חומץ אחר הנדר שהוא אסור עליו » (שו״ע יו״ד רט״ז:יא) and the same if that wine became vinegar after the vow: it is forbidden to him
יא « אבל מה שהיה חומץ בשעת הנדר מותר » (שו״ע יו״ד רט״ז:יא) but what was already vinegar at the time of the vow is permitted
יא « דיין אסר עליו ולא חומץ) (ב״י בשם תשובת הרשב״א » (שו״ע יו״ד רט״ז:יא) (for it is wine he forbade himself, and not vinegar) (Beit Yosef in the name of a responsum of the Rashba)
יב « אמר קונם זיתים וענבים עלי מותר בשמן ויין היוצא מהם » (שו״ע יו״ד רט״ז:יב) He said: קונם, olives and grapes are [forbidden] to me — he is permitted the oil and wine that come from them
יב « אפי׳ הוא חדש » (שו״ע יו״ד רט״ז:יב) even if it is new
יב « ואם אמר קונם זיתים וענבים שאני טועם או שאמר קונם זיתים אלו עלי אסור אף במשקים היוצאים מהם ובתבשיל שנותנין בהם טעם » (שו״ע יו״ד רט״ז:יב) and if he said: קונם, the olives and grapes that I taste — or: קונם, these olives are [forbidden] to me — he is forbidden even the liquids that issue from them and a dish to which they impart taste

7. Practical cases

Five situations, taken in the order of the siman. Each closes on the same referral: actual conduct belongs to the Rav.

Case 1 — an undertaking made on “this”

Someone designated a particular thing — this one, his own, that of a certain place. The siman says the prohibition travels: it passes to what is obtained in exchange, to what grows from it, to what flows from it. The first thing to establish is therefore not what he meant to forbid but which word he used. That is not reconstructed from memory: ask your Rav.

Case 2 — “I will not eat of…”

A verbal formula bounds the prohibition to the act it names. Eating the exchange of the thing is not eating it. But seif 2 sets an unexpected correction: if the seed persists, the growth still contains the object and becomes forbidden again — down to the second degree. The reasoning is physical as much as juridical, and applying it to a modern product belongs to a Rav.

Case 3 — “your house” or “this house”

Seifim 4 to 8 show that two formulas nearly identical to the ear produce opposite consequences on sale, inheritance and rebuilding. And seif 6 shows what happens when both are used: three positions, the first keeping both stringencies. None of these distinctions is settled without a Rav.

Case 4 — a collective undertaking, and the word “and”

The Rama’s gloss on seif 7 reports three responsa of the Rashba, all three resting on the reach of a word: “and” between two destinations of a collection, “so-and-so and so-and-so” in a permission, “over her” in a marriage undertaking. The Shakh disputes the last and refers to the Bedek HaBayit. Responsa matter, and a Rav’s.

Case 5 — taste in a dish

This is the commonest case of the siman today. Seif 9 sets the default: a general formula does not reach the dish, a designating or verbal one does. But the Shakh, at ס״ק כ״ה, reverses the default if the taste distresses him; the Pit’hei Teshuva, at ס״ק ד, adds the question of the pot and נ״ט בר נ״ט; and the Shakh, at ס״ק כ״ו, refers to siman 98 for the measure. Three layers of conditions: ask your Rav.

8. Comprehension questions

  1. What is the general rule the Tur lays down at the head of the siman, and which half does the Shulchan Arukh develop here?
  2. Why does “these fruits” carry the exchanges and growths, while “figs” carries nothing? Give the Shakh’s answer at ס״ק ד.
  3. What is a דבר שזרעו כלה, and what consequence does seif 1 draw from it for growths of growths?
  4. The Ba’h restricts growths of growths to seif 2 alone. How do the Shakh at ס״ק ב and the Taz at ס״ק ג answer him?
  5. Why, in seif 2, do the exchanges become permitted? Give the Taz’s reason at ס״ק ה.
  6. The Taz, at ס״ק ח, finds a difficulty in seif 3. What is it, and how does he resolve it in the Tur’s view?
  7. Set out the difference between seif 4 and seif 5 on a house sold and bought back, and on a house fallen and rebuilt.
  8. Seif 6 reports three positions. What are they, and what exactly is the disagreement about?
  9. Why, in seif 7, does the demonstrative survive a sale, whereas in seif 4 the possessive does not?
  10. The Shakh, at ס״ק כ״ד, wonders at seif 8 and concludes צ״ע. What surprises him, and what does the Taz answer at ס״ק י״ב?
  11. Why does “meat” not reach a dish, while “this meat” does?
  12. What is a דבר שיש לו מתירין, and why is the wine of seif 10 not nullified in a barrel?
  13. Seif 11 permits vinegar that was already vinegar and forbids wine that became vinegar. Give the reason, and compare it with seif 4.
  14. What does אזלינן בתר שמא mean, and to which clause of seif 12 does the Shakh apply it?
