A first approach to Siman 217, forty-eight seifim — the longest in the tractate of נדרים. The previous siman settled the reach of words in לשון תורה, what a word makes one hear of itself; this one settles לשון בני אדם, what people call by that name, in a given place and a given period. The first seif states it in three conditions: אם דרך אותו מקום באותו לשון ובאותו זמן. Everything that follows flows from there: cookery, foods, places, persons and time. These are rules למעשה: every real case goes to a Rav.

8. Comprehension questions

1. What is this siman about?

The Tur opens siman 216 with the rule that governs both simanim: all vows follow the language. If it is the tongue of the Torah, according to what the word makes one hear; if it is the language of men, according to how people speak in that place and at that time. Siman 216 took the first half. Ours takes the second, and devotes forty-eight seifim to it — the longest in the tractate.

The opening line states it in three cumulative conditions, and they are worth counting: אם דרך אותו מקום — the usage of that place; באותו לשון — in that tongue; ובאותו זמן — and at that period. None of the three is optional. A word has no reach of its own: it has the reach three circumstances give it, and loses it when they change. The Chakh says so himself in two places, about field-vegetables and about the flesh of fish: in our day it is otherwise.

What follows is the application of that sentence to some forty words, arranged in blocks. Seifim 1 to 3 lay down the principle on modes of cooking and supply the rule for disagreement. Seifim 4 to 24 run through the foods, from vegetable to wine, seeking each time what the word covers and what a second word distinguishes from it. Seifim 25 to 32 move to things and places — water, clothing, the house, the city. Seifim 33 to 46 to categories of persons. Seifim 47 and 48 to time and to undertakings, and the siman’s last word refers to intention, that is, to the next siman.

The siman in five blocks. Seifim 1 to 3: the principle, and the doubt when usage is divided. Seifim 4 to 24: the foods. Seifim 25 to 32: things, places, dwellings. Seifim 33 to 46: categories of persons. Seifim 47 and 48: time, undertakings, and the passage to intention.

2. The forty-eight seifim, clause by clause

Here are the forty-eight seifim, each first in full — as the source gives it, with parenthetical glosses, editorial brackets and the Rama’s glosses included — and then broken down clause by clause.

Seif 1 — “the cooked”: what the word names here, in this tongue, at this time

The siman opens on the rule that governs the whole of it, and states it as three cumulative conditions: the place, the tongue, the period. The previous siman asked what a word makes one hear of itself; this one asks what people actually call by that name. Nothing is settled in advance: the same word forbids everything here and almost nothing elsewhere.

The laws of one who vows [to abstain] from the cooked, from the salted, from pot-work and the like, and how in vows one follows the language of men. And it contains forty-eight seifim:
« נדר או נשבע מהמבושל אם דרך אותו מקום באותו לשון ובאותו זמן שקוראין מבושל אפי׳ לצלי ולשלוק הרי זה אסור בכל » (שו״ע יו״ד רי״ז:א)
He vowed or swore off “the cooked”: if the usage of that place, in that tongue and at that time, is to call “cooked” even what is roasted and what is boiled down, he is forbidden in all of them.
Three conditions, and they are cumulative: that place, that tongue, that time. The Choulhan Aroukh does not say “according to usage” in general; it dates and it localises. A usage attested elsewhere, or attested here a century ago, decides nothing.
« ואם אין דרכם לקרות מבושל אלא לבשר שנתבשל במים ובתבלין הרי זה מותר בצלי ובשלוק » (שו״ע יו״ד רי״ז:א)
And if their usage is to call “cooked” only meat cooked in water and spices, he is permitted in the roasted and in what is boiled down.
« וכן המעושן והמטוגן והמבושל בחמי טבריא וכיוצא בהם הולכים בו אחר הלשון של בני העיר » (שו״ע יו״ד רי״ז:א)
And likewise the smoked, the fried, and what is cooked in the hot springs of Tiberias and the like: in this one follows the language of the townsfolk.
The list in the third clause is not a catalogue of cooking methods: it is the proof that the rule does not stop at roasting and boiling. Smoked, fried, the natural hot water of Tiberias — for each the question is asked afresh, and the answer is “the language of the townsfolk”, not a classification of cookery.
Seif 1 in a word. The word has no scope of its own; it has the scope that the usage of a place, a tongue and a period gives it. The whole siman is nothing but the application of that sentence to some forty words.

Seif 2 — pot-work, what goes down into the pot, what goes into the oven

The first seif laid down the principle; this one shows at once how a formula narrows or widens according to the word chosen. Three pairs are set side by side, and each opposes a naming of a kind — “pot-work”, “the bread of the oven” — to a naming of an instrument: everything that goes down into the pot, everything made in the oven.

One who vows off pot-work is forbidden only in those things that are brought to a boil in a pot, such as crushed groats and fritters and the like.
« אסר עצמו מכל היורד לקדירה הרי זה אסור בכל המתבשלים בקדירה » (שו״ע יו״ד רי״ז:ב)
If he forbade upon himself everything that goes down into the pot, he is forbidden in everything cooked in a pot.
« נדר מהיורד לתוך התנור אינו אסור אלא בפת » (שו״ע יו״ד רי״ז:ב)
He vowed off what goes down into the oven: he is forbidden only in bread.
The contrast is exemplary. “What goes down into the oven” is bread — because in people’s mouths, what one puts in the oven is bread. “All oven-work” is the oven as an instrument, and then everything is included. Two formulas nearly identical to the ear, two scopes with no common measure.
« ואם אמר כל מעשה תנור עלי אסור בכל הנעשה בתנור » (שו״ע יו״ד רי״ז:ב)
And if he said: all oven-work is upon me, he is forbidden in everything made in the oven.
Seif 2 in a word. To name a dish is to name what people mean by it; to name a vessel is to take everything. The Chakh, at ס״ק ב, notes that the Mehaber omitted the Tur’s distinctions between pot and pan, following the Rambam and for the reason the Beit Yossef gives: they are self-evident.

Seif 3 — the salted, the pickled, and what to do when the town is divided

Two applications of seif 1, then the question seif 1 left open — the most practical in the siman: what does one do when usage is not unanimous? The Choulhan Aroukh here expressly sets aside the expected solution, the majority, and imposes the rule proper to vows.

He vowed or swore off the salted: if their usage is to call “salted” everything salted, he is forbidden in all salted things, even one salted only so as to keep for a while.
The qualification “even if it is salted only to keep for a while” is the heart of the clause: it removes the temptation to define “salted” by a degree of salting. It is not the technique that decides, it is the word.
« ואם אין דרכם לקרות מליח אלא לדג מליח בלבד אינו אסור אלא בדג מליח » (שו״ע יו״ד רי״ז:ג)
And if their usage is to call “salted” only salted fish, he is forbidden only in salted fish.
« (טור ורא״ש ור״ן בשם הירושלמי) » (שו״ע יו״ד רי״ז:ג)
(Tur, Rosh and Ran in the name of the Yerushalmi)
« נדר או נשבע מן הכבוש אם דרכם לקרות כבוש לכל הכבושים הרי זה אסור בכל » (שו״ע יו״ד רי״ז:ג)
He vowed or swore off the pickled: if their usage is to call “pickled” all pickled things, he is forbidden in all of them.
« ואם אין דרכם לקרות כבוש אלא לירק כבוש בלבד אינו אסור אלא בכבוש של ירק » (שו״ע יו״ד רי״ז:ג)
And if their usage is to call “pickled” only pickled vegetable, he is forbidden only in pickled vegetable.
« וכן כל כיוצא בזה » (שו״ע יו״ד רי״ז:ג)
And likewise everything similar to this.
« היו מקצת בני המקום קורין לו כך ומקצתן אין קורין » (שו״ע יו״ד רי״ז:ג)
Some of the people of the place called it so and some did not call it so:
« אין הולכין אחר הרוב אלא הרי זה ספק נדרים וכל ספק נדרים להחמיר » (שו״ע יו״ד רי״ז:ג)
one does not follow the majority; rather it is a doubt in vows, and every doubt in vows [is resolved] stringently.
The decisive rule of the siman, and it runs against intuition: the majority does not settle usage. A word used by part of the town in one sense and by the other part in another leaves a doubt, and doubt in vows is resolved stringently. The Chakh, at ס״ק ג, at once opens the way out: if the one who vowed says he meant the word as the majority means it, he is believed — and for this he refers to siman 208.
Seif 3 in a word. Salt and brine are only examples; what the seif really adds to seif 1 is the conduct when usage is divided — no majority, a doubt, and stringency. With, from the Chakh, the reservation of a declared intention.

Seif 4 — the vegetable: three formulas, three scopes, and the proof from the agent

The siman leaves methods of cooking for the foods themselves, and it begins with the vegetable, because that is where the language of men is least stable. Three formulas are set in series, from the narrowest to the widest; then the seif produces its test of proof, one of the finest in the tractate: whatever the agent comes back to ask about belongs to the kind.

He said: קונם, vegetable is upon me — he is forbidden only in those eaten raw.
The bare word “vegetable” names, for people, only what is eaten raw. It is the narrowest of the three. The Chakh, at ס״ק ה, explains it in a few words: those vegetables that are eaten raw as well — “as well”, not “only”.
« ואם אמר ירקי קדירה עלי אסור אף בנכבשים בה » (שו״ע יו״ד רי״ז:ד)
And if he said: pot-vegetables are upon me, he is forbidden even in those pickled in it.
« ואם אמר ירק המתבשל בקדרה אינו אסור אלא במתבשל בה » (שו״ע יו״ד רי״ז:ד)
And if he said: the vegetable that cooks in the pot, he is forbidden only in what cooks in it.
« ומיהו אסור בכל המתבשל בה אף בדילועין » (שו״ע יו״ד רי״ז:ד)
Nevertheless he is forbidden in everything that cooks in it, even in gourds
« (פירוש מין ירק שעליו גדולות ביותר. ערוך) » (שו״ע יו״ד רי״ז:ד)
(explanation: a kind of vegetable whose leaves are very large. Arukh)
« שכל דבר שהשליח נמלך עליו הוא בכלל המין ההוא » (שו״ע יו״ד רי״ז:ד)
for anything about which the agent comes back to consult is within the category of that kind.
The test of the agent. One does not ask a dictionary what the word covers; one watches what a man sent to market does: if he comes back and asks “do you want gourds?”, then the gourd lies within the possible reach of the word. Usage is measured by a behaviour, not by a definition.
« ואם אמר לשלוחו קח לי ירק ואינו מוצא אלא דילועים הוא נמלך בו לומר תרצה דילועין » (שו״ע יו״ד רי״ז:ד)
And if he said to his agent: get me vegetable, and he finds only gourds, he comes back to consult him, saying: do you want gourds?
« אבל אם נדר מהדילועין מותר בירק » (שו״ע יו״ד רי״ז:ד)
But if he vowed off gourds, he is permitted in vegetable.
The asymmetry, and it is logical: the kind contains the particular, the particular does not contain the kind. The Chakh, at ס״ק ז, specifies that gourds are not included in plain “vegetable” nor in “pot-vegetables”, since they are eaten only cooked.
Seif 4 in a word. Three formulas, three scopes: raw vegetable; pot-vegetable with pickled ones; cooked vegetable with gourds. And a method for deciding — the question the agent asks. The Taz, at ס״ק ג, and the Chakh, at ס״ק ו, differ at length over exactly what “pot-vegetables” includes.

Seif 5 — why dried vegetable is still vegetable, and dried beans are not

A material test, and a surprising one: it is not moisture that decides but the existence of a threshing floor. What has a harvest season and a threshing floor ceases to be called vegetable; what has none remains vegetable even when dried.

הנודר מהירק אסור אפילו ביבש מאחר שאין לו גורן ומותר בפולין יבשים מאחר שיש לו גורן ואינם נקראים ירק אלא הלחים:
« הנודר מהירק אסור אפילו ביבש מאחר שאין לו גורן » (שו״ע יו״ד רי״ז:ה)
One who vows off vegetable is forbidden even in the dried, since it has no threshing floor,
« ומותר בפולין יבשים מאחר שיש לו גורן ואינם נקראים ירק אלא הלחים » (שו״ע יו״ד רי״ז:ה)
and he is permitted in dried beans, since they have a threshing floor, and only the fresh are called “vegetable”.
The last clause gives the key and dissolves the apparent contradiction: only the fresh are called “vegetable” — and yet dried vegetable remains forbidden. The answer is in the Taz, at ס״ק ה: dried vegetable does not leave the category “vegetable”, having no other category to enter; the bean has one.
Seif 5 in a word. A thing leaves a word only if another word receives it. The threshing floor is the sign that there is one — the bean is a pulse, not a vegetable.

Seif 6 — a doubt left open: the kolkas

A one-line seif, and a precious one: the Choulhan Aroukh here reports a doubt of the Yerushalmi without resolving it. It is the reminder that the language of men cannot be deduced — where the source did not know, we do not know.

הנודר מהירק נסתפק בירושלמי אם הוא אסור בקולקס (פירש הערוך שהוא מין לוף ומונח בתרמילו ארוך ויש בו גרגרין הרבה):
« הנודר מהירק נסתפק בירושלמי אם הוא אסור בקולקס » (שו״ע יו״ד רי״ז:ו)
One who vows off vegetable: the Yerushalmi was left in doubt whether he is forbidden in kolkas
An unresolved doubt falls under the rule of seif 3: ספק נדרים להחמיר. The Chakh, at ס״ק ח, merely refers to the Arukh, at the entries קרקס and לוף — that is, to a question of botany, not of law.
« (פירש הערוך שהוא מין לוף ומונח בתרמילו ארוך ויש בו גרגרין הרבה) » (שו״ע יו״ד רי״ז:ו)
(the Arukh explained that it is a kind of arum, held in a long pod containing many grains)
Seif 6 in a word. Where usage is not established, the Choulhan Aroukh does not invent it. The doubt stands, and it is conducted stringently.

Seif 7 — meat and sinews: the subordinate follows, the principal does not

Two lines, and a text that both the Chakh and the Taz declare corrupt in the editions before them. Sefaria here carries the word [אסור] in editorial brackets: precisely the correction the two commentators demand.

הנודר מהבשר [אסור] בגידין מהגידין מותר בבשר:
« הנודר מהבשר [אסור] בגידין » (שו״ע יו״ד רי״ז:ז)
One who vows off meat is [forbidden] in the sinews;
The Chakh, at ס״ק ט, is categorical: in all the Mehaber’s books one reads מותר בגידים, and it is an error; one must read אסור בגידים, for sinews are subordinate to meat — so the Beit Yossef and the Yerushalmi. The Taz, at ס״ק ה, says the same and adds that the Levush laboured to explain the reading “permitted”, which is a mistake.
« מהגידין מותר בבשר » (שו״ע יו״ד רי״ז:ז)
[one who vows off] sinews is permitted in meat.
Seif 7 in a word. The subordinate is included in the principal; the principal is not included in the subordinate. And this seif is one of the few places in the siman where the apparatus corrects the printed text.

Seif 8 — meat: what the place adds, what the place does not remove, and manifest intention

The richest seif of the first third. It sets out three storeys: what local usage adds to the word (fish, where the agent consults), what is forbidden everywhere and depends on no usage (fowl, innards, head, feet), and finally the reversal — when the circumstances show the intention, they override usage.

A place where the usage is that, if a man sends an agent to buy him meat, the agent tells him: I found only fish —
« אם נשבע או נדר במקום זה מהבשר נאסר אף בבשר דגים » (שו״ע יו״ד רי״ז:ח)
if he swore or vowed in that place off meat, he is forbidden even in the flesh of fish.
Here is the language of men in action. Fish is not meat — and yet, in a town where the agent comes back to say “I found only fish”, the word “meat” has swallowed it. The Taz, at ס״ק ו, and the Chakh, at ס״ק י״א, both note in the name of the Maharshal that today it is no longer so: the agent no longer consults, and fish is permitted.
« וכן כל כיוצא בזה » (שו״ע יו״ד רי״ז:ח)
And likewise everything similar to this.
« ובכל מקום הנודר מהבשר אסור בבשר עופות ובקרבים ובראש וברגלים בקנה ובלב » (שו״ע יו״ד רי״ז:ח)
And in every place, one who vows off meat is forbidden in the flesh of fowl, in the innards, in the head, in the feet, in the windpipe and in the heart,
“In every place”: this list depends on no usage. Fowl, innards, head, feet, windpipe and heart are meat everywhere. The siman does not surrender everything to custom — it keeps a core that local language cannot eat into.
« ומותר בחגבים » (שו״ע יו״ד רי״ז:ח)
and he is permitted in locusts.
« ואם מראים הדברים בעת שנדר שלא נתכוין אלא בבשר בהמה בלבד [או לבשר עוף ובהמה בלבד] ה״ז מותר בבשר דגים » (שו״ע יו״ד רי״ז:ח)
And if the circumstances show, at the time he vowed, that he intended only the flesh of a beast [or the flesh of fowl and beast only], he is permitted in the flesh of fish,
The third storey, and the strongest: ואם מראים הדברים. Local usage had extended the word to fish; manifest intention retracts it, and even in that very place. This is the doorway to siman 218, which will treat intention for its own sake. The Pit’hei Teshuva, at ס״ק ב, reports a harder case from the Havot Yaïr: even if nothing was manifest at the time of the vow, but he says afterwards that he meant the flesh of a beast, he is permitted in fowl.
« ואפי׳ במקום שהשליח נמלך עליהם » (שו״ע יו״ד רי״ז:ח)
and even in a place where the agent comes back to consult about them.
« (ואפילו בבשר עופות נמי שרי דהא לא נתכוין רק לבשר בהמה) » (שו״ע יו״ד רי״ז:ח)
(And even the flesh of fowl is permitted, since he intended only the flesh of a beast)
« (כן משמע לשון הטור וכן מטין דברי הר״ן) » (שו״ע יו״ד רי״ז:ח)
(so implies the language of the Tur, and so the words of the Ran incline)
Seif 8 in a word. Three storeys: local usage extends, a core resists everywhere, manifest intention retracts. And an observation of the Aharonim that holds for the whole siman — usage has changed since, and what was forbidden in Safed is not necessarily forbidden elsewhere.

Seif 9 — the sediment, the broth and the meat: three words for one dish

One dish, three names, and none of the three overlaps another. The seif is built on the same asymmetry as seif 7, but adds the reservation that overturns it: a verbal or a designating formula reaches what a name of kind does not.

הנודר מהקיפה מותר ברוטב מהרוטב מותר בקיפה מהבשר מותר בשניהם אם לא שאומר קונם בשר עלי שאני טועם או שאני אוכל:
« הנודר מהקיפה מותר ברוטב » (שו״ע יו״ד רי״ז:ט)
One who vows off the sediment is permitted in the broth;
The Taz, at ס״ק ח, explains קיפה: fine crumbs that congeal at the bottom of the pot. The seif therefore contrasts two parts of the same dish, and a vow on one does not touch the other.
« מהרוטב מותר בקיפה » (שו״ע יו״ד רי״ז:ט)
[one who vows] off the broth is permitted in the sediment;
« מהבשר מותר בשניהם » (שו״ע יו״ד רי״ז:ט)
[one who vows] off meat is permitted in both —
« אם לא שאומר קונם בשר עלי שאני טועם או שאני אוכל » (שו״ע יו״ד רי״ז:ט)
unless he says: קונם, meat is upon me, that which I shall taste, or that which I shall eat.
The reservation, and it is decisive: “meat” takes neither broth nor sediment, but “meat, whatever I taste of it” takes them, because the taste is there. Yet the Taz, at ס״ק י, holds that קונם בשר עלי is a printer’s error and one should read בשר זה — and refers, to prove it, to this very siman, seif 9.
Seif 9 in a word. A name of kind takes only what it names; a verb of action takes everything that carries the taste. The rule is that of siman 216, seif 9, restated here on a case from the kitchen.

Seif 10 — the great list of foods: nine couples, and the accompanying name

The longest seif of the first third, and it is very nearly an entire mishnah. It proceeds by inverted couples — from A one is forbidden in B, from B one is permitted in A — and each rests on a different reason. The last clause supplies the concept that explains all the rest: שם לווי, the accompanied name.

One who vows off groats is forbidden in the thick porridge
« (פי׳ מרק קפוי ועב) » (שו״ע יו״ד רי״ז:י)
(explanation: a congealed and thick broth)
« של גריסין מהמקפה מותר בגריסין » (שו״ע יו״ד רי״ז:י)
of groats; [one who vows] off the thick porridge is permitted in groats.
« מהמקפה אסור בשום » (שו״ע יו״ד רי״ז:י)
[One who vows] off the thick porridge is forbidden in garlic;
Why garlic? The Taz, at ס״ק י״א, and the Chakh, at ס״ק י״ג, give the same reason in the name of the Ran: מקפה covers everything congealed and thick, and garlic, which one thins with a little water and eats so, is of that kind. The Taz adds the Rosh’s explanation: garlic is put into every kind of porridge because it gives taste.
« מהשום מותר במקפה » (שו״ע יו״ד רי״ז:י)
[one who vows] off garlic is permitted in the thick porridge.
« מהתבלין אסור בחיין ומותר במבושלין » (שו״ע יו״ד רי״ז:י)
[One who vows] off spices is forbidden in the raw and permitted in the cooked;
Raw spices, not cooked. The Chakh, at ס״ק י״ד, bounds the rule: it holds only for what is put in to give taste to the pot — garlic, onion and the like — and has no sense for pepper, where the raw/cooked distinction does not arise.
« ואם אמר קונם תבלין שאני טועם אסור בחיין ומבושלין » (שו״ע יו״ד רי״ז:י)
and if he said: קונם, spices that I shall taste, he is forbidden in the raw and in the cooked.
« מהכרוב [אסור] באספרגוס » (שו״ע יו״ד רי״ז:י)
[One who vows] off cabbage is [forbidden] in asparagus-water
« (פי׳ מין מים שבשלו בהם הכרוב רמב״ם ורש״י פי׳ מין כרוב) » (שו״ע יו״ד רי״ז:י)
(explanation: a kind of water in which the cabbage was boiled — Rambam; and Rashi explained: a kind of cabbage)
« מהאספרגוס מותר בכרוב » (שו״ע יו״ד רי״ז:י)
; [one who vows] off asparagus-water is permitted in cabbage.
« מהכרישין מותר בקפלוטות » (שו״ע יו״ד רי״ז:י)
[One who vows] off leeks is permitted in kaplotot.
« מהירק מותר בירקות שדה מפני שהוא שם לווי » (שו״ע יו״ד רי״ז:י)
[One who vows] off vegetable is permitted in field-vegetables, because that is an accompanied name
שם לווי — the accompanied name. “Field-vegetable” is not a species of “vegetable”: it is another name, and a vow on the bare word does not reach it. But the Chakh, at ס״ק ט״ו, adds on his own authority what changes everything today: now he is forbidden in field-vegetables, for they too are included in “vegetables” in the language of men.
« (משנה ס״פ הנודר מן המבושל) » (שו״ע יו״ד רי״ז:י)
(mishnah at the end of the chapter “one who vows off the cooked”)
« (דבלשון בני אדם אינם קורין ירק סתם רק לירקות הגדלים בגנות) » (שו״ע יו״ד רי״ז:י)
(for in the language of men one calls plain “vegetable” only those vegetables that grow in gardens)
« (ב״י ורש״י שם בפי׳ המשנה) » (שו״ע יו״ד רי״ז:י)
(Beit Yossef and Rashi, there, in his commentary on the mishnah)
Seif 10 in a word. Nine couples, one principle: a word takes what people file under it, and what a second word distinguishes escapes its grip. Two commentaries expressly date this — the Chakh at ס״ק ט״ו for field-vegetables, the Taz at ס״ק י״ג for asparagus-water: in their day they called it so; in ours, not.

Seif 11 — milk, whey and cheese: when another’s name attaches

Three products of one substance, and the question is which of them draws the others along. The seif reports the Rambam, then a contrary opinion — one of the few open disputes of the siman, and the one to which the Chakh devotes his longest treatment.

One who vows off milk is permitted in whey
« (פי׳ מים המובדלים מהחלב כשמעמידים אותו הנקראת סור״ו) » (שו״ע יו״ד רי״ז:י״א)
(explanation: the waters separated from milk when one curdles it, called “soro”)
« נדר מהקום מותר בחלב » (שו״ע יו״ד רי״ז:י״א)
; [one who] vowed off whey is permitted in milk
« (רמב״ם פ״ט מה״נ ד״ח) » (שו״ע יו״ד רי״ז:י״א)
(Rambam, chapter 9 of the Laws of Vows, halakhah 8).
« וי״א דאם קורין לקום על שם החלב כגון שקורין אותה קומא דחלבא אסור (טור וב״י בשם הר״ן) » (שו״ע יו״ד רי״ז:י״א)
And some say that if whey is called by the name of milk — for instance if one calls it “the kuma of milk” — it is forbidden (Tur and Beit Yossef in the name of the Ran)
The Chakh, at ס״ק י״ז, refuses to read this clause as one first reads it. At first sight it would work both ways: one who vows off milk would be forbidden in whey, and conversely. But the Beit Yossef himself rejected the Ran, and the Tur, Rashi and most of the poskim plainly contradict him. The Chakh therefore concludes that the clause bears only on one who vows off milk — forbidden then in whey; but one who vows off whey remains permitted in milk.
« מהחלב מותר בגבינה » (שו״ע יו״ד רי״ז:י״א)
[One who vows] off milk is permitted in cheese;
« מהגבינה מותר בחלב » (שו״ע יו״ד רי״ז:י״א)
[one who vows] off cheese is permitted in milk,
« ואסור בה בין מלוחה בין תפילה בין לחה בין יבשה » (שו״ע יו״ד רי״ז:י״א)
and he is forbidden in it, whether salted or unsalted, moist or dry.
Cheese is cheese in all its states. The closing clause shuts the door on the argument that might have served here as it serves in seif 13 for dates: a change of state does not remove a thing from its name where the name remains.
Seif 11 in a word. Two products of one substance do not draw each other along — unless usage attaches the name of one to the other, and then in one direction only. Seif 13 will give the reason for this exception, by contrast with date honey.

Seif 12 — fish: brine and muries have left them

One line from the Rambam, and a rule that the Taz and the Chakh at once bound with a capital reservation absent from the text: the permission holds only for what already came out before the vow.

הנודר מן הדגים מותר בציר ומורייס של דגים (לשון הרמב״ם שם):
« הנודר מן הדגים מותר בציר ומורייס של דגים » (שו״ע יו״ד רי״ז:י״ב)
One who vows off fish is permitted in the brine and in the muries of fish
The Chakh, at ס״ק י״ח, and the Taz, at ס״ק ט״ז, say the same thing, and it is the practical key to the seif: the permission bears only on what had already left the fish before the vow. What comes out afterwards is forbidden if he said קונם דגים שאני טועם, or שאני אוכל, or קונם דגים אלו — and they refer to siman 216, seif 9. The Taz expressly extends the same reservation to the whey of seif 11 and the date honey of seif 13.
« (לשון הרמב״ם שם) » (שו״ע יו״ד רי״ז:י״ב)
(the language of the Rambam, there).
Seif 12 in a word. What is already separated at the moment of the vow is no longer the thing; what separates afterwards still is, if the formula designates or names an act. The seif states the first half, the apparatus the second.

Seif 13 — date honey: why the name is not enough to hold

The question is raised by the text itself: date honey bears the name of dates, and yet one who vows off dates is permitted in it. The Rama gives two reasons, both from the Ran — the second explaining, by contrast, why the whey of seif 11 behaves otherwise.

One who vows off dates is permitted in date honey.
« הגה אע״פ ששם התמרים עליו ונקרא דבש תמרים הואיל ונשתנה צורתן ממה שהיו תחילה משא״כ בקומא דחלבא » (רמ״א יו״ד רי״ז:י״ג)
Gloss: although the name of the dates is upon it and it is called “date honey”, since their form has changed from what it was at first — which is not the case with “the kuma of milk”
First reason: the change of form. And the gloss supplies its own counter-example — קומא דחלבא, where nothing has changed in form. The Taz, at ס״ק י״ז, reports a third reason, found in Rabbi Leib of Prague: whey was a liquid and stayed one, whereas the date was a food and became a drink.
« (ר״ן בשם רשב״א) » (רמ״א יו״ד רי״ז:י״ג)
(Ran in the name of the Rashba)
« ועוד דמה שנקרא דבש תמרים אינו אלא כדי להבדילו משאר דבש » (רמ״א יו״ד רי״ז:י״ג)
and further: that it is called “date honey” is only in order to distinguish it from other honeys
Second reason, and it is of another order: the name “of dates” is not there to attach but to distinguish. A name that serves to separate from its neighbours does not attach to its origin. It is exactly the שם לווי of seif 10, turned around.
« (הר״ן) » (רמ״א יו״ד רי״ז:י״ג)
(the Ran)
« מדבש תמרים מותר בתמרים » (שו״ע יו״ד רי״ז:י״ג)
[One who vows] off date honey is permitted in dates.
« מסתוניות » (שו״ע יו״ד רי״ז:י״ג)
[One who vows] off late grapes
« (פי׳ ענבים רעים הנשארים בגפן בימות הסתיו ועושין מהם חומץ) » (שו״ע יו״ד רי״ז:י״ג)
(explanation: poor grapes that remain on the vine in the autumn and from which vinegar is made)
« מותר בחומץ היוצא מהם » (שו״ע יו״ד רי״ז:י״ג)
is permitted in the vinegar that comes from them.
The Chakh, at ס״ק י״ט, opens here the seif’s one real difficulty, in the name of the Ba’h: why does the mishnah not teach the case of saying תמרים אלו or שאני טועם תמרים, where one would be forbidden in what comes out of them, as it teaches for olives and grapes? His answer is brief and worth keeping: is the tanna a pedlar, to list everything and go?; in truth the rule is the same in all of them.
Seif 13 in a word. Bearing a thing’s name does not suffice to be of it: the name must attach and not distinguish, and the form must not have changed. Two reasons from the Ran, a third from the Taz, and the Chakh’s reservation at ס״ק י״ח — what comes out after the vow remains forbidden.

Seif 14 — honey and vinegar: the bare word takes only its own

The reverse of seif 13. Two words one might have thought cover a whole genus in fact cover only their most ordinary referent.

הנודר מדבש מותר בדבש תמרים מהחומץ מותר בחומץ סתוניות:
« הנודר מדבש מותר בדבש תמרים » (שו״ע יו״ד רי״ז:י״ד)
One who vows off honey is permitted in date honey;
The Chakh, at ס״ק כ״ב, and the Taz, at ס״ק י״ט, give the same reason in four words from the Tur: plain honey is only bees’ honey. The bare word has a default referent, and only one.
« מהחומץ מותר בחומץ סתוניות » (שו״ע יו״ד רי״ז:י״ד)
[one who vows] off vinegar is permitted in vinegar of late grapes.
Seif 14 in a word. “Honey” means bees’ honey; whatever carries a qualifier is another object. It is the שם לווי of seif 10 applied to liquids.

Seif 15 — wine: apple wine, cooked wine, and spiced wine

Three cases, three answers, and the third is left in disagreement. The seif closes with the Rama’s reference to the previous siman for vinegar — one of the two places where 217 admits its dependence on 216.

הנודר מהיין מותר ביין תפוחים ואסור ביין מבושל ומותר בקונדיטון (פי׳ משקה שיש בו דבש ויין ופלפלין) ויש מי שאוסר בקונדיטון (ודין חומץ עיין לעיל סוף סימן רט״ז סעיף י״א):
« הנודר מהיין מותר ביין תפוחים » (שו״ע יו״ד רי״ז:ט״ו)
One who vows off wine is permitted in apple wine
« ואסור ביין מבושל » (שו״ע יו״ד רי״ז:ט״ו)
and he is forbidden in cooked wine;
Why is cooked wine forbidden while apple wine is permitted? The Taz, at ס״ק כ, gives the Ran’s answer, and it refers back to seif 10: one might have thought “cooked wine” is a שם לווי like “field-vegetable”. But there it is another kind, whereas here both are wine — and having been cooked it lost nothing.
« ומותר בקונדיטון » (שו״ע יו״ד רי״ז:ט״ו)
and he is permitted in kondyton
« (פי׳ משקה שיש בו דבש ויין ופלפלין) » (שו״ע יו״ד רי״ז:ט״ו)
(explanation: a drink in which there is honey, wine and pepper)
« ויש מי שאוסר בקונדיטון » (שו״ע יו״ד רי״ז:ט״ו)
; and there is one who forbids kondyton
The Choulhan Aroukh here leaves an opinion undecided: ויש מי שאוסר. The Chakh, at ס״ק כ״ג, does not argue the substance but the definition: kondyton is, per the Tur, wine cooked with spices; and he reports from the Maharil’s responsa that the right reading is [מבושם] — spiced — not (מבושל) — cooked.
« (ודין חומץ עיין לעיל סוף סימן רט״ז סעיף י״א) » (שו״ע יו״ד רי״ז:ט״ו)
(and for the law of vinegar, see above at the end of siman 216, seif 11)
Seif 15 in a word. Apple wine is another object; cooked wine is the same object; kondyton is in dispute. And vinegar, which would raise the same question, is referred to siman 216.

Seif 16 — tirosh: a word of the Torah in a mouth that speaks another tongue

The seif where the two simanim touch. תירוש has, in the tongue of the Torah, a wide reach — everything sweet; but “for us”, who do not speak that tongue, it names only wine. A word does not keep its biblical reach in a mouth that no longer speaks Scripture.

הנודר מהתירוש לדידן אסור ביין ומותר בכל מיני מתיקה:
« הנודר מהתירוש לדידן אסור ביין » (שו״ע יו״ד רי״ז:ט״ז)
One who vows off tirosh — for us, he is forbidden in wine
The Chakh, at ס״ק כ״ד, and the Taz, at ס״ק כ״א, rest on the Ran: “for us” means because we speak in the vernacular. The Chakh then draws the symmetrical consequence, and it is subtle: one who vows off tirosh in the holy tongue is forbidden in wine and permitted in sweet things — for we ourselves call “tirosh”, in the tongue of the Torah, only wine.
« ומותר בכל מיני מתיקה » (שו״ע יו״ד רי״ז:ט״ז)
and permitted in all kinds of sweet things.
Seif 16 in a word. A biblical word used by a man who does not speak the language of the Bible is worth what it is worth in his tongue. The Chakh, at ס״ק א, had already laid down the converse in the name of Rabbenu Yeruham: where there is no language of men — where he vowed in the holy tongue in a place where it is not spoken — one follows the language of the Torah.

Seif 17 — oil: what the place supplies itself with decides, and the majority does not save

The seif applies the rule of seif 1 to a case where two usages coexist. And it draws the consequence seif 3 had laid down in principle: when both are in use, both are forbidden — even if one greatly predominates.

One who vows off oil: if he is in a place where they supply themselves with olive oil, he is forbidden in it and permitted in sesame oil;
« ואם הוא במקום שמסתפקין בשמן שומשמין אסור בו ומותר בשמן זית » (שו״ע יו״ד רי״ז:י״ז)
and if he is in a place where they supply themselves with sesame oil, he is forbidden in it and permitted in olive oil;
« ואם מסתפקין בשניהם אסור בשניהם » (שו״ע יו״ד רי״ז:י״ז)
and if they supply themselves with both, he is forbidden in both,
« אע״פ שרוב סיפוקן מאחד מהם » (שו״ע יו״ד רי״ז:י״ז)
even though the greater part of their supply comes from one of them.
The clause that gives the seif its whole value. The Chakh, at ס״ק כ״ה, ties it explicitly to seif 3: we do not follow the majority, for a doubt in vows is conducted stringently. The Baer Hetev, at ס״ק י״ד, repeats it word for word. The Taz, at ס״ק כ״ב, refers for this to siman 208.
Seif 17 in a word. It is not what is produced that decides but what one supplies oneself with, and the coexistence of two usages forbids both. The majority has no voice here: it is the law of seif 3, applied.

Seif 18 — the crop, the “yield” and the grain: the five species

Three words, one answer. The seif decides a dispute of the mishnah — Rabbi Meir extended דגן to all pulses — in favour of the Sages.

הנודר מהתבואה או הנודר מעללתא אינו אסור אלא בחמשת המינים והוא הדין לנודר מהדגן:
« הנודר מהתבואה או הנודר מעללתא אינו אסור אלא בחמשת המינים » (שו״ע יו״ד רי״ז:י״ח)
One who vows off the crop, or one who vows off “alalta”, is forbidden only in the five species;
The Taz, at ס״ק כ״ג, gives the meaning of עללתא in the name of the Rosh: everything choice and excellent. The Chakh, at ס״ק כ״ו, lists the five: wheat, barley, spelt, oats and rye.
« והוא הדין לנודר מהדגן » (שו״ע יו״ד רי״ז:י״ח)
and the same holds for one who vows off grain.
The Taz, at ס״ק כ״ד, reports from the Tur that Rabbi Meir forbade, for דגן, all pulses except split and crushed wheat — since the wheat has already changed — while the Sages forbid only the five species. The Rosh ruled like Rabbi Meir; the Mehaber follows the Rambam and the Sages. The Pit’hei Teshuva, at ס״ק ד, adds from the Tiferet LeMoshe a question left in צ״ע: the gemara teaches that “the crop of the field” forbids everything that grows in the field, and the poskim omitted it.
Seif 18 in a word. Three different words, one scope: the five cereals. A dispute of the mishnah decided in favour of the Sages, and a question of the Pit’hei Teshuva left open.

Seif 19 — bread, sustenance, and “everything that nourishes”

Three concentric circles, from narrowest to widest, and the widest is so wide that the Chakh must at once bound it so that the vow can still exist.

הנודר מפת סתם אינו אסור אלא בפת חטים ושעורים ובמקום שנוהגין לעשות פת מכל דבר ונדר מהפת או מהמזון אסור בחמשת המינין ואם אמר כל הזן עלי אסור בכל חוץ ממים ומלח:
« הנודר מפת סתם אינו אסור אלא בפת חטים ושעורים » (שו״ע יו״ד רי״ז:י״ט)
One who vows off bread, without further specification, is forbidden only in bread of wheat and barley;
« ובמקום שנוהגין לעשות פת מכל דבר ונדר מהפת או מהמזון אסור בחמשת המינין » (שו״ע יו״ד רי״ז:י״ט)
and in a place where they are accustomed to make bread of anything, if he vowed off bread or off sustenance, he is forbidden in the five species;
The Chakh, at ס״ק כ״ח, and the Baer Hetev, at ס״ק ט״ז, specify that מזון means the five species even in a place where bread is made only from wheat and barley: the word has a scope of its own. The Taz, at ס״ק כ״ה, distinguishes the two words: “sustenance” is what supports the heart, while “what nourishes” is what satisfies without supporting.
« ואם אמר כל הזן עלי אסור בכל חוץ ממים ומלח » (שו״ע יו״ד רי״ז:י״ט)
and if he said: everything that nourishes is upon me, he is forbidden in everything, except water and salt.
The bound, and it is structural. The Chakh, at ס״ק כ״ט, in the name of the Ba’h: the vow must have been taken for a time he can endure; otherwise it is like vowing off all the fruits of the world, and there is no vow at all — he refers to siman 232. The Taz, at ס״ק כ״ה, draws it from the Ran, and the Baer Hetev, at ס״ק י״ז, repeats it.
Seif 19 in a word. “Bread” follows usage, “sustenance” has its own measure, “everything that nourishes” takes all but water and salt — provided it is bounded in time, failing which there is no vow at all.

Seif 20 — wheat singular and plural: four formulas, four results

The most technical seif of the siman, and one of the most surprising in the tractate: the grammatical number of the word decides. “A grain of wheat” aims at what is eaten as a grain; “wheat” at what is made from it. To say both is to take everything. The Rama’s gloss grafts on a second dispute, about the reach of a word governing a list.

One who vows off wheat is forbidden in it, whether raw or cooked.
« חטה חטים שאיני טועם אסור בהם בין קמח בין פת » (שו״ע יו״ד רי״ז:כ)
“A grain of wheat, wheats — that I shall not taste”: he is forbidden in them, both as flour and as bread.
« חטה שאיני טועם אסור בהם באפויה ומותר לכוס » (שו״ע יו״ד רי״ז:כ)
“A grain of wheat — that I shall not taste”: he is forbidden in them as baked bread, and it is permitted to him to chew them.
The singular חטה aims at the grain; a grain is not ordinarily chewed, so a vow naming it bears on bread. The plural חטים aims at the substance; that is what one chews, and bread has already left it. The reversal is exact, and it is a lesson in grammar as much as in law.
« חטים שאיני טועם מותר באפויה ואסור לכוס » (שו״ע יו״ד רי״ז:כ)
“Wheats — that I shall not taste”: he is permitted as baked bread, and forbidden to chew them.
« חטה חטים שאיני טועם אסור בין באפויה בין לכוס » (שו״ע יו״ד רי״ז:כ)
“A grain of wheat, wheats — that I shall not taste”: he is forbidden both as baked bread and to chew them.
« הגה האומר פת חטים ושעורים וכוסמין עלי אינו אסור אלא בפת חטים ופת שעורים ופת כוסמין דפת דקאמר קאי על כולם » (רמ״א יו״ד רי״ז:כ)
Gloss: one who says “bread of wheat, and barley, and spelt is upon me” is forbidden only in bread of wheat, bread of barley and bread of spelt, for the word “bread” he said governs all of them
The Rama here opens a question of pure syntax: when a word governs a list, does it govern every term? The Ran says yes — “bread” bears on all three cereals. The gloss then reports the contrary view, and resolves it by the two exits of the entire siman: declared intention, or the language of the people of that city.
« (הר״ן פ׳ שבועות שתים) » (רמ״א יו״ד רי״ז:כ)
(the Ran, chapter “Shevuot shetayim”)
« ויש מחמירין לאסור בשעורים וכוסמין לגמרי אלא אם כן אומר שלא היתה כוונתו רק אפת או שידוע לשון בני אדם שבאותו העיר דאז הולכין אחר לשון בני אדם » (רמ״א יו״ד רי״ז:כ)
and some are more stringent and forbid barley and spelt entirely, unless he says that his intention was only as to bread, or unless it is known that the language of the people of that city is such — in which case one follows the language of men
« (כ״כ הר״ן בשם הרמב״ן) » (רמ״א יו״ד רי״ז:כ)
(so wrote the Ran in the name of the Ramban)
Seif 20 in a word. Singular and plural do not have the same reach, and adding both takes everything. And an unresolved dispute in the Rama, on the word that governs a list.

Seif 21 — groats: the same rule of number, applied to split beans

Seif 21 does seif 20 again on another food, and in the opposite direction. The singular גריס aims at what is cooked; the plural גריסין at what is eaten raw.

גריס שאני טועם אסור לאכול מבושל ומותר לאכול חי גריסין שאני טועם אסור לאכלם חיים ומותר לאכלם מבושלים גריס גריסין שאני טועם אסור לאכלם חיים ומבושלים:
« גריס שאני טועם אסור לאכול מבושל ומותר לאכול חי » (שו״ע יו״ד רי״ז:כ״א)
“Groat — that I shall not taste”: it is forbidden to him to eat it cooked and permitted to eat it raw.
Why the reverse of seif 20? Because usage is the reverse: the split bean in the singular is used for the dish, in the plural for the raw substance. The siman lays down no rule of grammar; each time it records what the word does in people’s mouths.
« גריסין שאני טועם אסור לאכלם חיים ומותר לאכלם מבושלים » (שו״ע יו״ד רי״ז:כ״א)
“Groats — that I shall not taste”: it is forbidden to him to eat them raw and permitted to eat them cooked.
« גריס גריסין שאני טועם אסור לאכלם חיים ומבושלים » (שו״ע יו״ד רי״ז:כ״א)
“Groat, groats — that I shall not taste”: it is forbidden to him to eat them raw and cooked.
Seif 21 in a word. Grammatical number is an index of usage, not a law. Saying both forms takes both states.

Seif 22 — the fruits of the year: what “fruit” does not mean

The siman leaves particular foods for general categories. And it lays down a distinction that runs through three seifim: fruits against growths. The second word takes what the first leaves.

הנודר מפירות השנה אסור בכל פירות השנה ומותר בגדיים וטלאים בחלב ובביצים ובגוזלות ואם אמר גידולי שנה עלי אסור בכולם:
« הנודר מפירות השנה אסור בכל פירות השנה » (שו״ע יו״ד רי״ז:כ״ב)
One who vows off the fruits of the year is forbidden in all the fruits of the year,
« ומותר בגדיים וטלאים בחלב ובביצים ובגוזלות » (שו״ע יו״ד רי״ז:כ״ב)
and he is permitted in kids and lambs, in milk, in eggs and in fledglings;
The Taz, at ס״ק כ״ז, raises the objection and resolves it. The gemara, at the start of “Meruba”, derives from a verse that animals too are a “fruit”. His answer is the whole siman: in matters of vows it is otherwise, for one follows the language of men, and in the language of men they are not called “fruit”. The Chakh, at ס״ק ל, brings the same point from siman 177.
« ואם אמר גידולי שנה עלי אסור בכולם » (שו״ע יו״ד רי״ז:כ״ב)
and if he said: the growths of the year are upon me, he is forbidden in all of them.
The Chakh, at ס״ק ל״א, draws from the Ran an observation that holds for seif 19 as well: the final clause stands only if the vow is for a bearable time, otherwise there is no vow. And he infers, from where the Ran placed his remark, that the first clause holds even forever — since kids and lambs remain to him, he can keep his vow.
Seif 22 in a word. “Fruit” is a word of tree and field in people’s mouths, whatever the verse says; “growth” is a word of life, and it takes the animals.

Seif 23 — the fruits of the earth: truffles and mushrooms

The exact counterpart of seif 22, on the axis of soil instead of the axis of time, and with the same pair of words. The exception is botanical, and it is famous.

הנודר מפירות הארץ אסור בכל פירות הארץ ובפרי העץ ומותר בכמיהין ופטריות ואם אמר גידולי קרקע עלי אסור בכולם:
« הנודר מפירות הארץ אסור בכל פירות הארץ ובפרי העץ » (שו״ע יו״ד רי״ז:כ״ג)
One who vows off the fruits of the earth is forbidden in all the fruits of the earth and in the fruit of the tree,
« ומותר בכמיהין ופטריות » (שו״ע יו״ד רי״ז:כ״ג)
and he is permitted in truffles and mushrooms;
The Taz, at ס״ק כ״ח, gives the reason in a line: they are not in the category “fruit of the earth”, for they draw their nourishment from the air, even though they grow from the ground. It is the classic talmudic image of truffles.
« ואם אמר גידולי קרקע עלי אסור בכולם » (שו״ע יו״ד רי״ז:כ״ג)
and if he said: the growths of the ground are upon me, he is forbidden in all of them.
The Taz, at ס״ק כ״ט, decides a question the seif does not ask: does “growths of the ground” take kids and lambs? No — for in the language of men animals are not called “growths of the ground”, just as they are not called “fruit” in seif 22. And he notes that the Ba’h says otherwise; the Baer Hetev, at ס״ק י״ט, reports the dispute.
Seif 23 in a word. What feeds on air is not a fruit of the earth, even if it comes out of it. And “growth of the ground” does not reach cattle, against the Ba’h.

Seif 24 — “summer” means the figs

One line, and perhaps the purest example in the siman: a word that, in people’s mouths, does not name at all what it means.

הנודר מהקיץ אינו אסור אלא מהתאנים:
« הנודר מהקיץ אינו אסור אלא מהתאנים » (שו״ע יו״ד רי״ז:כ״ד)
One who vows off summer is forbidden only in figs.
Neither the Chakh nor the Taz comments on this seif, and that is telling: there is nothing to explain. קיץ was the word for the fruit dried in summer, and the season gave its name to the fig. The word is not deduced from a root — it is observed.
Seif 24 in a word. Usage can give a word a sense its root does not contain, and the vow follows usage.

Seif 25 — the water of a given spring: the name against the provenance

The siman moves from foods to things and places, and opens with a case where two nearly identical formulas follow two opposite criteria: one follows the water, the other follows the name.

One who vows off the waters that flow from a given spring is forbidden in all the rivers that draw from it,
« ואין צריך לומר מהנמשכים ממנו » (שו״ע יו״ד רי״ז:כ״ה)
and it goes without saying, in those that flow from it,
« ואע״פ שנשתנה שמו ואין קורין אותו אלא נהר פלוני או מעין פלוני » (שו״ע יו״ד רי״ז:כ״ה)
and this although its name has changed and it is called only “such a river” or “such a spring”.
The hinge clause. To name the waters that flow from a spring is to aim at the matter, and matter travels under other names. A change of name does not break the link.
« אם אמר מנהר פלוני או ממעין פלוני אינו אסור אלא בנקראים על שמו » (שו״ע יו״ד רי״ז:כ״ה)
If he said: from such a river, or from such a spring, he is forbidden only in those called by its name.
And the reverse: to name the river or the spring is to aim at the name, and then only what still bears that name is caught. Two formulas, two criteria — it is the very structure of siman 216, carried over here into the language of men.
Seif 25 in a word. “The waters of” follows the water; “the river” follows the name. Neither of the two principal commentators pauses here, and the seif reads on its own.

Seif 26 — a vow of benefit from a spring: an immersion of a mitzvah

The only seif in the siman dealing with a מודר הנאה — the subject of siman 221, announced here in one line. The distinction is seasonal, and its reason is physical.

הנודר הנאה ממעין טובל בו טבילה של מצוה בימות הגשמים אבל לא בימות החמה:
« הנודר הנאה ממעין טובל בו טבילה של מצוה בימות הגשמים » (שו״ע יו״ד רי״ז:כ״ו)
One who vows off benefit from a spring immerses in it an immersion of a mitzvah in the rainy season,
« אבל לא בימות החמה » (שו״ע יו״ד רי״ז:כ״ו)
but not in the hot season.
The Chakh, at ס״ק ל״ב, and the Baer Hetev, at ס״ק כ, give the reason in three words: there is a bodily pleasure there. In winter, the immersion is only the fulfilment of the mitzvah; in summer, cool water is an enjoyment, and that is a benefit.
Seif 26 in a word. What is only a mitzvah is permitted to one forbidden in benefit; what adds a bodily comfort is not. The dividing line is comfort, not the act.

Seif 27 — clothing: what one does not wrap oneself in

The test is actual use: only what people cover themselves with is “clothing”. A coarse fabric is not, if nobody covers himself with it.

הנודר מהכסות מותר בשק וביריעה ובחמילה (פי׳ מיני בגדים גסים שאין דרך בני אדם להתכסות בהם):
« הנודר מהכסות מותר בשק וביריעה ובחמילה » (שו״ע יו״ד רי״ז:כ״ז)
One who vows off clothing is permitted in sacking, in canvas and in the ḥamila
The Chakh, at ס״ק ל״ג, condenses the Tur in four words: they are kinds of coarse garments. The Baer Hetev has no entry here; Sefaria’s parenthesis already supplies the explanation within the body of the seif.
« (פי׳ מיני בגדים גסים שאין דרך בני אדם להתכסות בהם) » (שו״ע יו״ד רי״ז:כ״ז)
(explanation: kinds of coarse garments that people are not accustomed to cover themselves with).
Seif 27 in a word. A fabric is not a garment because it covers: it is one because people clothe themselves in it.

Seif 28 — the house and the upper storey: the subordinate and the principal again

Seif 7 on meat and sinews, carried over into building. The Chakh grafts on to it a limit taken from civil law, and it is instructive.

הנודר מהבית אסור בעליה מהעליה מותר בבית:
« הנודר מהבית אסור בעליה » (שו״ע יו״ד רי״ז:כ״ח)
One who vows off the house is forbidden in the upper storey;
The Chakh, at ס״ק ל״ד, at once bounds the extension in the name of the Rosh: but the chamber and the lean-to are not in the category “house” — and he proves it from the law of sale: one who sells the house has sold neither the chamber nor the lean-to. He refers to Hoshen Mishpat, siman 214. The Baer Hetev, at ס״ק כ״א, repeats it.
« מהעליה מותר בבית » (שו״ע יו״ד רי״ז:כ״ח)
[one who vows] off the upper storey is permitted in the house.
Seif 28 in a word. The upper storey is in the house, the house is not in the upper storey — and the proof of a word’s reach is taken, here, from the law of sale.

Seif 29 — the city: seventy cubits and a remainder

A precise measure where one expected a notion. And the Chakh draws from it the most explicit lesson in the siman about what distinguishes it from the rest of halakhah.

הנודר מהעיר אסור ליכנס לעיבורה דהיינו תוך שבעים אמה ושירים:
« הנודר מהעיר אסור ליכנס לעיבורה דהיינו תוך שבעים אמה ושירים » (שו״ע יו״ד רי״ז:כ״ט)
One who vows off the city: it is forbidden to him to enter its ibbur, that is, within seventy cubits and a remainder.
The Chakh, at ס״ק ל״ה, raises the objection and answers it, and it is the key sentence of the whole siman. For everything else — Orah Haïm 496 and 574, Yoreh De’ah 228 — the city extends to the tehum, two thousand cubits. But here, in vows, it is otherwise: one follows the language of men, and that reaches only seventy cubits and a remainder. He cites the Maharshal. The Baer Hetev, at ס״ק כ״ב, copies him.
Seif 29 in a word. One and the same word does not have the same extent in one tractate and another. In vows, the city stops where ordinary speech stops it — and not two thousand cubits further on.

Seif 30 — the house: the thickness of the threshold is not inside

The same demand for precision as seif 29, on the scale of a door. The boundary is the line where the door shuts.

הנודר מהבית אינו אסור אלא מהאגף ולפנים דהיינו מסתימת הדלת ולפנים אבל מסתימת הדלת ולחוץ על עובי המפתן מותר:
« הנודר מהבית אינו אסור אלא מהאגף ולפנים דהיינו מסתימת הדלת ולפנים » (שו״ע יו״ד רי״ז:ל)
One who vows off the house is forbidden only from the agaf inward, that is, from the closing of the door inward;
The Chakh, at ס״ק ל״ו, does not explain: he refers to Orah Haïm 55, seif 13 — where the same question of the אגף arises for a minyan, and is decided the same way.
« אבל מסתימת הדלת ולחוץ על עובי המפתן מותר » (שו״ע יו״ד רי״ז:ל)
but from the closing of the door outward, on the thickness of the threshold, it is permitted.
Seif 30 in a word. “The house” begins at the line where the door shuts, not at the outer edge of the threshold.

Seif 31 — standing in a house, living in a quarter, and the Rama’s gloss

The exact counterpart of seif 30: undertaking to stay in the house does not have the same boundary as forbidding oneself the house. Then the Rama adds two cases from communal life, the second of which has nothing further to do with housing.

One who swears to stand in a certain house is forbidden from the agaf outward.
« הגה הנודר לדור בשכונת היהודים צריך לדור בשכונה הגדולה וברחוב שלה דכן הוא לשון בני אדם » (רמ״א יו״ד רי״ז:ל״א)
Gloss: one who vows to live in the quarter of the Jews must live in the great quarter and in its street, for such is the language of men,
The Rama here applies the siman’s rule to a social notion: quarter. The language of men, he says, does not call three houses a quarter; undertaking to live in “the Jewish quarter” obliges one to the great quarter and its street.
« ולא אמרינן דג׳ בתים מקרי שכונה » (רמ״א יו״ד רי״ז:ל״א)
and we do not say that three houses are called a quarter
« (ב״י סי׳ רכ״ח דף רע״ד סוף ע״ב בשם תשובת הרשב״א) » (רמ״א יו״ד רי״ז:ל״א)
(Beit Yossef, siman 228, folio 274, end of column b, in the name of a responsum of the Rashba)
« קהל שגזרו שלא לקנות בתים מעובדי כוכבים אסור להחליף עמהם דזה נמי מקרי קנייה ומכירה » (רמ״א יו״ד רי״ז:ל״א)
A community that decreed not to buy houses from idolaters: it is forbidden for them to make an exchange with them, for that too is called buying and selling
The Rama’s second case is of another nature, and it shows the siman’s reach: a communal decree is also a form of speech, and is read like a vow. “To buy” covers exchange, because exchange is, in the language of men, a buying and a selling.
« (מרדכי פרק המקבל) » (רמ״א יו״ד רי״ז:ל״א)
(Mordechai, chapter “HaMekabbel”)
Seif 31 in a word. The positive obligation and the prohibition draw the boundary on the same side of the threshold, but in opposite directions. And the rule holds outside vows: for a communal decree too, the question is what the word means in people’s mouths.

Seif 32 — the dwellers of the city and its sons: thirty days, twelve months

Two expressions, two durations, and behind them one principle — belonging is measured in time. The Rama adds a gloss that expressly refers, and twice, to the language of men and then to intention: the only place in the siman where both criteria are named in the same sentence.

He vowed off the dwellers of the city: he is forbidden as to anyone who has resided there thirty days;
« מבני העיר אינו אסור אלא במי שישב שם י״ב חדש » (שו״ע יו״ד רי״ז:ל״ב)
[he vowed off] the sons of the city: he is forbidden only as to one who has resided there twelve months.
« הגה ואם נדר ממי שדר שם אפילו דירת עראי מקרי דירה » (רמ״א יו״ד רי״ז:ל״ב)
Gloss: and if he vowed as to one who dwells there, even a temporary dwelling is called dwelling
« (רשב״א סימן תרס״ז) » (רמ״א יו״ד רי״ז:ל״ב)
(Rashba, siman 667)
« מיהו הולכים אחר לשון בני אדם שאין נקרא דירה אלא בדר שם עם בני ביתו דרך קבוע אע״פ שהוא פחות מל׳ יום » (רמ״א יו״ד רי״ז:ל״ב)
however, one follows the language of men, according to which only he who dwells there with his household in a settled manner is called “dwelling”, even if it is less than thirty days;
The gloss overturns the Rashba by the siman’s own rule. Not the nominal duration, but what people call “dwelling”: living there with one’s household in a settled way. The Chakh, at ס״ק ל״ז, and the Baer Hetev, at ס״ק כ״ג, both bring the Mabit — in these places, in our time, a residence of less than six months is not called dwelling.
« ואם לשון בני אדם הוא בדרך אחר הולכין אחריו אחר כוונת הנודר » (רמ״א יו״ד רי״ז:ל״ב)
and if the language of men is otherwise, one follows it — according to the intention of the one who vows.
The last clause is the hinge of the two simanim: if the language of men is otherwise, one follows it — and the Rama at once adds אחר כוונת הנודר. Language is not the final horizon: behind it lies intention, and that is the whole of siman 218.
Seif 32 in a word. Thirty days make a dweller, twelve months make a son of the city — but these durations yield to local usage, and local usage to intention. Here the siman confesses its own provisionality.

Seif 33 — those who go down to the sea: an identity, not a voyage

The siman moves to categories of persons, and will stay with them through seif 46. The question changes in nature: no longer what a thing is, but who a man is. And the answer is the same — whom people call so.

נדר מיורדי הים אסור בכל יורדי הים אפילו באותם שאין הולכים אלא מעכו ליפו ואפילו באותם שיורדים לטייל ומותר ביושבי יבשה:
« נדר מיורדי הים אסור בכל יורדי הים אפילו באותם שאין הולכים אלא מעכו ליפו » (שו״ע יו״ד רי״ז:ל״ג)
He vowed off those who go down to the sea: he is forbidden as to all who go down to the sea, even those who go only from Akko to Jaffa,
The shortness of the voyage does not remove the name, nor does pleasure: neither distance nor motive is in the word. What the word names is a kind of men — those who take to the sea.
« ואפילו באותם שיורדים לטייל » (שו״ע יו״ד רי״ז:ל״ג)
and even those who go down to take the air,
« ומותר ביושבי יבשה » (שו״ע יו״ד רי״ז:ל״ג)
and he is permitted as to those who dwell on dry land.
Seif 33 in a word. “Those who go down to the sea” names a condition, not a journey; neither coastal hops nor pleasure trips fall outside it.

Seif 34 — those of dry land: the wide term takes the narrow

The reversal of seif 33, and it is not symmetrical. Dry land is everyone’s condition; the sea is only that of a few.

נדר מיושבי יבשה אסור גם ביורדי הים ואפי׳ באותם שמפליגים בו הרבה שסופם לירד ליבשה:
« נדר מיושבי יבשה אסור גם ביורדי הים » (שו״ע יו״ד רי״ז:ל״ד)
He vowed off those who dwell on dry land: he is forbidden also as to those who go down to the sea,
« ואפי׳ באותם שמפליגים בו הרבה שסופם לירד ליבשה » (שו״ע יו״ד רי״ז:ל״ד)
and even as to those who sail far out, for they will end by coming back down to land.
The reason is given in three words: שסופם לירד ליבשה. Belonging to the land is a background condition that temporary absence does not interrupt. That is why the inclusion runs only one way.
Seif 34 in a word. Every man of the sea is also a man of the land; the reverse is not true. The more general word encompasses the more particular, never the contrary.

Seif 35 — “after thirty days”: a vow is read at the moment it is spoken

A seif of method, and it holds for the whole tractate: when a vow names a category and takes effect later, the category is fixed at the moment of speech, not at the moment the vow takes effect.

אמר יורדי הים לאחר ל׳ יום עלי מי שהוא בשעת הנדר מיורדי הים אסור בו ומי שאינו מיורדי הים בשעת הנדר מותר בו אע״פ שלאחר ל׳ יום כשחל הנדר הוא מיורדי הים:
« אמר יורדי הים לאחר ל׳ יום עלי מי שהוא בשעת הנדר מיורדי הים אסור בו » (שו״ע יו״ד רי״ז:ל״ה)
He said: those who go down to the sea, after thirty days, are upon me — one who, at the time of the vow, is of those who go down to the sea is forbidden to him,
« ומי שאינו מיורדי הים בשעת הנדר מותר בו אע״פ שלאחר ל׳ יום כשחל הנדר הוא מיורדי הים » (שו״ע יו״ד רי״ז:ל״ה)
and one who is not of those who go down to the sea at the time of the vow is permitted to him, although after thirty days, when the vow takes effect, he is one of them.
The Chakh, at ס״ק ל״ט, states the rule and extends it: in vows one follows the moment of speech, not the moment the vow takes effect — and refers to siman 234, seif 34. Then he generalises: one who said “after such a time, the dwellers of such a city shall be forbidden to me”, and one of them moves away meanwhile, remains forbidden as to him; and one who settles there meanwhile remains permitted.
Seif 35 in a word. Speech is read at the moment it is uttered. What happens to the world afterwards does not alter what the word named then.

Seif 36 — “those the sun sees”: the word prevails over a denied intention

The most disputed seif of the second half, and the only one where the Rama expressly rules against a declared intention. The phrase רואי החמה is read passively: those whom the sun sees. And the Choulhan Aroukh draws two exclusions from it — fish and foetuses.

He vowed off those the sun sees: he is forbidden even as to the blind, for he intended only one whom the sun sees —
« לאפוקי דגים ועוברים » (שו״ע יו״ד רי״ז:ל״ו)
to the exclusion of fish and of foetuses.
« הגה ואפילו אמר לא נתכוונתי לכך לא מהני » (רמ״א יו״ד רי״ז:ל״ו)
Gloss: and even if he said “I did not intend that”, it is of no avail
Here is the limit of intention, and it is sharp: where the language is certain, a denied intention does not undo it. The Rama does not say intention has no value — he says this one cannot contradict a word whose sense is not in doubt. Compare seif 8, where manifest circumstances do prevail.
« (ב״י בשם הרא״ש) » (רמ״א יו״ד רי״ז:ל״ו)
(Beit Yossef in the name of the Rosh)
« הואיל והלשון ודאי כך הוא ומותר בכל דבר שאינו בעל חיים אע״פ שהחמה רואה אותו » (רמ״א יו״ד רי״ז:ל״ו)
since the language is certainly so; and he is permitted in anything that is not a living being, although the sun sees it
« (ב״י בשם התוספות) » (רמ״א יו״ד רי״ז:ל״ו)
(Beit Yossef in the name of the Tosafot)
« ואם נדר מרואים החמה מותר בסומים » (שו״ע יו״ד רי״ז:ל״ו)
And if he vowed off those who see the sun, he is permitted as to the blind.
The last clause distinguishes רואי החמה from רואים החמה — a single letter. But the Taz, at ס״ק ל, refuses the distinction: the difference between these two phrasings is truly astonishing, he says, and the plain sense of both is “those who see”. The Chakh, at ס״ק מ״א, reports the Ba’h in the same direction. The Baer Hetev, at ס״ק כ״ו, concludes for practice: one does not rely on this permission, the Tur standing alone against the other poskim.
Seif 36 in a word. When the word is clear, a denied intention does not undo it; and the one-letter distinction between “those the sun sees” and “those who see the sun” is contested by the Taz, the Ba’h and the Baer Hetev.

Seif 37 — “the black-headed”: a word of usage, not of description

The most demonstrative example in the siman: a word that describes a hair colour names, in people’s mouths, men — and therefore the bald and the white-haired too, whose heads are not black at all.

He vowed off the black-headed: he is forbidden as to the bald and as to grey-haired men,
The Taz, at ס״ק ל״ב, sets out the gemara’s reasoning, and it is elegant: had he meant hair, he would have said “those who have hair”. Having said “black-headed”, he means those habitually so called — men — and the bald and the aged are among them.
« ומותר בנשים ובקטנים שאין נקראי׳ שחורי הראש אלא האנשים » (שו״ע יו״ד רי״ז:ל״ז)
and he is permitted as to women and minors, for only men are called “black-headed”;
« ואם דרכם לקרות שחורי הראש לכל אסור [בכל] » (שו״ע יו״ד רי״ז:ל״ז)
and if their usage is to call everyone “black-headed”, he is forbidden [as to all]
« (הנודר מכל דבר שהוא אדום אסור לראות בחמה שגם כן היא אדומה) » (שו״ע יו״ד רי״ז:ל״ז)
(One who vows off every red thing: it is forbidden to him to look at the sun, which is likewise red)
The Rama’s parenthesis is of a wholly different register, and opens on to vows of benefit: one who has forbidden himself everything red can no longer look at the sun. It is the logic of a word taken literally pushed to its end — and it is a warning, not a common rule.
« (נימוקי יוסף פ׳ המוכר את הספינה ותוס׳ שם דף ע״ד ע״א וחדושי רמב״ן שם) » (שו״ע יו״ד רי״ז:ל״ז)
(Nimukei Yosef, chapter “HaMokher et haSefina”, and Tosafot there, folio 74a, and the novellae of the Ramban there)
Seif 37 in a word. A descriptive word becomes a group name, and keeps the group while losing the description. The Chakh, at ס״ק מ״ב, specifies what “looking at the sun” means here: deriving benefit from its light.

Seif 38 — “those who rest on Shabbat”

First of the nine seifim bearing on appellations of peoples and groups. Each rests on a single distinction, and here it is that of being commanded against the bare fact.

הנודר משובתי שבת אסור אף בכותיים:
« הנודר משובתי שבת אסור אף בכותיים » (שו״ע יו״ד רי״ז:ל״ח)
One who vows off those who rest on Shabbat is forbidden even as to the Kutim.
The Taz, at ס״ק ל״ג, gives the reason in the name of the gemara, and it is subtler than it seems: the Kutim are commanded concerning Shabbat and do it; whereas an idolater who kept Shabbat is not commanded in it — and so does not enter the appellation.
Seif 38 in a word. It is not the act that places one within the name, but the obligation from which the act proceeds.

Seif 39 — “those who go up to Jerusalem”

The exact counterpart of seif 38, and it shows that the criterion of commandment does not suffice alone: here the Kutim are commanded, and yet they are excluded — because they do not do it.

נדר מעולי ירושלים אסור בישראל ומותר בכותיים:
« נדר מעולי ירושלים אסור בישראל ומותר בכותיים » (שו״ע יו״ד רי״ז:ל״ט)
He vowed off those who go up to Jerusalem: he is forbidden as to Israel and permitted as to the Kutim.
The Taz, at ס״ק ל״ד, explains: they do not go up, though commanded; the Beit Yossef adds that they go up to Mount Gerizim instead of Jerusalem. He then vigorously rejects a gloss of the Prisha holding that “pilgrims” would include the Kutim on account of Mount Gerizim — וישתקע הוראה כזאת. The Baer Hetev, at ס״ק כ״ח, repeats him and adds that these words surely did not come from that righteous man himself.
Seif 39 in a word. The appellation follows the act performed, not obligation alone; and seif 38 follows obligation, not the act alone. The two criteria take turns according to what the word names.

Seif 40 — “the sons of Noah” and “the seed of Abraham”

Two appellations that, taken literally, would encompass everyone, and which in people’s mouths name exactly distinct groups. The exclusion of Ishmael and Esau is the most remarkable in the siman.

נדר מבני נח אסור באומות העולם ומותר בישראל. נדר מזרע אברהם אסור בישראל ובגרים ומותר באומות העולם אפי׳ בבני ישמעאל ועשו:
« נדר מבני נח אסור באומות העולם ומותר בישראל » (שו״ע יו״ד רי״ז:מ)
He vowed off the sons of Noah: he is forbidden as to the nations of the world and permitted as to Israel.
« נדר מזרע אברהם אסור בישראל ובגרים » (שו״ע יו״ד רי״ז:מ)
He vowed off the seed of Abraham: he is forbidden as to Israel and to converts,
Why are converts within “the seed of Abraham”? The Taz, at ס״ק ל״ה, admits he has found no source for it and offers his own: from the fact that a convert may say אלהי אבותינו, for it is written I have made you father of a multitude of nations — so the Tosafot, chapter “HaSefina”, folio 81.
« ומותר באומות העולם אפי׳ בבני ישמעאל ועשו » (שו״ע יו״ד רי״ז:מ)
and permitted as to the nations of the world, even as to the sons of Ishmael and of Esau.
Yet Ishmael and Esau are of Abraham’s descent by blood. The Taz, at ס״ק ל״ו, gives the verse: for in Isaac shall a seed be called for you — and not all of Isaac, excluding Esau; and Ishmael all the more so.
Seif 40 in a word. A genealogical appellation is not read genealogically: it is read as people say it, and people’s usage here follows Scripture.

Seif 41 — “the uncircumcised”: a name of belonging, not of condition

The purest case in the siman, and of an almost provocative sharpness: the word does not name a bodily condition, it names a people — and so it aims at the circumcised of the nations and not at the uncircumcised of Israel.

נדר מהערלים אסור במולי אומות העולם ומותר בערלי ישראל:
« נדר מהערלים אסור במולי אומות העולם ומותר בערלי ישראל » (שו״ע יו״ד רי״ז:מ״א)
He vowed off the uncircumcised: he is forbidden as to the circumcised of the nations of the world and permitted as to the uncircumcised of Israel.
The Taz, at ס״ק ל״ז, gives the reason, and it is scriptural: “uncircumcision” is named in Scripture over the totality of the nations, and likewise the name “circumcised” over the nation of Israel alone. The Pit’hei Teshuva, at ס״ק ט, adds the Beer Yaakov: the same applies to an apostate to idolatry, forbidden although he is circumcised; and for an apostate through uncircumcision he remains in צ״ע.
Seif 41 in a word. A word describing a body may name nothing but a belonging. Here the language of men follows exactly the language of Scripture.

Seif 42 — “the circumcised”: the exact mirror of seif 41

The converse, given separately so that the rule leaves no doubt: the word follows the people, in both directions.

נדר מהמולים אסור בערלי ישראל ומותר במולי אומות העולם:
« נדר מהמולים אסור בערלי ישראל ומותר במולי אומות העולם » (שו״ע יו״ד רי״ז:מ״ב)
He vowed off the circumcised: he is forbidden as to the uncircumcised of Israel and permitted as to the circumcised of the nations of the world.
The Baer Hetev, at ס״ק כ״ט, condenses the Taz’s reason in four words: for the name “circumcised” is said of the nation of Israel alone. The Pit’hei Teshuva, at ס״ק י, adds from the Beer Yaakov that if one vowed off the circumcised, a circumcised slave is forbidden.
Seif 42 in a word. Neither bodily condition nor act performed: the name follows belonging, in both directions.

Seif 43 — Israel and converts

Another asymmetrical pair, the third the siman builds on this model — after meat and sinews, house and upper storey.

נדר מישראל אסור בגרים מהגרים מותר בישראל:
« נדר מישראל אסור בגרים » (שו״ע יו״ד רי״ז:מ״ג)
He vowed off Israel: he is forbidden as to converts;
Neither the Chakh nor the Taz pauses here: the reason has already been given at seif 40, where the Taz places converts within “the seed of Abraham”. The convert is within Israel; Israel is not within the converts.
« מהגרים מותר בישראל » (שו״ע יו״ד רי״ז:מ״ג)
[he vowed off] converts: he is permitted as to Israel.
Seif 43 in a word. The particular group is within the general name; the general name is not within the particular group.

Seif 44 — Israel, kohanim and levi’im

The same structure applied to the tribes. And it contains an assertion the seif does not comment on: kohanim and levi’im are within “Israel”, even though halakhah distinguishes them from it everywhere else.

נדר מישראל אסור בכהנים ולוים מכהנים ולוים מותר בישראל:
« נדר מישראל אסור בכהנים ולוים » (שו״ע יו״ד רי״ז:מ״ד)
He vowed off Israel: he is forbidden as to kohanim and levi’im;
It is exactly the teaching of seif 29 in another form: the word “Israel” does not have, in vows, the technical scope it has in the laws of terumah or of marriage. In people’s mouths, “Israel” is the whole people.
« מכהנים ולוים מותר בישראל » (שו״ע יו״ד רי״ז:מ״ד)
[he vowed off] kohanim and levi’im: he is permitted as to Israel.
Seif 44 in a word. In vows, “Israel” is said of the people and not of the tribe; and the name of a tribe does not take the people.

Seif 45 — kohanim and levi’im, one against the other

Two groups of the same rank: neither is within the other, and the rule is therefore symmetrical, unlike the three preceding seifim.

נדר מכהנים מותר בלוים מלוים מותר בכהנים:
« נדר מכהנים מותר בלוים » (שו״ע יו״ד רי״ז:מ״ה)
He vowed off kohanim: he is permitted as to levi’im;
The seif is the proof by contrast of the three before it: when neither of the two names encompasses the other, the rule becomes symmetrical. The asymmetry of seifim 43 and 44 was thus not a formal rule but an observation of content.
« מלוים מותר בכהנים » (שו״ע יו״ד רי״ז:מ״ה)
[he vowed off] levi’im: he is permitted as to kohanim.
Seif 45 in a word. Two names of equal rank do not take one another. No commentator has an entry here — the seif reads on its own.

Seif 46 — sons and grandsons

The last seif of the block on persons, and the briefest. The word “sons” does not descend a generation, and this is the one place in the siman where the Pit’hei Teshuva brings a case from life that overturns it entirely.

נדר מבנים מותר בבני בנים:
« נדר מבנים מותר בבני בנים » (שו״ע יו״ד רי״ז:מ״ו)
He vowed off sons: he is permitted as to sons of sons.
The Pit’hei Teshuva, at ס״ק י״א, reports from the She’ilat Yaavets a far harder case: one who raises an orphan or another man’s son and calls him “my son”, the other calling him “my father” — and they vow off one another saying “son” and “father” with no proper name. It is a doubt, and one follows stringency: in vows they are forbidden to one another; in money, stringency lies with the claimant.
Seif 46 in a word. “Sons” does not reach the grandson in ordinary speech, but it may reach one whom a man calls his son — and there, the doubt is stringent.

Seif 47 — “except the festivals”: are Hanukkah and Purim among them?

The siman leaves persons for time, and poses the question by way of the exception: a man reserved the festivals for himself; may he then say that he meant Hanukkah and Purim as well?

מי שנדר או נשבע על דבר חוץ ממועדות וי״ט אם אמר שבדעתו היה להוציא גם חנוכה ופורים מהכלל נאמן. (ועיין בא״ח סימן תק״ע):
« מי שנדר או נשבע על דבר חוץ ממועדות וי״ט » (שו״ע יו״ד רי״ז:מ״ז)
One who vowed or swore about a thing, except the festivals and holy days:
« אם אמר שבדעתו היה להוציא גם חנוכה ופורים מהכלל נאמן » (שו״ע יו״ד רי״ז:מ״ז)
if he says that his intention was to exclude Hanukkah and Purim too from the general rule, he is believed.
The Taz, at ס״ק ל״ח, gives the reason and, in doing so, sums up the whole siman: in the language of men these days too are called “festive days” — as in the phrase עבידנא יומא טבא לרבנן: any day on which there is rejoicing. And the rule throughout this siman is that one follows the language of men; but here the matter is somewhat forced, which is why he had to say it expressly.
« (ועיין בא״ח סימן תק״ע) » (שו״ע יו״ד רי״ז:מ״ז)
(and see Orah Haïm, siman 570)
The Chakh, at ס״ק מ״ג, notes a misprint here: in all the books and in the Levush one reads “siman 179”, and it is an error; one must read “siman 570”. Sefaria’s text already carries the corrected reading.
Seif 47 in a word. Hanukkah and Purim are not of themselves within “the festivals”, but they enter if the one who vowed declares he had them in view — because the language of men nearly puts them there. The Pit’hei Teshuva, at ס״ק י״ב, adds a neighbouring case from the Tiferet Tzvi: one who swore not to drink brandy except on Shabbatot and festivals is permitted at the close of Yom Kippur as well, if he says he meant it.

Seif 48 — gaming, wagers, and the Rama’s six cases: where language yields to intention

The closing seif, built like a door open on to the next siman. The Mehaber deals with the vow not to game; the Rama adds five cases taken from responsa, and the fifth states in plain words what is to follow: it seems that one follows his intention, and as will be explained in siman 218.

One who vowed or swore to play no game: it is forbidden to him to cast lots, nor may anyone do so on his behalf,
The Taz, at ס״ק ל״ט, cites the Beit Yossef in the name of Rabbenu Yeruham: the main intention of one who so swears is to keep away from every game that leads to loss of money. He infers that one who swears simply not to game has forbidden himself only the game that loses — then draws back: in any case it seems to me that one follows the intention of the one who swears.
« וכן אסור להמרות עם חבירו שקורין אפוסטאר » (שו״ע יו״ד רי״ז:מ״ח)
and likewise it is forbidden to him to wager with his fellow, what is called “apostar”.
« (תשובת חזה התנופה) » (שו״ע יו״ד רי״ז:מ״ח)
(responsa Ḥazeh haTenufa)
« הגה צבור שגזרו שלא להתפלל במנין משום איזה דבר אסורים לקרות בתורה דכל דבר קדושה נקרא תפלה » (רמ״א יו״ד רי״ז:מ״ח)
Gloss: a community that decreed not to pray in a minyan for some reason, it is forbidden to them to read in the Torah, for every matter of holiness is called “prayer”
« (תשובת הרא״ש כלל ג׳ סי׳ ט׳) » (רמ״א יו״ד רי״ז:מ״ח)
(responsa of the Rosh, klal 3, siman 9)
« מי שנדר שלא לקבל פקדון אסור להלוות על משכון לישראל » (רמ״א יו״ד רי״ז:מ״ח)
One who vowed not to receive a deposit, it is forbidden to him to lend on a pledge to a Jew
The Chakh, at ס״ק מ״ה, refuses the Maharil’s proof and says so plainly: I do not know what proof this is. A pledge is a deposit, granted; but a deposit is not a pledge. One who vowed not to receive a deposit had in view the Sages’ exhortation הרחק מן הפקדונות, which has nothing to do with lending on a pledge. And he concludes with the Rama: one follows the intention of the one who vows.
« (מהרי״ל) » (רמ״א יו״ד רי״ז:מ״ח)
(Maharil)
« מיהו נראה דהולכין אחר כוונתו וכדרך שיתבאר בסימן רי״ח (ד״ע) » (רמ״א יו״ד רי״ז:מ״ח)
however, it seems to me that one follows his intention, and in the manner that will be explained in siman 218 (his own view).
The sentence that closes the siman and opens the next. After forty-eight seifim spent measuring what words say, the Rama writes that measurement is not the last word: behind language stands intention — וכדרך שיתבאר בסימן רי״ח. The Pit’hei Teshuva, at ס״ק ט״ו, bounds this conclusion in the name of the Veshav HaKohen: intention is followed only to narrow, not to move the prohibition from one object to another.
« מי שנדר או נשבע להתענות סך ימים ואירע תענית חובה עולה לו למנין הימים » (רמ״א יו״ד רי״ז:מ״ח)
One who vowed or swore to fast a certain number of days, and an obligatory fast came about, it counts for him in the number of days;
Two cases of positive vows, and they work on the same principle as the whole siman: what was said is fulfilled by whatever answers to the word, even if the occasion arose otherwise. An obligatory fast is a fast day; a visit made on business is a coming to the place.
« וכן מי שנדר לילך לבית הקברות או למקום ואירע לו שהלך ע״י עסק שם יצא ידי נדרו » (רמ״א יו״ד רי״ז:מ״ח)
and likewise one who vowed to go to the cemetery or to a place, and it happened that he went there on business, he has fulfilled his vow
« (תשובת מהרי״ל סימן קי״ח) » (רמ״א יו״ד רי״ז:מ״ח)
(responsa of the Maharil, siman 118)
« וע״ל סימן רל״ט עוד מזה » (רמ״א יו״ד רי״ז:מ״ח)
and see further, siman 239, more on this.
Seif 48 in a word. The siman closes by going beyond itself: the language of men has bounded forty-eight seifim, and the last line announces that intention is about to take them up again. The Chakh, at ס״ק מ״ג, recalls here the Rambam in chapter 9 of the Laws of Vows: for everything written in this siman, the law of one who vows and one who swears is one.

3. The key concepts of this siman

לשון בני אדם — The language of men — the spoken usage of a place, a tongue and a period. It is the rule of reading for this whole siman, as against לשון תורה, what a word makes one hear of itself, which belongs to siman 216.
ספק נדרים להחמיר — A doubt in vows is conducted stringently. That is what forbids settling divided usage by the majority — seif 3, then seif 17 for oil. The Chakh, at ס״ק ג, opens the way out: declared intention.
שליח נמלך — The agent who comes back to consult. The test of seif 4: within the kind is whatever a man sent to market comes back to ask about — “do you want this?”. Usage is measured by a behaviour, not by a definition.
שם לווי — The accompanied name. A qualified word — “field-vegetable”, “date honey”, “vinegar of late grapes” — is another name, and a vow on the bare word does not reach it. Seifim 10, 13, 14 and 15.
נשתנה צורתן — The change of form. The Rama’s first reason at seif 13: bearing a thing’s name does not suffice if the form has changed. The Taz, at ס״ק י״ז, offers another: a food that has become a drink is no longer the food.
היוצא לאחר הנדר — What comes out after the vow. A capital reservation, absent from the text and laid down by the Chakh at ס״ק י״ח and the Taz at ס״ק ט״ז: the permission of brine, whey and date honey holds only for what had already separated before the vow.
עיבורה של עיר — The ibbur of the city: seventy cubits and a remainder. The Chakh, at ס״ק ל״ה, draws from it the siman’s key sentence — everywhere else the city reaches the tehum, two thousand cubits; here, in vows, one follows the language of men.
בתר שעת אמירה — We follow the moment of speech. Seif 35 and the Chakh at ס״ק ל״ט: when a vow names a category and takes effect later, the category is fixed at the moment it is uttered.
מראים הדברים — The manifest circumstances. At seif 8 they retract what local usage had extended. At seif 36, by contrast, the Rama sets their limit: where the language is certain, a denied intention does not undo it.
דין הנודר ונשבע אחד הוא — The law of one who vows and one who swears is one. The Chakh, at ס״ק מ״ג, reports this sentence of the Rambam for everything written in this siman — whence the נדר או נשבע that opens so many seifim.

4. Where these seifim come from

The mishnah and the gemara — נדרים, chapters “הנודר מן המבושל” and “הנודר מן הירק”

The siman’s raw material is the sixth and seventh chapters of Nedarim, which bear precisely the names of the siman’s opening words. Seifim 1 to 24 follow their order closely: the cooked, pot-work, the salted and the pickled, the vegetable, meat, broth and sediment, groats, cabbage, milk, dates, wine, oil, the crop, bread. Seifim 33 to 46 come from the third chapter, that of נדרי שגגות and the appellations of persons.

The Rambam — הלכות נדרים, chapter 9

The Rambam gathered all this material into the ninth chapter of the Laws of Vows, and the Mehaber follows him very closely — sometimes word for word, as Sefaria notes at seif 12: לשון הרמב״ם. The Chakh, at ס״ק מ״ג, cites the sentence the Rambam sets at the end of that chapter, and it is a warning for the whole siman: דין הנודר ונשבע אחד הוא.

The Tur and the Beit Yossef

The Tur is present throughout the apparatus, and often against the Mehaber: the Taz, at ס״ק א, opens the siman by noting that the Tur does not write ולשלוק; at ס״ק ל, he observes that the Mehaber follows the Tur on a distinction he himself finds forced. The Beit Yossef, cited from beginning to end, is the source of most of the parenthetical explanations Sefaria inserts into the text.

5. The apparatus of the siman, entry by entry

The apparatus of this siman is the densest of the block: one hundred and thirty-six entries — forty-six ס״ק of the Chakh, thirty-nine of the Taz, thirty-two of the Baer Hetev, sixteen of the Pit’hei Teshuva, three of the Nekudot HaKesef. We cite them all, in order, summarising none. The Arukh HaShulchan is not cited: it is not accessible to us for this siman. Nor are the Pri Ḥadash, the Biur HaGra and the Beer HaGolah.

The Chakh (ש״ך) — מ״ו ס״ק

ס״ק א — boiled down: “cooked and not cooked”, and Rabbenu Yeruham’s rule

ס״ק ב — what the Mehaber omitted from the Tur: pot and pan

ס״ק ז — why gourds are not within plain “vegetable”

ס״ק י״ד — what a “spice” is: what gives taste to the pot, not pepper

6. The table of the forty-eight seifim

The whole siman in one grid: the seif, what it treats, and the rule it lays down.

SeifWhat it treatsThe rule
1
א
“the cooked”: what the word names here, in this tongue, at this timeThe word has no scope of its own; it has the scope that the usage of a place, a tongue and a period gives it. The whole siman is nothing but the application of that sentence to some forty words.
2
ב
pot-work, what goes down into the pot, what goes into the ovenTo name a dish is to name what people mean by it; to name a vessel is to take everything. The Chakh, at ס״ק ב, notes that the Mehaber omitted the Tur’s distinctions between pot and pan, following the Rambam and for the reason the Beit Yossef gives: they are self-evident.
3
ג
the salted, the pickled, and what to do when the town is dividedSalt and brine are only examples; what the seif really adds to seif 1 is the conduct when usage is divided — no majority, a doubt, and stringency. With, from the Chakh, the reservation of a declared intention.
4
ד
the vegetable: three formulas, three scopes, and the proof from the agentThree formulas, three scopes: raw vegetable; pot-vegetable with pickled ones; cooked vegetable with gourds. And a method for deciding — the question the agent asks. The Taz, at ס״ק ג, and the Chakh, at ס״ק ו, differ at length over exactly what “pot-vegetables” includes.
5
ה
why dried vegetable is still vegetable, and dried beans are notA thing leaves a word only if another word receives it. The threshing floor is the sign that there is one — the bean is a pulse, not a vegetable.
6
ו
a doubt left open: the kolkasWhere usage is not established, the Choulhan Aroukh does not invent it. The doubt stands, and it is conducted stringently.
7
ז
meat and sinews: the subordinate follows, the principal does notThe subordinate is included in the principal; the principal is not included in the subordinate. And this seif is one of the few places in the siman where the apparatus corrects the printed text.
8
ח
meat: what the place adds, what the place does not remove, and manifest intentionThree storeys: local usage extends, a core resists everywhere, manifest intention retracts. And an observation of the Aharonim that holds for the whole siman — usage has changed since, and what was forbidden in Safed is not necessarily forbidden elsewhere.
9
ט
the sediment, the broth and the meat: three words for one dishA name of kind takes only what it names; a verb of action takes everything that carries the taste. The rule is that of siman 216, seif 9, restated here on a case from the kitchen.
10
י
the great list of foods: nine couples, and the accompanying nameNine couples, one principle: a word takes what people file under it, and what a second word distinguishes escapes its grip. Two commentaries expressly date this — the Chakh at ס״ק ט״ו for field-vegetables, the Taz at ס״ק י״ג for asparagus-water: in their day they called it so; in ours, not.
11
י״א
milk, whey and cheese: when another’s name attachesTwo products of one substance do not draw each other along — unless usage attaches the name of one to the other, and then in one direction only. Seif 13 will give the reason for this exception, by contrast with date honey.
12
י״ב
fish: brine and muries have left themWhat is already separated at the moment of the vow is no longer the thing; what separates afterwards still is, if the formula designates or names an act. The seif states the first half, the apparatus the second.
13
י״ג
date honey: why the name is not enough to holdBearing a thing’s name does not suffice to be of it: the name must attach and not distinguish, and the form must not have changed. Two reasons from the Ran, a third from the Taz, and the Chakh’s reservation at ס״ק י״ח — what comes out after the vow remains forbidden.
14
י״ד
honey and vinegar: the bare word takes only its own“Honey” means bees’ honey; whatever carries a qualifier is another object. It is the שם לווי of seif 10 applied to liquids.
15
ט״ו
wine: apple wine, cooked wine, and spiced wineApple wine is another object; cooked wine is the same object; kondyton is in dispute. And vinegar, which would raise the same question, is referred to siman 216.
16
ט״ז
tirosh: a word of the Torah in a mouth that speaks another tongueA biblical word used by a man who does not speak the language of the Bible is worth what it is worth in his tongue. The Chakh, at ס״ק א, had already laid down the converse in the name of Rabbenu Yeruham: where there is no language of men — where he vowed in the holy tongue in a place where it is not spoken — one follows the language of the Torah.
17
י״ז
oil: what the place supplies itself with decides, and the majority does not saveIt is not what is produced that decides but what one supplies oneself with, and the coexistence of two usages forbids both. The majority has no voice here: it is the law of seif 3, applied.
18
י״ח
the crop, the “yield” and the grain: the five speciesThree different words, one scope: the five cereals. A dispute of the mishnah decided in favour of the Sages, and a question of the Pit’hei Teshuva left open.
19
י״ט
bread, sustenance, and “everything that nourishes”“Bread” follows usage, “sustenance” has its own measure, “everything that nourishes” takes all but water and salt — provided it is bounded in time, failing which there is no vow at all.
20
כ
wheat singular and plural: four formulas, four resultsSingular and plural do not have the same reach, and adding both takes everything. And an unresolved dispute in the Rama, on the word that governs a list.
21
כ״א
groats: the same rule of number, applied to split beansGrammatical number is an index of usage, not a law. Saying both forms takes both states.
22
כ״ב
the fruits of the year: what “fruit” does not mean“Fruit” is a word of tree and field in people’s mouths, whatever the verse says; “growth” is a word of life, and it takes the animals.
23
כ״ג
the fruits of the earth: truffles and mushroomsWhat feeds on air is not a fruit of the earth, even if it comes out of it. And “growth of the ground” does not reach cattle, against the Ba’h.
24
כ״ד
“summer” means the figsUsage can give a word a sense its root does not contain, and the vow follows usage.
25
כ״ה
the water of a given spring: the name against the provenance“The waters of” follows the water; “the river” follows the name. Neither of the two principal commentators pauses here, and the seif reads on its own.
26
כ״ו
a vow of benefit from a spring: an immersion of a mitzvahWhat is only a mitzvah is permitted to one forbidden in benefit; what adds a bodily comfort is not. The dividing line is comfort, not the act.
27
כ״ז
clothing: what one does not wrap oneself inA fabric is not a garment because it covers: it is one because people clothe themselves in it.
28
כ״ח
the house and the upper storey: the subordinate and the principal againThe upper storey is in the house, the house is not in the upper storey — and the proof of a word’s reach is taken, here, from the law of sale.
29
כ״ט
the city: seventy cubits and a remainderOne and the same word does not have the same extent in one tractate and another. In vows, the city stops where ordinary speech stops it — and not two thousand cubits further on.
30
ל
the house: the thickness of the threshold is not inside“The house” begins at the line where the door shuts, not at the outer edge of the threshold.
31
ל״א
standing in a house, living in a quarter, and the Rama’s glossThe positive obligation and the prohibition draw the boundary on the same side of the threshold, but in opposite directions. And the rule holds outside vows: for a communal decree too, the question is what the word means in people’s mouths.
32
ל״ב
the dwellers of the city and its sons: thirty days, twelve monthsThirty days make a dweller, twelve months make a son of the city — but these durations yield to local usage, and local usage to intention. Here the siman confesses its own provisionality.
33
ל״ג
those who go down to the sea: an identity, not a voyage“Those who go down to the sea” names a condition, not a journey; neither coastal hops nor pleasure trips fall outside it.
34
ל״ד
those of dry land: the wide term takes the narrowEvery man of the sea is also a man of the land; the reverse is not true. The more general word encompasses the more particular, never the contrary.
35
ל״ה
“after thirty days”: a vow is read at the moment it is spokenSpeech is read at the moment it is uttered. What happens to the world afterwards does not alter what the word named then.
36
ל״ו
“those the sun sees”: the word prevails over a denied intentionWhen the word is clear, a denied intention does not undo it; and the one-letter distinction between “those the sun sees” and “those who see the sun” is contested by the Taz, the Ba’h and the Baer Hetev.
37
ל״ז
“the black-headed”: a word of usage, not of descriptionA descriptive word becomes a group name, and keeps the group while losing the description. The Chakh, at ס״ק מ״ב, specifies what “looking at the sun” means here: deriving benefit from its light.
38
ל״ח
“those who rest on Shabbat”It is not the act that places one within the name, but the obligation from which the act proceeds.
39
ל״ט
“those who go up to Jerusalem”The appellation follows the act performed, not obligation alone; and seif 38 follows obligation, not the act alone. The two criteria take turns according to what the word names.
40
מ
“the sons of Noah” and “the seed of Abraham”A genealogical appellation is not read genealogically: it is read as people say it, and people’s usage here follows Scripture.
41
מ״א
“the uncircumcised”: a name of belonging, not of conditionA word describing a body may name nothing but a belonging. Here the language of men follows exactly the language of Scripture.
42
מ״ב
“the circumcised”: the exact mirror of seif 41Neither bodily condition nor act performed: the name follows belonging, in both directions.
43
מ״ג
Israel and convertsThe particular group is within the general name; the general name is not within the particular group.
44
מ״ד
Israel, kohanim and levi’imIn vows, “Israel” is said of the people and not of the tribe; and the name of a tribe does not take the people.
45
מ״ה
kohanim and levi’im, one against the otherTwo names of equal rank do not take one another. No commentator has an entry here — the seif reads on its own.
46
מ״ו
sons and grandsons“Sons” does not reach the grandson in ordinary speech, but it may reach one whom a man calls his son — and there, the doubt is stringent.
47

“except the festivals”: are Hanukkah and Purim among them?Hanukkah and Purim are not of themselves within “the festivals”, but they enter if the one who vowed declares he had them in view — because the language of men nearly puts them there. The Pit’hei Teshuva, at ס״ק י״ב, adds a neighbouring case from the Tiferet Tzvi: one who swore not to drink brandy except on Shabbatot and festivals is permitted at the close of Yom Kippur as well, if he says he meant it.

gaming, wagers, and the Rama’s six cases: where language yields to intentionThe siman closes by going beyond itself: the language of men has bounded forty-eight seifim, and the last line announces that intention is about to take them up again. The Chakh, at ס״ק מ״ג, recalls here the Rambam in chapter 9 of the Laws of Vows: for everything written in this siman, the law of one who vows and one who swears is one.

7. Practical cases

Six situations, taken in the order of the siman. Each closes on the same referral: actual conduct belongs to the Rav.

Case 1 — a word used today

Someone has forbidden himself “the cooked”, “the salted”, “meat”. The first question is not what he meant to forbid, but what that word names where he said it, in the tongue he said it, at the time he said it. Nothing transposes from one century to another: the Chakh himself writes, at ס״ק ט״ו, that the rule of field-vegetables has changed since the mishnah. Ask your Rav.

Case 2 — when people disagree about the word

Part of the town calls it so, part does not. Seif 3 expressly sets aside the majority: it is a doubt, and doubt in vows is conducted stringently. But the Chakh, at ס״ק ג, opens a door: the one who vowed may say he meant the word as the majority means it, and he is believed. Whether that declaration is admissible here is for a Rav.

Case 3 — the by-product and the dish

Whey, brine, date honey, broth, the sediment of the pot. The siman permits them — but the Chakh, at ס״ק י״ח, and the Taz, at ס״ק ט״ז, add the condition the text lacks: only what had separated before the vow, and only if the formula neither designated nor named an act. Three conditions that cannot be read off the seif: ask your Rav.

Case 4 — a vow with no bound in time

“Everything that nourishes”, “the fruits of the year”, “the growths of the year”. The Chakh, at ס״ק כ״ט and ל״א, and the Taz, at ס״ק כ״ה, set the same limit in the name of the Ba’h and the Ran: if the vow cannot be kept, there is no vow at all, and they refer to siman 232. Whether a real undertaking falls under this rule is a matter for a Rav.

Case 5 — an undertaking made about persons

Seifim 33 to 46 show that appellations of persons are read neither genealogically, nor descriptively, nor by bodily condition: they are read as people say them. And the Pit’hei Teshuva, at ס״ק י״א, reports the case of one called “my son” who is not — a doubt, hence stringency. None of these qualifications is decided without a Rav.

Case 6 — a communal or personal undertaking

The Rama, at seifim 31 and 48, applies the siman outside the individual vow: a communal decree, a resolution not to game, a promise to fast a number of days. The question stays the same — what does the word mean? — but the Rama and the Chakh add, at the last seif, that one follows intention. The Pit’hei Teshuva, at ס״ק ט״ו, bounds that conclusion. Three layers, and therefore: ask your Rav.

8. Comprehension questions

  1. What are the three conditions seif 1 accumulates, and why is none of them optional?
  2. What does one do when the town’s usage is divided? Give the rule of seif 3 and the Chakh’s reservation at ס״ק ג.
  3. Explain the test of the agent at seif 4, and say why it measures usage better than a definition.
  4. Why does dried vegetable remain vegetable while the dried bean does not? Give the Taz’s answer at ס״ק ה.
  5. The Chakh, at ס״ק ט, corrects the text of seif 7. What does he correct, and on what proofs?
  6. Set out the three storeys of seif 8, and say which prevails over which.
  7. What is a שם לווי? Give three examples taken from different seifim.
  8. The Chakh, at ס״ק י״ז, refuses the immediate reading of seif 11. Which reading, and for what reason?
  9. The Rama gives two reasons at seif 13, and the Taz a third. What are they?
  10. Why is cooked wine forbidden and apple wine permitted? Give the Taz’s answer at ס״ק כ.
  11. Explain why “wheat” singular and plural do not have the same reach at seif 20, and why seif 21 reverses the order.
  12. The Taz, at ס״ק כ״ז, sets the verse against the language of men. On what point, and how does he decide?
  13. What is the Chakh’s sentence at ס״ק ל״ה, and why is it the key to the whole siman?
  14. At seif 36 the Rama sets aside declared intention; at seif 8 the circumstances prevail. How are the two reconciled?
  15. Why does “the uncircumcised” aim at the circumcised of the nations? Give the Taz’s reason at ס״ק ל״ז.
  16. The Chakh, at ס״ק מ״ה, refuses the Maharil’s proof. What is his distinction, and what conclusion does he reach?
  17. With what sentence does the siman close, and on to which siman does it open?
